The report contains evidence of the relevant rates of pay from government and third party remuneration statistics, and job advertisements for the purpose of benchmarking the appropriate wage and pay rates for Mr. Client Nominee in the role of Panel Beater at Beat It Body Works Pty Ltd. (Beat It). Following this is a section containing a response to Genuine Position. Details of the Sponsor Following are the details of the business as listed on the Australian Business Register. The directors propose an annual gross wage of AU$55,000 which has been calculated against the following four sources: 1. Modern Award MA000089: Vehicle Manufacturing, Repair, Services and Retail Award The Australian Government Job Outlook website 3. Current market rates provided by third party online remuneration sites 4. Online Job Advertisements Remuneration and No Equivalent Worker The proposed annual gross wage for Mr. Nominee is AU$55,000 exclusive of superannuation. This equates to a weekly wage of $1, Following is a chart depicting this wage breakdown. Page 2 of 12

3 Statement explaining why you are paying the nominee the proposed base salary. This may include information regarding the nominee s years of experience, qualifications, additional skills, expertise and/or background. The Nominee, Mr. Nominee has been offered the proposed base salary of AU$55,000. As per the Market Salary Rate, the average salary for a Panel Beater is between AU$50,000 and AU$55,000. The nominee has been offered a salary which is at the higher end of the salary scale for this position taking into account the following factors: The Nominee s qualifications - As per the Vehicle Manufacturing, Repair, Services and Retail Award 2010 and ANZSCO information, the qualification requirement for a Panel Beater is a Diploma or Trade Certificate. The Nominee has also completed a number of mechanical qualifications that enable him to complete work that will add to the services offered. These qualification give Mr. Nominee an edge over other workers in the same position as him as his skill set and level of understanding is superior to an average Panel Beater. The Nominee s years of experience The Nominee has three years of experience as a Panel Beater in an organisation where he was responsible for managing client relationships. The duties he performed which are relevant to the position are as follows: - High Quality Customer Service and Maintaining Client Relations - Managing Complaints and Conflicts - Maintaining Customer Satisfaction and Loyalty - Providing training and support to design/development team - Inventory and Stock Management Additional Qualities of the Nominee Mr. Nominee is a talented and qualified professional with similar experience in client facing role. Mr. Nominee possesses excellent self management and daily administration skills and will be able to establish good professional relationships with the other stake holders of the business. A further advantage is that he holds several mechanical certificates which give him a significant edge over other candidates. If there is a fair work instrument, state industrial instrument or transitional instrument that would apply to Australian citizens or Australian permanent residents in similar workplaces, and an Australian citizen or Australian permanent resident would be provided with employment terms and conditions in line with the instrument, please provide a copy of the relevant instrument. Upon contacting support at the Fair Work Ombudsman it is agreed that the appropriate award for the position of Panel Beater is the Fair Work Commission Consolidated Modern Award MA000089: Vehicle Manufacturing, Repair, Services and Retail Award Upon analysis of the award Mr. Nominee has been determined to be a Vehicle industry RS & R employee level I R6. Following is an extract of the award as well as an extract of the description and distinctive duties of an employee operating at this level. A full copy of the award is accompanying this document. B.6 Vehicle industry RS&R-tradesperson or equivalent Level I R6 [B.6 varied by PR ppc 15Feb11;PR ppc 01Apr11] An employee at this level is an employee who holds a Trade Certificate, Tradesperson s Rights Certificate or equivalent, nationally accredited training achieved through Australian apprenticeship arrangements as prescribed by the National Quality Council in the Australian Qualifications Framework Qualifications Issuance Policy. An employee at this level performs work above and beyond the skills of an employee at Level R5 and to the level of their training: Page 3 of 12

4 - Assists in the provision of on-the-job training in conjunction with supervisors/trainers; - works under limited supervision either individually or in a team environment; - plans the work of others and solves the work planning problems; - is responsible for the quality of their own work; - exercises discretion within the scope of tasks performed at this level; - possesses good communication skills; - has keyboard skills relevant to the tasks performed at this level; - understands and applies quality control techniques; and - is able to inspect products and/or materials for conformity with established operational standards. Remuneration data cannot be obtained from these associations for this report. 2. Information from unions There are a number of unions relevant for workers in the automotive repair industry that a Panel Beater may belong to in Australia. Unfortunately, none readily offer an indication of relevant wages. Broader labour market salary date including: 1. Appropriate references to the Australian Bureau of Statistics (ABS) The ABS does not provide anything specific for the role of Panel Beater. 2. Appropriate references to the Australian Government s Job Outlook website available at Job Outlook The following graph from Job Outlook shows the median weekly earnings for the occupation of a Panel Beater compared with the median across all occupations, for total employment and for full-time workers. Earnings are before tax and do not include employer superannuation contributions. This graph indicates an average weekly wage of $1,000. This is a median value that represent a range of values. The figure of $1,054 being offered for the role at Beat It is within 10% of all fulltime Panel Beaters and is therefore a fair wage, that is no less favourable than would be provided to an Australia citizen or permanent resident. Where broad ranges are given in the remuneration surveys provided, please also provide reasons a particular salary level has been selected for the nominee, and PayScale The following information regarding remuneration has been obtained from PayScale, Inc. which is an online salary, benefits and compensation Information Company that is widely used by individuals and companies to obtain accurate real-time information on job market compensation. The service works via the Internet by enabling individual employees to submit their job profile and salary data, which is then compared to others. Because a very large number of people use the service PayScale, Inc. is able calculate this information to determine accurate real-time salary data. Following is an image of PayScale, Inc. s remuneration figures for a Panel Beater in Australia. PayScale, Inc. calculates that the median wage for this role is equivalent to $ per week. As the wage being offered for this role is $1054 and is above the median wage of $ for a Panel Beater that is operating at level 6 of the award, the wage being offered is no less favourable than would be provided to an Australian citizen or permanent resident for pertaining equivalent duties. 7 Similar job vacancy advertisements together with the salary, duties and job description. Job advertisements must be recent. Following are three adverts for a Panel Beater position in Queensland. These positions describe a similar level of capability that is required for the role at Beat It. Each advert has been highlighted to point out the similarities to the role in question, and each is followed with a supporting statement and extracts from the position description of the role at Beat It, as seen below. Position description Panel Beater Beat It The Panel Beater at Beat It will be a fully qualified and experienced Panel Beater for our mobile panel beating service. This is a new business and a new opportunity for which we need a driven and proven Panel Beater who is able to deliver high standards consistently in a timely manner. The Panel Beater will repair damage to metal, plastic and fibreglass bodywork on vehicles. The Panel Beater also fabricate and form vehicle panels using machines or hand tools. The duties of a Panel Beater are to restore vehicles to factory state. This involves assessing the vehicles damage and determining how to repair. This person will require ability to fabricate new panels depending, and weld and grind panels to full restoration. Key Accountabilities and Key Performance Indicators: Assessment Management - Assess damage and estimate costs and materials for repair - Report to Operations Manager regarding status on repairs KPI: The Panel Beater will be required to report on costs and materials for repair, and not exceed pre-set values. Repair Management - Repair damaged panels and components by unbolting or cutting them away - Repair damaged body panels with specialist tools and equipment - Use measuring, mechanical and hydraulic equipment to restore vehicles to factory clearances - Cut and join replacement sections or damaged panels using correct welding procedures - Repair dents with plastic fillers, and file, grind and sand repaired surfaces using power and hand tools - Fit the repaired panels on the framework of the vehicle and refit body hardware, such as door locks and door trims - Replace badly damaged sections with new or second-hand panels - Realign chassis and body frames using chassis aligners and measuring systems - Remove and replace accident-related mechanical items - Remove and replace auto-electric components - Help vehicle body builder to build custom-designed, specialty or vintage vehicles - Assist with spray painting vehicles KPI: The Panel Beater will ensure that repairs pass quality checks and factory clearances. 8 Advert One - Indeed Remuneration for this role is $27 per hour which calculates to $1,022 per week and is in range of the $1054 being offered to Mr. Nominee. The highlighted elements in the advert above indicate a role that requires the individual to have the capability to perform the following tasks from the role description for the Panel Beater at Beat It and is therefore similar in scope. - Repair damaged panels and components by unbolting or cutting them away - Repair damaged body panels with specialist tools and equipment - Use measuring, mechanical and hydraulic equipment to restore vehicles to factory clearances - Cut and join replacement sections or damaged panels using correct welding procedures Page 8 of 12

9 Advert Two - Reed Remuneration for this role is $27 per hour which calculates to $1,022 per week and is in range of the $1054 being offered to Mr. Nominee. 10 Advert Three Jobactive Remuneration for this role is $28-$34 per hour which calculates to $1,064-$1,292 per week and is in range of the $1054 being offered to Mr. Nominee. The highlighted elements in the advert above indicate a role that requires the individual to have the capability to perform the following tasks from the role description for the Panel Beater at Beat It. 11 - Cut and join replacement sections or damaged panels using correct welding procedures - Repair dents with plastic fillers, and file, grind and sand repaired surfaces using power and hand tools - Fit the repaired panels on the framework of the vehicle and refit body hardware, such as door locks and door trims Conclusion According to the research outlined above $55,000, exclusive of Superannuation, and benchmarked against industry indicators, indicate that it is an accurate remuneration for Mr. Nominee. Genuine Position Following is an explanation of how the role of Panel Beater fits in with the scope, scale and operations of Beat Its business. Evidence that the position fits within the scope and scale of the business, Beat It requires a Panel Beater to fix scratches and dents, stone chips, scuff marks, rust and paint issues. This position was not required previously as the business is new. Following are a number of elements of the business that require a qualified person for the role. The Panel Beater will have the expertise to diagnose and troubleshoot different types of faults. The business requires a Panel Beater that has the extensive knowledge of troubleshooting different faults. This person will prepare and estimate damage and make an accurate report for the client, the business and insurance company. Then Panel Beater will chose the most efficient way to fix all manor of faults to maintain customer satisfaction and a profitable margin. It is imperative that after servicing vehicles the Panel Beater ensures that all controls and systems are functioning in a vehicle to prevent accidents, injuries or death. The business requires a Panel Beater that has the ability to assess the serviceability of a vehicle and recommend whether it is road-worthy or not. The directors understand the importance of repairing and servicing vehicles to its specified specifications to ensure road safety for the passengers and other motorists. As the directors of Beat It wish to expand its business and offer more services. The directors recognise the importance of the quality and service that only an experienced qualified person can. The directors also recognise that vehicles are an important means of transportation and that faulty repairs and poor service can cause devastating consequences. Therefore, the directors wish to employ an experienced and knowledgeable Panel Beater for Beat It. Evidence that the position is necessary to the operations of the business. The directors are seeking to expand the businesses services and require a Panel Beater who has the capability to provide quality service and create revenue for the company. Road safety is significant and clients seek shops that repair and offer services at affordable prices without compromise. Beat It wishes to offer these additional services at a reasonable price. Following are a number of elements that point towards the fit of a Panel Beater to the operations of the business. The Panel Beater will provide estimate costs for repairs. The Panel Beater will provide costs for labour and materials needed for repairs; the business aims to provide quality services at affordable prices. It is imperative for the Panel Beater to be precise on estimates to ensure budgets for repairs do not go beyond the contracted price. This work requires an experienced and confident Panel Beater particularly that the work is without supervision being a mobile business. Page 11 of 12

12 The Panel Beater will ensure quality services and repairs to clients and recommend best practice for the repair of any damages. Fundamental to the success of the business is the Panel Beater performing well. Panel Beating, spray painting and all of the operations required by the business require expertise and a level of capability that only qualified Panel Beaters obtain. The Panel Beater will a timely turn around. Time management is an ability the Panel Beater must have in order to manage projects and repairs within budget. The Panel Beater will have to multi-task on different repairs and ensure that services take no longer than the allotted two hours. The directors recognise that this level of capability in operation can be found only in qualified and experience Panel Beaters.
