1 The ACC Guidelines were approved by the Board of Directors March 26, 2017; effective March 26, PREFACE: These Architectural Guidelines, Standards, and Criteria (hereinafter referred to as Guidelines) have been prepared by and for the Kings Ridge Community Association, and are based upon, and incorporate guidelines, standards, and criteria originally established by Kings Ridge Community Association, Inc. (The Declarant ) and dated Friday, November 22, The 1 st Revision of these Architectural Guidelines, Standards, and Criteria is dated April 2006, and approved and adopted by the Kings Ridge Board of Directors on July 26, A subsequent revision was dated December 1, 2007 and again approved by Kings Ridge Community Assoc. Board of Directors. Any major changes in or additions to the guidelines since that date have been approved by the Kings Ridge Community Assoc. Board of Directors. All guidelines have been reviewed recently and modified as needed. Subsequently, the Kings Ridge Board of Directors ratified the entirety with an effective date of August 1, Clarification of terminology and current descriptions were reviewed and modified as needed. Subsequently the Kings Ridge Board of Directors ratified the entirety on March 25, 2015 with an effective date of April 15, All guidelines were reviewed and modified as needed. Additionally, modifications were added to allow changes to the exterior of the homes. The Kings Ridge Board of Directors ratified the entirety on December 14, 2016, with an effective date of January 18, INTRODUCTION: The intent of these Guidelines, as well as the existence of the Architectural Control Committee (ACC) is to provide the guidelines required to maintain an aesthetically pleasing community. Adhering to these Guidelines is beneficial for all involved in that they are meant to protect the investment of all Homeowners, as well as to portray a quality community of well-planned homes constructed with long lasting materials maintaining high construction standards. In conjunction with the Documents for the Kings Ridge Community Association, Inc. at Clermont, the design standards are binding on all parties having interest in any portion of Kings Ridge, and each Homeowner shall comply with the requirements of the Guidelines and shall be subject to remedies provided for in the Kings Ridge Community Declaration of Restrictive Covenants and Rules and Regulations. Terms such as good taste and sound design are difficult to define and even more difficult to legislate. It is the intent of these Guidelines to encourage architectural pleasing design by providing criteria for the desired result. Elements such as deed restrictions, appropriate attention to scale, proportion to the community should be with all requests for home and site improvements. 1
2 Nothing contained in these Guidelines shall obligate any agency, government or other, to approve any request, nor shall the approval of the ACC be construed as meeting the requirements of the City and/or any governmental agency having jurisdiction. THE REVIEW PROCESS GENERAL: The architectural review process is a 4-step procedure: 1. Initial Application and Review. 2. Submission of Documents for City Approval (if required). 3. Commencement and Time of Construction. 4. Completion and Final Review of the Property. Thorough and timely submission of information together with adherence to these Guidelines as set forth herein will prevent delay and facilitate the approval process. Direct any questions concerning interpretation of any part of these Guidelines to the ACC. Initial Application and Review (This is a two-step process). It is required that a Homeowner submit to the ACC a completed Application for Approval form. This form is available from the Kings Ridge Community Management Office (CMO). Submit with and attach to the form a copy of all required documents as listed on the submittal requirements form under General Requirements, and/or on the specific Guideline. First Step: Submit the Application form with required attachments to the Kings Ridge CMO. The Staff at the CMO will date stamp and log your application into the system. Your Neighborhood Architectural Review Committee (NARC) will review and approve or disapprove your application, and will forward your application to the ACC through the CMO. Second Step: The ACC will review the approved Application together with the documents submitted and indicate approval, disapproval, or recommendations for revisions. The ACC will return the Application with any comments to the Homeowner through the CMO as soon as possible. All applications whether approved or disapproved will be forwarded to the CMO, who will in turn telephone the resident to pick up the application. If the resident cannot be reached by telephone the CMO will return the application via US mail. Note: Do not start construction of any improvement, alteration, or addition to any existing structure or make any site improvements or changes until the appropriate documents indicating the proposed design, nature kind, shape, size, color, materials, and location of same have been submitted to and approved by the NARC and the ACC. (Florida Statute provides the authority of the association Architectural Control Committee (ACC) to review and approve plans, specifications and required documentation pertaining to all the items described and listed above in this note and to enforce the standards for the external appearance of any structure or improvement located on a parcel or home site within the community. 2
3 It is the policy of the NARC and the ACC to review all applications in an expedient manner. Applications not requiring modification to existing structure may be processed in less than 60 business days provided the application is clear and complete with copies of all pertinent documentation. Do not request approval for more than one item per application form. The more documentation submitted with each application, the more expeditiously the application may be processed. Submission of Documents for City Approval if required (or by any governmental authorities having jurisdiction). After obtaining the approval of the ACC, the homeowner shall; (1) submit construction documents for approval, and; (2) obtain and pay for all approvals and permits from the City of Clermont and/or any other governmental authorities having jurisdiction for the proposed work; (3) Any changes requested or required by the City or governmental authority having jurisdiction shall be resubmitted to the NARC and ACC for review and approval; (4) After obtaining approval of governmental authorities, submit copies of all required permits to the CMO to be filed with your Architectural Application. Commencement and Time of Construction Proposed work shall start within 45 days of approval of the ACC and shall be completed within 180 days of commencement. Time extensions may be granted by the NARC upon written request. Completion and Final Review The ACC shall have the right to enter upon and inspect any property at any reasonable time before, during, or after completion of work for which approval has been granted. Upon completion of the work and if required by the Guideline, the homeowner shall give notice to the NARC. The ACC may review the completed work to ascertain that the work has been completed in accordance with the approved application and attached documents. The Homeowner shall be responsible for the repair of any and all damage to streets, curbs, drainage, structures, walks, drives, street signage, landscaping, irrigation systems and all other site improvements. Should the Homeowner fail to repair the damage within an appropriate time following completion of the work, then Kings Ridge Community Association will do the repair work and assess any and all costs to the homeowner. The homeowner shall be responsible for the acts of their employees, contractors, subcontractors, suppliers, and any other persons involved in the work at the home site. Responsibilities include but not limited to the following: Ensuring that the construction site and the community properties and roadways are kept clean and free of all debris and waste materials, and that unused materials are kept in a neat and orderly manner. Prohibiting the use and consumption of alcoholic beverages, illegal drugs, or other intoxicants on or around the construction site that could affect the safety or wellbeing of all other persons. 3
4 NOMENCLATURE and DEFINITIONS ITEM Front porch and stoop DEFINITION The concrete slab immediately in front of your front door usually under roof cover. This may be a full porch on some house models. Rear porch Footprint Screened addition Patio Walkway Driveway Covered open porch at rear of house within building footprint, screened or not screened, with or without windows. Sometimes referred to as Lanai or covered porch or alcove. The house area under original roof and/or within the perimeter walls of the home. Freestanding aluminum stick-framed enclosure with fully screened sides and roof, attached to rear of house, set on concrete foundation or pavers. Sometimes referred to as Lanai or Birdcage. Hard surfaced pavement in rear yard of house outside of building footprint. Hard surfaced pavement between driveway and front porch or stoop. Hard surfaced pavement between edge of street and garage. Neither the Kings Ridge Community Association, Inc. nor the individual neighborhood association shall have nor shall assume any responsibility for the improvements permitted within Kings Ridge Community Association, Inc. Any violation of Architectural Guidelines or failure to comply with provisions of the approved application shall be considered a violation of this document, including the Community Declaration of Restrictive Covenants and Rules and Regulations. Any legal action necessary may be taken by the Kings Ridge Community Association, Inc. to correct said violation. 4
5 SITE IMPROVEMENT STANDARDS GENERAL STANDARDS: Homeowner shall maintain all site improvements in perpetuity. Any improvement to the interior of the home does not require approval of the NARC or ACC. However, said improvement may require approval of governmental authorities having jurisdiction. Irrigation Systems: Modification not permitted without specific approval of the NARC, ACC and the Kings Ridge Irrigation Committee. Weather Protective Devices (storm shutters): May be installed in the event of a storm warning and must be removed in accordance with Guidelines Garbage and Recycling Containers: These containers are furnished by the City of Clermont and shall be kept within the garage at all times when not in use. Place at the end of driveway for the next day collection not earlier than 5:00 p.m. the day before. After collection, return containers to garage as soon as possible. Water Softeners and Refiners: Must be installed and kept within the garage. Exterior installation is not permitted. Exterior mechanical/electrical equipment is permitted as described in Guideline 4.6. Exterior lighting shall be consistent with the character established in the Kings Ridge Community, and shall be limited to the minimum necessary for safety, identification, and decoration. Flowering plants (annual or perennial) are permitted provided they are maintained. Patio and porch furniture is permitted in the patio and porch areas only. Patio furniture, cannot be left unattended outside the patio and porch areas. Temporary holiday decorations are permitted as described in Guideline 2.8. Storage and use of gas and electric powered golf carts is permitted within Kings Ridge Community. The furnishings in a screened addition, i.e., screened porch or screened lanai, are the responsibility of the homeowner and will not require approval as long as it does not infringe on the rights of the neighborhood. FLORIDA FRIENDLY LANDSCAPING STANDARDS Florida-friendly landscaping encompasses the use of drought-tolerant turf, flowers, vines, groundcovers, shrubs, and trees that might result in the reduction of irrigation. For conversion of existing landscaping, the homeowner is required to submit an application and include two copies of landscape plans. All other requirements of Article XV Architectural Control, in the Document Book for Kings Ridge Community Association, Inc., must be met. Any changes to lawn and landscaping plans must be approved by the Neighborhood Architectural Review Committee and the Kings Ridge Architectural Control Committee. Homeowners replacing existing or adding to their plant beds must select from a pallet of Floridafriendly plants listed in the Water Wise, a booklet published by the State of Florida and defined in Section of the Florida Statues; Website: Any landscaping plan must prevent encroachment of the Florida-friendly plants into abutting property. 5
6 THE FOLLOWING IMPROVEMENTS ARE NOT PERMITTED: Construction of any addition to the house outside of the original footprint, adding a second floor, changing slope or appearance of the existing roof. Fences or fencing of any type. Whitehall is the only neighborhood that allows fences. Vegetable gardens except within the fenced yards in the Whitehall Neighborhood. Artificial flowers and vegetation. Free standing out buildings of any type. Bahama shutters on the exterior of the home. Changing the use of the garage for anything other than storage. This area may not be inhabited, airconditioned or heated. Driveway; footprint additions. Planting of large leafed deciduous trees/shrub. Keeping potted plants in the lawn, planting beds, driveways, or walkways. Hanging anything from roof edge gutters except temporary holiday decorations. Addition to irrigation systems. Window or wall air conditioning units or window fans. THE FOLLOWING IS A LIST OF IMPROVEMENTS. REVIEW THE APPLICABLE GUIDELINE FOR THE PROPER PROCEDURES.
