3 Twn f Malta Adptin f Dwntwn Frm-Based Cde Full Envirnmental Assessment Frm INTRODUCTION This Envirnmental Assessment Frm has been prepared fr the planned adptin f Dwntwn Malta Frm- Based Cde ( FBC r Cde ). The FBC will replace the Dwntwn Overlay Zne and Cmmercial Dwntwn 1 (C 1) zning district as well as the Dwntwn Design Standards. The FBC prvides illustrative and descriptive prvisins regarding building type, frm, placement, design as well as cnventinal zning elements regarding height, setback, site use, etc. The stated purpse f the cde is t implement the adpted Malta Dwntwn Plan, guide implementatin f this plan and t fster predictable results and a high quality public realm by prescribing the physical frm f buildings and ther elements and addressing the relatinship between building facades and the public realm, the frm and mass f buildings in relatin t ne anther, and the scale and types f streets and blcks. The Twn f Malta Adpted the Malta Dwntwn Plan n March 7, 2011 and the FBC implements the visin f the Malta Dwntwn Plan. The FBC establishes ten (10) distinct districts that allw fr a mixing f land use and building types t achieve a cmpact frm f develpment. Each district utlines a purpse (r intent), allwed building types, as well as site placement and building frm prvisins. Building types are established with a gal f ensuring the building frm, physical character and quality is cnsistent with the district bjectives. Permissible building types are assigned by district. Fcusing n frm rather than use, the FBC allws use flexibility while establishing a predictable physical utcme. The Illustrative Plan which accmpanies the cde depicts ne scenari fr the develpment f dwntwn when the FBC is applied. The Illustrative Plan als incrprates a Cmplete Streets plan identifying additinal street cnnectins, intercnnectivity f prperties, access management measures, enhanced bicycle and pedestrian facilities, and ther measures designed t accmmdate ther mdes f travel. These measures when implemented are intended t imprve cnnectivity, reduce traffic n Rute 9, and imprve the walkability f the dwntwn. The Frm Based Cde wuld allw apprximately 30 percent less develpment. When all elements f the plan are cnsidered a psitive impact n traffic is anticipated. The FBC has been develped with significant public input. 4 Twn f Malta Adptin f Dwntwn Frm-Based Cde Full Envirnmental Assessment Frm The FBC addresses many f the less desirable aspects f the Twn s current zning cde as expressed by the public during the develpment f the Dwntwn Plan. The FBC addresses building height; allwing buildings frm 2 t 4 stries depending n the district lcatin. (The Twn s current zning allws fr building heights f 54 ft. and 80 percent lt cverage.) The FBC establishes a mix f building types with a variety f building mass requirements. A maximum building length f the street-facing façade is limited t 175 feet as an example. Building materials are specified, buffers between land uses are established, and building transparency and pedestrian access are addressed. In this fashin, the FBC represents a significant imprvement ver the current zning requirements, reducing the scale and density f the dwntwn mre clsely reflecting the cmmunity s visin fr the Twn center. As nted abve, the FBC includes measures that will further reduce building heights, lt cverage, and verall develpment densities. It is anticipated the buildut f the dwntwn will ccur ver a 20 t 50 year timeframe and that the rate at which this grwth will ccur is influenced by many factrs which are difficult t frecast. Overall, the FBC reduces the amunt f develpment that will ccur in the dwntwn when cntrasted with the current zning plan.

The questin f whether an actin may be significant is nt always easy t answer. Frequently, there are aspects f a prject that are subjective r unmeasureable. It is als understd that thse wh determine significance may have little r n frmal knwledge f the envirnment r may nt be technically expert in envirnmental analysis. In additin, many wh have knwledge in ne particular area may nt be aware f the brader cncerns affecting the questin f significance. The full EAF is intended t prvide a methd whereby applicants and agencies can be assured that the determinatin prcess has been rderly, cmprehensive in nature, yet flexible enugh t allw intrductin f infrmatin t fit a prject r actin. Full EAF Cmpnents: The full EAF is cmprised f three parts: Part 1: Prvides bjective data and infrmatin abut a given prject and its site. By identifying basic prject data, it assists a reviewer in the analysis that takes place in Parts 2 and 3. Part 2: Part 3: Fcuses n identifying the range f pssible impacts that may ccur frm a prject r actin. It prvides guidance as t whether an impact is likely t be cnsidered small t mderate r whether it is a ptentially large impact. The frm als identifies whether an impact can be mitigated r reduced. If any impact in Part 2 is identified as ptentially large, then Part 3 is used t evaluate whether r nt the impact is actually imprtant. The bald eagle was delisted n August 8, While there are n ESA requirements fr bald eagles after this date, the eagles cntinue t receive prtectin under the Bald and Glden Eagle Prtectin Act (BGEPA) Accrding t the Envirnmental Resurce Mapper n the NYSDEC website and NYCRR Title 6 Chapter X Subchapter B Sectin Items 70.1 and 122, the suthwestern prtin f the prject area may cntain a prtin f a NYSDEC classified stream identified as a tributary f Ballstn Creek, which is identified as H-260-P , and the nrtheastern prtin f the prject area may be lcated in the vicinity f a NYSDEC classified stream identified as H-299- P , a tributary f Brwn Brk. Bth f these streams are classified as Class C streams. The reviewer is nt expected t be an expert envirnmental analyst. The Examples prvided are t assist the reviewer by shwing types f impacts and wherever pssible the threshld f magnitude that wuld trigger a respnse in clumn 2. The examples are generally applicable thrughut the State and fr mst situatins. But, fr any specific prject r site, ther examples and/r lwer threshlds may be apprpriate fr a Ptential Large respnse, thus requiring evaluatin in Part 3. The impacts f each prject, n each site, in each lcality, will vary. Therefre, the examples are illustrative and have been ffered as guidance. All land develpment activities have sme impact n surface drainage/flw. There are a cmprehensive set f rules and regulatins in place t ensure strmwater drainage frm land develpment is prperly managed. adverse impact f large and/r imprtant magnitude t drainage flw r patterns, r surface water runff is anticipated as a result f the prpsed actin. Currently, drainage n Rute 9 is handled via an pen drainage system (i.e., radside ditch). Individual site develpment prjects are required t manage strmwater in cnfrmance with NYSDEC GP requirements. This generally cnsists f a series f site specific strmwater treatment practices designed t infiltrate strmwater such that the vlume and rate f strmwater flw ff-site mirrrs pre-develpment cnditins. Lng term transfrmatin f the study area (including NYS Rute 9) t a new urbanist pedestrian riented envirnment will invlve many elements, including the installatin f sidewalks. Article 6 f the FBC identifies street typlgy; street width and assciated elements vary by functin and crrelate t adjacent land use. The FBC requires the installatin f sidewalks, bike facilities and verge n new streets as well as existing streets (Article 6.2A). This requirement exists under the current zning scheme as well. The practical implicatin is that individual develpments are required t install sidewalks alng existing streets/rads including Rute 9. The installatin f sidewalks, as well as any new curb cuts, n Rute 9 has the ptential t impact the existing pen drainage system.. The cnventinal apprach is t have the applicant (i.e., individual develper) size the radside culvert size apprpriately t cnvey existing strmwater flws. This apprach, in cncert with cmpliance with the NSYDEC General Permit is adequate t address any negative impacts t the lcal strmwater cnveyance system. Lng term this apprach may nt be the mst effective means t realize the Twn s visin f cmplete streets and a pedestrian riented dwntwn. The Twn may cnsider ther practive means t address this gal. The Malta Dwntwn Plan recmmended the Twn cnsider establishing a special district r imprvement district t address the capital prject needs f Dwntwn such as sidewalks, lighting, and parking. A special district culd be established t address drainage needs as well. The need fr a cmprehensive apprach t address the bjectives cited in the FBC may be met by the develpment f a detailed dwntwn drainage plan. Funding requirements t implement such a culd include, but are nt limited t, establishment f a special district, establishment f develpment impact fees, use f already established transprtatin mitigatin fees (where applicable and apprpriate), establishment f a drainage escrw fund budget funded as private develpment ccurss, use f Twn general revenue, funding cntributins frm NYS DOT fr imprvements alng state wned rads r cntributins frm Saratga Cunty DPW fr imprvements alng cunty wned rads r funding cntributins frm private prperty wners fr where future develpment will require cnstructin f streets, and/r future grant r ther financial incentives. 11. Lt cverage includes all hard surfacing (i.e., pavement) and building cverage. Building setbacks in the C-1 district vary but generally are defined as fllws: Frnt Setback 15-25ft., Side Setback 0-10 ft., and Rear Setback 20 feet. The C-1 District des nt have a greenspace r pen space requirement per se. The FBC des nt define/regulate lt cverage as the C-1 District des. The FBC has minimum and maximum setbacks and they vary by building type, they are generally designated as fllws: Frnt Setback 5 ft. min/20 ft. max, Side 5ft./20ft., Rear. The FBC des require a 20% Outdr Amenity Area fr mst building types. An utdr amenity area can be cnsidered pen space and may be fund at the building frnt r elsewhere n the lt. Additinally, the FBC designates frmal pen space areas at the Dunning Street Cemetery, the Parade Grund, and at the Twn Center. The develpment ptential f the Malta Dwntwn study area was examined, cmparing the current zning scheme t the planned zning. A buildut analysis is an estimate f the verall develpment ptential f a land area given a set f assumptins and cnstraints. It is an estimate f the ttal ptential fr develpment; it des nt predict the amunt r rate f develpment that culd ccur. Land within the study area is either zned C-1 cmmercial r is designated as a prject specific Planned Develpment District (PDD). Figure 1 depicts the study area examined and identified the current zning. Develpment ptential within the C-1 district was estimated utilizing the fllwing assumptins: 30% green space, 20% parking, 20% strmwater, utilities, and site access, and 30% building area lt cverage. These assumptins were derived frm the zning cde, as well as the prir buildut analyses cnducted by the Twn. A building height f 5 stries is allwed per the C-1 District and was utilized t estimate the ttal building square ftage.

Existing PDD s include Blacksmith Square, Crystal Springs, Ellswrth Cmmns, rthway Mbile Estates, Parade Grund Village, Saratga Village, and Shps f Malta. Where a PDD has been prpsed r prpsed and apprved but nt yet built, the develpment ptential per the plan was utilized. These PDDs include Kelch Drive, Malta Gardens, and Park Place. Fr the purpse f the analysis, the Dunning Street Cemetery was excluded frm the analysis. Fr the prpsed cnditin, the Dwntwn Malta FBC Illustrative Plan prepared by Cde Studi was utilized fr the analysis. The building layer frm the plan was digitized and a building ftprint was calculated using GIS. Building heights frm each f the FBC districts was utilized t calculate a ttal building square ftage. Based n the analysis, the prpsed FBC/Illustrative Plan reduced the develpment permitted in the study area. Ttal SF Current Zning 15,520,528 FBC (Illustrative Plan) 10,592,503 As a result f the reductin in develpment ptential it is anticipated there will be a crrespnding reductin in traffic attributable t new develpment. The FBC includes further measures t reduce traffic related impacts as nted. The Twn als has measures in place t address traffic related impacts Twnwide. Therefre n adverse traffic related impacts f large magnitude r imprtance are anticipated t ccur as a result f the adptin f the FBC.
