1 POSITION DETAILS: Title: Compliance Officer Department: Auckland Regional Public Health Service (ARPHS) Date: April 2015 Professional Reporting Line and Reports to: Programme Supervisor Health Promotion PRIMARY FUNCTION: The Compliance Officer s area of responsibility is to carry out ARPHS regulatory responsibilities by identifying and monitoring areas of compliance to ensure effective enforcement of the Sale and Supply of Alcohol Act 2012 and the Smokefree Environments Act 1990 Accurate investigation, assessment and reporting of all type of liquor licence applications Supporting the inclusion of a public health perspective in the liquor licensing process Preparation of oppositions, including briefs of evidence and presentations at District Licensing Committee and Alcohol Licensing Regulatory Authority hearings Conducting visits and controlled purchase operations when appropriate Investigation of smokefree complaints and preparation of smokefree prosecution files when appropriate Active relationship building and networking with stakeholders and networks appropriate to support the compliance goals and objectives Support the development and maintenance of strategic relationships which contribute to the achievement of health outcomes Keep up to date with legislative knowledge, case law, research and developments relevant to the compliance work programme. SERVICE DESCRIPTION: ARPHS delivers public health services on behalf of the three District Health Boards (DHB s) in the Auckland region. ARPHS is a fully integrated public health unit delivering promotion, protection and screening programmes designed to improve the health and wellbeing of the populations of the Auckland region. ARPHS focuses on a whole-of-population approach to improving the environments in which people are born, live, learn, work and play, in order to support health and wellbeing. As a Crown agent we support manawhenua in its role to manaaki (care for) all people within its tribal rohe (area). We ensure participation of mata waka (those with affiliations other than manawhenua) in planning and providing services that promote the wellbeing of all Aucklanders.

KEY ACCOUNTABILITIES Key Result Area Expected Outcomes/Performance Indicators Inspections and monitoring of liquor licensing applications Building relationships and networking Identify grounds for oppositions to liquor licences. Where appropriate prepare cases and briefs of evidence and appear before the District Licensing Committees and Alcohol Regulatory Licensing Authority Ensure correspondence is accurate and helpful to all participating agencies i.e. Licencing Inspectors and Police Foster relationships with Inspectorates and Police to maintain and address emerging issues relating to effective enforcement of the Sale and Supply of Alcohol Act 2012 (e.g. CLEG meetings) Work with programme supervisors, clinical partners and Health Improvement Managers to identify existing and new stakeholder relationships relevant to ARPHS priorities for alcohol and tobacco compliance and control, such as Auckland Council, Ministry of Health, and NZ Police Model ARPHS values in all interactions with key stakeholders, internally and externally Actively participate in multi-agency operations to strengthen Host Responsibility implementation and enforcement Work to raise the profile of ARPHS as an effective and proactive agency in the monitoring and enforcement of the Sale and Supply of Alcohol Act 2012 Ensure correspondence is accurate and helpful to all participating agencies i.e. Licensing Inspectors and Police. Provide comprehensive reports as requested Support the provision of strategic leadership and coordination within regional forums of key regulatory and non-regulatory partners (including Police and Licencing Inspectors).
3 Investigate complaints under the Smokefree Environments Act (1990) following appropriate protocols and conduct proactive Smokefree enforcement checks as per the Ministry of Health Smokefree Compliance and Enforcement Manual Provide leadership capabilities Investigate complaints under the Smokefree Environments Act 1990 and follow up on, as appropriate, following the recognised protocols and procedures Respond to requests from external stakeholders for advice and information provision Perform proactive monitoring of tobacco retailers to ensure compliance with the Smokefree Environments Act 1990 year), including tobacco retailer compliance checks and controlled purchase operations. Ensure effective sector leadership by providing directly or supporting existing leadership, both within ARPHS and externally. Ensure the integrity of ARPHS programmes and service is maintained Monitor and respond as appropriate to issues which arise within areas of responsibility by providing timely, high quality information, and advice to the Programme Supervisor Produce and support reports, develop materials and support the evaluation of relevant programmes Participate and support other relevant or related health promotion or protection programmes that contribute to achieving health outcomes Respond appropriately to changes in legislation in agreement with Programme Supervisor. Emergency Response All Auckland Regional Public Health Service employees are expected to respond in an emergency situation to: Protect the health of the affected population in a civil defence emergency Contribute to the implementing of response & emergency and pandemic incident response plans Enable the provision of business continuity of the service Participate in rosters to ensure work coverage during response & emergency events. 5 Person Specification Education & Qualifications Essential Professional A specific undergraduate +/- post graduate qualification(s) within the appropriate discipline Or extensive experience in an enforcement/compliance or health promotion role Full & Current Drivers licence Willingness to travel and work flexible hours if/as required. Experience/Knowledge Three or more years experience in alcohol and tobacco regulatory work/ health promotion or another relevant discipline Relationship management Experience in the public health and/or social development/education sectors Have demonstrated health promotion networks within the Auckland region Proficiency in the use of the internet, web-based software and Microsoft Office software Proficiency in writing and presenting information A sound knowledge and experience working within the Treaty of Waitangi principles. Desired An understanding of the principles and practices of Te Pae Mahutonga, the Ottawa Charter and other health promotion frameworks Knowledge of te reo me ona Tikanga Relevant post-graduate study or progress towards completion where this is available Smokefree Enforcement Officer Designation. Experience in working with research and evaluation frameworks Knowledge of government strategies: Primary Health Care Strategy, HEHA, Reduce Inequalities and He Korowai Oranga Knowledge of social research and evaluation methods with ability to analyse social/ scientific research.
