2 1 INTRODUCTION This section contains local objectives and controls for development in the flood prone areas of Dora Creek as defined in Figure 1 - Extent of Area Plan. For general development controls, refer to DCP 2012DCP BACKGROUND Dora Creek is located 30km south west of Newcastle. Dora Creek rises in the Sugarloaf Ranges, some 460m above sea level and flows in an easterly direction to its mouth at Lake Macquarie. The township of Dora Creek is located about 3km from the mouth and is subject to flooding constraints. Flooding in Dora Creek is influenced both by rainfall over its catchment and high water levels in Lake Macquarie. Inundation of overbank areas occurs when the carrying capacity of the Dora Creek channel is exceeded. Overbank flows where floodwaters do not return to the main creek channel occur at several locations in the vicinity of the Dora Creek Township. Upstream of the Main Northern Railway, there are overflows to the north to Muddy Lake. Downstream of the railway, overflows occur to Muddy Lake and Lake Eraring in the north and to Bonnells Bay in the south. The Dora Creek Floodplain Management Plan 1998 provides the basis for the future management of flood liable lands and the management of development within the Dora Creek floodplain area. Site-specific controls are required to ensure development adequately considers flooding issues. 1.2 EXTENT OF AREA PLAN This Area Plan applies to the flood prone areas shown in Figure 1 and further detailed in Figures 2 6. 3 1.3 FLOOD DEVELOPMENT CONTROLS Objectives: Controls: a. To ensure that subdivision and development is carried out in accordance with the Dora Creek Floodplain Management Plan b. To restrict more intensive forms of development in the flood prone areas of Dora Creek. 1. On flood prone land west of the railway line, as identified in the Dora Creek Floodplain Management Plan (1998), the following forms of development are prohibited: i. Subdivision, ii. Dual Occupancy Attached and Detached, iii. Multiple Dwelling Housing, iv. Small Lot Housing. 2. On flood prone land east of the railway line, as identified in the Dora Creek Floodplain Management Plan (1998), the following forms of development are prohibited: i. Multiple Dwelling Housing, ii. Small Lot Housing, iii. Senior Living Developments. 3. Subdivision east of the railway line is carried out in accordance with the Dora Creek Floodplain Management Plan (1998): i. Lot sizes should be a minimum of 700m 2, ii. Each additional lot created attracts a levy of $1,000 (indexed to the Consumer Price Index from 1990) to assist in funding flood mitigation works in Dora Creek. 4. Dual Occupancy developments east of the railway line are carried out in accordance with the Dora Creek Floodplain management Plan, (1998): i. Minimum Parent Lot size for Dual Occupancy Attached or Detached Development 1400m 2, ii. The maximum site coverage including all buildings, garages, sheds, raised swimming pools, filled areas, is less than 35 percent of the lot size for the lands identified in the Dora Creek Floodplain Management Plan (1998), iii. Buildings or any area of the site raised above the required filling level observes a two-metre side boundary setback, and iv. Solid internal fencing must not be constructed. Page 3 F2009/00952
