2 Implementation Status Overview The Project was declared effective in October 2010 (more than a year after board approval) and the loan resources were included in the Project budget in January The Project is closing on June 30, All project activities are underway, some of them completed. Disbursements total US$ 5.87 million (about 59% of the loan amount). If implementation pace continues, there will be no need to extend the closing date, despite the delays that occurred in declaring the loan effective. One of the main outcomes of the project is the creation of a River Basin Council (RBC) in each of the three pilot river basins whose main responsibility is the formulation of the river basin plans and the coordination of their implementation. The three RBCs were created and the river basin planning process was completed in the three basins in November The technical secretaries that will support the RBCs once the Project closes were also established. Another significant Project achievement to date is the definition of the Methodology for water use and pollution charges. Those charged are supposed to finance the newly created River Basin Organizations as well as part of the administrative costs of the National Water Authority in Lima. It is also supposed to provide some funds to co-finance the implementation of the River Basin Plans. This new methodology is being applied nationwide since January It is now important to carry out the second phase of the study that will determine the distribution of the collected funds; in particular how much will be allocated to the RBCs (the technical secretariats) and the plans. This study is programmed for Its results will be critical to insure the sustainability of the RBCs and the implementation of the plans. In the meantime, a pilot project is being implemented with the support of WSP to establish a water fund in the river basin of Piura (and possibly Chili) that would be financed by the water use and pollution charges; a fee on potable water supply for the payment for environmental services as well as direct contribution from private sponsors. This pilot is expected to provide interesting insights for the upcoming study and, if successful, will be expanded to the other pilot basins and considered in the design of the new Project currently under preparation. Since last mission, the issue related to the formalization of water rights for irrigation was resolved. Water users organizations recognized by ANA, but not necessarily legally established as civil society (very few of them are), will be able to have their water use formalized (Decreto Supremo No MINAGRI). A pending issue is the formalization of water rights for potable water supply. The interpretation of the legal framework by controloria is that a water right cannot be issued if water quality "after treatment" does not meet potable water standards. However, ANA is responsible for assigning water rights at the "source"; before treatment. Compliance with water quality standards after treatment is the responsibility of another institution. In most cases, water supplied in small villages does not meet those standards, and they cannot get a water license, putting at risk their water security. ANA, along with the environmental unit of the Ministry of Agriculture, will contact "Controloria" to clarify that, in accordance with ANA mandate, the formalization of existing water uses, should involve analysis at the withdrawal point, in the water source, before treatment is being made. Finally, the activities related to the promotion of a new water culture are now progressing well. One of those activities is related to the introduction in the curriculum of the primary schools of the water conservation theme. While an inter-institutional agreement was signed with the Ministry of Education; due to a change of Minister, it was not possible so far to introduce "water" in the "Directiva Nacional de Educacion Basica Regular". The Project has therefore worked directly with the Education Directorate of the Regional Governments of the six pilot basins. Already "water" was included in the Regional Directive for basic education in Chancay- Lambayeque and are about to be included in those of Piura; Chancay- Huaral and Arequipa. In February 2014; training of teachers will take place. In the meatime, the Project was encouraged to pursue its efforts with the Ministry of Education so that "water" is included in the curriculum at national level.
