4 1. Introduction 1.1 Philosophy. The architectural character of each home and lot must be compatible with the character of existing homes & the overall theme of Jetton Cove. It is intended that the basic harmony of existing architecture be compatible with all improvements so that no improvement will detract from the attractiveness of the overall environment & the community as a whole. 1.2 Definition of Improvements The term Improvements shall mean and include any and all man-made changes or additions to a Lot, connecting to or appurtenant to a Lot located within Jetton Cove. These improvements include but are not limited to the location, materials, size & design of all buildings, including any exterior devices attached to or separate from buildings such as antennae, satellite dishes, storage sheds or areas, roofed structures, fences, enclosures, poles, driveways, walkways, changes in grade or slope, swimming pools, hot tubs, Jacuzzi, tree houses, swing sets, playhouses, signs, exterior illumination and changes in any exterior color or shape. The definition of Improvements includes both original Improvements and all later changes to Improvements. However, the definition of Improvements does not include the replacement or repair of Improvements previously approved by the Architectural Review Committee (ARC), provided that such replacement or repair does not change exterior colors, materials, designs or appearances. 1.3 Applicability These guidelines ( ARC Guide ) are adopted as part of the Rules and Regulations pursuant to the Articles of Incorporation of Jetton Cove Community Association and the Declaration of Covenants, Conditions and Restrictions for Jetton Cove (DCCRs) by recommendation of The Architectural Review Committee (ARC). These documents provide for the establishment of reasonable rules and regulations concerning the exterior presentation of existing and future homes and lots in Jetton Cove. The ARC Committee serves as representatives of the Board of Directors while enforcing the Guide. Compliance with this Guide is required, but is not the sole basis for review or approval nor does it guarantee approval of any application. In reviewing each application, the ARC may consider any factors it deems relevant. Decisions may Page 4 of 16

5 be based purely on aesthetic considerations. Each builder/owner acknowledges that determinations as to such matters are purely subjective in nature and that opinions may vary as to the desirability and attractiveness of a proposed addition or modification Purpose The Architectural Guidelines are not adopted to replace the DCCRs, but to clarify the process by which builders and homeowners may construct and customize the exterior presentation of their homes and/or lots. The intent of the ARC is to provide consistent guidance to builders/owners regarding requirements for design, additions and modifications to home lots in the community and matters of particular concern to the ARC when considering applications for approval of such design plans, additions and modifications. Additionally, the Guide sets forth various restrictions relating to community standards and the overall appearance of property in the community. 1.5 Future Revisions & Amendments It is the responsibility of the Homeowner to obtain the most current version of the ARC Guidelines. The Application and all Final Plans shall be prepared in compliance with the most current version of these Guidelines as of the date the Application & Plans are submitted to the ARC. 1.6 Applications and Review Process A). All proposed exterior designs, modifications or additions to residential units or lots require prior approval by the ARC, unless otherwise specifically exempted by the DCCRs. The committee will review builder and homeowner requests for approval at the ARC s monthly scheduled meeting & will act only upon a written request. Items required for Application to Jetton Cove Architectural Committee: 1. Homeowner Application for Architectural Approval - see page 16 & 17 (at the end of these guidelines). 2. A brief written summary providing a description of your proposed improvements 3. Copy of the property survey indicating the location of the current home, along with a drawing of the proposed changes. If your project includes a home addition, provide the exact location & dimensions of the new Page 5 of 16

6 improvements. This must include the distance of the new improvements within the property setbacks & property line. 4. Drawing or sample photo of the final project. Provide specific height information for proposed structure. 5. Copy of the builder s proposal outlining the scope of the work (if using outside contractor). This should include (but is not limited to) all information that will be required to obtain a building permit. 6. Exterior color, landscaping & material selections samples to be provided (manufacturer brochure can be used). This includes paint, roof material etc. 7. Submit (3) copies of the application & all exhibits to Jetton Cove Community Association, Inc. Association Management Group P.O. Box Charlotte, NC B). The ARC may require submission of such additional information as may be reasonably necessary to consider any application. Applicants will be informed in writing of the committee s decisions. If there is no response within (30) days, contact AMG (Association Management Group of Charlotte) at Where specifically permitted to proceed without prior approval, such permission shall only be effective so long as the builder/owner complies with every requirement of this Guide. C). Builders and Homeowners must obtain all necessary building permits and other government approval that may be required for the proposed construction, modification or addition.. The ARC is not responsible for ensuring structural integrity, compliance with state and local building codes or generally accepted building practices. D). The ARC reserves the right to make a final inspection upon the completion of the homeowner s project. E). If the Homeowner, FOR ANY REASON, is unable to follow the original plan approved by the ARC, a resubmission for re-approval MUST be made. F). An application approved by the ARC has a timeframe of (1) Year for the homeowner to complete the project from the date of the initial approval. If the Page 6 of 16

7 project is not completed within this timeframe, the homeowner must submit for re-approval General Homeowner Architectural Standards 2.1 Antennas, Satellite Dishes No radio or television transmission or reception towers, antennas, dishes or disks shall be erected on any Home Lot or Condominium Unit, except that one (1) of the following shall be permitted on each Home Lot or Condominium Unit: a) A dish or disk not exceeding one (1) meter in diameter for receiving direct broadcast satellite service or b) An antenna not exceeding one (1) meter in diameter or diagonal measurement for receiving video programming services via wireless cable or television broadcasting signals, which antenna may be mounted on a mast not exceeding six (6) feet in height. Any dish or antenna (and associated mast) permitted hereunder shall: (i) In the case of a Home Lot, not be located in the area between the street right-of-way line and the minimum building setback lines shown on the recorded plat showing such Home Lot, (ii) Be placed in an inconspicuous area and shielded from view from all public streets & right of way. Homeowner to plant shrub(s) to hide from public view. (iii) In all events, be approved by the Committee pursuant to Section of this Declaration prior to installation and be installed in compliance with the Guidelines as provided under Section of this Declaration. 2.2 Birdbaths, Birdfeeders, Birdhouses Birdbaths, bird feeders, & bird houses placed in backyards are pre-approved provided they measure no larger than twenty (20) inches in diameter for a Page 7 of 16

8 birdbath, one (1) foot by one (1) foot for feeders and houses, and six (6) feet in height for poles or posts. Any items built outside of these dimensions require committee approval. Birdbaths, bird feeders, & birdhouses placed in front or side of the yard requires committee approval. 2.3 Clotheslines Clotheslines are not permitted. 2.4 Decks, Patios, Porches, Committee approval is required prior to construction, modification (including but not limited to covering, enclosing and extending) of decks, patios & porches. Deck footings, porches and patios must stay within the setback lines of any lot. Privacy fencing around patios & decks are not to exceed six (6) feet in height (measured from the base floor of the deck). Deck waterproofing, sealing and staining for maintenance purposes is preapproved provided that the existing color is used. Any color change to the deck requires approval and is subject to the painting criteria in Section Driveways, Walkways Driveways shall be concrete only. Any modifications to existing driveways require committee approval prior to construction. Permanent, non-concrete walkways require committee approval prior to construction. Installation of any new walkways require committee approval 2.6 Doghouses, Dog Pens, Dog Runs Doghouses require committee approval and must meet the following criteria The doghouse must match the color scheme of the existing structure, Page 8 of 16

9 Must be in the backyard at least (6) feet from any property line Maximum (4) feet high. Must be fully screened from street view & have no impact on adjacent lots. Dog Pens and Runs are not permitted. 2.7 Exterior Colors Any exterior color change requires committee approval. This includes but is not limited to the exterior of the home, trim, garage door, entry doors, patio doors, deck etc. Color samples are required to be submitted with the application. Exterior painting of a home when there is no color change (painted with the same existing color) is pre-approved. 2.8 Exterior Lighting, Seasonal Decorations (a). Ground landscaping lights are approved provided they are white, are limited to 2,000 lumens and are directed towards the house, landscaping and/or ground. (b). Solar powered lighting is also pre-approved provided it meets the requirements specified in (a). Any other form of lighting requires ARC approval. Electric and Gas lampposts are pre-approved provided they are in line with the existing neighborhood style currently installed. Holiday decorative lights are pre-approved from Thanksgiving through January 15. Seasonal decorations are approved two weeks prior to the event until two weeks after the event. 2.9 Fences Fences require committee approval prior to construction and must meet the following criteria: Page 9 of 16

10 Not erected on any home lot closer to the street than the side street setback or the front of the building facade. Shall be: 1. Wooden with natural or white finish Picket style 2. Vinyl (White only). If an application for vinyl fencing is submitted, the application must contain a vinyl sample & a Manufacturer s Brochure Perimeter fencing: o Shall be four (4) feet in height as measured from the ground. o Picket facing outside of fenced property, spaced not less than 1 ½ inches apart nor more than 3 inches apart, o Fence must be placed on the property lot line. No gap is allowed when the fence is built next to an adjoining fence (no gap allowed between the fences). o Built with the grade of the land Privacy fencing around patios and decks are not to exceed six (6) feet in height as measured from the base floor of the deck. (See Section 2.4 regarding Patios & Decks) Privacy fencing around the perimeter of the lot is not permitted Flagpoles, Flags Freestanding flagpoles are not permitted. Flags, which in the ARC s judgment, tend to incite or antagonize are not permitted. Flags meeting the following criteria are pre-approved: One flagpole, not to exceed two inches in diameter and sixty (60) inches in length, may be mounted on the front of a dwelling. Flags shall not exceed 4 x 8 in size. Flags must be maintained in good condition and shall not be displayed if mildewed, tattered, or faded Garage Sales, Garage Sale Signs, Items for Sale Garage sale signs placed in the yard of a residence are pre-approved provided they are displayed no more than 48 hours in advance of a sale and are removed immediately following a sale. Sale items must be kept in or in the immediate area of the garage. See Section 2.20 of these Guidelines for additional signage requirements Items for sale such as cars, boats, lawnmowers, may not be displayed in front of the residence. Page 10 of 16

11 2.12 Garbage Containers No Garbage containers, trash or other waste material shall be kept or permitted upon any Lot except in an appropriate area screened & concealed from view by methods and with materials approved by the ARC. Construction of any exterior garbage or trash container requires committee approval prior to installation. Garbage containers must be stored out of sight, only put out the night before the scheduled pick-up and returned to the garage/screened area the same day as garbage pick up Landscaping, Ornaments, Fountains Any landscape changes other than planting of flowers, trees, shrubs and bushes that will remove more than 25% of the lawn in front of the building facade requires committee approval. Garden and lawn ornaments or water fountains that are permanent fixtures require committee approval prior to installation (see section 2.2) 2.14 Mailboxes All mailboxes must be of the standard color & design (the mailbox is black with a white base). Mailboxes must be kept in an attractive condition & good repair. The residence address (house number) must be clearly visible on the mailbox Outdoor Furniture Furniture not enclosed in a room shall be limited to such types as is designed for outdoor use Parking, Recreational Vehicles, Campers, Boats, Trailers, Commercial Vehicles No vehicle, including recreational, camper, boat, trailer, car or truck will be parked on the grass or sidewalk of any lot. Recreational vehicles, campers, boats, trailers & commercial vehicles must be kept in the garage. The vehicle may be parked temporarily in the driveway once during any calendar month for a period not exceeding 24 hours when it is being prepared for use or repair. Page 11 of 16

12 2.17 Play Equipment, Basketball Goals All Play Equipment (Swing Sets & similar Outdoor Play Structures) must have committee approval prior to installation. Swing sets & outdoor play structures must be located where they will have minimum impact on adjacent lots & screened from general public view. Playhouses or Tree houses must have committee approval (see also paragraph 2.22). All play equipment must be properly maintained & remain in a neat and attractive conditions and to a suitable state of repair. Portable and free standing basketball goals mounted in the ground are permitted as long as: o The backboard is mounted perpendicular to the street, o The goal post is at least 15 feet from the curb, o The goal post is at least six feet inside the homeowner s property line. o The goal post, backboard and net must be kept in good repair at all times. Children s toys, including but not limited to skateboard ramps, practice nets, small goals & other equipment or structures are to be removed from public view & stored in the garage or out of sight when not in use Pools, Hot Tubs, Spas, Saunas In-ground pools, hot tubs spas and saunas require committee approval prior to installation. Pools will not be allowed outside of the Building Setback, except in limited circumstances as approved by the ARC. Pool and pool equipment enclosures must be architecturally related to the residence & other structures in their placement on the lot. Such structures shall be screened or treated so to avoid distracting views. Owners are required to install safety features such as locks or covers and comply with all applicable state and local codes. Aboveground pools are not permitted Roofs Any change in material or color of roof material requires prior committee approval. Repair or replacement with the same material and color is preapproved. 13 2.20 Signs No signs of any type or kind shall be erected, placed or permitted to remain on any residence, lot or common area except: One professionally manufactured sign of not more than five (5) square feet (2 feet by 3 feet in dimension), advertising a home for sale or rent. A single garage sale sign as described in paragraph (Max size 2 feet by 3 feet in dimension) A single security service sign. Invisible fence signs. Building Permits as required by legal/government agencies. Official community events as approved by the Board. Up to 3 professionally manufactured directional signs for the purposes of selling real estate are allowed to be in the common areas. They are only allowed from Friday until Sunday. One Political Sign endorsing an issue or candidate - maximum size (18) inches by (24) inches in dimension. All such signs may be erected no sooner than (30) days in advance of the election for which they were made & all such signs shall be removed within (5) days after the election for which they were made. Permitted signs are allowed to be erected in the front yard & must be properly maintained. Signs are not allowed to be attached to or hang from the home. No signs shall be placed in any right of way, on light poles or street sign, or on any public property. Contractor/construction signs used for advertisement are not allowed Storage Storage of any materials (such as but not limited to fuel tanks, lawnmowers, lawn equipment and landscaping materials) outside an enclosed structure is not permitted Storage Sheds, Accessory Buildings Storage sheds, accessory buildings or noncommercial greenhouse require committee approval prior to construction or installation. This requirement applies to a temporary POD storage type structure placed anywhere on a lot. Page 13 of 16

14 Storage shed or accessory buildings must be located in the rear of any home lot so that it is directly behind the residence as viewed from the street. Such structure shall not exceed 200 square feet. Concrete slab foundations for a storage shed are not permitted. The maximum height of a storage shed or accessory building cannot exceed 12 feet. This is measured from the lowest point of the existing undisturbed grade elevation to the top of the highest exterior feature of the structure. When submitting an application, consideration should be given to placement of the structure, the general public impact and any additional screening or landscaping. Additional screening may be required depending on the visual impact of the storage shed or accessory building on adjoining lots and or streets. Poly-Vinyl storage containers are pre-approved as long as they Do not exceed 64 cubic feet in capacity (example: 2 x4 x8 ) Are located adjacent to the rear of the house (containers located away from the house are in violation) Window Air Conditioners, Window Fans Window air conditioning units and window fans are not permitted Window Boxes, Planters Window boxes and planters to be installed on the home require committee approval. Window boxes and planters installed on the homeowner s deck are pre-approved provided: They are of a color and material complimentary to the residence exterior and shall be maintained in a neat and attractive manner. Dead and diseased plants and all weeds shall be promptly removed Awnings Awnings, retractable and fixed, are allowed only after receiving approval from the ARC. They must be of a complimentary color to the exterior of the home. Awnings must be made from acrylic fabrics only & may only be installed over a deck or patio in the rear of the home. 15 3.0 Construction Rules for All Homeowners and Contractors 3.1 Applicability These rules will apply to construction activities, remodeling or renovations associated with any lot. Any reference made herein to an Owner shall also apply to the Owner s builder & subcontractor. Owners shall abide by these Rules & each Owner is responsible for the actions of any builders or contractors hired to do work on their property. Plans for a complete tear down shall be submitted to the ARC under the terms of the Jetton Cove New Construction ARC Guidelines 3.2 Construction Hours and Noise Construction activities must be conducted between: Monday through Friday: 7:00am to 7:00pm Saturday and Holidays: 8:00am to 6:00pm Sunday: 12:00pm to 6:00pm No loud radios or distracting noises will be permitted during construction. 3.3 Construction Debris The Lot shall be left in a neat & orderly condition at the close of each workday. Debris shall be disposed of in trash receptacles & such receptacles shall be collected & emptied prior to their becoming overfilled. Streets & sidewalks must be cleaned daily to remove any building materials (including nails), 3.4 Construction Access Construction vehicles must be parked so they do not block or impede traffic or damage vegetation. 16 3.5 Material Storage No construction materials, equipment or debris of any kind may be stored on any street, curb, sidewalk or area between streets & sidewalks. 3.6 Portable Chemical Toilets The Toilet may not be placed in the Owner s front yard without committee approval prior to placement. A Portable toilet required during construction must be located in as inconspicuous location as possible. Removal is required immediately upon completion of the project. 3.7 Property Damage It is the responsibility of the Owner for all costs associated with damages & repairs to common area &/or community property resulting from all construction activities. The Homeowner agrees to follow all the terms and conditions of the Jetton Cove Covenants, Conditions and Restrictions and the Architectural (ARC) Guidelines. Compliance with the ARC Guidelines is required, but is not the sole basis for review or approval, nor does it guarantee approval of any application.
