3 BAPETEN OVERVIEW
4 BAPETEN was established in 1998 based on the Act No. 10 Year 1997 on Nuclear Energy Article 4 (1) The Government establishes a Regulatory Body, under and directly responsible to the President. The Regulatory Body shall have the task to control any activity using nuclear energy. (2) To accomplish the task under clause (1), the Regulatory Body establishes regulations, conduct licensing processes and inspections.
5 There are two kinds of object or facility to be controlled by BAPETEN: Radioactive Materials and Radiation Facilities Nuclear Installations and Materials Radioactive Materials and Radiation Facilities consists of all radiation facilities and radioactive materials, that are used in areas of: Public Health: Diagnostic, Therapy, etc. Industry: Radiography, Gauging/Logging Tracer, etc. Research, etc.
6 Nuclear Installations and Materials comprises: Nuclear reactor, a. Multi Purpose Reactor ( 30 MW) in Serpong b. TRIGA Mark II Reactor ( 2 MW ) in Bandung c. TRIGA Mark II Reactor ( 100 kw ) in Jogjakarta Other Nuclear Cycle Facilities: RR Fuel Element Production Installation Experimental Fuel Element Installation Radiometallurgy Installation Transfer Channel Interim Spent Fuel Storage Facility. Nuclear Materials: Nuclear fresh and spent fuels.

17 LICENSING based on GR No.43/2006 on Licensing of Nuclear Reactor
18 Article 2 (1)This Government Regulation regulates the licensing of nuclear reactors in each stage of construction, operation and decommissioning of nuclear reactors. Article 4 (1)Nuclear reactors to be licensed are: a. Commercial and non-commercial power reactors; and b.commercial and non-commercial non-power reactors. Article 5 (3)The construction, operation and decommissioning of commercial power or non-power reactors are performed by State-owned corporation, co-op and/or private companies. (4)Construction of the aforementioned commercial power reactor in the form of nuclear power plant is issued by Ministry of Energy after consulting with the House of Parliament.
19 Article 6 (1)The promoting body, State-owned corporations, co-op and/or private companies which will conduct the construction, operation and decommissioning of nuclear reactors shall have an authorization from the Chairman of BAPETEN. (2)The authorization as stipulated in paragraph (1) is issued in stages, which include: a. Site Permit; b. Construction Permit; c. Commissioning License; d. Operation License; and e. Decommissioning Permit.

Administrative Requirements : Deed of establishment of the promoting body, stateowned corporations, co-op, and/or private companies. Other licenses or requirements in accordance with applicable laws and regulations. 2. Technical Requirements : Site Evaluation Report executor organizing structure; documentation and reporting; data evaluation and analysis on: impacts of external event within the site and its vicinity that are caused by natural event including geological, seismological, meteorological events as well as events that are caused by human activities against nuclear reactor safety coming from chemical installation, toxin release and inflammable gas and air crash; site and its environment characteristics that can influence nuclear installation and radioactive material released from nuclear reactor to human; public demography and other characteristic of the site that are related to risk evaluation against public member and the feasibility of the implementation of emergency preparedness. 31 BAPETEN (Directorate of Licensing) tried to identify Acceptance Criteria in each of those aforementioned Regulation for the purpose of establishing Standard Review Plan for : Site Evaluation Program Site Evaluation Quality Assurance Program Site Evaluation Report The problem is there is not much Acceptance Criteria we could collect (especially for SER SRP), as there were no obvious value limitation in it. For SRP purpose we are force to use Acceptance Criteria outside our own Regulation (especially NRCs), as it is necessary in pratice, although it will not have legal basis.
32 CONCLUDING REMARKS Development in Indonesia is currently heading the right way. As a Regulatory Body, BAPETEN already establish regulations (especially for siting stage), although it still need some improvement and starting next year will have a grand program on Regulatory Preparation. It is BAPETEN s task to close gaps/holes in our s (Site) Regulatory Requirements in order to be prepare for Indonesia s 1 st in the near future.
