1 SEVILLE HOMEOWNERS ASSOCIATION SINGLE FAMILY RESIDENTIAL ARCHITECTURAL COMMITTEE RULES ARCHITECTURAL AND LANDSCAPE DESIGN GUIDELINE ORIGINATION DATE - APRIL 17, 2002 AMENDMENT DATES: ACCESSORY STRUCTURES BASKETBALL EQUIPMENT REQUIREMENTS DRIVEWAY EXTENTIONS & SIDEWALKS FLAG AND FLAGPOLES Due to the nature of the community documents, we felt it was important to converge pertinent information regarding architectural submittals into one document-architectural AND LANDSCAPE DESIGN GUIDELINES. These Architectural and Landscape Design Guidelines, as allowed in the Declaration of Covenants, Conditions and Restrictions (CC&R s) for Seville Homeowners Association will provide you with information relevant to improvements which will require approval from the Association, per Article V of the Declaration. Since there are two areas in the community documents, which contain this information relevant to improvements that will require approval from the Association, some items may refer to both sections. The two sections are (a) Article V in the CC&R's Use Restrictions, and (b) Architectural and Landscape Design Guidelines. A. ARCHITECTURAL COMMITTEE In accordance with the CC&R's, an Architectural Committee shall be established and shall perform the duties set forth in the CC&R's. In addition to other duties outlined in the CC&R's, the Architectural Committee shall adopt guidelines and procedures for the preparation, submission and determination of the application for any approvals required for the construction of any structures, landscaping, or other improvements within the Seville Homeowners Association. The Single Family Residential Architectural and Landscape Design Guidelines, as set forth in this document, shall interpret and implement procedures for the Residential Architectural Committee s review of, and the standards for the development of single family homes within Seville, including, but not limited to, architectural design, placement of buildings, landscaping, plant selection, color schemes, exterior finish and material, signage, wall design and similar matters and shall have the same force and effect as the Association Rules. A separate set of design guidelines shall apply to all non-residential properties in Seville and are in addition to the requirements of the Town of Gilbert Unified Land Development Code and Building Code and the CC&R s. Parcels 7, 8, 15, 31, 32, 36, and 40 will accommodate nonresidential uses. 1

2 SEVILLE ASSOCIATION RULES A. ACCESSORY STRUCTURES ADDED Accessory Structures shall include gazebos, ramadas, pergolas, play equipment, and any and all other such Accessory Structures proposed for rear yards. Such Accessory structures must be set back a minimum of five feet (5 ) from all surrounding property lines. They require Architectural Committee approval if they are taller than the surrounding fences. The intent is to use colors that are consistent with the Community; however, materials are subject to review by the Committee. If it is felt that the materials will not last in the Arizona weather, the Committee has the authority to request additional information or require that the materials be better suited to our climate. Any lighting proposed for Accessory Structures must be included in the submittal and approved by the Committee prior to installation. The maximum height to be considered for all Accessory Structures shall be eleven feet (11 ) from the original grade. Gazebos and ramadas must be of natural stained wood or be painted to match the house color. Pergolas must contain an open slated roof and must be painted to match the body color of the home. Support pillars must be stuccoed and painted to match the body color of the home or faced with stone accents as applicable to the Community. Play structures are subject to additional restrictions included in Design Guidelines under Playground Equipment. B. ANTENNAS AND SATELLITE DISHES The preferred installation locations are as follows in descending order of preference: 1. A location in the back yard of the lot where the receiver will be screened from view by landscaping or other improvements. 2. An unscreened location in the backyard of the lot. 3. On the roof but completely below the highest point of the roof line. 4. A location in the side yard of the lot where the receiver and any pole or mast will be screened from view by landscaping or other improvements. 5. On the roof above the roofline. 6. An unscreened location in the side yard. 7. A location in the front yard of the lot where the receiver will be screened from view by landscaping or other improvements. NOTE: All exposed wires must be painted to match the body of the house. Landscaping or other improvements ( screening ) shall be installed as soon as possible, but not later than thirty (30) days following installation. Screening must be maintained by the homeowner. C. AWNINGS Awnings over all windows shall be synthetic canvas or similar material, of solid color which matches or complements the color of the body of the exterior of the home or roof color and shall be installed only on the side and/or rear of the home. 1. All awnings must be submitted for approval prior to installation and must include a drawing with the location of the proposed awning installation, sample of material, color of awning and design of awning. 2. Owner is responsible for maintenance and repair of awnings. Association retains the right to determine when awning must be cleaned, repaired or replaced due to weathering, fading, tearing, ripping etc. 2

3 D. BASKETBALL EQUIPMENT AMENDED No basketball backboards shall be installed without the prior approval of the Architectural Committee. 2. Basketball backboards shall not be installed structurally on a building or structure (they must be 3. pole mounted). 4. Backboards must be professionally manufactured, of neutral color (clear, white, gray, or tan) and free of brightly colored decals or graphics. 5. Poles and support brackets must be painted black or match the body color of the house. 6. All equipment including poles, support brackets and netting shall be maintained in good condition. Broken equipment, including backboards, bent poles, supports, rims and netting and peeled or chipped paint are prohibited. Netting is limited to nylon or similar cord netting, metal or other chain nets are prohibited. 7. The basketball pole must be set in the ground permanently and must be installed on the "interior" side of the driveway. Architectural approval request must include a site plan of the exact location of where the goal will be installed. 8. Spotlights or other lighting for the purpose of illuminating the area of play for use after sunset is prohibited. 9. The owner of the home is fully responsible for ball containment on their individual property. Painting of the driveway for a basketball court layout or any other similar purpose is prohibited. 10. Rear yard basketball backboard installations must conform to all of the above specifications. Temporary (portable) basketball goals are permitted; provided the play hours are between 8:00 AM -8:00 PM, the basketball goal must be placed on the "interior" side of the driveway, have the house number stenciled down the goal pole and must be maintained in good condition. 3

4 E. CHIMNEYS Chimneys shall be constructed of the same materials and textures as utilized elsewhere on the exterior of the home. F. CLOTHES DRYING FACILITIES Outside clotheslines or other outside facilities for drying or airing clothes shall not be erected, placed or maintained on any Lot or Parcel unless they are erected, placed and maintained exclusively within a fenced service yard or otherwise concealed and not be visible from neighboring property. G. DECORATIVE AND HOLIDAY ITEMS 1. Holiday decorative items, such as seasonal lighting, displays and holiday flags, do not require approval; however, such decorative items shall not be displayed more than 30 days prior to the actual holiday with which they are associated or more than 14 days after the actual holiday. 2. Seasonal and Decorative Flags: Seasonal flags shall not be displayed more than 30 days prior to the actual holiday and must be removed within 14 days of the date of the holiday. Flags must be maintained in a good condition at all times. Torn, ripped, faded, etc.... constitute grounds for removal. Flags may not be offensive to neighbors or the Association. The Board of Directors, at its sole discretion, shall make this determination on a case by case basis. 3. Decorative and Seasonal Items: The Board of Directors of the Seville Homeowners Association reserves the right to require removal of decorative items in front yards based on size, quantity, color, location and any other criteria. The Board of Directors, at its sole discretion, shall make its determination on a case by case basis. 4. Decorative Art on Houses: Decorative art on houses shall be neutral in color and limited to two items of similar character, color and style. The largest dimensions of decorative art shall be no greater than three feet in length, width or diameter. 5. Lawn Art: Lawn art is prohibited. Lawn art includes, but is not limited to, iron, ceramic, plastic, clay or wood people, animals, carts or other unnatural or man-made items. H. DRIVEWAY EXTENSIONS AND SIDEWALKS AMENDED Driveway extensions are discouraged and are prohibited without prior review and approval by the Architectural Committee. Sidewalk additions will be reviewed on a case-by-case basis with strong consideration of any impact on the architectural features of the neighborhood. 1. A plat with exact lot dimensions and the location and dimensions of the proposed extension must be submitted to the Architectural Committee for review and approval prior to commencing any work. 2. The total width of the concrete area may not exceed 30 linear feet of contiguous area or 50% of the lot width, whichever is less. 3. Example: 2 car driveways (17 ) may request a driveway extension of a maximum width of 13 and 3 car driveways (25 ) may request a driveway extension of a maximum width of The base of the driveway extension shall meet the base of the existing driveway at a 45 degree angle. 5. A minimum of two plants, three feet in height are required in the angle portion of the driveway extension. 6. The driveway extension must end within one foot of the side property line. 7. Parking is permitted on the driveway extension subject to the restrictions included under Section R of the Guidelines and Rules and Sections 5.5, 5.6 and 5.7 of the Declaration of Covenants, Conditions and Restrictions for Seville Recorded on 09/10/2001 ( CC&Rs ). 4

5 Submittal for sidewalks will be reviewed on the following: 1. Additional sidewalks will only be considered if there is landscaping on each side. 2. Sidewalks upon individual lots shall not exceed four feet in width. All extensions, driveways and sidewalks must be kept clean and clear of debris, oil, rust and other stains. I. EXTERIOR COLORS 1. The exterior colors of all buildings and structures must be approved by the Architectural Committee based on submitted manufacturer s color chips. 2. Plans and specifications submitted to the Architectural Committee must include details of the exterior color scheme, including all exterior surfaces. Exterior surfaces must be compatible with the other buildings in the neighborhood. 3. Any repainting or redecorating of exterior surfaces, regardless of the color to be used, will also require submission to the Architectural Committee for approval. J. FLAGS AND FLAGPOLES Per Arizona Statute display of one of the following flags shall be permitted: American, Arizona State, United States Air Force, United States Army, United States Navy, United States Marine Corp or United States Coast Guard, Gadsden, POW MIA or an Arizona Indian Nation. Prior approval of the Design Review Committee is not required for flagpoles that are installed in the front or rear yard of the Lot at least fifteen (15) feet from the property line. The height of the flagpole shall be no greater than the height of the highest point of the roofline. Flagpoles that are house mounted below the roofline of the Residential Unit do not require prior approval of the Design Review Committee. Only one flagpole of any type (free standing or house mounted) is allowed on a Lot. Definition: As used herein, the term flagpole shall mean a pole or staff of wood or metal for display of the American Flag, whether such pole or staff is horizontal or vertical, or free-standing or attached to a structure. Definition: background. The union portion of the flag is the portion with the stars on the blue Display of the United States Flag: 1. The American Flag may only be displayed from sunrise to sunset unless appropriate lighting is installed that properly illuminates the flag without disturbing the quiet use and enjoyment of the neighboring property. If an Owner wishes to illuminate the flag, the Owner must submit, in writing, a request to install lighting to illuminate the flag along with lighting plans, including wattage/lumens and specifications to the Architectural Control Committee prior to illuminating the flag. 2. The flag should not be displayed on days when the weather is inclement, except when an all weather flag is displayed. 3. No other flag or pennant should be placed above or, if on the same level, to the right of the flag of the United States of America. 4. If the flag of the United States is displayed from a vertical flagpole, or a flagpole/staff projecting horizontally or at an angle from the windowsill, balcony, or front of a Unit, the union of the flag should be placed at the peak of the flagpole/staff unless the flag is at half-staff. 5. When displayed either horizontally or vertically against a wall, the union should be uppermost and to the flag's own right, that is, to the observer's left. When displayed in a 5

6 window, the flag should be displayed in the same way, with the union or blue field to the left of the observer in the street. 6. The flag, when flown at half-staff (the term ''half-staff'' means the position of the flag when it is one-half the distance between the top and bottom of the staff), should be first hoisted to the peak for an instant and then lowered to the half-staff position. The flag should be again raised to the peak before it is lowered for the day. On Memorial Day the flag should be displayed at half-staff until noon only, then raised to the top of the staff. By order of the President, the flag shall be flown at half-staff upon the death of principal figures of the United States Government and the Governor of a State, territory, or possession, as a mark of respect to their memory. In the event of the death of other officials or foreign dignitaries, the flag is to be displayed at half-staff according to Presidential instructions or orders, or in accordance with recognized customs or practices not inconsistent with law. In the event of the death of a present or former official of the government of any State, territory, or possession of the United States, the Governor of that State, territory, or possession may proclaim that the National flag shall be flown at half-staff. The flag shall be flown at half-staff 30 days from the death of the President or a former President; 10 days from the day of death of the Vice President, the Chief Justice or a retired Chief Justice of the United States, or the Speaker of the House of Representatives; from the day of death until interment of an Associate Justice of the Supreme Court, a Secretary of an executive or military department, a former Vice President, or the Governor of a State, territory, or possession; and on the day of death and the following day for a Member of Congress. The flag shall be flown at half-staff on Peace Officers Memorial Day, unless that day is also Armed Forces Day. 7. The flag should never be displayed with the union down, except as a signal of dire distress in instances of extreme danger to life or property. 8. The flag should never touch anything beneath it, such as the ground, the floor, water, or merchandise. 9. The flag should never be fastened, displayed, used, or stored in such a manner as to permit it to be easily torn, soiled, or damaged in any way. 10. The flag, when it is in such condition that it is no longer a fitting emblem for display, removed and replaced with a new flag. K. FENCES/WALLS/GATES 1. The Architectural Committee has approved standard wall designs that shall be used on all exterior walls of the subdivision where a theme wall or view wall is required. Gates may not be constructed in any wall or fence without prior Architectural Committee approval of the size, location, color, and material. Residential developments requiring walls or fences around the parcel will have the walls or fences installed by the developer of the parcel. 2. Prior to the construction of any fence or wall, plans indicating materials to be used and location shall be submitted to the Architectural Committee for approval. 3. Any fences or walls installed by the Declarant will not be removed, altered, or painted without the Architectural Committees prior written approval. 4. Perimeter walls on lots bordering common areas may not be torn down to allow access to rear yards. AN ASSESSMENT OF $2, WILL BE APPLIED TO A LOT OWNER IN WHICH A COMMON WALL HAS BEEN REMOVED WITHOUT ARCHITECTURAL COMMITTEE APPROVAL. Access must be gained through the front wall on the side of the home, repairs to this wall must be completed in a timely fashion and include repairing the wall to match the texture and color of the remaining wall. 5. All Lots with perimeter view fencing and all theme walls cannot be painted any other color than the installation color or altered in any way, unless the Architectural Committee, at its sole discretion, changes the color scheme or orientation for the entire community. 6

7 6. Backyard Wrought Iron Pool Fencing: The specifications for backyard wrought iron pool fencing installation on a Lot with view fencing shall be of a color to match or blend with the exterior body or trim color of the home. L. FINE GRADING AND MOUNDING Fine grading is a critical aspect of landscaping. Each lot has been graded such that all storm water will drain away from the house. It is important that this drainage pattern is maintained when preparing the landscape design, especially if mounding or berming is proposed. In all cases, the installation must comply with the City approved grading and drainage plan. Every effort should be made to make mounding appear natural. M. GARAGES The interior of all garages situated on any lot shall be maintained in a neat and clean condition. Garages shall be used only for the parking of vehicles and the storage of normal household supplies and materials and shall not be used for or converted to living quarters or hobby/recreational activities without the prior written approval of the Architectural Committee and applicable City and State Zoning and Code requirements. Garage doors shall be left open only as needed for ingress and egress. N. GARBAGE 1. No garbage or trash may be placed on any lot or parcel except in covered containers meeting the specifications of the Town of Gilbert or of a type, size and style which are approved in writing by the Architectural Committee. 2. In no event shall such container be maintained so as to be Visible from Neighboring Property except to make the same available for collection not more than 12 hours prior to collection and stored in a location not visible from neighboring property within 12 hours of collection. 3. Rubbish, debris and garbage shall not be allowed to accumulate. Each owner shall be responsible for removal of rubbish, debris and garbage not only from his lot or parcel, but also from all public right of ways either fronting or siding his lot or parcel, excluding (a) public road improvements, and (b) those areas specified on a Tract Declaration or subdivision plat to be maintained by the Seville Homeowners Association. O. GUTTERS & DOWNSPOUTS Gutters and downspouts will be considered for approval if the finish matches the exterior body, trim or roof tile color of the home. The Association strongly recommends use of high quality materials that offer long life, as the gutters must be maintained in good condition. P. INSTALLATION OF LANDSCAPING Within six (6) months after occupancy of a Single Family Residential Unit, (a) the Owner shall install landscaping and irrigation improvements in compliance with the xeriscape principles and other applicable requirements set forth in the applicable municipal zoning ordinances (i) in that portion of the Lot which is between the street (s) adjacent to the Lot and the exterior wall of the Residential Unit or any wall separating the side or back yard of the Lot from the front yard or the Lot and/or (ii) in all portions of any Lot that has fencing designed to allow viewing through the fence (e.g. wrought iron fencing). The landscaping and irrigation improvements shall be installed in accordance with plans approved in writing by the Architectural Committee. Prior to installation of such landscaping, the Owners shall maintain the front yard and back yards with view fencing of the Lot in a weed-free condition. FRONT YARD AND BACK YARD LANDSCAPING MUST BE SUBMITTED FOR APPROVAL TO THE ARCHITECTURAL COMMITTEE PRIOR TO INSTALLATION. 7

8 1. Front yard landscaping must be installed within six (6) months after occupancy of a Single Family Residential Unit. 2. Back yard landscaping that is visible to the common areas (wrought iron fencing) must be installed within six (6) months after occupancy of a Single Family Residential Unit. 3. Front yard landscaping must have a minimum of two (2) 15-gallon trees at least three (3) feet in height. Also, a minimum of six (6) five-gallon plants or shrubs will be required in all front yards. Prohibited Plant material for front yard landscaping is as follows: A. Any species of tree or shrub whose mature height may reasonably be expected to exceed 30 feet. B. All pines (Pinus), cypress (Cupressus), False Cypress (Chamaecypans), Juni-per or Cedar (Juniperus). C. Olive Trees (Olea europaea) other than the Swan Hill variety. D. Oleanders (Nerium oleander) other than the dwarf variety and Thevetia. (Thevetia species). E. Fountain Grass (Pennesethus setaceum) or Pampas grass (Cortanderia selloana). F. Mexican Palo Verde (Parkinsonia aculeatea). G. All Eucalyptus. H. All varieties of mulberry trees. 4. An approved organic material to provide a neat, dust-free appearance must cover all bare earth. 5. Ground cover may be low growing ground covers, decomposed granite, or other natural rock material approved by the Architectural Committee. 6. All hardscape for front yards must receive approval prior to installation. Hardscape includes but is not limited to walls, driveways, walkways, lighting, fountains, and additional concrete or other hardscape additions. 7. Rocks and boulders, patios, sidewalks, railroad ties, etc., may be used to supplement and create imaginative landscaping design. Approval from the Architectural Committee must be granted prior to installation of hardscape material. 8. Artificially colored rock yards are not acceptable at any location. 9. Decomposed granite colors must be of a natural earth tone color and not white, green, blue or other bright colors. All rock areas shall be treated with a pre-emergent weed control at regular intervals to retard weed growth. Boulders must be natural earth tones; no white, brightly colored or artificially colored boulders are permissible. River rock shall be one to six inches in diameter and not more that ten percent (10%) of the front yard landscape may be river rock. Q. LIGHTING 1. Other than seasonal decorative lighting, no outside lighting, other than indirect lighting, may be placed, allowed, or maintained on any lot without the Architectural Committee prior written approval. 2. Exterior lighting must be soft and indirect, with no light sources visible directly to neighboring properties or common area tracts. 3. Tennis court, sport court, and other similar lighting shall be reviewed and approved on an individual basis. Approval is subject to light type, orientation, site plan, use brightness, and other factors that the Architectural Committee considers in the best interest of the owners and residents of Seville. 4. Additional lighting for porches and garages, including sconces and carriage (garage) lights, must receive Architectural Committee approval prior to installation. 8

9 R. MACHINERY & EQUIPMENT 1. No machinery, fixtures, or equipment of any type, including but not limited to heating, cooling, air conditioning and refrigeration equipment, and clothes lines, may be placed on any lot without the prior approval of the Architectural Committee. Approval shall be conditioned upon prior screening or concealment from view of neighboring or public property. The screening or concealment should be solid and integrated architecturally with the design of the building or structure. It should not have the appearance of a separate piece of machinery, fixture or equipment. It should be structurally stable in accordance with sound engineering principles. 2. Ground mounted air conditioning units will be concealed by a solid enclosure on all sides visible to neighboring property. The Architectural Committee prior to installation will approve location and screening. 3. Wind turbines are not allowed. S. PATIO COVERS 1. All patio covers not installed by the builder will need to be submitted to the Architectural Committee for review. 2. Patio Covers must be constructed of materials that match and complement the home. 3. Patio columns must be of sufficient mass and scale relative to the roof they support and must be and painted to match the color of the home. T. PARKING 1. Resident parking is prohibited on major thoroughfares. 2. Temporary street parking is allowed on the street; in no event shall overnight street parking be allowed. 3. Parking in the front or side yard of any Lot or on unpaved surfaces is prohibited. 4. Parking in rear or rear side yards of view fencing lots will require that the parked/stored vehicle, boat, camper, trailer, etc. be screened from the view through the rear view fence. The method of screening requires submittal to the Architectural Committee for approval. 5. Parking of boats, campers, trailers, etc., is not permitted within public or private view except as specifically permitted by the CC&R s. U. PLAYGROUND EQUIPMENT All playground equipment, including, but not limited to play houses, forts, or swing sets, visible from a neighboring property will require review and approval by the Architectural Committee prior to installation. 1. All such equipment will require a minimum five (5) foot set back from all neighboring walls. 2. Color and type of building material is subject to Architectural Committee review and approval. 3. Canvas covers shall be off-white, beige, light brown, dark blue or dark green. ALL PLAYGROUND EQUIPMENT MUST BE SUBMITTED FOR APPROVAL PRIOR TO INSTALLATION. V. POOL AND SPAS Pools and spas do not require the prior approval of the Architectural Committee. Perimeter walls on lots bordering common areas may not be demolished or removed to allow access to rear yards for the purpose of pool, spa or other construction. AN ASSESSMENT OF $2, WILL BE APPLIED TO A LOT OWNER IN WHICH A COMMON WALL HAS BEEN REMOVED WITHOUT ARCHITECTURAL COMMITTEE APPROVAL. In the event wall 9

10 removal is approved by the Architectural Committee, the Committee may require a deposit to secure replacement of removed walls. Access must be gained through the front wall on the side of the home, repairs to this wall must be completed in a timely fashion and include repairing the wall to match the texture and color of the remaining wall. All pool and spa equipment must be screened from view of neighboring property. W. SIGNS 1. No exterior signs or advertisements of any kind may be placed, allowed, or maintained on any lot without the prior approval of the Architectural Committee. 2. All signs must conform to applicable municipal ordinances. 3. The following are specifications for security signs: a. Security signs must be located a maximum distance of 2 feet from the front of the home. b. Security signs must not exceed 12" x 12" in size. c. Security signs must be professionally fabricated and maintained in good condition at all times. Signs advertising landscaping or pool contractors, etc. must be removed within forty-eight (48) hours of substantial completion of work. X. STORAGE SHEDS Storage sheds will be permitted and need not be submitted for approval provided the maximum height of the shed does not exceed the height of the immediately surrounding wall(s) or fences(s). Y. OIL BOARDS Oil pans, boards, carpet or any other object used to collect oil spills from driveway must be removed when not in use. Z. SUNSCREENS/ SECURITY DOORS/ SCREEN DOORS SUNSCREENS- Brown, tan, charcoal, black or white sun screen material may be installed without prior approval. All other sunscreen colors must be submitted for approval. Sunscreens must be maintained to their original condition, free from dirt, torn screen material and bent frames. SCREEN DOORS- Brown, tan, charcoal, black or white screen doors do not need to be submitted, all other colors must be submitted for approval. Silver-colored aluminum screen/security doors and/or wire screen mesh doors are strictly prohibited. Screen doors must be maintained to their original condition, free from dirt, torn screen material and bent frames. SECURITY DOORS- Wrought iron security/screen doors need not be submitted for approval provided they are painted to match the exterior color of the body of the home. Those which do not match the home in color or are not made of wrought iron must be submitted for approval consideration. The following information must be submitted: Photograph, brochure or detailed drawing showing the door frame design Color of frame Color of screen or other material Any screen must match the home s window screens. Silver colored aluminum screen doors are prohibited. 10

11 AA. BB. CC. TENNIS COURTS/SPORT COURTS 1. No tennis court or sport court may be installed without prior written approval of the Architectural Committee. 2. Courts may be allowed, providing their setting, visual appearance, lighting, noise generation, construction, and landscaping do not detract from the enjoyment of neighboring property as determined by the Architectural Committee. Each proposed installation will be judged on a case-by-case basis. WATER FEATURES AND STATUARY Items such as fountains, statuary, etc., are permissible with written approval by the Architectural Committee. 1.
