1 PROCEDURE FOR THE ISSUANCE (INITIAL AND RENEWAL) OF ENVIRONMENTAL PERMIT / NO OBJECTION CERTIFICATE (NOC) 1.0 PURPOSE This procedure specifies the process of securing Environmental Permit or No Objection Certificate (NOC). 2.0 SCOPE All projects or activities under the Ports, Customs and Free Zone Corporation (PCFC) and Dubai World jurisdiction areas with significant environmental concern. Please see table below for applicability of each type of Environmental Permit or NOC. # Type of Permit Applicability 1 Harbor / Open Sea Discharge Permit For project / activity disposing treated wastewater to harbor or open sea 2 Irrigation Permit For project / activity utilizing treated wastewater for irrigation purposes 3 Groundwater Discharge Permit For project / activity which intends to remove and dispose or reuse underground water 4 Air Emission Permit For project / activity utilizing process or fuel burning stacks with possible air emission or air pollution control equipment 5 Permit to Cut and/or Relocate Trees For project / activity which requires to cut / relocate trees 6 Marine Mammal Related Activity For a specific activity, as described by the permit, which involves marine mammal 6.1 Permit to Operate Captive Marine Mammal Facility 6.2 Permit to Transport Marine Mammal 6.3 Permit to Conduct Scientific Research Marine Mammal 6.4 Permit to Export / Import Marine Mammal For a specific activity, as described by the permit, 7 Aquatic Animal Related Activity which involves aquatic animal 7.1 Permit to Operate Public Aquarium Facility 7.2 Permit to Transport Aquatic Animal 7.3 Permit to Conduct Scientific Research Aquatic Animal REVISION: 02 February 2015 Page 1 of 6
2 7.4 Permit to Export / Import Aquatic Animal 8 No Objection Certificate (NOC) For project which intends to manage a marine area Marine Area Management with significant ecological value 9 Coral Translocation Permit For project which intends to perform coral translocation activity 10 No Objection Certificate (NOC) For project which intends to conduct dredging Dredging and/or Reclamation and/or reclamation activity For project which intends to conduct a certain 11 No Objection Certificate (NOC) activity, apart from those listed above and specified Conditional Environmental Activity in other procedures, with significant environmental concern 12 Permit to Transport Sand For activity that will shift sand from a construction site to another construction area / stockpile area 3.0 PROCEDURE 3.1 Procedure for Open Sea Discharge Permit, Groundwater Discharge Permit, Permit to Cut and/or Relocate Tree/s, Marine Mammal Related Activity Permits, Aquatic Animal Related Activity Permit, NOC Marine Area Management, Coral Translocation Permit, NOC Dredging and/or Reclamation, NOC Conditional Environmental Activity, Permit to Transport Sand; and new applications of Harbor Discharge Permit, Irrigation Permit and Air Emission Permit Submission of Application Form and Documentary Requirements The Client / Contractor shall submit a fully accomplished permit application form together with all other necessary documents listed on the relevant application form and as required during application. All submissions must be in electronic format and has to be submitted to EHS Main Office Reception (near Main Gate No. 3), Jebel Ali Free Zone or through to EHS.environment@trakhees.ae. Incomplete and paper submissions shall be rejected and will not be accepted Review of Environmental Permit / NOC Submission The submitted application form and all other supporting documents shall be reviewed by Environment Department. The Client / Contractor shall be notified of any deficiency, clarifications and/or requirements to be submitted for further review and assessment Site Inspection Site Inspection, as needed, shall be conducted by an Officer. Upon notification, the Client / Contractor shall agree with the Officer the time and date of the Site Inspection. The scope of Site Inspection shall include all facilities covered by the relevant Environmental Permit / NOC. REVISION: 02 February 2015 Page 2 of 6
3 3.1.4 Approval / Rejection of Environmental Permit / NOC Approval or rejection of the application shall be notified by the Environment Department to the Client / Contractor concern. Upon approval, appropriate permit shall be issued Payment Client / Contractor securing an Environmental Permit / NOC shall pay an amount as specified in Table 1. The payment can be settled at any Trakhees Cash Counters located at EHS Main Office (near Main Gate No. 3), Jebel Ali Free Zone or at Trakhees Main Office, Dragon Mart. In case of payment by check, the check shall be made payable to PCFC- Trakhees. Also, all transactions are required to pay the Knowledge Dirham fee at an amount of AED 10/-. 4 Payment advice for the relevant fee/s shall be forwarded by EHS Environment Department to the Client through . No issuance of Permit / NOC shall be given unless all fees are settled. 3.2 Procedure for renewal of Harbor Discharge Permit, Irrigation Permit and Air Emission Permit EHS Environment Department shall initiate the renewal process of Harbor Discharge, Irrigation and Air Emission Permits on an annual basis within forty five (45) to sixty (60) days prior to Permit s expiry date. Inspection by EHS Environment Department and sampling by EHS Laboratory shall be conducted at the same time without prior notice to the Client. Corresponding analysis report/s shall be released by EHS Laboratory within five (5) working days for air emissions, seven (7) working days for irrigation water and eight (8) working days for harbor water after sampling date As soon as the corresponding analysis report/s has been released, succeeding steps which will depend on the results of sampling shall be detailed by the EHS Environment Department. The steps shall include but not limited to compliance with the applicable standards, submission of documentary requirements and settlement of relevant fees (i.e. permit approval, laboratory analysis and financial penalty) Payment Client shall pay the relevant permit approval fee/s as detailed in the Table 1 and the corresponding laboratory analysis fee/s as specified in Table 2. Financial penalty (Table 3), as applicable, should be settled prior to permit issuance. The payment can be settled at any Trakhees Cash Counters located at EHS Main Office (near Main Gate No. 3), Jebel Ali Free Zone or at Trakhees Main Office, Dragon Mart. In case of payment by check, the check shall be made payable to PCFC-Trakhees. Also, all transactions are required to pay the Knowledge Dirham fee at an amount of AED 10/-.
