1 Gary McGifford is an expert forensic planner with over twenty years of experience working in consultant and client organisations. Gary has design, pre-site and site construction planning experience, primarily in the building (commercial, government and private), rail, water utility, air transport and, recently, renewable energy (wind farms onshore and offshore) sectors. Gary has specialised in forensic planning and delay analysis over the last eight years, assisting clients in the production and defence of extension of time (EOT) claims. He has also been instructed on a number of occasions in respect of formal dispute resolution proceedings. Career Synopsis Examples of the commissions that Gary has undertaken during his professional career are listed below: Expert Witness Building Projects Appointed as a delay expert adviser on a listed building project to review the EOTs granted by the contract administrator and to undertake a delay and causation analysis. The project comprised the conversion and refurbishment of two existing listed buildings together with a new three storey extension and a link building. Appointed as the delay expert on a building project which comprised the conversion, refurbishment and alterations to existing buildings creating a new private residential dwelling including a new basement and high specification fit-out including new M&E services. Appointed as delay expert to provide advice and to produce an independent expert report for the purposes of pre-action discussions for the demolition, refurbishment and new build elements of a school academy. As part of the instructions, considered the delay section and analysis included with contractor s EOT claim. Appointed as delay expert in anticipation of an adjudication on an adult college, to provide independent advice and to provide an independent report of the contractor s EOT claim. Provided planning support to the expert witness on an office development dispute in Maidenhead. Provided expert planning and programming advice and report on a listed building office development dispute in the City of London. Instructed to provide expert planning and programming advice on a multi-storey car park in Sheffield and attended mediation. Assisting the expert witness in all aspects of forensic planning in relation to a multimillion pound stadium dispute. Review of a dispute related to a warehouse redevelopment. 2 Appointed as the delay expert on a railway dispute. The project formed part of the Railway Capacity Improvement Project to increase the capacity of the London Overground. This required the construction of a new sidings and stabling facility for the stabling and inspection of new and longer trains. Appointed as the delay expert on railway adjudication. The project was the extension of the existing traction maintenance depot ( TMD ) shed, railway sidings and accommodation block, being carried out as part of the railway capacity improvement programme. Appointed as an independent expert providing independent programming assistance in a dispute between a railway engineering consultancy and a major UK civil contractor. Supported the appointed delay expert with delay analysis in a dispute between a railway engineering consultancy and train operating company. Transport Projects Assisted the expert witness in relation to a European airport. The project involved the construction of a cut and cover tunnel for a road project in Gibraltar, where the contract had been terminated. Assisted the independent planning expert to carry out a delay analysis and to investigate the causes of delay and grounds for termination. The case appeared at the Technology and Construction Court in Claims Management Buildings Projects Prepared a delay analysis for a major international contractor as part of an insurance claim, due to the insolvency of the concrete sub-contractor. The project was a mixeduse development comprising a 50 storey tower block for residential use, a six storey hotel and a four storey retail and leisure building. Provided an independent EOT assessment for a national museum. Instructed to provide an initial reaction report on a contractors EOT claim on a multistorey car park in Newport. Provided forensic review, analysis and drafting of a report on a 1.4m claim for a 33m, 27 storey residential tower block development in Manchester as part of the adjudication. Reviewed a contractor s EOT claim and prepared an independent delay analysis and causation report on a railway station refurbishment project. Prepared a delay analysis in support of an EOT claim for an international contractor for an offshore project in the Baltic Sea. Forensic analysis and production of a detailed rebuttal and positive case report in support of an adjudication response to a contractor s claim on a major rail signalling project. Provided forensic analysis on a major rail civils project EOT claim in Scotland. Claim preparation including construction of the as built programme in support of a train operating company (TOC). 3 Provided forensic planning support and prepared a report for consideration by the client for an EOT claim on Esholt Wastewater Treatment Works (Yorkshire Water). Provided forensic planning support to Southern Water on the 45m Sandown Waste Water Treatment Works and Sludge Recycling Centre. Claim value 9m. Reviewed and analysed a design consultant s claim and prepared a report for consideration by the client for a wastewater project in Lebanon. Energy Projects Prepared a number of EOT claims for an international contractor undertaking the construction of major offshore and onshore wind farms in the UK, including attending a mediation. Oil & Gas Projects Provided claims support to an Italian contractor for two onshore oil and gas plants in Algeria. Provided forensic planning support and a report on an EOT claim on Southhook LNG; 100m tanks, civils and building project; forensic analysis to demonstrate delay and disruption entitlement to substantiate a 25m claim for loss and expense. Project Controls Provided project controls support (project planning, change control, progress analysis and reporting) to ABN Amro in the role of Programme Manager for their Physical Separation programme. Developed a progress tracker to provide visibility of the project status (600+ sites) for the BT21C programme. This provided delay analysis reports for the client to resolve bottle-necks in the project delivery process. Provided project planning services on a capital works programme in excess of 30m per annum for the Parliamentary Works Services ate. Building Projects Developed high-level process guides covering programme and project planning and change control as part of a suite of project management process guides for an international developer (AFG-RE) in Dubai. The aim was to deliver a world class management approach to the planning and ongoing operation of its property portfolio and assets. Project controls support for Southern Water as part of their programme office to support the production of the business plan. This included the development and monitoring of the project programme schedule integrating different business units programmes. Developed a project controls toolkit to assist with the effective management of scheme design on T4 (Heathrow). Led a team of project control facilitators, rolling out project controls methodology across all BAA project teams and airports. Assisted BAA in their STEP Change programme (Project Delivery Cluster) to design and implement project controls processes and systems to assist deliver cost effective capital solutions. 4 roll-out training module on earned value theory and techniques to the project and commercial management community. Provided project planning support to Scott Wilson during RIBA Stages B-D on a 4m design project Victoria Station Upgrade. Capital cost estimate in excess of 200m. Energy Projects Assisting a client with the front end planning for an offshore wind farm. Programme Controls & Planning Gary has worked as a Programme Controls Manager and Planner on a number of live projects which are detailed below: Network Rail Programme Controls Manager Signalling & Telecoms Leading the programme controls function for the South East Territory (signalling and telecoms), ensuring accuracy and consistency of plans, cost and performance reporting, and the deployment of available controls team resources. Planning and Controls Manager for Railtrack (Southern Division). Responsible for the integrity of the planning process within the Regional Investment team. For all engineering disciplines, functionally responsible for adherence to the corporate planning procedures, the recruitment, training and development of planning staff (25 planners within team). Binnie Black & Veatch Chief Planner Provided project planning services to Southern Water on the 45m Sandown Waste Water Treatment Works and Sludge Recycling Centre. Provided planning advice to MBIA/AMBAC International for Seafield, Almond Valley and Esk Valley Waste Water Treatment Plants PFI. Provided planning support to the design team for the Thames Water Trident South Alliance, a five year programme with Thames Water Utilities, Costain Ltd and Binnie Black & Veatch. Established the planning, monitoring and reporting systems for the England-wide mapping access land project. Supported the preparation of national and international bid offers, preparing offer programmes. Prepared a construction programme and cash flow forecast for a client EPC bid document for an international water transfer project. Prepared client tender bidding programmes for an EPC desalination project in Saudi Arabia. Thames Water International Senior Planner For the commissioning and operational and maintenance phases of the Izmit Water Supply project in Turkey. The project was implemented on a BOT basis, with a 15 year Operating and Maintenance Agreement. The total investment was US$865m with construction costs of US$577m. The project comprised a dam, a 480,000 cubic metres per day water treatment plant, five pumping stations and approximately 146 km of pipelines. Page 4 of 5

5 Acted as Senior Planning and Scheduling Specialist for the Sector Implementation Unit (SIU1), providing technical assistance to the Lebanese Government, funded by the European Union. The objective of which was to ensure the implementation of the National Emergency Reconstruction Programme to achieve timely, effective and efficient management of the water supply, wastewater and irrigation sector investment programmes in Lebanon. The management of the sector programme involved the contract management of a five year sector investment of US$1,500m, encompassing 42 projects and over 200 contracts. Thames Water Senior Project Planner For the London Water Ring Main (LWRM), a 250m water distribution project, assigned to the Instrumentation Control and Automation (ICA) project team to provide programme and cost control information for effective project management. Responsible for the coordination of project programmes for the whole of the LWRM Programme (17 core projects). Senior Project controller for Thames Water Utilities (LWRM). Responsibilities included the planning and monitoring of milestones, project budgeting for expenditure and cash flow projections, the monitoring of monthly expenditures and payments. Project Controller for Thames Water Utilities Extended Arm Group. The project group was set up to adopt an innovative fast track approach to the design and construction of capital works. The group was responsible for the management of external contract management and design consultants implementing the design and construction of more than 90 water and wastewater projects. Planning Assistant for Thames Water Authority (Sewage and Sewerage Treatment). Work included the upgrading of several hundred wastewater treatment plants as part of a specific programme (Key Change 3) to meet to effluent standards, set by the European Commission. Page 5 of 5
