2 The missin f the U.S. Army Crps f Engineers Regulatry Prgram is t prtect the Natin's aquatic resurces, while allwing reasnable develpment thrugh fair, flexible and balanced permit decisins. The Crps evaluates permit applicatins fr essentially all cnstructin activities that ccur in the Natin's waters, including wetlands. The Regulatry Prgram in the Ls Angeles District is executed t prtect aquatic resurces by develping and implementing shrt- and lng-term initiatives t imprve regulatry prducts, prcesses, prgram transparency, and custmer feedback cnsidering current staffing levels and histrical funding trends. Crps permits are necessary fr any wrk, including cnstructin and dredging, in the Natin's navigable water and their tributary waters. The Crps balances the reasnably freseeable benefits and detriments f prpsed prjects, and makes permit decisins that recgnize the essential values f the Natin's aquatic ecsystems t the general public, as well as the prperty rights f private citizens wh want t use their land. The Crps strives t make its permit decisins in a timely manner that minimizes impacts t the regulated public. During the permit prcess, the Crps cnsiders the views f ther Federal, state and lcal agencies, interest grups, and the general public. The results f this careful public interest review are fair and equitable decisins that allw reasnable use f private prperty, infrastructure develpment, and grwth f the ecnmy, while ffsetting the authrized impacts t the waters f the United States. The permit review prcess serves t first avid and then minimize adverse effects f prjects n aquatic resurces t the maximum practicable extent. Any remaining unavidable adverse impacts t the aquatic envirnment are ffset by cmpensatry mitigatin requirements, which may include restratin, enhancement, establishment, and/r preservatin f aquatic ecsystem system functins and services. Evaluatin Factrs The decisin whether t issue a permit will be based n an evaluatin f the prbable impact including cumulative impacts f the prpsed activity n the public interest. That decisin will reflect the natinal cncern fr bth prtectin and utilizatin f imprtant resurces. The benefit, which reasnably may be expected t accrue frm the prpsal must be balanced against its reasnably freseeable detriments. All factrs which may be relevant t the prpsal will be cnsidered including the cumulative effects theref. Factrs that will be cnsidered include cnservatin, ecnmics, aesthetics, general envirnmental cncerns, wetlands, cultural values, fish and wildlife values, fld hazards, fld plain values, land use, navigatin, shreline ersin and accretin, recreatin, water supply and cnservatin, water quality, energy needs, safety, fd prductin and, in general, the needs and welfare f the peple. In additin, if the prpsal wuld discharge dredged r fill material, the evaluatin f the activity will include applicatin f the EPA Guidelines (40 CFR Part 230) as required by Sectin 404 (b)(1) f the Clean Water Act. The Crps f Engineers is sliciting cmments frm the public; Federal, state, and lcal agencies and fficials; Indian tribes; and ther interested parties in rder t cnsider and evaluate the impacts f this prpsed activity. Any cmments received will be cnsidered by the Crps f Engineers t determine whether t issue, mdify, cnditin r deny a permit fr this prpsal. T make this decisin, cmments are used t assess impacts n endangered species, histric prperties, water quality, general envirnmental effects, and the ther public interest factrs listed abve. Cmments are used in the preparatin f an Envirnmental Assessment and/r an Envirnmental Impact Statement pursuant t the Natinal Envirnmental Plicy Act. Cmments are als used t determine the need fr a public hearing and t determine the verall public interest f the prpsed activity. 2

3 Preliminary Review f Selected Factrs EIS Determinatin- A preliminary determinatin has been made an envirnmental impact statement is nt required fr the prpsed wrk. Water Quality- The applicant is required t btain water quality certificatin, under Sectin 401 f the Clean Water Act, frm the Arizna Department f Envirnmental Quality. Sectin 401 requires any applicant fr an individual Sectin 404 permit prvide prf f water quality certificatin t the Crps f Engineers prir t permit issuance. Castal Zne Management- Nt applicable within the State f Arizna. Essential Fish Habitat- N Essential Fish Habitat (EFH), as defined by the Magnusn-Stevens Fishery Cnservatin and Management Act, ccurs within the prject area and n EFH is affected by the prpsed prject. Cultural Resurces- The prpsed prject will have n adverse effect n any sites listed, r eligible fr listing, in the Natinal Register f Histric Places, r therwise f natinal, state, r lcal significance. The Federal Highway Administratin (FHWA), wh is the lead federal agency fr the prject, cnsulted with the State Histrical Preservatin Office. Cncurrence was received n June 2, Endangered Species- Preliminary determinatins indicate the prpsed activity may ptentially affect federally-listed endangered r threatened species and their critical habitat. ADOT and the FHWA, as lead federal agency fr the prject, have initiated frmal cnsultatin with the U.S. Fish and Wildlife Service under Sectin 7 f the Endangered Species Act. Public Hearing- Any persn may request, in writing, within the cmment perid specified in this ntice, that a public hearing be held t cnsider this applicatin. Requests fr public hearing shall state with particularity the reasns fr hlding a public hearing. Prpsed Activity fr Which a Permit is Required Basic Prject Purpse- The basic prject purpse cmprises the fundamental, essential, r irreducible purpse f the prpsed prject, and is used by the Crps t determine whether the applicant's prject is water dependent (i.e., requires access r prximity t r siting within the special aquatic site t fulfill its basic purpse). Establishment f the basic prject purpse is necessary nly when the prpsed activity wuld discharge dredged r fill material int a special aquatic site (e.g., wetlands, pl and riffle cmplex, mudflats, cral reefs). The basic prject purpse fr the prpsed prject is transprtatin. The prject is nt water dependent. Overall Prject Purpse- The verall prject purpse serves as the basis fr the Crps' 404(b)(1) alternatives analysis and is determined by further defining the basic prject purpse in a manner that mre specifically describes the applicant's gals fr the prject, and which allws a reasnable range f alternatives t be analyzed. The verall prject purpse fr the prpsed prject is t prtect the I- 17 bridges frm further ersin frm the Verde River and maintain the structural integrity f these facilities. 3

4 Additinal Prject Infrmatin Baseline Infrmatin- Within the prject limits, I-17 cnsists f tw, 12-ft-wide travel lanes in each directin, divided by a 60-ft-wide median. The Verde River bridges are bth seven-span steel cntinuus-girder bridges and are apprximately 525 feet lng and 45 feet wide. Bank slpe prtectin ccurs at bth banks, and wired rck baskets have been cnstructed arund ne f the piers f the suthbund (SB) bridge. Over time, the river has erded material frm arund the piers f bth bridges, undermining the bridges stability. In additin, cracking n pier walls and abutments is ccurring. If nt remedied, the bridges wuld becme unsafe fr use and wuld either need t be replaced r traffic wuld be detured t an alternate rute. The prpsed bridge scur retrfit prject wuld prevent this utcme by prtecting the bridges frm further ersin by the Verde River, thereby maintaining the structural integrity f these facilities. The prject is lcated within the Semi-desert Grassland Bitic Cmmunity at an apprximate lcatin f 3,200 feet abve mean sea level. Terrain in the greater prject vicinity is characterized by vast plateaus, intersected by steep ridges and canyns. Within the prject limits, the Verde River crridr is characterized by a relatively narrw lw-flw channel with steep cut banks t ne side cupled with brad, gently slping fldways n the ther side. I-17 traverses the tp f the plateau and spans the river channel belw. Vegetatin within the prject vicinity cnsists f 1) riparian and xer-riparian species within ephemeral areas f the Verde River, 2) emergent wetland vegetatin alng the river s edge, and 3) semi-desert grassland in drier upland sites away frm the river. Sils in the prject vicinity are predminantly cmpsed f sand, gravel and rck, and within the prject limits, sils include fine t lamy fine sand, gravelly sand t extremely gravelly lamy sand, lam, silt lam, and silty clay lam. The sils mapped within the prject limits are well-drained t excessively drained and are nt cnsidered hydric sils. The Verde River is a perennial stream and the nly water f the US in the prject area. It riginates in Big Chin Valley in nrth-central Arizna, flws suth-east thrugh the rugged highlands and valleys f central Arizna, and empties int the Salt River, east f Phenix. Within the prject vicinity, the Verde River generally flws tward the sutheast and under I-17, in the twn f Camp Verde. The Verde River, including the ephemeral areas and the intermittent fringe wetlands alng bth banks f the Verde River are cnsidered Waters f the US. In the vicinity f the Verde Bridges, the Verde River is generally cntained t a lw-flw channel between apprximately 25 and 65 feet wide and apprximately 2 t 4 feet deep. Sand and gravel bars adjacent t the lw-flw channel and the adjacent fldway are typically expsed during lw flw perids, but are lcated within the rdinary high water mark (OHWM) and are included within the jurisdictinal limits. During higher flws, the river can expand frm apprximately 420 feet wide t up t apprximately 816 feet wide acrss the sand and gravel bars beneath the Verde Bridges and acrss the adjacent fldway. The stream bed is primarily sft and cmpsed f sand with sme small cbbles. Prject descriptin- ADOT, in assciatin with the FHWA, is planning a bridge scur retrfit prject n the I-17 Verde River Bridges. The prpsed activities require temprary and permanent discharges f dredged and fill material belw the rdinary high water mark (OHWM) f the Verde River. If the prpsed prject is implemented, acre f permanent impacts wuld ccur within areas f the Verde River identified as ephemeral (0.271 acre), wetlands (0.044 acre), and pen water (0.212 acre). An additinal acres f temprary impacts wuld als ccur (3.552 acres f ephemeral, acre f wetlands, and acre f pen water). The prject wuld include the fllwing activities: Cnducting getechnical investigatins (perclatin test f sils) Accessing getechnical test pit lcatins frm I-17 via existing rads t Rundup Rad 4

5 Cnstructing temprary prject cnstructin access rads adjacent and parallel t I-17 Ingress will be via the suthbund I-17 ROW adjacent t the suthbund lanes and then Rawhide Rad, which cntinues as a dirt rad t the river and passes under the bridges n the nrth side f the river. Egress frm the cnstructin site will be via Rundup Rad and the I-17 ROW t merge int the nrthbund I-17 travel lanes nrth f the bridge. Creating temprary dry wrk znes within the river bttm Cnstructing cncrete armr prtectin arund each pier Restring all disturbed areas, excluding the existing dirt rads, t pre-cnstructin cnditin fllwing cnstructin Staging and stckpiling materials utside f and adjacent t the OHWM Reseeding previusly vegetated areas utside f the OHWM Prpsed Mitigatin The prpsed mitigatin may change as a result f cmments received in respnse t this public ntice, the applicant's respnse t thse cmments, and/r the need fr the prject t cmply with the 404(b)(1) Guidelines. In cnsideratin f the abve, the prpsed mitigatin sequence (avidance/minimizatin/cmpensatin), as applied t the prpsed prject is summarized belw: Avidance: T prtect the bridge piers frm further ersin by the river, scur prtectin wuld be cnstructed arund each pier. Because the piers are lcated within the OHWM f the Verde River, the jurisdictinal limits f the Verde River cannt be avided. Minimizatin: The fllwing features have been incrprated int the prpsed prject t minimize impacts t waters f the U.S. and assciated resurces: The area designated fr staging and stckpiling f equipment and materials is lcated utside f the OHWM f the Verde River. Staging and stckpiling f materials and equipment will be restricted t a 7.9-acre area lcated nrth f the Verde River OHWM and west f I-17. Best Management Practices (BMP s) designed t reduce ersin, minimize sedimentatin, and eliminate nn-strm water pllutants as identified in ADOT s Ersin and Pllutin Cntrl Manual fr Highway Design and Cnstructin (2012), and ADOT s Standard Specificatins fr Rad and Bridge Cnstructin (2008) wuld be implemented. Site access wuld ccur via existing rads t the extent pssible. Cnstructin access t the site via the suth bank f the river wuld have required additinal grading and/r rad cnstructin as well as vegetatin remval, prtins f which wuld have ccurred within the OHWM f the Verde River. As such, this ptin was eliminated frm cnsideratin. Instead, temprary bridges wuld be cnstructed acrss the lw-flw channel during the first phase f cnstructin and the temprary bypass channel during the secnd phase f cnstructin t allw cnstructin vehicles t access the suth bank f the river. The 180-day cnstructin duratin wuld begin in the fall when the Verde River s flws are typically at their lwest t minimize the vlume f water diverted. ADOT is prpsing t place the fllwing requirements n the cntractr selected t cmplete the prject: The cntractr shall give special attentin t the effect f its peratins upn the landscape, and shall take care t maintain natural surrundings undamaged. T avid cntaminatin f the Verde River, the cntractr shall develp and implement a cntainment plan fr sil, debris, cnstructin materials, and pllutants 5

6 such as fuels, il, bitumens, calcium chlride, fresh Prtland cement, fresh Prtland cement cncrete, raw sewage, muddy water, chemicals r ther harmful materials. The cntainment plan wuld be apprved by ADOT prir t cnstructin. The cntractr shall develp and implement a Channelizatin and Cntingency Plan fr bth phases f channelizatin that utlines prcedures t be fllwed during the pening, peratin, and clsing f the temprary bypass channels. The plan shall include prcedures t be fllwed if high flws ccur during cnstructin and shall address prtectin f existing wrk, uncvered bridge fundatins, and excavated material frm fldwater. The Channelizatin and Cntingency Plan wuld be apprved by ADOT prir t cnstructin. The cntractr s final cnstructin plan wuld be submitted t the US Army Crps f Engineers fr apprval prir t starting cnstructin. A Strm Water Pllutin Preventin Plan wuld be prepared during final design in accrdance with the requirements f the Arizna Pllutant Discharge Eliminatin System Cnstructin General Permit. N cnstructin activities shall be cnducted with the Verde River during strm events r ther perids when high flws are present. Cnstructin activities shall cease in the event f a cntainment breach until the breach is addressed and further breaches are prevented. Water fr cnstructin shall nt be withdrawn frm the Verde River. Wastewater shall be cntained and dispsed f at an apprved ff-site lcatin. Flws shall be maintained during and after cnstructin t ensure the functins and values f the dwnstream Waters f the US, including wetlands. During the getechnical investigatins, water that accumulates in the test pits wuld be filtered t remve sediment prir t being dispersed back int the river using ne f several ptins, including filter scks, a cmbinatin f filter scks and rck bags, r allwing it t settle int a basin. The cntractr shall use temprary bridges t crss the Verde River and temprary bypass channels as necessary. The cntractr wuld nt be permitted t frd the flwing river channel. The OHWM f the Verde River wuld be flagged prir t prject cnstructin and the flagging wuld be apprved by ADOT. Fencing wuld be temprarily placed within the OHWM f the Verde River t demarcate cnstructin avidance areas, then remved. A mvable cncrete barrier wuld be placed alng the nrthern edge f the OHWM t prevent cnstructin vehicles frm inadvertently driving int ephemeral waters frm the staging area. Staging and stckpiling f materials and equipment wuld be restricted t a 7.9- acre area lcated nrth f the Verde River OHWM and west f I-17. N materials r equipment wuld be stred r stckpiled with the OHWM f the Verde River vernight. Any excess excavatin r ther materials wuld be backfilled r mved t the designated area befre the end f the same wrking day. N equipment refueling wuld ccur within the OHWM f the Verde River. Prject activities wuld avid all large trees greater than 12 diameter at breast height (dbh). Perennial riparian vegetatin wuld be avided t the extent pssible. An n-site bilgical mnitr wuld be present prir t any grund disturbing activities t assist in the demarcatin f riparian vegetatin t be avided. The cntractr shall cmplete the prject in as shrt f a timeframe as pssible. Temprary bypass channels wuld be remved incrementally t minimize pulses f sediment dwnstream. 6

7 All previusly vegetated areas utside f the OHWM wuld be reseeded upn cmpletin f the prject using an ADOT-apprved seed mix. The cntractr shall remve all cnstructin material and debris frm the cnstructin site upn cmpletin f the prject and all temprarily disturbed areas within the OHWM f the Verde River shall be reclaimed t their pre-cnstructin elevatins and tpgraphy. The cntractr shall cmply with all terms and cnditins f the Sectin 404 Individual Permit as established by the US Army Crps f Engineers. The cntractr shall cmply with all terms and cnditins f the Individual Sectin 401 Water Quality Certificatin certified by the Arizna Department f Envirnmental Quality. Cmpensatin: The applicant has prpsed t prvide cmpensatry mitigatin fr permanent impacts t waters f the U.S. in the frm f in-lieu fees. T mitigate impacts t waters f the U.S., the applicant wuld purchase credits frm the Presctt Creeks Preservatin Assciatin s Watsn Wds in-lieu fee site. The final impacts-t-mitigatin rati is still being determined at this time. Prpsed Special Cnditins The fllwing list is cmprised f prpsed Permit Special Cnditins, which are required f similar types f prjects: 1. Mitigatin. Prir t initiating cnstructin in WUS, and t mitigate fr impacts t waters f the U.S., the Permittee shall prvide dcumentatin verifying purchase f credits frm the Crps-apprved Presctt Creeks Preservatin Assciatin s in-lieu fee prgram (ILFP). The Permittee shall nt initiate wrk in WUS prir t receiving written cnfirmatin (by letter r ) frm the Crps Regulatry Divisin as t cmpliance with this special cnditin. The Permittee retains respnsibility fr prviding the cmpensatry mitigatin until the number and resurce type f credits described have been secured frm Presctt Creeks and the district engineer has received dcumentatin that cnfirms that Presctt Creeks has accepted the respnsibility fr prviding the required cmpensatry mitigatin in accrdance with the ILFP instrument. 2. Ntificatin. The Permittee shall prvide ntificatin, via r letter, t the Crps Regulatry Divisin at least ne week prir t the start f wrk, as t the anticipated beginning and ending dates f cnstructin. 3. Flagging. The Permittee shall clearly mark the limits f the wrkspace with flagging r similar means t ensure mechanized equipment des nt enter preserved waters f the U.S. and riparian wetland/habitat areas shwn n Figure 1. Offset stakes with the distance t the limits indicated n the marker are acceptable where marking f the exact lcatin is unfeasible r creates a hazard. The cntractr(s) shall be thrughly familiar with each f the prject bundaries, and all perimeter markings shall be maintained intact during cnstructin. Adverse impacts t waters f the U.S. beynd the Crps-apprved cnstructin ftprint are nt authrized. Such impacts culd result in permit suspensin and revcatin, administrative, civil r criminal penalties, and/r substantial, additinal, cmpensatry mitigatin requirements. 7

8 4. Maintenance f flws. Except when required by the Sectin 401 Water Quality Certificatin, apprpriate measures must be taken t maintain nrmal dwnstream flws and minimize flding t the maximum extent practicable. N wrk will ccur when water is present in the wrksite except the Big Sandy River. N alteratin f flws during cnstructin are authrized. 5. Dewatering. Dewatering and diversin f flws arund the prject site is authrized during cnstructin. The Channelizatin and Cntingency Plan, which utlines prcedures fr dewatering peratins and will be develped by the cntractr fr the prject, must be submitted and apprved by the Crps prir t initiating cnstructin. Water remved frm the wrk area will be returned t the channel withut cntributing t an increase in sediment/turbidity dwnstream f the prject site. T prevent ersin at the discharge pint, energy dissipatin and/r scur prtectin will be utilized as apprpriate, and must be remved after dewatering peratins have ceased. 6. Temprary fills. Temprary fills must cnsist f materials, and placed in a manner, that will nt be erded by expected nrmal flws. N stckpiling r staging f materials r equipment is authrized within WUS. Temprary fills necessary in rder t dewater r temprarily divert flws arund the wrksite, such as cffer dams, are authrized within the Verde River during cnstructin in the areas indicated n the impact sheets. The Channelizatin and Cntingency Plan fr the prject, which will utline prcedures t be fllwed if high flws ccur, must be submitted and apprved by the Crps prir t initiating cnstructin. After the initial cnstructin activity is cmpleted, temprary fills must be remved in their entirety and the affected areas returned t precnstructin elevatins, t the maximum extent pssible. The lcatin f these temprary fills must be lcated t avid the remval f mature trees (greater than 12 dbh), t utilize previusly disturbed areas t the maximum extent pssible, and minimize the ttal area f disturbance. All prject areas disturbed by cnstructin-related activities must stabilized and upland areas reseeded with a native seed mixture that is apprpriate fr the site cnditins. 7. Fill free f cntaminants All fill placed in WUS must be f suitable material (n trash, debris, asphalt, etc.). All discharges f fill material int WUS must be free frm txic pllutants in txic amunts (Sectin 307 f the CWA) 8. Invasive species. The Permittee is respnsible fr cntrlling and preventing the spread f nxius invasive species in WUS. The Permittee shall utilize integrated vegetatin management practices in accrdance with State and Federal Laws and Executive Orders t manage invasive species in WUS. 9. Endangered Species This Crps permit des nt authrize yu t take any threatened r endangered species. In rder t legally take a listed species, yu must have separate authrizatin under the Endangered Species Act (ESA) (e.g. ESA Sectin 10 permit, r a Bilgical Opinin (BO) under ESA Sectin 7, with "incidental take" prvisins with which yu must cmply). The enclsed U.S. Fish and Wildlife Service BO cntains mandatry terms and cnditins t implement the reasnable and prudent measures that are assciated with "incidental take" that is als specified in the BO. Yur authrizatin under this Crps permit is cnditinal upn yur cmpliance with all f the mandatry terms and cnditins assciated with incidental take f the attached BO, the terms and cnditins f which are incrprated by reference in this permit. 8

9 Failure t cmply with the terms and cnditins assciated with incidental take f the BO, where a take f the listed species ccurs, wuld cnstitute an unauthrized take, and it wuld als cnstitute nn-cmpliance with yur Crps permit. The USFWS is the apprpriate authrity t determine cmpliance with the terms and cnditins f its BO and with the ESA. 10. Migratry Birds and Bald and Glden Eagles. The Permittee is respnsible fr ensuring their actin cmplies the Migratry Bird Treaty Act and the Bald and Glden Eagle Prtectin Act. The Permittee is respnsible fr cntacting the apprpriate lcal ffice f the U.S. Fish and Wildlife Service t determine applicable measures t reduce impacts t migratry birds r eagles, including whether incidental take permits are necessary and available fr a particular activity.
