1 Mdel Rules AFMA MODEL FARMERS MARKET RULES AND GUIDELINES These mdel Farmers Market Rules and Guidelines have been develped by AFMA fr use as a template in establishing new Farmers Markets thrughut Australia r encuraging and adapting existing markets t achieve designatin as a Farmers Market as defined by AFMA. T be recgnised as an authentic Farmers Market by AFMA these rules and guidelines shuld be adhered t and replicated in the cnstitutin and/r rules f an individual market. New markets r thse existing markets that wish t becme authentic Farmers Markets can cntact AFMA and/r where applicable a state farmers market assciatin fr guidance and assistance. The Farmers Market is defined as a predminantly fresh fd market that perates regularly within a cmmunity at a fcal public lcatin that prvides a suitable envirnment fr farmers and specialty fd prducers t sell farm- rigin and assciated value- added specialty fds fr human cnsumptin, and plant prducts, directly t cnsumers. Gvernance 2. The Farmers Market is run by a cmmunity based, nt- fr- prfit Assciatin, lcal gvernment, scial enterprise, c- perative r cmpany with the purpse f cmplying with pint The Farmers Market is a member f the relevant state Farmers Market bdy, which is a member f AFMA. Where there is n State Assciatin applicatin can be made direct t AFMA until a state, r reginal, bdy is in place. 4. All prduce must be sld by the farmer/prducer, family member, r emplyee directly invlved with the grwing, rearing, catching r manufacturing f the prduct. C- perative farming ventures may be included at the discretin f the individual Farmers Market, but must be genuine business arrangements, nt slely frmed t create the ability t resell prducts r sell multiple prducts at ne stall. 5. Resellers are nt permitted at the Farmers Market and the reselling f prduce is nt permitted at the Farmers Market. 6. The Farmers Market perates with clear gegraphic bundaries (GB) frm within which its stallhlders are lcated and prduce is surced. The GB is defined by the individual Farmers Market. Sme Farmers Markets may have similar r verlapping bundaries. Stallhlder Eligibility 7. The hierarchy f stall allcatin at the Farmers Market shall be; i) primary prduce grwn within the GB ii) value- added/specialty prduce made by farmers frm their wn prduct within the GB iii) value- added/specialty prduce made by farmers frm their wn prduct, and ther prduce grwn within the GB 1

2 iv) value- added/specialty prduce made within the GB frm prduct grwn within the GB v) value- added/specialty prduce made within the GB frm prduct grwn within Australia vi) value- added/specialty prduce made within the GB frm prduct grwn utside Australia where a high degree f prcessing is carried ut within the GB vii) re- packaging f prduct with minimal additinal prcessing is nt acceptable 8. Where a prduct is available that is higher up the level f hierarchy that prduct will receive pririty fr a stall at the Farmers Market befre any prduct lwer dwn the hierarchy. Stallhlder Regulatry Cmpliance 9. All stallhlders will cmply with all relevant lcal, state, natinal r market specified quality, fd safety, weights & measures, and labeling regulatins applicable t their prduct. 10. All stallhlders will be cvered by apprpriate public and prduct liability insurance fr their prduce and sales activity. 11. Organic r bidynamic status can nly be claimed by prducers with relevant certificatin, which must be displayed at their stall. Current relevant certificatin is limited t ACO, OGA, Demeter, NASAA and TOP. Definitins AFMA advcacy fr best practice farmers markets is embraced in the fllwing additinal definitins drawn frm sustainable and successful mdels perating internatinally. Farmer A persn, family member, family cmpany that grws, raises, catches r gathers fd and/r prcesses value- added/specialty fds derived frm n- farm inputs. Farm c- perative (C- p, cmmunity supprted farm r share farming) The stallhlder is a prducer representative f the cllabrative farming arrangement, and all market day prceeds are distributed back t the respective prducers. C- peratives must invlve a genuine business arrangement utside the Farmers Market and nt simply exist t create the ability t sell r re- sell multiple prducts at ne stall. These arrangements can invlve cnsiderable administratin burden n Farmers Market management and shuld be carefully cnsidered and nly allwed where there are extenuating circumstances (eg. significant travel fr prducers n the utskirts f a GB). Stalls shuld be manned by cllabrating farmers n a rtatinal basis and a maximum f three farmers shuld be allwed t participate. Permissin t perate in this way shuld nt be a right but at the sle discretin f individual market management. Farm staff Market day sellers may als be farm emplyees wh can demnstrate farm and prduct knwledge. Share Farmer Share farmers wh lease grazing r arable land fr the purpses f prducing fd, plants and ther eligible prducts by their sle endeavur are entitled t sell the prduce they have raised r cultivated at a farmers' market. Specialty maker/prducer A specialty fd prducer f value- added fd prducts that primarily cmprise lcal, seasnal and reginal ingredients, preferably surced directly frm farmers, and thse specialty fds sld by the specialty maker r business staff. Refer t the hierarchy f stall allcatin fr guidance n assessing ingredient cntent and prcessing levels. Individual markets must define these levels clearly t make decisins abut eligibility f applicants. Market manager The nminated persn respnsible fr the management f the farmers market n market day. 2

3 Market rganisatin The rganisatin respnsible fr the gvernance f the farmers market/s, t which the market manager is respnsible. In the event that the market is a cmmercial enterprise (nt an Incrprated Assciatin) these entities may be ne and the same. PRODUCTS: 1. PRODUCTS RECOMMENDED FOR SALE AT A FARMERS MARKET Primary fd prducts A primary fd prduct sld in its raw frm that has nt been prcessed r manufactured in any way, ther than packaged. Seafd, game and fraged fds Seafd (salt, freshwater, wild r farmed), game r fraged fd that has been caught, hunted r gathered. Value- Added Fds Whereby the raw / fresh fd/ ingredient is mdified by means f a cking r related prcess eg: brining, fermenting, marinating, smking, drying, that prcess undertaken whlly by the specialty prducer. Specialty fd prducts Made frm primary farm rigin prduce, which has been cked, prcessed, cmbined r substantially altered frm the raw ingredient, t which additinal fd ingredients may have been added t create a new value- added specialty fd. This categry excludes re- packaging, and lw level prcessing r re- prcessing f prduce. Garden Inputs Prducts derived frm an entire prductin life cycle that takes place n the prducer s prperty r ther prperties t which the prducer has access. ie. wrm farms and their assciated by- prducts, fertilisers such as chk manure, pea straw and lucerne. Small livestck Farm reared edible small livestck and pultry predminantly raised n the prducers farm fr live sale. eg: pultry, rabbits, sheep, piglets, kids. Other farmed prducts Flriculture and Hrticulture Prducts nt fr human cnsumptin, but grwn and prduced by Farmers, that are generally acceptable fr sale at a Farmers Market are ptted plants and herbs, cut flwers, and raw pet fd. 1. PRODUCTS NOT RECOMMENDED FOR SALE AT A FARMERS MARKET Nn- fd farm by- prducts Any nn- edible prduct derived frm fd r fibre that is grwn, reared, caught r gathered by the farmer and thrugh a manufacturing prcess has been cnverted t a nn- edible by- prduct ie. wllen fleece r wven baskets frm farmed banana plantains, leather bags. Bks Bks by the farmer r cmplementary t a sellers prduct range. Craft A hand- made r cmmercially manufactured nn- edible prduct that includes but is nt limited t textiles, ceramics, glassware, leather, jewellery, wax- ware, plymer, wden, metal, and plant rigin items. 3

SELLERS RECOMMENDED AT A FARMERS MARKET T distinguish farmers markets frm ther cmmunity markets it is imprtant that sellers be as cited abve farmers, farm family r farm staff, farm cllabrative stalls, r specialty makers. 1. SELLERS NOT RECOMMENDED AT A FARMERS MARKET Reseller Any persn wh surces and re- sells prduce frm anther party including a farmer, where mnies are exchanged with the intent t re- sell that prduce t cnsumers. This includes any primary and specialty fd prducts, and the re- packaging f any fd r beverage. Agent Any persn/s acting n behalf f any ther persn/s in any financial and cmmercial transactin, ffering fr sale primary prduce r specialty fd prducts. RECOMMENDED STALL CONFIGURATION OPTIONS Single stall A stall representing ne farmer r farming enterprise, attended by that farmer, farm family r farm staff. Shared/Cperative stall A stall representing mre than ne farmer where the attending farmer is ne f thse farmers, farm family r farm staff. The farm rigin f all prduce is clearly identified. All mnies frm the sale f that prduce are whlly remitted by the attending farmer t the riginating farmer. MARKET ESTABLISHMENT CONSIDERATIONS Farmers Markets shuld als cnsider the fllwing items specific t their wn needs and situatin, and lcal gvernment requirements, and incrprate them in their market rules and guidelines fr stallhlders.
