4 Dear Mr Tran Van Vinh, have checked the electrocnic versions of the draft EMP prepared for Binh Duong, Vinh Long and Ba Ria Vung Tau, Dong Thap and Ben Tre sub-projects. For Binh Duong, find that the English versions of the main text, the attached map are technically acceptable. Meeting minutes and the photos shown that Community consultation has been carried out very well. The environmental certificate attached to the EMP should cover all sub-project communes. However, article 1 of the certificate only addressed the sub-project communes belonging to Di An district only. This certificate should also be sent to other DPCs of which their communes are also be covered under this subproject, however the certificate content indicate that it would be sent to ditrict environmental division, PC2 only. For Vinh Long, Dong Thap and Ba Ria-Vung Tau EMPs, find that all parts of the full EMPs (texts and all the required attachments) are technically acceptable. For Ben Tre, the main text is acceptable for the communes located outside the protected area, however additional works may be required to ensure the safeguarding for the three communes located within Thanh Phu protected area. the map need to show all the project sites in Thanh Phu commune instead of showing only seven out of 12 at present. So please go ahead with the translation of the documents into Vietnamese and subsequently submit the hard copies of the EMPs provided that: (i) environmental certificate attached to the Binh Duong EMP is valid to all sub-project communes. (ii) the Ben Tre sub-project commune location map be updated (iii) the additional requirements regarding the three communes in Thanh Phu protected area would be informed later after The Anh's visit to Ben Tre. 6 1. PURPOSE OF PROJECT NVESTMENT The Project is aimed to solve overload of rural distribution system. The Project will upgrade and extend rural distribution network in order to meet electricity demand; ensure power quality; reduce losses; increase reliability, safety and increase effectiveness of power business. 2. CURRENT ENVRONMENTAL CONDTONS The information on current environmental conditions of Ba Ria- Vung Tau province is taken from DONRE Report on Ba Ria - Vung Tau environmental conditions SURFACE WATER - Water quality of Thi Vai river is getting worse (according to monitoring data from 2002 up to 2005); - There is not yet pollution control system for waste water discharge from industrial zones such as Vedan; Nhon Trach 1,2,3; and Go Dau; - At the confluence of Thi Vai and Dong Nai hver the water has black color. - Underground water is polluted by coli form; - Water in coastal zone is slightly polluted. The main pollutants are TSS, coli form, organic substances AR QUALTY - Noise and air pollution in the province are occurred only locally. Main noise problem happens in cross section of Gieng Nuoc, Le Hong Phong of Vung Tau city. The main air problem is in surrounding areas of Dinh CO gas processing factory No 1 and No 2. 10 5. SCREENNG FOR ENVRONMENTAL MPACTS 5.1. LEGAL FRAME WORK OF ENVRONMENTAL ASSESSMENT Viet Nam regulations and laws: The Law 011 Environmental Protection (LEP) No 52/2006/QHl l dated ; The Law on Culhlral Helitage, 29 June 2001; Decree 80/2006/ND-CP dated 09/08/2006 to regulations and specific guidance on the implementation of some articles under the revised of LEP; Decree 81/2006/ND-CP dated 09/08/2006 to regulating sanctioning administrative violations in the domains of LEP. Cicular 08/2006/TT-BTNNMT dated 08/09/2006 to guide implementation of the SEA and EA and Commitement on Environmental Protection. Decree 106/2005/ND-CP dated 17/08/2005 relating to the protection of high-voltage networks. Existing Vietnamese environmental standards. The World Bank safeguard policies OP 4.01 Environmental Assessment; OP 4.04 Natural Habitats; OP 4.11 Cultural Property; BP Public Disclosure PROJECT ENVRONMENTAL ASSESSMENT The Project will play an important role in promotion of socio-economic development in Ba Ria- Vung Tau province. The Project will also contribute to (i) reduce power losses; (ii) increase capacity to supply electricity for customers; (iii) other purposes. Electricity demand in Ba Ria- Vung Tau is estimated to increase 15 % to 17% annually. t will also promote the policy of industrialization and modernization of the Government of Vietnam as well as create a great opportunity for overall socioeconomic development of the poor area. 11 Beside the significant beneficial impacts, the project may cause different minorlmedium negative impacts on the environment and local socio-economy. By using Environmental Screening Data Checklist and Environmental baseline Checklist as guided in Framework for Applying Environment Safeguards to RD Project, the potential impacts of the Project are described in Table 5.1. These communes are Xuyen Moc, Phuoc Buu town; Ward 11 and 12 of Vung Tau city; My Xuan, Tan Phuoc, Phuoc Hung, Phuoc Tinh, An Ngai, Dat Do town, Phuoc Hai town, Loc An, Lang Lon, Xa Bang, Nghia Thanh, Tan Hung. 8 Noise and vibration Small Short - Noise and vibration are caused by: equipment, material transportation, project's vehicles, pole's erection and cable's pulling, generators (if there is any) - Main of Project work will be done manually or small scale machines. Duration of construction for each site at pole's foundation is short. 2 or 3 days for foundation excavation, 5 days for pouring concrete. 2 or 3 days for cable pulling. The noise and vibration (if there are any) will be caused only during very short of time in each foundation position. - The proposed power line in Ba Ria- Vung Tau province is going cross residential and communes centers. n Xuyen Moc district, it is carried out l00 m near school; 200 m near school, 500 m near hospital in Vung Tau city; 200 m far from office of People committee in Tan Thanh districts... - Among the Project communes, there are some communes with higher level of noise and vibration impacts such as: Ward 11 and 12 of Vung Tau city, Phuoc Hung, Phuoc Tinh, An Ngai, Dat Do town, Phuoc Hai, Loc An, Long Huong, Tan Hung. No soil is remained unused after foundation construction. - The impact is considered as Minor and Mitigable. 10 Air pollution Medium Short - Dust generated from soil excavation for Medium and foundation, especially during dry seasons. Mitigable - Many earth need to be excavated, removed and transported to the working site. - Transportation of Project material and equipment are considerable. This will cause the dust and air pollution as well; But trucks for material need to be covered during transportation. - Amount of excavation work is limited, duration for excavation and foundation construction lasts only for few days, so exposure time is very short. - Places mentioned in section of "Noise and vibration impact" are places with high risk of air pollution because Project activities will be carried out near dense population areas. 11 Agricultural production due to Medium Medium - Some of productive land will be required for a Mitigable temporary and permanent acquisition of short period for construction 270,938 m2 of productive land agricultural land for fruit trees and dry crops will be temporary acquired. 16 12 No Traffic disturbance mpact Magnitude Medium Duration Short Description of the impacts permanently acquired is 2,771 m2. - Construction of the Project will intensively carried out during 6 months in the whole province. At each commune the work will last from 2 to 3 months. The temporary agricultural production loss therefore will be happen only in one harvest at each place. - Compensation will be done for acquisition of land temporary or permanent. - Transportation of material and equipment, soil excavation and cable pulling activities will disturb the normal traffic in the areas during short period of time. - n open air area, the transportation of material and equipment is very easy due to very well developed road system in the Project sites. - Conditions for transportation of material and equipment are quite convenience. There are a good system of national, provincial and inter district roads. - Transportation of traffic flow caused by Project will not exceed the capacity of the existing traffic flow in the area. Evaluation of impacts Minor - Cable pulling might be main activity that cause some impact on the traffic. Scaffolds will be construct to enable cable pulling and minimize impact on traffic when the TL is crossing roads. - Among the Project sites, there are some sites with higher level of traffic disturbance such as centers of Vung Tau city, towns and communes, where local people activities are EMP for RD Project in Bn Rio- V~tng Tau province 11

17 No 13 mpact Degradation of the existing rural roads Magnitude Minor Duration Short Description of the impacts quite intensive. - Transportation of construction material may cause damage to the existing rural roads; - n some cases the vehicles with heavy load can cause damage to the existing roads. Especially, when the road is not yet asphalted and transportation is carried out in the rainy seasons. - Road condition in the areas is quite good. Main inter-commune roads are asphalted and they are 6 to 12 m wide. The road branches to households are not yet asphalted, they are about 4-5 m wide. But the work in these roads are very simple, no Project vehicle is transported in these not asphalted roads. Evaluation of impacts Mitigable 14 Solid waste generated from soil excavation None None - The soil and construction materials remained after excavation will be used for filling back of the foundation. No soil and construction material is remained. - n case there is some remaining soil and construction materials, they will be collected to proper places. But this is rarely happen, usually the soil need to be additionally brought from another site for compaction of foundation. Only skilled workers are hired from outside places, but these workers mainly come from the region, not very far from the Project sites. Only skilled workers need to stay at the guest houses or camp sites. Number of workers stay in each communes is estimated as 20 peoples. - The impact therefore is considered as minor and mitigable. 16 Conflict between construction worker Small Medium - Difference in incomes, cultures, behaviors; Minor Negative and local people - Project usually carried out in well developed area, quite crowded places and the number of workers is not considerable in comparison with local peoples; - Project duration is 1 year, so the duration of workers staying in each site is shorter (from 2-3 monthslsite). This problem (if there is any) will not last for long time. - The impact therefore considered as minor negative. 17 Health and Safety Medium Short - Accidents might happen during construction if Minor the safety issues are not well considered. Common accidents can be: some objects falling down during cable pulling or pole erecting; injury for workers during construction materials transportation etc. - There is an assigned person in each working group, camp site responsible for first aid and EMPfor RD Project in Ba Ria- Vung Tau province 13

22 6. PUBLC CONSULTATON AND DSCLOSURE During project preparation stage ( ), the following activities were carried out: Activity 1: Site investigation. Activity 2: Meetings with PAHs on EMP and RP - When the survey was completed, the Consulting Company (in coordination with the commune officials) held meetings with PAHs having land in the line ROW and with village representatives. - Meeting will be carried out in Ba Ria town and in Chau Duc district. Representatives of PAHs, people association such and Women Union, Father Front, Farmer Association etc. were invited. - Project owner - PC2 and Consultants will present main project features, objectives, main activities, EMP and RP to consult opinion of local peoples and PA persons. Since affected and local people may pay more attention on compensation, so EMP need to consult separately from RAP in order to hear public opinion about EMP and their comments for improvements. - The public consultation in form of public meeting has been carried out in the office of Ba Ria town people committee. Main comments of local peoples on the Project and the environmental issues of the Project are summarised in Table 6.1. Activity 3: Receiving Further Feedback fiom PAHs - Opinion and comments of local and affected peoples will be recorded by the Project owner and consultants. Necessary considerations will be made later by both Project owner and consultants. Relevant justification of EMP will be made if it is required. - All of these comments are received by PC 2 consulting staff and these issues will be carefully considered in designing and management of the Project. Activity 4: Public disclosure and Clearance on EMP - The Project will receive an investment license only after appropriate modification of location, design, capacity andlor technology of the project to meet the requirement of environmental protection and resettlement. To address disclosure requirements of OP 4.01, Power Company 2 as representative of Project owner will: Provide Vietnamese-language copies of the EMP and Project Summary to office of People committee of Vung Tau city and 6 Project districts and Ba Ria- Vung Tau Provincial Power Service. Announce in public communication media or in news board of Provincial/districts over a two-month period about disclosure of EMP, RAP, and Project Summary. Full EMP is available for public review for a two months period during normal working hours at the following locations: 1) Project districts People Committees; and 2) Provincial Power Service. All interested parties are invited to read and give comments to the EMP and RAP. Address and contact person to receive comments will be provided. EMP for RD Project in Bn Rio- V~rng Tau province 17

CAPACTY BULDNG Future training includes the following: EVN training: nternal training course on how to monitor SEMPs and how to report environmental results as part of quarterly and annual project reports. The training will also include the methods for corrective action plan if some of EMP activities do not go well. PC2 training: The following training will be provided for the staffs of local power service and partly for local peoples: Safety training: Regular training on safety issues related to the distribution network maintenance; Monitoring and reporting of environmental management plan for stakeholders of the Project's district or communes: The training will give guidance to the local stakeholders about the participation of local peoples during implementation of EMP.
