Improvements include pavement milling and resurfacing, base repairs, excavation of adjacent slopes to provide wider shoulders with curb for traffic and pedestrians, new pavement markings, upgrade guardrail to meet National Park standards, new storm water inlets and drain replacements where necessary. Project is within the Cuyahoga Valley National Park (CVNP). All work will be performed within the existing right of way acres of the 1.65 acres of construction limits is existing paved roadway. No new right of way will be needed for the project. No homes or businesses will be removed by the project. 4 FEDERALLY LISTED SPECIES Species Name: Indiana Bat (Myotis sodalis) Total amount of impact to forested areas as a result of the project (ac): 0.1 ac Total Number of PMRTs Impacted: Listing Status: Endangered 0 Total Number of RTs Impacted: Effect Determination (Completed by ODOT OES): (Choose) 2 PC Category (Completed (Choose) by ODOT OES): Suitable Habitat: The Indiana bat life cycle requires suitable summer roosting and brood rearing habitat (which includes living or standing dead trees or snags with exfoliating, peeling or loose bark, split trunks and/or branches, or cavities) and suitable hibernacula during the winter months (typically caves, or abandoned mines that provide cool, humid, stable conditions for hibernation). The Project Area is located within the northeastern management unit as defined in by the Programmatic Biological Opinion (PBO) on the Ohio Department of Transportation s Statewide Transportation Program for the Federally listed endangered Indiana bat (Myotis sodalis), dated January 26, Discussion Including Impacts to Suitable Habitat: A survey of the Project Area did not identify any portals, openings, cracks, or crevices in rock outcrops that may be an entrance to a cave or mine that would be considered suitable winter hibernacula habitat for the bat. Some marginal suitable habitat (6 potential roost trees) was observed within the Project Area. The potential suitable habitat trees were all observed south of Boston Mills Road (No potential roost trees observed north of Boston Mills Road). Two of the potential roost trees (B2 and B4 on Figure 7) are located within the construction limits. In addition, all of the potential habitat trees are located in close proximity to Boston Mills Road which makes them less desirable for roosting. Species Name: Northern Long eared Bat (Myotis septentrionalis) Listing Status: Endangered Effect Determination (Completed by ODOT OES): (Choose) Suitable Habitat: During winter, northern long eared bats hibernate in caves and abandoned mines. Summer habitat requirements for the species are not well defined but include roosting habitat in dead or live trees and snags 3 inches in diameter at breast height with cavities, peeling or exfoliating bark, split tree trunk and/or branches, which may be used as roost or maternity roost areas. Occasionally the species may roost in structures like barns and sheds. Foraging habitat for the species includes upland and lowland woodlots and tree lined corridors. Discussion Including Impacts to Suitable Habitat: A survey of the project study area did not identify any portals, openings, cracks, or crevices in rock outcrops that may be an entrance to a cave or mine that would be considered suitable winter hibernacula habitat for the bat. Some marginal suitable habitat (6 potential roost trees) was observed within the Project Area. The potential suitable habitat trees were all observed south of Boston Mills Road (No potential roost trees observed north of Boston Mills Road). Two of the potential roost trees (B2 and B4 on Figure 7) are located within the construction limits. In addition, all of the potential habitat trees are located in close proximity to Boston Mills Road which makes them less desirable for bat roosting. Species Name: Bald Eagle (Haliaeetus leucocephalus) Listing Status: Species of Concern Effect Determination (Completed by ODOT OES): (Choose) Is a known nest (based on NHDB or other source) located within 0.5 Will the project require No mile of the project?: No blasting?: Based on field surveys and/or a NHDB record search, is a nest within 660 ft. and/or visible from the project or activity area? If yes, indicate proximity to construction limits: No Suitable Habitat: The bald eagle is protected under the Bald and Golden Eagle Protection Act which prohibits taking bald eagles, including disturbance. The preferred habitat includes mature forests adjacent to open water for nesting and foraging. Discussion Including Impacts to Suitable Habitat: No bald eagle nests were observed during the site visit on March 15, 2016 and no suitable habitat was observed within the Project Area. The Project Area is located north and south of Boston Mills Road and within existing ROW. Species Name: Monkshood (Aconitum noveboracense) Listing Status: Threatened Effect Determination (Completed by ODOT OES): (Choose) Suitable Habitat Description: On sandstone in cool, shaded ravines in close proximity to running water; Also found near seeps and on algific talus slopes, rock shelters and vertical cliffs. Discussion Including Impacts to Suitable Habitat: Arcadis biologists visited the Gorge Metro Park to observe favorable habitat for this species. The only known location of this species is in an area of low ecological disturbance which is inaccessible to the public. Habitat consisted of a forested sloped terrace with a northwest aspect at the base of a sandstone bluff. During the 3/15/2016 site evaluation, the species was not observed; however emergence of the species is typically in April or May. Two areas were observed that contain marginal habitat for this species which include sandstone outcropping and running water. Both of these areas were abutting Boston Mills Road and are exposed to moderate seasonal levels of disturbance. During the winter, salt spray from the roadway would cover these areas. In addition, an active ODOT facility is located just west of the Project Area along Boston Mills Road. The added heavy truck traffic from this facility would increase the amount of salt spray and exhaust fumes during the winter. Both of these factors would decrease the favorability of this potential habitat in comparison to the Gorge Metro Park site. Minimal impacts are anticipated to these two areas (~0.04 acres) (Figure 7).

5 Additional Information: Mike Johnson, Chief of Resource Management for Gorge Metro Park, was contacted on February 2, Mr. Johnson indicated metro parks has attempted to propagate this species in its favorable habitat for many years unsuccessfully. He indicated that even if favorable habitat was present, the potential of the species being present given the site conditions would be highly unlikely. YES Date of NHDB Check: 3/14/16 Species Name: Crinkled hair grass (Deschampsia flexuosa) Listing Status: Potentially threatened Effect Determination: Not Likely To Impact Suitable Habitat Description: Occurs on sandy soils of mountains, woodlands and sand plains and sometimes forms large stands on midelevation, forested peaks. Also occurs in dry, open woods; fields, roadsides, and hillsides; often on sandy soils. Discussion Including Impacts to Suitable Habitat: Soils observed at the site were not sandy and most slopes appeared to have moderate to high levels of moisture and some seeps. No suitable habitat observed within the construction limits. Species Name: Dark eyed junco (Junco hyemalis) Listing Status: Special interest Effect Determination: Not Likely To Impact Suitable Habitat Description: Breeding habitat largely confined to hemlock gorges in the extreme northeastern corner of the state Discussion Including Impacts to Suitable Habitat: No suitable habitat observed within the construction limits. Proximity to Boston Mills Road would also negatively affect nesting of this species. Species Name: Golden fruited sedge (Carex aurea) Listing Status: Potentially threatened Effect Determination: Not Likely To Impact Suitable Habitat Description: A variety of wet, open situations on calcareous or sandy substrates; wet prairies, fens, meadows, beach pools, interdunal swales Discussion Including Impacts to Suitable Habitat: No suitable habitat observed within the construction limits. Species Name: Leafy goldenrod (Solidago squarrosa) Listing Status: Threatened Effect Determination: Not Likely To Impact Suitable Habitat Description: Rocky upland woods, thickets, and clearings Discussion Including Impacts to Suitable Habitat: No suitable habitat observed within the construction limits. Species Name: Seaside arrow grass (Triglochin maritimum) Listing Status: Threatened Effect Determination: Not Likely To Impact Suitable Habitat Description: In full sun in calcareous substrates: marshes, fens, wet sandy beaches, interdunal swales, and springheads Discussion Including Impacts to Suitable Habitat: No suitable habitat observed within the construction limits. Species Name: Spotted coral root (Corallorhiza maculate) Listing Status: Potentially threatened Effect Determination: Not Likely To Impact Suitable Habitat Description: Various types of mature deciduous forest; most Ohio records are from mixed mesophytic or beech sugar maple communities; the species is tolerant of deep shade Discussion Including Impacts to Suitable Habitat: No suitable habitat observed within the construction limits. Mature forest is surrounding the construction limits however within the construction limits, disturbance from previous construction activities has limited the succession. Species Name: Weak spear grass (Poa saltuensis ssp. Phase 1 project, including a one mile radius, in Boston Township, Summit County, Ohio. This data will not be published or distributed beyond the scope of the project description on the data request form. Records included in the data layer may be for rare and endangered plants and animals, geologic features, high quality plant communities and animal assemblages. Fields included are scientific and common names, state and federal statuses, as well as managed area and date of the most recent observation. State and federal statuses are defined as: E = endangered, T = threatened, P = potentially threatened, SC = species of concern, SI = special interest, FE = federal endangered, FT = federal threatened and A = recently added to inventory, status not yet determined. We have a record for an Indiana Bat (Myotis sodalis) capture location within a five mile radius of the project site. Due to the sensitivity of this species, we do not provide the precise location of the observation. We have a record for an Indiana Bat hibernaculum within a ten mile radius of the project site. Due to the sensitivity of this species, we do not provide the precise location of this feature. The managed areas layer includes state, federal and county lands, as well as areas owned by non-profits, museums and other entities. Managed areas are sites under formal protection for their natural resources. Please be aware that this layer may not be complete and we are continually updating it as new information becomes available to us. Our inventory program has not completely surveyed Ohio and relies on information supplied by many individuals and organizations. Therefore, a lack of records for any particular area is not a statement that rare species or unique features are absent from that area. This letter only represents a review of rare species and natural features data within the Ohio Natural Heritage Database.
