5 PROJECT LABOR COMPLIANCE REQUIREMENTS Contract can only be awarded to a contractor who is registered with the State of California Department of Industrial Relations (DIR) Prevailing Wage Determination includes: Basic Rate paid to the worker Fringe Benefits paid to the union(s) Training Fund Contributions Certified Payroll Records Must be kept weekly and submitted monthly to the Consultant and DIR Apprentice Utilization Apprentices must be utilized within the ratio requirements for each craft employed on this project Must be registered in a bonafide approved apprenticeship program 5

6 PROJECT LABOR AGREEMENT REQUIREMENTS A PLA Compliance Consultant will be assigned to the awarded Contractor Union vs Non-Union Contractors Both Union and Non-Union Contractors are eligible to bid and win the award of Public Works Contracts that are subject to the PLA. However, it is required that all contractors agree and sign the Letter of Assent found in Attachment A to the PLA. Letter of Assent The Letter of Assent is an agreement to abide by the terms and conditions contained within the Project Labor Agreement and the Union Schedule A s for each craft employed as well as ensure that all subcontractors are bound to abide by them as well. Must be signed by the Prime and all subs before each can be performed on this project. 6

7 PROJECT LABOR AGREEMENT REQUIREMENTS CORE EMPLOYEES (Section 3.8A of the PLA) Submit Core Employee List before work begins on the Contract Employees whose names appeared on the Contractor s active payroll for 60 of the 100 working days immediately prior to Contract Award Who have been residing in the 1st or 2nd tier zip codes for the 100 working days immediately prior to the award of the contract. Core employees are required to register with the appropriate union hiring hall prior to the 1st day work is performed on this project Non-Union Contractors can select the 1 st employee from their own workforce, however when a 2 nd employee is needed the 2 nd employee must be dispatched from the union hall. This pattern is to be followed for the first 10 workers on the project (which can include up to five core employees) For the 11 th employee and beyond all additional workers must be dispatched from the union hall. 7

8 PROJECT LABOR AGREEMENT REQUIREMENTS TARGETED HIRING Local Hiring The Local Hire Goal established for this project is 40% of the total hours worked. As this is a Tidelands funded project, Local Hire means individuals who reside within Orange and Los Angeles Counties (PLA Section 3.5 (a)1.). Apprentices There is a 30% Apprentice goal for each craft/workforce. Disadvantage/Veteran Workers The Disadvantaged Worker goal for this project is 10%. This category includes low-income and veterans and requires the completion of a form to determine qualification for each worker. 8

9 PROJECT LABOR AGREEMENT REQUIREMENTS Grievance Process Three-Step Grievance Process, which ends with Arbitration through a thirdparty mediator. If grievances are not resolved prior to Step 3 Arbitration, the cost of the Arbitrator is to be split between the Union and the contractor. Pre-Job Conference Each Primary Contractor which is awarded a Construction Contract by the City for Project work shall conduct a Pre-Job Conference with the appropriate affected Union prior to commencing work, which additionally requires that you notify the Trades Council and the PLA Administrator. 9

12 PROJECT OVERVIEW & SCOPE Demolition +/- 2,200 s.f. of existing concession/restroom building Building A is a two-story core and shell café/concession building with roof deck. Building B includes public restrooms, rinse station, and recreational rental facility. New buildings 4,240 s.f. and 1,322 s.f., respectively. Scope also includes an outdoor play area, public promenade, shade structures, wayfinding signage, improvements to the public beach parking lot, and site improvements. 12

16 SPECIAL ATTENTION ITEMS Substitutions for Cause, Substitutions for Convenience, & Approved Equal Substitutions The General Contractor is completely responsible, and shall pay in full for all A/E Fees associated with the review and approval of the proposed substitution Any Additional time added to the schedule due to the request of the substitution shall be the responsibility of the General Contractor GC responsibility for certain permits Demolition/Recycling Deposit found in the waste management forms AQMD Fee Per Paragraph of the Project Manual, The Contractor shall submit Plans, handle all coordination, follow through, and obtain plan check approval and permits for the automatic sprinklers, fire alarm system, underground fire line, elevator system, shade structure, and signage from the Bureau of Fire Prevention, the Department of Planning and Building, and other required agencies 16
