As such, the overall Project belongs to the Category B project according to the World Bank's operational policy on Environmental Assessment (OP4.01). However, owing to the possibility of great differences of the subprojects in environmental issues, it is possible for some subprojects to have significant environmental issues and if evaluated on their own merit might be required by both the Government of China and the World Bank to require a detailed Environmental Impact Assessment (Category A EIA). Therefore, it is not suitable to prepare a uniform environmental assessment (EA) documentation for all subprojects. The purpose of this framework EA document (Framework Document) is to be used to provide guidance for the environmental assessment process to be followed in evaluating individual subprojects that are to be considered for financial support under the overall Project. This Framework Document defines the contents, procedures and responsible authority for environmental assessment of the subprojects, whose purpose is to ensure the environmental assessment in compliance with both Chinese laws and regulations and in accordance with World Bank Environmental Assessment policies and procedures as specified in OP/ BP 4.01 (Environmental Assessment). This procedure covers the following seven aspects of preparation/construction phase and two aspects of implementation phase. 2 7.2 Preparation Procedure for Frame of Environmental Impact Assessment The detailed procedures in each aspect are given as follows. 1? Preparation/Construction Phase Project Screening The Project Sponsor will complete the screening criteria evaluation form presented in Annex A (Tables A-1 and A-2). If any of the screening criteria of Table A-1 are indicated to be positive (a Yes noted in Table A-1) the project will require an EIA be prepared in accordance with both the Government of China requirements and the World Bank requirements for a Category A project (see OP 4.01 Annex B, Content of an Environmental Assessment Report for a Category A Project). Preparation of the EIA report is the responsibility of the Project Sponsor. If all screening criteria of Table A-1 are indicated to be negative, there are no further Environmental Assessment requirements from the Government of China. However, the Zhejiang Provincial Hydropower Development and Management Center (the Center ) will further review screening criteria of Table A-2. If any of the screening criteria here are indicated to be positive an Environmental Management Plan (EMP) in accordance with World Bank requirements for a Category B project (see OP 4.01 Annex C, Environmental Management Plan) will be required. Preparation of the EMP is the responsibility of the Project Sponsor. If all screening criteria of both Table A-1 and A-2 are indicated to be negative, there are no further Environmental Assessment requirements for the subproject (Category C under World Bank policy OP 4.01). EA Document Content The Project Sponsor is responsible for preparing the EIA or EMP. CATEGORY A (EIA) The EIA document will conform to the Chinese regulation, «Code for Environmental Impact Assessment of Water Conservancy and Hydropower Project» HJ/T and contain the following Sections: Executive Summary Policy. Legal and Administrative Framework Project Description Baseline Conditions (Existin g Conditions) 2
3 Assessment of Impacts (Construction and Operation Phases) Analysis of Alternatives Environmental Management Plan Mitigation Plan Monitoring Plan Schedule Record of Public Consultation CATEGORY B (EMP) The EMP form is shown in Annex B1. Sample EMPs for a newly constructed hydropower plant and reconstruction of an existing hydropower plant are presented in Annex B2. Public Consultation CATEGORY A The objectives of public consultation are to get together the significant project-related environmental issues the local residents think and the collected issues should be included in the EMP. The Government of China requires the Environmental Protection Bureaus (EPBs) of the county/city/district project office are responsible for notifying, organizing, carrying out and recording public consultation. Details of the public consultation record are shown in Annex B1-E( Public Consultation). Two consultations are required: (1) before the project feasibility study is prepared, and (2) after a draft EIA document is available. CATEGORY B The regional or branch offices of the Center will be responsible for notifying, organizing, carrying out and recording public consultation. Details of the public consultation record are shown in Annex B1-E (Public Consultation). There are two methods to collect these issues:( a) holding a consultation meeting prior to preparing a draft EMP and incorporating the collected issues in final draft EMP or( b) preparing a draft EMP in advance, promulgating for discussion in public consultation and deciding whether to add or delete the draft contents based upon the recommendations of the public. 3
4 EA Examination and Approval CATEGORY A First, the Center will review the EIA and provide comments. Second, an English language translation of the EIA modified with the Center comments incorporated will be sent to the World Bank for their review and approval. After, the World Bank reviews and approves the EIA, the Chinese language version will be sent to the Provincial EPB for the final review and approval. CATEGORY B The Center is responsible for approving the EMP. After revised by the borrower based on the recommendations in public consultation, the EMP is submitted to the Center for approval. After examination, the Center will either approve the EMP being implemented or require further revision and supplementary information. Disclosure CATEGORY A The regional (county/city/district) offices of the Center will be responsible for disclosing the EIA. The approved EIA will be disclosed in the living clustered areas of project affected people or in the nearby villages. The Center will send an English language version of the EIA to the World Bank for disclosure in the World Bank Infoshop. CATEGORY B After EMP is approved by the Center, the regional offices of the Center is in charge of disclosure. The approved EMP should be promulgated in the living clustered areas of project affected people or in the nearby villages. Related Conditions and Responsibilities During the project tender, it's the responsibility of the regional office of the Center to confirm that the requirements put forward in the EMP for both Category A or Category B subprojects have been included in all the tendering documents. Satisfying these conditions is prerequisite to winning the bid. 4

Implementation Phase During construction, the regional office of the Center is responsible for assuring that all actions of the EMP included in the Contractor tender documents are being properly implemented. Institutional Organization CATEGORY A and CATEGORY B Institution organization must be determined in EMP as shown in Annex B1-D. The Project Sponsor entrusts (engages) an independent party to organize, direct and monitor EMP implementation. During construction, the Center will check the activities of their regional offices on a routine basis to examine whether the articles set forth in the EMP have been incorporated in the bid documents. During operation, the Center will independently check whether the articles set forth in the EMP are being faithfully implemented. Reporting The regional office of the Center reports the EMP monitoring and corrective measures monthly to the Center. The Center in turn, on a quarterly basis summarizes the monthly reports and will send a report on EMP implementation to the National Project Management Office (PMO) in Beijing and to the World Bank. 6

If it is a new construction hydropower project, the approval document of the environmental protection bureau should be enclosed. A? 9 C? Scheduling Program The start and completion date of mitigation and examining action should be listed in a form. D? Institutional Organization It should be shown in the organization chart and the following should be determined: Work division, responsibilities and interrelationship of the institutions that carry out EMP mitigation and monitoring program; Flow direction of environmental information (confirming that who collects the related environmental information, to whom it will report and time interval for reporting); and Implementation route for environmental management orders. The purpose of institutional organization is to guarantee effective environmental management --- determine the collector and analyzer of the information, persons who prepare the report, report delivery route, time interval for report submission, report reviewer, issuer of the environmental management orders and implementation route for the orders, etc.. E? Public Consultation Public consultation is carried out to the residents and organizations in the subproject-affected areas and the following data should be submitted: Date of public consultation; Location of public consultation; Information about the name, telephone number, fax number and address, etc. of residents and organizations that attend the consultation meeting; Meeting proceedings and schedule Minutes of meeting the issues proposed by the public, discussion condition and conclusion, and name of the participants from the county/city/district project office. 25 Training Plan for Environmental Administration Personnel in Execution Institution for the Program Preparation of the environmental impact evaluation reports, approval procedures and environmental supervision management during project construction and operation periods are insufficient to the requirement of frame of the program and the World Bank Operation Manual. Therefore, it s necessary to carry out the training for environmental administration personnel in the execution institution and upgrade their capability so as to realize the successful progress for Zhejiang provincial recycle energy scaling up development of small hydropower. 1? Training personnel and number Training personnel: calculated at 1~2 persons for each sub-project( single sub-project:1 person, cascade sub-project: 2 persons),totally 30 persons. 2? Training subject Pertinent laws, regulations and policies for the domestic environmental protection, environmental evaluation frame and operation procedures, environmental supervision and management during construction and operation periods, study on similar environmental protection measures in developed countries. 3? Training time Training is proposed to be held in half a year after formal evaluation of the program, lasting 15 days. 4? Training provider The training would be organized by Zhejiang Provincial Hydropower Development and Management Center. Domestic and overseas experts from the provincial environmental bureaus and universities would be invited for the training. In addition, the environmental experts from the World Bank are requested to give a lecture on the frame 25
26 of environmental impact assessment and related profession. 5? Training Place The training would be held in Hangzhou, Zhejiang province and study tour for small hydropower in the developed countries be organized. 6? Training Budgetary Estimate 1) 30-person training class, including board and lodging, overseas visitin g, costs 1 thousand USD altogether, 00 USD per capita on average. 2) Inviting experts: 5 person/time, 4000 USD/ person/time on average, altogether 20 thousand USD. 3) Material and the other: 10 thousand USD. The total budgetary cost for 1) ~ 3) is 180 thousand USD. 26
