Cork Company Background: The Old Midleton Distillery was founded in It operated as a private Company until 1966 when it merged with the Powers and Jameson companies in Ireland to form Irish Distillers Ltd. The present Distillery at Midleton was built in Since 1988 Irish Distillers has formed part of Group Pernod Ricard the French multinational drinks company Brief Description of Activities at the Site: The Midleton Distilleries complex occupies a 45-hectare site and comprises a number of modern industrial buildings with associated large - scale warehousing. The distillery is involved in the following production activities: Pot Whiskey Distilling Grain Whiskey Distilling Feeds Recovery Spirit Store / Maturation The main buildings located on-site consist of the brew house, still house, feeds recovery house, vat house, bonded spirit store, offices, canteen and 34 warehouses. The main utilities on-site are the process water treatment, cooling tower, ESB substations, gas supply station and there is also a waste water treatment plant (WWTP). The plant operates seven days per week. The annual production capacity, based on a 7-day operation, is as follows: Pot Whiskey Line Grain Whiskey / Grain Neutral Spirit (GNS) Feeds Recovery / Distillers Dark Grain / Syrup 11,000,000 litres of alcohol 22,000,000 litres of alcohol 29,500 t DDG equivalent The site lies outside the Midleton Urban fringe to the east of the town mainly in a semi-rural area. To the east and south of the site the landscape is dominated by extensive farmlands. To the west of the site are primary and secondary schools and their playing fields. Beyond these is Midleton town. The Old Midleton Distillery, now a Heritage Centre, is located immediately to the southwest. The nearest houses to the site are located on the northwestern boundary behind the weighbridge control room.

4 MIDLETON DISTILLERIES QSE POLICY The Board of Directors of Irish Distillers Limited regards the promotion of health and safety, food safety, quality and the environment (QSE) as a priority at all levels within the organisation, and undertakes to produce distilled spirits and associated by-products of the highest quality in a safe manner which protects the environment. Midleton Distilleries is therefore committed to: - complying with all applicable regulatory, legislative and corporate requirements and relevant standards (ISO9001, ISO14001, OHSAS18001, ISO22000 and FEMAS); - identifying hazards and evaluating risks associated with the distilleries activities on a regular basis, and documenting a programme to reduce or eliminate, as far as reasonably practicable, any risks identified; - continually monitoring and improving site management and developing best practices to provide a safe and healthy work environment, to prevent pollution and to minimise the use of natural resources in line with the principles of sustainable development; - controlling all food safety related process hazards using the Hazard Analysis and Critical Control Point (HACCP) principles; - providing products which, according to their intended use, are safe for customers and meet agreed specifications; - continual improvement and performance measurement by setting and reviewing, on a regular basis, QSE objectives, targets and management programmes at all levels within the organisation; - ensuring, through appropriate training, planning, resource availability and communication, that all personnel on-site at Midleton are aware of their QSE responsibilities; - consulting with, and encouraging employees to participate in, the QSE management system; - maintaining the QSE management system through regular auditing, reviewing and updating; - continually improving emergency preparedness and response procedures. The success of this policy requires commitment from all employees, visitors, suppliers and contractors. It is the responsibility of each employee to observe all rules and procedures and co-operate with the company in complying with its statutory obligations. Employees must be aware at all times of the responsibility that they have for both their own safety and the safety of others. Responsibility for implementation of this policy lies with the Group Production Director, who ensures through the Head of Distilling Operations and line management that the objectives of the policy are achieved. This policy is communicated, implemented and maintained at all levels throughout Midleton Distilleries. It is available to external interested parties upon request.

No. SE Final No. of exceedences vs. No. 1 vs 13 of samples Maximum Exceedence vs vs 1000 Emission Limit Value Cause The sample for micro analysis was taken at approximately 09h10. The UV system was operating normally and the records show that, at the time the sample was taken, the dose rate was in excess of 5000 J/m 2. The minimum dose rate between 09h00 and 10h00 was 637 J/m 2 and the average was 2615 J/m 2. The recommended dose rate for disinfection is 400 J/m 2. During the period 09h00 to 10h00 the total volume discharged was 27 m 3 of which 25 m 3 was treated effluent which is sterile. Microchem have reviewed the results and are satisfied that there were no errors on their part. The only possible explanation is that the sample was somehow contaminated. Corrective Action We have reviewed the methods used for taking samples for micro analysis as part of the exercise and have modified the sampling methodology to comply with the guidelines issued by the Environment Agency. As part of the whiskey maturation process ethanol evaporates from the casks and escapes to atmosphere. The rate of evaporation is temperature dependent with the losses being higher in the summer than in the winter. When it rains this ethanol is washed out of the atmosphere and results in the COD levels reported above. These emission points serve 30 maturation warehouses with approximately 200,000 m 2 of impermeable surface area. Ethanol is highly biodegradable and is not persistent. Until March 2000 the millstream was in use and had a thriving fish population, which was not affected by the surface water discharges. The occasional turbidity is caused by the construction activities in the area.

Complaints There was one noise complaint during the course of the year. On 21 st June 2010 a demolition contractor was using hydraulic shears to cut up steel sections of the old fermenter vessels adjacent the northern site boundary. The complainant was having a family gathering in her back garden at the time. Once the complaint was received the activity was halted and relocated to a more remote part of the site. No further action was required.

32 Tank and pipeline testing and inspection report A weekly inspection of valves and flanges in sensitive areas is carried and a record of the inspection is maintained. There were no issues to report. A list of critical vessels is maintained and these are subjected to an inspection every two years by an independent agency. The inspection was last conducted in July 2009 and is next due in The foul and organic drains were subjected to inspection/ testing programme in Q3 of A programme to address the remedial action was completed.in A summary of the repairs is contained in Appendix I: Repairs to Foul & Organic Drain Report. Noise Monitoring A daytime boundary noise survey was conducted on 21 st May 2009 and, due to weather conditions, a nighttime survey on the 25 th /26 th May 2009 by AWN Consulting. The results show that the noise levels are in compliance with the License conditions with the exception of the nighttime levels at Noise Sensitive Location 1 (NSL1). The next survey will be conducted in 2012 Atmospheric Monitoring The annual atmospheric emissions monitoring was conducted in November 2010 by Odour Ireland. The results indicate that all emissions were within the license limits. A copy of the report is contained in Appendix II: Atmospheric Monitoring Report. Groundwater Monitoring (GW1 to GW5) Four boreholes, GW1 to GW4, are monitored annually for groundwater and the fifth, GW5, is monitored biannually for groundwater and landfill gas. The analytical results for GW1 to GW4 show predominantly normal groundwater values. GW5 is located in the disused landfill and was sunk to bedrock level and for the past number of years the borehole has been dry indicating little or no infiltration. The landfill gas analysis occasionally shows trace levels of methane and carbon dioxide. A copy of the report is contained in Appendix III: Ground Water Monitoring Report List I & II substance reductions There are no List I or List II substances on site. Bund Inspection Report All bunds were inspected by an independent third party in 2009 as required by the Licence. The next integrity test is due in 2012.

33 Review of Environmental Liabilities Insurance Cover Irish Distillers Ltd. and its parent company Irish Distillers Group Ltd are subsidiaries of the French multinational drinks company Group Pernod Ricard. Irish Distillers Group and Subsidiary Companies carry a Public Liability Policy which is placed with a panel of insurers, AXA Insurance Company being the leading office. The following cover is provided: Public/Products Liability Limit of Indemnity Accidental Pollution Greater than 13,000,000 any one event 50,000,000 per year Pollution cover applies if it is caused by a sudden, identifiable, unattended and unexpected incident which takes place in its entirety at a specific time and place during the period of insurance. Pollution or contamination is defined in the policy to mean: 1. All pollution or contamination of buildings or other structures or of water or land or the atmosphere and; 2. All loss or damage or injury directly or indirectly caused by such pollution or contamination. This level of cover is in excess of the potential liabilities outlined in the Environmental Liabilities Risk Assessment report submitted to and approved by the Environmental Protection Agency.

37 Allen Barber 1.0 BACKGROUND Under the terms of its IPPC Licence, Irish Distillers Limited (IDL) undertakes an assessment of the condition of its site foul sewer and organic drainage systems. This includes hydrostatic and/or air testing, and general assessment of the drains conditions, with CCTV surveys being carried out where required. The assessment is done on a three-year cycle, with the latest survey carried out by Project Management and Dyno-Rod in July This detected a number of defects, and a report was issued listing these and recommending that remedial action be undertaken on a prioritised basis. CCTV reports were also issued to aid in location of defects. These reports were submitted to the EPA and should be read in conjunction with this report. Following receipt of the reports, IDL engaged Allen Barber Limited to implement a programme of repair and/or replacement of defective drains and manholes. 2.0 SCOPE OF WORK & SPECIFICATION A scope of work and specification document was drawn up for each of the two systems. This detailed the repair work to be undertaken based on the assessment reports, the materials to be used, etc. It was recognised that these scopes could change significantly as the work progressed and pipelines were excavated and exposed for external inspection. 3.0 SCHEDULE Schedules were drawn up which indicated that work on the repairs would commence in October 2009 and be complete by the end of April In the event the work was substantially complete by the end of May 2010 and a programme of re-testing of the repaired pipelines was undertaken in the July 2010 plant shutdown. This identified minor defects in a limited number of areas; repair of these and final re-testing was complete in October The main reason for the delay in completing the works was the substantial increase in the scope undertaken, including the full replacement of lines which had been assumed to be reparable. IDL Drain Repair 3 Repair Report

38 Allen Barber 4.0 ACTUAL SCOPE OF WORK The actual scope of work completed is set out in the following schedule: ORGANIC DRAIN MH 22 MH 4 MH 22 has been eliminated, the existing Polypropylene line from MH 21 has been extended to connect directly to MH 4. Manhole connections were made good with vibrated concrete coated internally with a chemical-resistant material. MH 22 MH 21 Defective connections in the existing Polypropylene line were exposed and repaired. MH 21 MH 21.1 Defective connections in the existing Polypropylene line were exposed and repaired. MH 24 MH 23 The cracks in the existing Polypropylene pipeline were exposed and repaired with Polypropylene sections extrusion welded. The initial test failed, apparently due to 2no. poorly-made lateral connections, which service the redundant fermenter base. These connections were exposed and blanked off and a subsequent test was successful. Work in this area was delayed due to demolition of the redundant fermenter vessels. MH 4 MH 24 A new Polypropylene line was laid from MH 4 to MH 1. MHs 2 and 3 were eliminated as part of this work (these drained the redundant fermenters). Manhole connections were made good with vibrated concrete coated internally with a chemical-resistant material. MH 27 MHs 7 & 8 This system was demolished and replaced in Polypropylene, with stainless steel connections to the underfloor drainage system in the Still House. The system was connected on the downstream side to an existing Polypropylene line discharging to the High Wines Tank bund sump. MH 5 MH5.1 IDL Drain Repair 4 Repair Report

39 Allen Barber A new shallow Polypropylene line was laid to reverse flow from MH 5.1 to MH 5. The submersible pump set was relocated to MH 5 and connected to the High Wines Tank bund sump via a stainless steel rising main. The existing defective line from MH 5 to MH 5.1 was sealed off with vibrated concrete coated internally with a chemical-resistant material. MH 26 MH 15 The existing lined vitreous clay lines from MH 15 to 14 and from MH 14 to 26 have been replaced in Polypropylene. MH 14 remains in place with new connections. Manhole connections were made good with vibrated concrete coated internally with a chemical-resistant material. MH 19 MH 20 On exposing this pipeline (lined vitreous clay) at the identified defective area, it was discovered that This line was replaced in its entirety with Polypropylene, from the Mill Race to the Reception Pit, including removal of MH 19. A new intermediate manhole was constructed at WH 2. Manhole connections were made good with vibrated concrete coated internally with a chemical-resistant material. This work included a crossing of the Mill Race, which was restored and the affected area sealed with a bentonite-based GCL. MH 17 MH 18 This line was replaced in Polypropylene. Manhole connections were made good with vibrated concrete coated internally with a chemical-resistant material. FOUL SEWER MH 1 MH 2 The damaged area of pipe was exposed and repaired a new with PVC section. The initial test failed, and an in-situ sleeve repair also was unsuccessful, so the entire line has now been replaced in new PVC. Repairs to manhole benching were also carried out. MH 26 Central Lab A new 150mm PVC line was laid from the Central Laboratory system directly to MH 26 to correct the backfall which had existed in the system. MH 12 MH 34 This line was excavated and replaced in new PVC. IDL Drain Repair 5 Repair Report

40 Allen Barber MH 33 MH 6 The damaged area of pipe identified on the CCTV survey was exposed and repaired in PVC. MH 37 MH 36 The faulty joint identified on the CCTV survey was exposed close to MH 36. This was then repaired using a GRP wrapping bonded to the liner inside the vitreous clay pipe and surrounded in vibrated concrete. MH 11 MH 4 This serves a single upper floor toilet in the Still House. A new PVC line was installed from the SVP to MH 11, with MH 4 replaced by a Wavin AJ. MH 24 MH 23 The defects identified appear to be lateral gully connections, but do not leak in normal service. This line in fact takes drainage from the laboratory sinks rather than any sanitary appliances. It passes under a landscaped areaso that replacing the line would cause unnecessary disruption. MH 44 MH 43 This line was re-tested and passed, so no repair work proved to be necessary. 5.0 TESTING The completed repair works were tested by Dyno-Rod in accordance with the provisions of the EPA IPC Guidance Note on Storage and Transfer of Materials for Scheduled Activities.
