7 1. INTRODUCTION AND BUILDING SCALE: 1.1. Project Objectives The RE11 project (expansion) will provide electricity for 26 communes of 10 districts of Binh Dinh province with the concrete goals: + Expanding and improving the LV grid of the rural areas in communes of projects to meet demand for developing economic society in the period from Reducing the loss of the power from 28% down 10% + Improving the quality of electricity supply communes in the project area. Increasing the percentage of electrification of the communes from 95% to 100% + To carry out conversion of the local power management models, in order to raise the management ability, business low voltage electricity network. + Increasing reliability provide electricity for the consumption households. Minimize the time lost electricity + Meeting the power using requirements of economic sectors, creating conditions to promote development of socio-economic phase The communes were selected to join the Project Table 1.1. Description Summary natural conditions of the society and localities in the region Project: RE11 of Binh Dinh Province (expansion) has been implemented comprehensively in the 26 communes of 10 districts, including Vinh Thanh, Van Canh, An Lao, An Nhon, Tuy Phuoc, Phu Cat, Phu My, Hoai Nhon, Hoai An, Tay Son. 19 3. The legal framework for the evaluation of environmental impact of the project: 3.1. The Law and regulations of Viet Nam - Law on Environment Protection (LEP), 11/29/ The Protocol 80/2006/ND-CP, (1 1/29/2006) guiding the implementation of the Law on Protection of the environment. - Circular No 490 "Guide to the establishment and evaluation reports assessing the impact the environment for investment projects" - The Protocol 106/2005/ND-CP on protect the high voltage grid. - The Protocol 24/2000/ND-CP, regulations on the implementation of the Law on Foreign Investment in Viet Nam, (Article 82 - relating to the protection of the environment). - The Protocol 52/1999/ND-CP on the review of environmental management in construction. - The Protocol 121/2004/ND-CP regulating the administrative fines for violating the Law on environmental protection. - Standards of Viet Nam (ISO), these are the national standards by the Ministry of Science and Technology (MOST) applied to government agencies. These standards include: the manufacturing, construction, standards in science and the environment. Overview of environmental impact: 4.1. Classification of impacts: The impacts of the before construction period, the period of construction and operation period can have been assessed belonging to one of the types of impacts following: Not impact. Potential impact of activities of project is rated not to have an impact if the activities of the project is completely separated from the environmental factors on space or time. Large Impact. One impact is considered if the project activity has the potential to affect an environmental factor. The large impact can be " negative big impact " or " positive big impact ". The following criteria used to determine a certain impact has been seen as not Large: a. Space scale of the impact ( scene, local, regional, country, international); b. Limits on the time of impact (short-term, medium term or long term); c. Change scale of environmental factors by the activities of the project could cause (small, medium, large); d. 21 e. The level of compliance with laws, standards and regulations on protecting the environment of the nation, province, district; f. Compliance with the international commitment of Viet Nam. The commitments include: "the Convention on the slime which has the international importance, especially the habitats of waterbirds " ( RAMSAR ), "the Convention on the protection of cultural heritage and natural heritage of the World "(also known as the Convention World Heritage) and" Convention on international trade for animals and plants are at risk of extinction "(CITES); g. Potential impact of a work project for an environmental factor is seen as it can minimize if mitigation measures are proposed to prevent or reduce the impact down to the acceptable level Determining the potential impact of the project The objective of the project is to provide electricity for 26 communes in Binh Dinh province. The implementation of the project will create many new opportunities for employment, quality of life of local people will improve, distance of the rich poor people will be shortened, will create good conditions for economy development. In addition to the very meaningful beneficial impact, the project may create detrimental impacts on the environment and the social - economic of locals. Use the "List of inspection data environment" (Environmental Data Screening Checklist) and "List of inspection standards on the environment" (Environmental Baseline Checldist) as the instructions in "regulation framework for the application of the environment regulations for Rural Energy Project I1 ", the potential impact of the project is described in Table 4.1 Table 4.1. COMMUNITY CONSULTING AND OPENLY INFORMATION: During the preparation for investment projects (2008), it has conducted the following activities: Activity 1: Provide information and discuss with local authorities about the direction of line Activity 2: Survey and statistic impact Activity 3: Meeting of households affected When the investigation was completed, the compensation board of the district (in collaboration with the staff at communal level) organize the meeting with the affected households who have land in the corridor and online with other village representatives trafficking. During the exposure, the consultant presented several different documents, including: Summary Project, the draft RAP (Action Plan resettlement) and the draft EIA (Assessment of environmental impact schools), the status quo maps, figures, tables, paintings, photos and other supporting materials Organization officials have exposed to notify the participants the aim of the project, presented details of the implications for land crops, introduced the principles and policies for compensation, and advised people not to construct the new in the comdor line. Households affected be consulted on compensation policies and the amount of compensation for each household. Activity 4: Continue to receive feedback from households affected Activity 5: Publish information The project will receive investment licenses after they have adapted to the location, design, capacity or technology of the project to meet the requirements of environmental protection and resettlement. To meet the requirements of OP 4:01 on published information, Electricity Company 3 will: Provide Vietnamese version of the EIA report, RAP, Abstract Project for the People's Committees at district level and commune level in the project area. Post newspaper several times on the newspaper's major local time in 02 months. 73 Appendix Some specific regulations on Ensuring the health and safety in electricity Electric Line - measures to prevent and control: - Only allow the workers who have been trained fully implement the installation, maintenance or repair of electrical equipment; - Cutting off electricity fully before implementing the work - Ensuring that only those workers who have been trained operate on the electric line and must comply with strict regulations on safety and electricity. 77 Appendix Duties of the independent monitoring environment Consultant 1. Objectives: Safety policies independent monitoring Consultant (hereinafter called the Consultant) is to evaluate of the implementation of Planning and Environment management. Consultant will implement and monitor the implementation of mitigation measures by contractors and the impacts of the project to the environment as well as households affected by the project, test the level of efficiency in the report process, give the necessary adjustments propositons to enhance effective implementation of environmental commitments. 2. Duties: A. Monitoring the implementation of the EMP proposed in the EIA report, the impacts of the project to the environment and people. Observations and the monitoring of environmental issues stated in the TOR as well as the environmental management plan. - Sanitation works after construction. - Problems with the forests in the project area (area, number, and after cleaning the optics, etc.) - Status of road traffic. - The re- afforestation (if any). - The level of influence in the process of construction (dust, noise, the level of degradation of the road, with the level of forests, etc.) in the field as well as the around residential area. - Safety and hygiene in accommodation areas of workers - Distance between the house and transmission line (T / L) - The implementation of safety measures - Other issues as noted in EIA...
