Reject all bids for the Hesperian Boulevard Corridor Improvement Project, from Embers Way to West A Street in Eden Township, Alameda County, California; Specification No. 2124; B. Approve Project Specification No for the Hesperian Boulevard Utility Undergrounding; and C. Direct the Clerk of the Board to advertise the project for bids for construction for Project Specification No. 2339, with bids to be received by the Director of Public Works on July 11, 2017 by 2:00 p.m., with a report of the bidders and the respective amounts of their bids presented to your Board at a later date. SUMMARY/DISCUSSION: Your Board previously approved Project Specification No for advertisement. The project consists, in general, of providing traffic control and construction area signs; implementing construction staging plan; providing and implementing water pollution control plan; clearing and grubbing; performing roadway excavation and site grading; completing utility undergrounding; providing roadway and sidewalk lighting; installing traffic signals; constructing concrete and decorative concrete improvements; milling asphalt; placing asphalt; installing traffic striping and pavement marking; installing irrigation; planting trees, plants, and landscaping; and cleaning of the site at the end of the job.

It was determined by Agency staff that it would be in the best interest of the County to reject all bids. Based on an analysis of bids and the project documents, the delivery of the project will be best served by splitting into two phased, separate projects; one for undergrounding of utilities, and a separate later project for streetscape improvements. The undergrounding of utilities portion of the work will be advertised immediately, as Specification No Project Specification No consists, in general, of coordinating with utility companies, businesses, schools, and property owners; providing traffic control and construction area signs; implementing construction staging plan; providing and implementing water pollution control plan; clearing and grubbing; completing utility undergrounding; providing temporary roadway lighting; modifying existing traffic signal electrical services; replacing and repairing existing concrete improvements; placing asphalt; installing traffic striping and pavement marking; and cleaning of the site at the end of the job. Board approval for authorization for advertisement for the streetscape portion of the work will be sought at a later date SELECTION CRITERIA AND PROCESS: This will be a publicly bid construction contract. The current M/WBE goals require that contractors show good faith efforts to subcontract with minority-owned business enterprises (MBE) and women-owned business enterprises (WBE). For projects over $100,000, bidders are encouraged to meet a 15% MBE and 5% WBE participation goal. Construction contracting opportunities are posted in Plan Rooms, local trade organizations, and published in local ethnic newspapers. To convey the M/WBE goals to interested contractors, PWA will hold a mandatory pre-bid meeting to discuss the M/WBE goals and to facilitate relationships between contractors and subcontractors. 3 Approved as to Form DONNA ZIEGLER, County Counsel THE BOARD OF SUPERVISORS OF THE COUNTY OF ALAMEDA, ST ATE OF CALIFORNIA RESOLUTION NUMBER: R- 2O REJECT ALL BIDS FOR SPECIFICATION NO. 2124; APPROVE PROJECT AND ADVERTISEMENT FOR SPECIFICATION NO WHEREAS, this Board of Supervisors by Resolution No. R , adopted on 411 9/16, directed the Clerk of the Board to advertise for proposals for the Hesperian Boulevard Corridor Improvement Project, from Embers Way to West A Street in Eden Township, Alameda County, California; Specification No. 2124, said bids to be received by the Director of Public Works or his authorized representatives in Room 300, Alameda County Public Works Agency, 951 Turner Court, Hayward, California 94545, until Tuesday, 5/24/16, at the hour of 2:00 PM, at which time said bids would be taken by the Director of Public Works or his authorized representative to the Conference Room of said Public Works Agency, and opened and publicly read; said bids together with a report of the bidders and the respective amounts of their bids to be presented to this Board of Supervisors at a later date at 10:00 AM in the regular meeting room of said Board of Supervisors in the Alameda County Administration Building, 1221 Oak Street, Oakland, California 94612; and WHEREAS, addenda were issued to extend the bid opening date to Thursday, 4/27/17; and WHEREAS, on Thursday, 4/27/17, two (2) bids were submitted in response to said advertisement; WHEREAS, Resolution R contains a provision reading as follows: and "The Board of Supervisors reserves the right to reject any or al I bids and any or all items of such bids;" WHEREAS, in the opinion of this Board of Supervisors, it is not in the best interest of the County of Alameda that said bids, submitted as heretofore set forth, be accepted; WHEREAS, in the judgment of the Board of Supervisors of the County of Alameda, it is necessary to secure all labor, material, equipment, mechanical workmanship, transportation, and services required as follows: HESPERIAN BOULEVARD UTILITY UNDERGROUNDING NOW, THEREFORE, BE IT RESOLVED, that the above-listed bids, presented for Specification No. 2124, be and the same are hereby rejected; and

4 BE IT FURTHER RESOLVED, that the Clerk of this Board be and she is hereby authorized and directed to return the bids and bid bonds submitted by the unsuccessful bidders to said bidders for Specification No. 2124; BE IT FURTHER RESOLVED that the plans and specifications No for the above-mentioned Hesperian Boulevard Utility Undergrounding work as prepared by the Director of Public Works, as authorized by the Board of Supervisors be and they are hereby accepted and approved; and BE IT FURTHER RESOLVED that the bid bond to be submitted with the proposals for the above work shall be in the amount equal to ten percent ( l 0%) of the base bid; and BE IT FURTHER RESOLVED that the general prevailing rate of per diem wages and the general prevailing rate for holiday and overtime work shaji be as determined by the Director of the Department of Industrial Relations, State of California, for each craft, classification, or type of workman needed to execute the contract as set forth in Sections 1770 and 1773 of the Labor Code of the State of California; and BE IT FURTHER RESOLVED that the Clerk of this Board be and is hereby authorized and directed to advertise for proposals for the above-mentioned work, in accordance with law by publishing the same in the Inter-City Express, a newspaper of general circulation published in the County of Alameda, State of California; and BE IT FURTHER RESOLVED that the Notice to Bidders shall be in the form as follows:

6 Specification No NOTICE TO BIDDERS On June 6, 2017, the Board of Supervisors approved the following project and invites all qualified contractors to submit proposals for all labor, material, equipment, mechanical workmanship, transportation and services required for the work to be performed on: HESPERIAN BOULEVARD UTILITY UNDERGROUNDING GENERAL WORK DESCRIPTION: The project consists, in general, of coordinating with utility companies, businesses, schools, and property owners; providing traffic control and construction area signs; implementing construction staging plan; providing and implementing water pollution control plan; clearing and grubbing; completing utility undergrounding; providing temporary roadway lighting; modifying existing traffic signal electrical services; replacing and repairing existing concrete improvements; placing asphalt; installing traffic striping and pavement marking; and cleaning of the site at the end of the job. This project is subject to all Local, State, and Federal laws, rules and guidelines contained in the plans and specifications, including but not limited to payment of prevailing wages. These wage rates are available at the Alameda County Public Works Agency s office. Contractor and subcontractors must be currently registered and qualified to perform public work contracts pursuant to Labor Code Section Contractor must possess a Class A license at the time this contract is awarded and throughout the construction contract duration. BID OPENING: Tuesday, July 11, 2017, 2:00 p.m., Public Works Agency, 951 Turner Court, Room 300, Hayward, CA There is a mandatory pre-bid meeting required for all prime contractors. Interested sub-contractors are invited and encouraged to attend pre-bid meetings. The pre-bid meeting has been scheduled on June 22, 2017 at 10:00 a.m. at 951 Turner Court, Room 301, Hayward. Bid Proposals from prime contractors that fail to attend this mandatory pre-bid meeting will be rejected. The County of Alameda Public Works Agency strongly encourages the participation of disadvantaged/minority/womenowned business enterprises in the County public works capital improvement projects.
