4 ADDITIONAL TERMS AND CONDITIONS 1. Offers only from the manufacturers shall be considered. The validity of offer should be 180 days from the date of opening of tender particulars. 2. The tender should be in two part, i.e Techno-commercial and Price bids only. The price bid should distinctly indicate the following clause Quoted price with clear differentiation of Ex-factory price, Freight & Insurance and Taxes & Duties. The tender shall submit (i) Earnest Money Deposit (ii) Other Technical details along with Type test certificate from recognized Govt. approved test house (iii) Validity of offer (iv) Terms of payment (v) Delivery schedule (vi) Annual turnover (vii) Order executing details (viii) Users performance certificate. 3. The Techno-commercial and price bids shall be opened on the due date and time, or on the next working day incase due date is holyday. 4. Post revision of quoted rates, terms and conditions having direct or indirect impact on the quoted rates shall not be accepted and the offer should be rejected the earnest money shall be forfeited. Withdrawal of offer within the quoted validity period shall not be accepted and earnest money shall be forfeited. Purchaser reserved the right for negotiation of rates, terms and conditions only. 5. Telegraphic / Talex offer shall not be considered and tenders received after the due time even though posted earlier shall not be accepted. 6. Tenderers should furnish order execution details of items of similar specification for a minimum of last 3 years. 7. Each and every paper of the tender / bid should be signed affixing their seal and date. 8. In comparing bids and making awards, the purchaser will consider such factors as compliance with specification, relative quantity, the technology and process involved in production, experience, financial soundness, records of integrity etc. 9. Pre-Despatch Testing: Each and every offered lot of the oil shall be tested in accordance with the latest amendments in the relevant specification of the IS. The tests must be carried out in presence of APDCL s Engineer as deputed by the purchaser. The oil shall be despatched only after approval of the results by the purchaser. At the time of sealing the drums, in presence of the APDCL s Engineer as deputed by the purchaser, required sample may be drawn which will be sent for re-testing at any NABL accredited testing house. If the test results are not found in order, dispatch clearance will not be accorded. i) Security seal shall be provided on both the leads of the barrel. ii) The vendor shall put the stencil mark of BIS and their manufacturing licence number on every barrel. iii) The barrels should conform to the relevant IS and bear BIS stencil mark with barrel manufacturing license number on each barrel. iv) All testing charges will be on supplier s accounts. v) After issue of dispatch clearance, the oil should be dispatched within 15(fifteen) days. Incase of delay in dispatch, oil may be subjected to re-testing at the supplier s cost. 10. Suppliers Guarantee: The tenderer/contractor shall warrant by stipulation a guarantee clause that the item supplied will be new, unused and in accordance with the NIT specifications and contract documents and free from defects in material and workmanship, disclosing manufacturer s guarantees and warranties, if any, along with the duration for which these are valid, commencing immediately upon the satisfactory commissioning of products offered and

5 providing for minimum period for rectification/ free replacement thereof for the period of guarantee. The terms period of guarantee shall mean the period of 12(twelve) months from the date of commissioning and successful use of the item. In any case, this period shall not be less then 18(eighteen) months from the date of material received in purchaser s stores in good condition. During this period of supplier s guarantee and the manufacturer s warranty, the contractor / supplier shall rectify all defects in design, materials and workmanship that may develop under normal use of the item upon written notice from the engineer who shall indicate in what respects the item is faulty. This rectification/free replacement during the Guarantee / warranty period shall be to the Tenderer / Contractor s account. 11. All other terms and conditions as mentioned in the APDCL General Conditions of Supply and Erection 2009, unless in contravention of the above conditions, will remain in force. 12. Delivery being the essence of the contract, the tenderers should preferably quote their delivery to commence within one month from the date of placing of LOI/ order and to complete approximately within three months thereafter at uniform rate in a phased manner. Tenderers may be asked to re-phase delivery schedule as per requirement of APDCL. 13. The purchaser reserves the right any / all tenders without assigning any reason thereof, the right to accept any tender or part of which is advantageous to APDCL and to award the contract to one party or split up amongst the different bidders. 14.
