5 Sidewalk Inspection Problems Background Information Ontario Reg 239/02 under the Municipal Act Minimum Maintenance Standards for Municipal Highways Inspections to be carried out annually Surface discontinuity (vertical) in excess of 2cm to be treated Treatment involves taking reasonable measures to protect users of the sidewalk from the discontinuity, including making permanent or temporary repairs, alerting users attention to the discontinuity or preventing access to the area of discontinuity.

Prior to 2016 the sidewalk inspection was contracted to a third party Annual cost for inspection - $60,000 +/- Information collected was by hard copy, eventually translated to a spreadsheet and provided to the City monthly. This information was slow in getting to the front line work crews City s Risk Management concerned about the adequacy of inspection information

7 Court Case year-old wins $192K settlement after tripping on cracked Hamilton sidewalk A Hamilton court has ruled in favour of an 89-year-old woman who slipped and fell on a 23.8 millimetre bump in the sidewalk, a gap that cost city taxpayers $192,000 in damages. Citing a City of Hamilton worker as a hostile witness, missing inspections for a stretch of sidewalk on Upper Sherman and a city policy to repair raised edges in sidewalks over 19 millimetres, Judge said the municipality "failed" in its responsibilities, leading him to find the city "legally accountable."

27 Lessons Learned Yesterday s bottleneck was data collection. Today s bottleneck is work order creation, integration with the City s CMMS (Hansen) and the timely undertaking of repairs Hardware support for tablets. City of Hamilton did not have a standard in place for simple tablets, leaving the much more expensive Surface and ruggedized Motion devices as the only supported options. There s a lot of sidewalk. May need to alter the number of resources or the details captured during inspection cycle. Asphalt treatment of MMS deficiencies are temporary need long term strategy for repair being worked on.

30 Inspection History: Commenced with consultant assignment in 2012 By 2016 we had completed 4 phases of culvert collection and inspection Total 1886 culverts collected and inspected during this time Averaged 472 culverts per phase 2017 Approach Worked with IT Dept to develop Collector App for culverts (6 weeks) Developed a culvert inspection and rating guide Hired two co-op students and provided them with tablets
