Dear Sir, Tender document in respect of sale of old machines as per list given at Annexure-A, containing 10 pages as details given at page 3 (Index) are forwarded herewith. Please note that the sealed tenders duly filled in will be received in the office of the General Manager on or before 06/01/2010 up to 1 p.m. The price can be quoted for any Machine or all the Machines as given at Annexure- A of the Tender Document. The tender should be signed and dated by the Authorized Signatory in all the pages including the pages provided for in the Tender Document. The General Manager reserves the right to accept /reject any or all offers. This letter shall form the part of the contract and must be signed and returned along with the tender documents. 4 NOTICE INVITING TENDER Sealed tenders are hereby invited on behalf of the General Manager, NSIC Technical Services Centre (Howrah), Balitikuri, Japani Gate, Howrah from Industry owners, Machine Traders, Individuals and others who are interested in buying old/used machine tools and equipments as per list given at Annexure-A so as to reach to General Manager, NSIC-Technical Services Centre (Howrah), Balitikuri, Japani Gate, Howrah up to 1 p.m. on The details of Tender are summarized below:- a) Name of the Machines and equipments As per Annexure-A b) Earnest Money Deposit 5% of the total quoted price c) Cost of Tender Document Rs. 1000/- d) Machines and equipments Lifting Time Within 10 days from the date of awarding the order e) Last date of submission of completed up to 1 p.m tender documents f) Date of opening of Tender at 3 p.m. 1. Tender Document may be obtained in person from our office against payment of Rs. 1000/- by cash or crossed Demand Draft/Pay Order in favour of NSIC Ltd. NTSC A/c payable at Howrah and also can be downloaded from our web site from 18/12/2009 to 05/01/ In case Tender Document is downloaded from web site, the cost of Tender Document should be enclosed with the Tender by way of Demand Draft/Pay Order in favour of NSIC Ltd. NTSC A/c payable at Howrah. 3. The other Terms and Conditions applicable to this tender have been incorporated in the tender documents. 4. The Competent Authority reserves the right to reject all or any tender wholly or partly without assigning any reason whatsoever. Page 4 of 10

5 INSTRUCTION TO THE TENDERERS The Tender shall be submitted in accordance with these instructions and any tender not conforming thereto is liable to be rejected. These instructions shall form the part of the tender and contract. 1. The tender should be submitted in sealed cover super scribed as TENDER FOR OLD MACHINES. 2. In case Tender Document is downloaded from web site, the cost of Tender Document should be enclosed with the Tender by way of Demand Draft/Pay Order in favour of NSIC Ltd. NTSC A/c payable at Howrah. 3. The tender shall be completed in all respect (should be signed and dated by the Authorised Signatory in all pages). The tender received without tender fee shall be rejected outright. 4. Earnest Money deposit 5% of the quoted price shall be submitted alongwith the tender as Earnest Money Deposit by Demand Draft/Pay Order in favour of NSIC Ltd.-NTSC A/c payable at Howrah. 5. The Tenderers are free to inspect the tendered machines at the NSIC- Technical Services Centre from am to 4.30 pm on the working days from Monday to Friday wef 18/12/2009 to 05/01/2010. Page 5 of 10

Instruction To The Tenderers 3. Form Of Tender 4. Terms & Conditions For Disposal I/We hereby submit our quoted rates in the enclosed format as Annexure-A. The validity of the offer is 30 days from the date of submission of tenders. Should our tender be accepted I/We agree:- 1. A sum of Rs. /- (Rupees only) which is 5% of the quoted price is furnished as Earnest Money Deposit shall be retained by NSIC-Technical Services centre on account of security deposit. 2. The tender document along with your delivery instructions shall constitute the bind contract between us and NSIC Technical services centre, Howrah. 3. In the event of failure to take delivery of the machines within stipulated time of 10 days period in full you shall be at liberty to forfeit the Earnest Money Deposit. 4. 9 COMMERCIAL AND GENERAL TERMS & CONDITIONS Sealed Tenders are hereby invited for disposal of Old machines on as is where is basis. The Machines are available at NSIC Technical Services Centre, Howrah as per following terms & conditions: 1. Tenderers shall submit their offers in a sealed cover super scribed as Tender for Old Machines at NTSC Howrah on or before up to 1 P.M. 2. The Tender should be accompanied with the Earnest Money Deposit equivalent to 5% of the total quoted price in the form of a Demand Draft/Pay Order in favour of NSIC Ltd. NTSC A/c payable at Howrah. No Cheque or cash shall be accepted. The offers without Earnest Money Deposit will be rejected. 3. Tenderers shall take into account the cost of labour & cartage etc. before quoting the rates. In this regard no extra claim what so ever shall be entertained by the Centre. 4. The validity of the offer shall be of 30 days from the last date of submission of the offer. 5. The General Manager, NSIC-TSC, Howrah reserves all the rights to accept or reject any or all the offers. 6. The offer should be made in the Tender form enclosed marked tender no. NTSC (H)/Disposal-1A/08-09 dated 18/12/ The tenders will be opened at NTSC-Howrah on at 3 p.m. The Tenderers or their authorised representatives (One person only) may be present at the time of opening of the tender. 8. The EMD deposited by the highest successful Tenderers shall be adjusted against the payment towards cost of the machine. The EMD of unsuccessful Tenderers will be refunded within two months after announcement of the decision and no interest will be payable on this account. Page 9 of 10

10 9. The successful Tenderers shall lift the Machine(s) from NTSC- Howrah Premises within 10 days from the date of issue of award letter. In case the Machine is not lifted within the stipulated period, The Earnest Money Deposit shall be forfeited. 10. All responsibility related to labour P.F., ESI, Insurance etc. as applicable will be of the successful Tenderers. NSIC shall not be responsible for the same. 11. The highest/successful Tenderers should deposit by Demand Draft/Pay Order the offered price along with all Taxes & duties applicable in favour of NSIC Ltd - NTSC A/c, payable at Howrah before lifting the Machine. 12. The machines are being sold on AS IS WHERE IS BASIS. They are being sold on the assumption that the Tenderers have inspected them and know what they are buying and the principles of CAVEAT EMPTOR shall apply and no reliance must be placed on any description of machine plant etc. 13. The successful Tenderers shall make all arrangements for lifting of the Machine at their own cost. 14. All the communication shall be addressed to: The General Manager, NSIC Technical Services Centre, Japanigate, Balitikuri, Howrah The decision of the NSIC Technical Services Centre, Howrah will be final and binding on the Tenderers. 16. In the event of any dispute the legal matter shall be subjected to the jurisdiction of Howrah / Kolkata court only. Page 10 of 10
