FND that this procurement process is in compliance with Los Angeles City Ordinance No , passed on May 27, 2015, allowing Los Angeles World Airports to use the competitive sealed proposal selection process for the Landside Access Modernization Program. 4. AUTHORZE the Chief Executive Officer to release a Request For Proposals using a Competitive Sealed Proposal Selection Process to procure a Design-Builder to perform engineering, design, demolition, pre-construction, and construction services for the Terminals Cores and Automated People Mover nterface Project at Los Angeles nternational Airport. 2 DSCUSSON: 1. Purpose Authorize the Chief Executive Officer to release a Request For Proposals (RFP) to solicit Proposals from Qualified Firms to provide comprehensive engineering, design, preconstruction and construction services for the Terminal Cores and Automated People Mover (APM) nterface Project (herein referred to as the Project) at Los Angeles nternational Airport (LAX). The Project will support the Landside Access Modernization Program (LAMP) by designing and constructing new facilities with vertical circulation "cores" (i.e. elevators, escalators and stairs) to connect passengers from the new Automated People Mover (APM) stations and pedestrian walkways into the existing Tom Bradley nternational Terminal (TBT) and Terminal 6, and upgrade the existing vertical circulation core at Terminal 7. The Project will provide interior commercial space to offer revenue-generating opportunities and enhance the functional capacities of the terminals. 2. Prior Related Actions April 16, Resolution No The Board of Airport Commissioners (Board) requested the Los Angeles City Council to consider and approve an ordinance to allow use of Alternate Project Delivery Methods and Competitive Sealed Proposal Selection Process (CSPSP) for Design-Build (DB), Design-Build-Finance-Operate and Maintain (DBFOM) and Construction Manager at Risk (CMAR) contracts for select Capital mprovement Projects (CP) related to the Landside Access Modernization Program (LAMP) at Los Angeles nternational Airport (LAX). On May 26, 2015 the City Council approved Ordinance No authorizing the use of alternate project delivery methods as requested, Council File November 3, Resolution No The Board authorized release of a RFP to solicit a Design-Build contractor for the LAMP Utilities and Enabling Projects at LAX using the CSPSP and alternative delivery methods. April 6, Resolution No The Board authorized the award of a (3)-year Design-Build Contract to Myers and Sons - Griffith, a Joint Venture for the LAMP Utilities and Enabling Projects for a cost not-toexceed $300,000, Current Action As part of the overall modernization program at LAX, LAWA is undertaking the LAMP program, which consists of a Consolidated Rental Car Center (ConRAC), ntermodal Transportation Facilities (TF), parking garages, and an APM. n order to connect the Terminals in the Central Terminal Area (CTA) to the APM, necessary modifications must be made to the Terminals to accommodate the vertical transportation of passengers for a connection to the three proposed APM stations in the CTA. The new Terminal Cores will Page 2
3 include a series of elevators, escalators, stairs and circulation space to facilitate the ingress and egress of passengers between the Terminals and the APM Stations. The Project will help LAWA deliver a Gold Standard Airport through the following actions: Provide first class facilities to elevate the guest experience; Utilize an innovative procurement process to strengthen focus, promote design excellence and increase speed of delivery; Enhance our pedestrian throughput capacity at TBT, Terminal 5, and Terminal 6 to support the success of the upcoming Landside APM; The Project includes a new single core between Terminals 5 and 6 (T5.5 Core), a new dual core in front of TBT (TBT Core) and improvements to the vertical circulation at Terminal 7 (T7 Vertical Circulation mprovements). This project also includes the relocation and restoration of displaced functions and systems, including restrooms, ticket counters and baggage claim. T5.5 Core: The T5.5 core is a proposed new three-level facility with vertical circulation including elevators, escalators and stairs at all three levels. The T5.5 Core will include structural provisions to interface with a future pedestrian walkway. The pedestrian walkway will connect the T5.5 Core to the future APM Station. TBT Core: The TBT core is a proposed new three to four level facility with vertical circulation including elevators, escalators and stairs at all levels. The TBT Core will include structural provisions to interface with a future pedestrian walkway. The pedestrian walkway will connect the TBT Core to the future APM Station. T7 Vertical Circulation mprovements: This project includes improvements to the circulation core in Terminal 7, as well as the demolition of the existing pedestrian walkway at Terminal 6 to further enable the LAMP Program. Separately, some of the Airline-Tenants at LAX are also developing new vertical cores in their respective terminals through separate projects and lease agreements. 6 Procurement Process On October 14, 2016, Los Angeles World Airports (LAWA) posted a Request for Qualifications (RFQ) on the Los Angeles Business Assistance Virtual Network (LABAVN) for qualified Design-Build (DB) Teams. Proposers were required to submit Statements of Qualifications (SOQ) that demonstrated relevant skills, experience and knowledge in providing a wide range of engineering, design, preconstruction, and construction services. The firms were evaluated on the following criteria: Evaluation Criteria and First Tier Sub-Criteria 1. Design and Construction Qualifications Lead Desk ner and Lead Contractor Qualifications & Exerience 2. Project Approach 5. nclusivity Organization, Team Structure and Key Personnel Design/Build Management Plan Communications Strate Prior Goals and Level of Achievement A roach to nclusivit Percent Weighting 40% 50% 10% The proposers were also required to show previous successful experience in delivering comparable projects using the DB delivery method. A Pre-Proposal Conference was held on December 12, As a result, SOQs were received from the following four (4) firms: Austin Commercial / AC Martin Hensel Phelps / Corgan Skanska - W.E. O'Neil, a Joint Venture / Leo A Daly Swinerton Builders / Gensler The firms were evaluated by a five-member evaluation panel consisting of LAWA staff: Deputy Executive Director, Planning & Development Director of Maintenance Director of Terminal Design Sr. Airport Engineer, Terminals Sr. Airport Engineer, LAMP Upon review by the Evaluation Panel, LAWA determined that all four teams were qualified to submit proposals for this project, and notified the teams on April 14, Draft RFP's were distributed to the qualified teams and LAWA hosted meetings with each of the teams in May, 2017 to review and discuss the project and procurement process. As a result, LAWA took into consideration and incorporated some of their suggestions into a second Draft RFP, which was distributed for a second round of reviews, meetings and final suggestions for consideration to improve the clarity and content of the document. 7 proposed action requests that the Board authorize LAWA to issue the final RFP to the qualified firms. The City Council approved an ordinance to allow the use of alternative project delivery methods and competitive sealed proposal selection process (CSPSP) for delivery of projects related to the LAMP. When using the CSPSP, City Charter Section 371(b) requires that the Design-Builder be selected based on the "Lowest Ultimate Cost to the City." Proposers must be able to demonstrate to LAWA their technical and construction experience, staffing and organizational approach, schedule and cost controls, and an understanding of the unique challenges of working in an airport environment. Proposers will be required to meet mandatory Small Business Enterprise (SBE) goal and Local Business Enterprise (LBE) / Local Small Business Enterprise (LSBE) goals for their subcontractor utilization. Proposers final scores for Part B will be based on information received in the written proposal and the interview (if conducted). Proposer points will be converted to "Efficiency Points" which will be used in the Lowest Ultimate Cost Calculation. Efficiency Points will effectively be the Proposer's decimal percentage of the total available points (i.e. 84 points will convert to 0.84 efficiency points). Lowest Ultimate Cost LAWA will award to the proposer deemed to provide the "Lowest Ultimate Cost" to the City for this project. The calculation for lowest ultimate cost is as follows: Page 8
9 Desi n to Bud et Value x 1 + Desi n-builder's Fee) Proposer Efficiency Points = Lowest Ultimate Cost Upon completion of the evaluations, LAWA will return to the Board with a recommendation to award a two-phase Design-Build Contract to the successful proposer, and authorize LAWA to execute "Phase 1" of the Contract for design and preconstruction services. LAWA may also purchase the work products from the unsuccessful proposers, and incorporate their best ideas and solutions into the design of the successful proposer. This will be accomplished under the terms of "Work Product Agreements" that each Proposer will be required to execute and submit with their proposal. Upon completion of 60% Design, LAWA will negotiate a Guaranteed Maximum Price (GMP) with the Design-Builder for the remaining design and construction, and will return to the Board once more for authorization to execute "Phase 2" of the Contract. f LAWA and the Design-Builder are unable to agree on a GMP, then LAWA will have no obligation to execute Phase 2 of the Contract. Should this scenario occur, LAWA will reevaluate procurement options and adjust course accordingly. Action Requested Staff requests authorization to release the RFP to qualified firms for the Terminal Cores and APM nterface Project at LAX using the competitive sealed proposal selection process and alternative delivery method. Fiscal mpact This is an approved capital project within the LAMP Program. Approval of this item is an administrative action and will have no fiscal impact to LAWA's Capital Budget at this time. 4. Alternatives Considered Take No Action Taking no action would prevent LAWA from advancing the design of the Terminal Cores and APM nterface, and subsequently put undue risk to the schedule of the LAMP Program. Design-Bid-Build (DBB) Utilizing a DBB contract delivery method for this project represents enormous risks to LAWA's ability to deliver the needed terminal modifications on time to meet the LAMP delivery date. These risks include conflicts which would arise due to inability to provide contractor input during the design, inability to perform destructive investigations and testing to determine the extent of certain unforeseen conditions and the inability to design to budget. Construction Manager at Risk (CMAR) A CMAR delivery method also represents major risk factors to LAWA's ability to deliver the project in a timely manner. Due to the nature of this project, delays caused by unforeseen conditions would be similar as with a DBB delivery. With no contractual relationship between designer and builder, contractor input during design is sometimes limited by timing of the agreements. Page 9
10 APPROPRATONS: As an administrative action, no appropriation of funds is being requested at this time. Upon completion of the procurement process, staff will return to the Board for authorization to award a Design-Build contract and to appropriate capital funds based on the total project budget. STANDARD PROVSONS: 1. This item, as a continuing administrative, maintenance and personnel-related activity, is exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to Article, Section 2.f of the Los Angeles City CEQA Guidelines. 2. This item is not subject to approval as to form by the City Attorney. 3. Actions taken on this item by the Board of Airport Commissioners will become final pursuant to the provisions of Los Angeles City Charter Section Qualified firms are subject to the provisions of the Service Contractor Worker Retention and Living Wage Ordinances. 5. Procurement Services has reviewed this action and established mandatory goals of 20% Small Business Enterprise (SBE), 7% Local Business Enterprise (LBE), and 5% Local Small Business Enterprise (LSBE) as a subset to LBE goal, for this specific project. Additionally, a mandatory goal of 3% Disadvantaged Veterans Business Enterprise (DVBE) will be established for this specific project after Council approval of the Ordinance. 6. Qualified firms will be required to comply with the provisions of the Affirmative Action Program as appropriate for each proposal resulting from this list. 7. Qualified firms will be required to obtain a Business Tax Registration Certificate prior to execution of any contract. 8. Qualified firms will be subject to the provisions of the Child Support Obligations Ordinance as appropriate for each proposal resulting from this list. 9. Qualified firms will be subject to the insurance requirements of the Los Angeles World Airports as appropriate for each proposal resulting from this list. 10. Pursuant to Charter Section 1022, staff determined the work specified on the proposed contract can be performed more feasibly or economically by an ndependent Contractor than by City employees. 11. Qualified firms have submitted the Contractor Responsibility Program Questionnaire and Pledge of Compliance and will comply with the provisions of the Contractor Responsibility Program. 12. Qualified firms will be subject to the provisions of the Equal Benefits Ordinance as appropriate for each proposal resulting from this list. Page 10
