INTRODUCTION The Second Rural Energy Project (REII, P074688, Cr VN) consists of (a) upgrading and /or expansion of rural power networks in about 1,200 communes; (b) conversion of current ad-hoc local electricity management systems to local distribution utilities (LDUs) as legal entities recognized under Vietnamese law; and (c) capacity building assistance for the LDUs, provincial national authorities, participating regional power companies, and national authorities involved in the planning and regulation of rural electrification. RE II has been implemented since 2004 and is ongoing. Additional financing is required to allow: (a) completion of the original project activities. Subprojects to electrify about 968 communes are under way. To complete these and to add a further 232 and hence achieve the original objective of 1,200 communes, an estimated additional $90 million is required; and (b) implementation of additional activities that will scale up the project's impact and development effectiveness. Since implementation has been satisfactory, and the mechanisms and institutions are in place, it will be relatively easy to add a further 300 communes and raise the number of communes covered to 1,500 for which an estimated $110 million is required PROJECT OBJECTIVES: The Rural Energy II Project (REII) aims at facilitating the Vietnamese Government to launch poverty elimination campaign in rural areas by providing key infrastructures such as power, accessibility to public services to improve life and production and business performance. The REII- the expansion shall continue supporting the Vietnamese Government to: - Develop a rural electrification strategy, specially focusing on power supply to mountainous and remote areas. - Rehabilitate, upgrade and expand the rural power system to satisfy power supply demand for the future socio-economic development. - Improve power supply reliability, reduce loss on power, and improve performance for production and business activities. - Re-consolidate the rural power grid system to improve reliability and power quality to be provided, including reduction of power loss due to technical or non-technical failure.- Expand 35kv and 22kv medium voltage grids to be able to supply additional power to households THE RURAL ENEGY II ADDITIONAL FINACING PHASE 5- THAI NGUYEN PROVINCE The subproject Rural Energy II project- Additional Financing - Phase 5 - Thai Nguyen Province is launched in 10 communes under 07 districts of Thai Nguyen Province including Thai Nguyen City, Song Cong country town, Dai Tu, Pho Yen, Phu Binh, Phu Luong, Đong Hy. The objectives of subproject are : 4

5 - In order to overcome overload, high losses of the grid in rural areas, expansion of medium-voltage grid (medium voltage lines and substations) will be built aiming at meeting power load demands and ensuring the quality, reducing power loss, strengthening reliability and safety in electricity supply to customers, improving business efficiency and sale of electricity. - Expansion of medium-voltage in rural areas where power load demand increase rapidly will be done in order to strengthen capacity of the grid, to meet on time growing demand of power load and ensure the quality of power supply. - Prevent overload of the local power grid for the subproject communes - Reduce power losses, improve electricity quality, and provide stable power supply for living, production, and business activities in the rural areas The Sub-project includes 03 components, namely: Medium voltage transmission lines: New construction km medium voltage transmission lines. In which: Substations: - New construction 901 km medium voltage (35Kv) transmission lines. - New construction km medium voltage (22Kv) transmission lines. New construction and rehabilitate of 05 substations with total capacity of 780 kva. Low voltage transmission lines( 0,4 kv) The total length of new construction and rehabilitate: km low voltage transmission lines. 6 2. PROJECT DESCRIPTION 2.1. BRIEF DESCRIPTION ON NATURAL AND SOCIAL CONDITIONS OF THAI NGUYEN PROVINCES Geographical position Thai Nguyen province s North borders with Bac Kan province, the West borders with provinces of Vinh Phuc and Tuyen Quang, the East borders with provinces of Lang Son and Bac Giang and the South borders with Hanoi capital. Thanks to its geological position as one of the political, economical and education centers of Viet Bac region in particular and the Northeastern mountainous midland area in general, Thai Nguyen is the socio-economic exchange gateway between the mountainous midland area and Northern delta area. The exchange is conducted through sector-shaped roadway, railway and river way systems which Thai Nguyen is the hub. Together with central position of Viet Bac, Thai Nguyen is also converging culture of ethnics in the Northern mountainous area, acting as a center of culture and education activities of the extensive mountainous area in the North. Thanks to its strategic position of Viet Bac, Thai Nguyen is the cultural center of ethnic groups in the mountainous area in the North, acting as the center of cultural and education activities of the entire extensively mountainous area in the North. Thai Nguyen has 07 districts, 01 town and 01 city including 180 communes, wards and towns with 125/180 high and mountainous communes. The remaining are delta and midland communes. Topography: Being a mountainous and midland province, Thai Nguyen has mountainous area of 315, hectares, accounting for 90.73%, midland area of 38, hectares, accounting for 9.27%. It is mainly characterized by low hilly mountain, which Tam Dao mountain is the highest one with 1,591m height, situated in the dividing crest of Tam Dao range and also a terrain of 3 provinces namely Thai Nguyen, Tuyen Quang and Vinh Phuc. Climate: In winter, climate in Thai Nguyen is divided into 3 clear areas: Colder area is situated in the North of Vo Nhai district. Medium cold area covers districts of Dinh Hoa, Phu Luong and the South of Vo Nhai district. Warm area covers districts of Dai Tu- Thai Nguyen city, Dong Hy, Phu Binh, Pho Yen and Song Cong town. The temperature varying between the hottest month (June: 28.9 C) with the coldest month (January: 15.2 C) is 13.7 C. Total sunny hours in the year fluctuates from 1,300 to 1,750 hours and it is relatively even distributed to months in the year. Climate in Thai Nguyen is divided into 2 clear seasons. The rainy season lasts from May to October and dry season last from October to May. The annual average rainfall is approximately 2,000 to 2,500 mm; the peak is August and the lowest one is January.. Population : Population in Thai Nguyen province were 1,124,786 persons as recorded in the population survey launched on 1 st April Population is unevenly distributed, especially 6

7 scattered in the high and mountainous areas, meanwhile population in city and delta is dense. The lowest population density is 72 persons/km² in Vo Nhai district, the highest one is 1,260 persons/km² in Thai Nguyen city. According to the general population and housing survey launched on 1 st April 2009, in 10 years ( ) the province s population gained the average increase of 0.7%/year, lower than the average level of whole nation, i.e., 1.2% because many people removed to other provinces. There are 3 districts namely Dinh Hoa, Dai Tu and Phu Binh with negative population growth rate.. Traffic infrastructure The province has 3,422.7 km. Road under the management of the Central, the province, the district and commune is 80,1km long (accounting for 2.34%), 271 long, (accounting for 7.91%) and km long (accounting for 22.19%), 2,312 km long (accounting for 67.54%), respectively. Aggregate road, macadam road account for km, accounting for 10%; the asphalt road is 379,7 km, accounting for 11% whereas the soil road is 2,692.7 km, accounting for 79%. Currently, 100% of communes, wards and towns in the province are equipped with the highway to the center.. Soil Thai Nguyen has 354,110 hectares of natural land area in which 94,563 hectares, 152,275 hectares and 20,539 hectares of agricultural land area; non-agricultural land area and unused land area, making up 26.70%, 43% and 5.8% of natural land area, respectively; the unused land area and stone springs and rivers are 78,535 hectares, accounting for 22.17% PROJECT S SCOPE The subproject The rural enegy II project additional financing PHASE 5 Thai Nguyen province refers to the following: New construction of medium voltage transmission lines, substation and new construction and rehabilitate of low voltage transmission lines in 10 communes under 07 districts : Thai Nguyen City, Song Cong town, Dai Tu,Pho Yen, Phu Binh, Phu Luong, Đong Hy in Thai Nguyen Province. 7

12 2.3. PRE-CONSTRUCTION AND WHILE-CONSTRUCTION ACTIVITIES AS SPECIFIED IN THE IMPLEMENTATION PROCEDURES - Compensation and site clearance. Site clearance covers mainly cutting trees off and clearing structures situated in pylon foundations, trees with height of over 4m and buildings available in the route. - Buildings in the route not affected should not be cleared. - Trees at pylon foundation positions are mainly crops (rice), trees (Tea, acaica, bamboo). Communal People s Committees and district People s Committees in the project area agree to implement compensation and site clearance as stipulated to ensure power construction and erection. If it is fallen in the harvest season of farmers, it is required to calculate to compensate trees on land for farmers in accordance with the average productivity. Trees with height of over 4m available in the route may be cut down before wiring. - Compensation is undertaken by power companies. Therefore, PCs of Thai Nguyen provinces should complete the land recovery procedures and grand land for construction so that site can be handed over to builders. - Camp construction: In order to ensure the storage of materials, plants and equipment and houses for workers, a temporary camp construction project is launched in each commune, including: + Indoor storage for cement, equipment, electrical materials and accessories: 30m2 x 1 commune = 30m2. + Outdoor storage with fence to protect transformers, medium voltage conductors, construction tools, beam, bracket and backstays: 10m2 x 01 commune = 100m2. + Temporary buildings for workers during construction: 50m2 x 1 commune = 50m2. + Indoor warehouse and temporary buildings are made from bamboo frame with fiberboard, its roofs are covered with fiberboard and roofing felt. Pylons are piled at the ending route and scattered transported to the site by combining the manual and mechanical method. + Other materials such as beam, backstay, accessories, etc from Hanoi shall be transported to the site by the 5-ton trucks and manually unloaded. + Cement bought in districts is transported by the 5-ton trucks and manually unloaded. + Sand and stone bought at the project s district, 20km distance, shall be transported by the 5-ton dump trucks and manually unloaded. 14

16 3. LEGAL FRAMEWORK ON THE PROJECT S ENVIRONMENT IMPACT ASSESSMENT 3.1. LAWS AND REGULATIONS OF VIETNAM The Vietnamese Government promulgates some laws and regulations on environmental protection. Such documents include: - Legislation of the Socialist Republic of Vietnam (April 1992) specifies that the Stateown enterprises, governmental agencies, cooperatives and national defense bodies must be responsible for fulfilling policies on environmental protection to ensure the proper use of natural resources and environmental protection. - Law on Environmental Protection approved by the National Assembly on 29 th November 2005 and valid since 1 st July 2006, superseding Law on Environmental Protection in 1993 which prescribes responsibilities of the central, locality, individuals and organizations in environment degrading prevention and protection and implements specific environmental protection functions. - Law on Forest Protection (1992) specifies on managing, protecting, developing and exploiting forest and preventing cutting trees downs and deforestation. - Law on Protection of People's Health (11 th July 1989): Rights and obligations of residents in health protection, guiding principles on health protection, sanitation education in people; conduct the standby measures; rehabilitate and clean living environment; ensure labor sanitation standards, food and foodstuff hygiene. - Decree No. 81/2006/ND-CP dated 9 th August 2006 of the Government on sanctioning of administrative violations in the field of environmental protection. - Decree No. 106/2005/ND-CP dated 17 th August 2005 of the Government on detailing and guiding the implementation of a number of articles of the electricity Law on Protection of safety of high-voltage power grid works (amending and supplementing Decree No. 54/1999/ND-CP). - Decree No. 52/1999/ND-CP: Regulations on managing construction investment with amendments on environmental issues in construction management. Decree of Government No. 29/2011/ND-CP dated 18 April, 2006 regulating strategic environmental assessment, environmental impact assessment and environment protection commitment. Circular No.26/2011/TT-BTNMT dated 18 July, 2011 on guidance for Decree No.29/2011/ND-CP dated 18 April, The national technical codes: QCVN08: 2008/BTNMT - the national technical regulations on quality of surface water; QCVN05: 2009/BTNMT Air quality- Standards on ambient air quality; QCVN 26:2010/BTNMT National Technical Regulation on Noise; QCVN 27:2010 National Technical Regulation on Vibration 3.2 PROTECTION POLICY OF THE WORLD BANK (WB) Environmental and social impact filtering have been made showing the following policies of the World Bank already applied to this subproject: 16

17 - OP/BP 4.01 Environmental Assessment - OP/BP 4.10 Indigenous People - OP/BP 4.12 Involuntary Resettlement - WB s Policy on Information Access - Guidelines on Environment, Health and Safety of World Bank group for power transmission and distribution projects - Framework regulations on environmental protection application for Rural Distribution Grid Project ENVIRONMENTAL DOCUMENTS IN ACCORDANCE WITH REQUIREMENTS OF VIETNAM AND WORLD BANK. The Government s regulation on EIA requires submission of an Environmental Protection Commitment (EPC) for the subproject. An EPC report has been prepared, submitted to, and approved by District People s Committee under the Confirmation No 14./TB-UBND, dated october 2 nd 2012 of Dai Tu DPC, Thai Nguyen Province. - This Environmental Management Plan was established to meet the requirements on environmental management of World Bank. 4. ENVIRONMENT IMPACT ASSESSMENT 4.1. SUBPROJECT S POTENTIAL IMPACTS The Project shall pay an essential role inelectrification and poverty elimination program in 10 communes of 07 districts in Thai Nguyen province. The Project also facilitates the industrialization and modernization policy promulgated by the Government and offers best opportunities for general socio-economic development to poor areas. When distribution wirelines are constructed, local persons tend to move to live near such wirelines. Local People s Committee shall prepare a specific plan to support the regional development. Such plans include road, residential areas, industrial and agricultural development, etc. Such district/commune or province shall divert the development as sketched in these plans. In addition to noticeable positive impacts, variety of adverse impacts may be posted on environment and local socio-economics. By using the Checklist of Environmental Test Data and Background Environment List as guided in the Guidelines, the environmental protection measures are applied for the Rural Energy Project. Clearing trees within line corridor may have small changes in landscape and increase wastes. One small part of people s field land will be permanently occupied for constructing foundation and column locations and substations. Subprojects mainly cause dust and noise, pollute air during construction. However, these effects are very small and can be minimized. Subproject causes no significant impacts on environment and society so that it is classified as grade B about environment in accordance with environmental screening criteria of World Bank and it is eligible for fund financing from the World Bank.Policies OP 4.01, OP 4.10 and OP 4.12 are applied to sub-projects 22

Temporarily and permanently occupied land The occupied land area of 10 communes, 07 districts in Thai Nguyen province is 34,757 m 2 of temporarily occupied agricultural and forestry land (In which, puplic land : 30,865 m 2 ; forestry and agricultural land: 3,892 m 2 ), respectively: and 7,507 m 2 of perrmanently occupied agricultural land. (In which, 2,083m2 is puplic land and 286m2 is forestry land). On average, the permanently occupied land area per commune is approximately 28.6m 2 and the temporarily occupied land area is about m 2. Land occupied by the Project (including medium voltage wirelines and transformer station) does not affect great and important works (such as buildings and outlets) or auxiliary works (such as cattle sheds, fence walls, garden and playground). Trees which are higher than 4m shall be cut down, this impact is short term and negligible. ROW shall be planted with trees for general vegetation with height of less than 4m. The Project s Resettlement Plan also specifies that contractors must return plane of temporarily occupied agricultural land lots to its origin status, which can cultivate for the land owners. The wirelines passing the agricultural land lots would cause no impact on lower cultivation. 24

25 4.3. Impacts on affected households The survey unveiled that the Project would affect three main groups of people, including farmers (majority, accounting for over 90% of total affected groups of people), trading and service groups and public servant groups in management agencies, companies and factories. Among these three groups, subsistence and income of farmer and business groups would be affected because a part of production land is recovered or business is suspended during construction. Whereas, the public servant group is free from this impact. Among households affected in terms of land, no household is required to resettle. The Project do not affect any households of ethnic minorities 25

COMMUNITY CONSULTATION AND INFORMATION DISCLOSURE During preparing the Project (2012), following works were conducted: Activity 1: Understand and discuss with the local authority about wiring position Activity 2: Make a survey and statistics about impacts Activity 3: Organize meetings with affected households After finishing survey, the Consultant must notify the local persons and affected communes about the project s activities. Public notice form should be applied. Such notices must be provided to the local persons with following contents, especially in the project communes: - General information about Project title, the Project Owner, project scale, names of project districts and communes. - Possible impacts on environment due to project s activities. - Applied mitigation measures to minimize impacts on environment. - Project implementation plan. - Place to receive the community s feedback on project-related environmental issues This activity was launched in April, 2012 in all project districts and communes. Following representatives of organizations were invited and involved in the community consultation meeting, concretely: Affected households; Fatherland Front Committee Women Association; Youth union; War Veteran Farmer association People s Committee; Other concerned agencies and mass organizations. In order to settle requirements of WB s OP 4.01, the Consultant and NPC must: Provide copies of on Environmental Protection Commitment, Compensation and Site Clearance Plan, Executive in Vietnamese to Communal People s Committees to Provincial People s Committees in the project area. Advertise on project in some series of main newspapers issued by the locality in 2 months. Notify in public about community opinion collection regarding the project s main activities, preliminary emigration plan, on Environmental Protection Commitment in working hours in 2 months at following locations: 1) Provincial People s Committees; and 2) Communal People s Committees. Copies of EMP report in English and Vietnamese shall be submitted to Vietnam Development Information Center at 63 Ly Thai To street, Hanoi City disclosure of information. 30

ENVIRONMENTAL MANAGEMENT PLAN 6.1: The project s social impact management: Information and communication program: Basic information includes: a) Population survey and statistics include: - Name and number of people in a household. - Number, types and area of damaged houses - Number, types and area of damaged residential land lot - Number, types and area of affected agricultural land - Number and types of affected crops and trees - Affected business including architectural structures, land and other assets. - Affected profitable assets: percent of total affected assets - Quantity and classification of other fixed assets affected by each sub-project, and - Temporary damages for profitable assets b) Certain socio-economic survey of DPs: Age, gender, nation, qualification, occupation, income source and total income of whole household. c) Public news release at the Site regarding (a) bidding package, (b) contractor, (c) detailed construction plan and (d) hotline to solve claims on social and environmental issues. Public news release during project preparation through community consultancy meeting and mass media. Claim and compensation mechanism Claims and questions relating to any aspects of RP, including determination of unit price and quantity of lost assets shall be solved in accordance with following steps: Step 1: If any person claims about any issue of the resettlement and life recovery program, he may present directly or submit a written claim to authority persons of the commune. The CPC shall settle such questions within 15 working days since the claim is received. Step 2: If claimer is not satisfied with decisions in Step 1, his claim may be submitted to district People s Committee or CRC within 15 working days since the date of receiving the decision in step 1. The DPC or CRC shall make decision within 15 working days since the date of receiving the claim. Step 3: If the claimer is still dissatisfied with decision of the district authority, he may lodge the appeal to the PPC or the district CRC within 15 working days since the date of receiving decision of DPC or district CRC. Within 15 working days, PPC or PCRC shall decide such claim. Step 4: If he is still dissatisfied with decision released by the provincial authority, he may file the appeal to the district court within 15 working days since the date of receiving decision made by PPC or PCRC. DPs are completely exempted from administrative and legal fees and charges. Monitoring and evaluation system Power companies and concerned PMUs work closely with corresponding DPCs/CPCs at the management units and independent supervision unit to launch regular monitoring of Compensation and Resettlement Plan Performance. Findings shall be 31

32 recorded in the quarterly report to submit EVN, power companies and concerned provincial power companies. Internal inspection and monitoring include: - Verifying that basic information about DPs, evaluating lost or damaged assets, compensations, benefits of resettlement and life recovery are conducted in accordance with the regulations of the corresponding Policy Framework and RP. - Monitoring that RP is conducted as designed and approved. - Determining that financial resources to implement RP are provided to PMUs in due date with full quantity to fufill the objectives; Such resources are properly used by PMUs as prescribed in RP. - Archiving all claims and questions and ensuring that such claims are solved as scheduled. Independent supervision: Independent units or independent consultancy units employed by PCs under EVN shall conduct regular monitoring and external evaluation in addition to RP performance. Independent organizations may be schools, research institutions, NGOs or independent consultancy companies with professional staffs and Terms of Reference (TOR) accepted by World Bank. In order to verify information provided to internal control and supervision report of corresponding power companies, employed external supervisors shall visit sample, approximately 20% of affected households in the concerned province in 6 months since RP is conducted to: - Determine whether procedures on involvement of DPs, compensation work, Rights of recovering new life are conducted in accordance with policy framework or not; and - Evaluating whether objectives of policy framework on improving or at least ensuring living standards and income of DPs are satisfied or not. - Collecting quality criteria of socio-economic impacts on DPs when the Project is conducted. - Recommending amendments during RP performance in case it is possible to put forward principles and objectives of policy framewor. 32

By exchanging in an opened-hearted and bidirectional manner, the CPC and the Contractor can arrange proper accommodation for this worker group. Contractor - Workers should be educated to conduct polite behaviors with local persons and vice versa. - Clearance: In the general provisions of the Contract, it is required to specify that: After finishing the Project, camps must be clearly removed and camping area must be restored with its intact status. Labor health and safety for workers - Healthcare service should be offered to worker teams. - Workers should be disseminated with regulations and procedures on labor safety. - Safety equipment should be provided to workers during construction. Any spills or leaks must be cleaned up immediately using sorbents like sand. PCBs contaminated area needs to be cleaned by using suitable solvents such as kerosene and turpentine. 40

Safety measures when working at height - Preventive and control measures include: - Check the firmness of structures before starting work - Take anti-fall measures including climbing skills, use of supporting devices and first aid toolkit - Install supporting and anti-fall devices - Safety bands will not be smaller than 16 mm, two layers, and durable strength.
