Customer Advisory on Goods & Services Tax (GST) Dear Valued Customer, New Goods and Service Tax (GST) Law and action points for smooth transition to GST regime GST is proposed to be implemented with effect from 1 July 2017 and hence it would be critical for the all the stakeholders to be ready for the said change. The said change would involve transformation of various functions of businesses like supply chain, accounting, IT and Tax perspective. One of the main objectives of GST is to create a seamless credit chain thereby reducing tax costs leading to an opportunity for businesses to work towards the same. While all the stakeholders would be working towards the said change, we have highlighted below a few critical areas for the customers to start with to ensure all the customers of the Company are ready for changes proposed under GST to enable a smooth transition thereof. We request you to please make sure that all your GST registration numbers for all the principal place of businesses are informed to us for updating our customers master. (Please refer attached WHL Customer GST Info.xls for updating your details) We will be invoicing you from the nearest Wan Hai Lines state to your container pick-up / drop-off location. Basis, the billing address you mention to us, transaction will be construed as either intrastate or inter-state transaction. Customer to ensure migration from the existing indirect tax registrations to GST registrations or obtain fresh GST registrations (if not registered under the current indirect tax laws) for all the principal place of business.

9 GST returns 2. Uploading details of Outward Supplies: Every registered taxable person is required to upload invoice wise (item level) details of sales of goods and services (outward supplies) on monthly basis by 10th of the subsequent month in Form GSTR-1 on GSTN Portal. 3. Uploading details of Inward Supplies: Every registered taxable person is required to upload invoice-wise (item level) details of purchases of goods and services (inward supplies) on monthly basis by 15th of the subsequent month in Form GSTR-2 on GSTN Portal. 4. The information submitted in Form GSTR-1 by the supplying dealer will be auto populated in the Form GSTR-2 of the corresponding recipient dealer. Further, the recipient dealer is allowed to modify the said details as populated in Form GSTR-2 including permission to add invoices (not uploaded by the supplier) if he is in possession of invoices and have received the goods or services. However, recipient dealer would be required to get the details uploaded by the supplying dealer rectified within 60 days else the mismatch in credit would be reversed by GSTN Portal and interest would be applicable on such reversed credit. 5. All invoices, whether Intra-state or of Interstate supplies to be uploaded to enable receipts avail Input Tax Credit (ITC) under invoice matching concept. 6. Monthly Return: Based on the details furnished in Form GSTR-1 and Form GSTR-2, the registered taxable person would be required to file the monthly return in Form GSTR-3 duly reflecting the details of tax liability, tax payment and input tax credits by 20th of the subsequent month. Other Points 7. Change in the Information Technology (IT) systems with respect to tax codes, formats of invoices, formats of sales and purchase registers, etc. in order to align with the requirements under GST Network (GSTN) 8. Customers to record the taxes paid on purchases of goods and services in their IT systems and claim eligible input tax credit on such purchases. 9. Benefits derived under GST law example increase in credits/ refunds should be passed on to the respective customers by way of reduction in price 10. In case of progressive and periodic supply of goods and services, no tax would be payable on supply of goods / services before the appointed day (date of on which GST Act comes into effect) where a part consideration for the said supply is received on or after the appointed day, but full duty has been paid under the earlier law.

Import of services or inter-state supply of goods and/or services made after the appointed day shall be liable to GST regardless of whether the transactions for such import of services or inter-state supply had been initiated before the appointed day: - No GST payable if the tax on such import or inter-state supply had been paid in full under the earlier law - If the tax on such import of services had been paid in part under the earlier law, balance amount of tax shall be payable on such import or inter-state supply under GST - A transaction shall be deemed to have been initiated before the appointed day if either the invoice relating to such supply or payment, either in full or in part, has been received or made before the appointed day. 12 Date: 24 th April 2017 Dear Valued Customer, The Government of India vide its Notification 14/2017 and 15/2017- Service Tax dated 13th April, 2017 has shifted the liability to pay service tax on import prepaid ocean freight onto the Consignees in cases where services are provided and received by persons located in non-taxable territory. This is by way of transportation of goods by a vessel from outside India upto a customs station of clearance in India. The said notification is effective from 23rd April, Hence, invoices for the Bill of Lading issued upto 22nd April 2017 for Prepaid Import Ocean Freight will attract service 4.5% (comprising abated base service tax rate 4.2%, Swachh Bharat cess 0.15%, Krishi Kalyan cess 0.15%). On all Bills of Lading issued on or after 23rd April, 2017, the person responsible to pay the service tax will be the Consignee/Importer of cargo. WHL appreciates your continued support. As per the new Service tax directive issued recently, Service tax at the rate of 4.5% shall be applicable on Ocean Freight & Surcharges for all Import Freight prepaid shipments and we need to pay the Service tax to the Tax Authority in India. Hence starting from vessel/ voy Venice Bridge Voy 023 ETA Nhava Sheva 23th Jan'2017 related to Import Freight prepaid, this amount shall need to be collected from Consignees and deposited to Service Tax department as per this new tax guideline.
