2 Intrductin The Duty f Care applies t anyne wh imprts, carries, keeps, treats r dispses f cntrlled waste. Yu MUST keep yur waste safe, and prevent it frm escaping frm yur cntrl The Regulatins require that any transfer f waste is nly t an authrised persn and is accmpanied by a Waste Transfer Nte which prvides a written descriptin adequate t help any subsequent hlder avid breaching the Duty. DC is a waste trail which requires details f the prducer, wh carries it and where and wh is receiving it. 3 Waste Transfer Ntes All transfers f waste between hlders must be accmpanied by a crrectly cmpleted Waste Transfer Nte. In sme instances an annual Waste Transfer Nte r seasn ticket can be used but nly in cases where the waste stream is cnsistent and is delivered t the same dispsal pint by the same carrier, fr example, lcal authrity dmestic waste cllectins. Regulatin 12 f the Waste (England and Wales) Regulatins 2011 nw sets ut the legal minimum amunt f infrmatin fr a Waste Transfer Nte Breeching the Duty f Care is an ffence, the maximum punishment is an unlimited fine WOSHA Waste Duty f Care / WTNs /

4 Waste Transfer Ntes Waste Descriptin and Waste prducer/hlder Full and accurate written descriptin Quantity f Waste and hw it is cntained (e.g. lse, in skip, sacks etc.) Time and Date f transfer (except fr seasn tickets where this is replaced by a validity perid) Place f transfer (e.g. the hlder s/prducers name and address and address where the waste is t be cllected) 2007 Standard Industry Cde (SIC) f the waste prducer/ hlder The 6 digit List f Wastes Cde/ EWC Cde. State the name and address f the parties invlved in the transfer, and cnfirmatin f their status (e.g. registered carrier, permitted facility etc.) and any permit/ licence number. 6 Tp 10 Tips 1. Use secure and sund cntainers and restrict access t them by yur emplyees (e.g. a lckable skip r a cmpund) 2. Label yur cntainers (this helps t prevent cntaminatin especially f recyclates) 3. Check yur waste carrier (it is nt sufficient fr yu t rely n a phtcpy they can easily be frged) g t the Envirnment Agency Public Register at: 4. Ask yur waste carrier where they will be taking yur waste and check that the site has bth a permit and can legally accept yur waste 5. Ask yur cntactr fr evidence f dispsal r audit the waste chain yurself 6. Thrughly read yur waste transfer nte, make sure that all the details are crrect befre yu sign it (especially the descriptin and EWC cde) 8. Make sure that yu have identified any difficulties with yur waste (e.g. is it very smelly?) 9. Make sure that yur recrds are kept up t date and are easily and readily accessible (bth the EA and the Lcal Authrities can legally request cpies, failure t cmply is an ffence) 10. 7 Sme Examples f Getting it Wrng 1.Example f Causing Difficulties t Others: Yu send green waste t a cmpsting site. Yur waste is cntaminated with fd waste which the site is nt allwed t accept. The fd waste attracts flies and prduces dur that affects lcal residents. Yu are partly respnsible fr causing this. 2.Example f an Unsuitable Cntainer If yu place lse pwder materials r waste paper in an pen builders skip as they are likely t blw away. Such materials must be securely cntained r bagged. 3.Example f Insecure Strage Yu have a cntract with a waste management cmpany t supply yu with a lckable skip fr yur ffice wastes. The skip is stred in yur car park at the frnt f yur premises. It is left unlcked vernight and smebdy dumps a small fridge in it. The skip cmpany cllects the skip and send yu an extra bill fr dispsal f the fridge, which requires specialist treatment befre dispsal. 4.Example f an inadequate descriptin Waste described as ffice waste, general rubbish r muck wuld nt cnstitute an adequate descriptin. 5.Knw where yur waste is ging Yu respnd t a leaflet psted thrugh yur dr fr cheap rubbish remvals. Yu are interviewed under cautin and it is established that by nt btaining a waste transfer nte yu have nt cmplied with the duty f care.
