3 Peventing Pollution at Hot Mix Asphalt Plants - Guide Sheet #1 As envionmental potection becomes moe and moe impotant, industies of evey type ae faced with some big questions. What envionmental egulations apply to my facility and me? How do I comply with those egulations? Ae thee things I can do to educe the numbe of egulations I must meet? How can I potect myself fom fines and liability? How do I potect my wokes and myself fom envionmental hazads at wok? This publication can help hot mix asphalt plants in Missoui answe some of those questions. The guides povide basic infomation about egulatoy equiements and suggestions fo potecting youself, you wokes and the envionment though pollution pevention. Each guide sheet deals with a sepaate issue that you may face at you asphalt plant. The guides will not answe evey question you have. 5 Peventing Pollution at Hot Mix Asphalt Plants - Guide Sheet #2 Pollution Pevention Asphalt plants deal with many things that can affect the envionment. Mateials such as aibone dust, contaminated stom wate and used oil can ham the envionment and people if they ae not popely managed. State and fedeal envionmental egulations explain what legally can and cannot be done with these mateials. The egulations descibe how pollution o waste should be contolled, stoed, teated o disposed. A bette solution is to pevent the waste o pollution. What is Pollution Pevention? Pollution pevention is simply not making the waste o pollutant in the fist place. It means doing what we can to educe the amount and toxicity of the pollution we geneate. Peventing pollution may be something as simple as using a catch basin to pevent spills o something as complex as edesigning you opeation to incease efficiency and educe waste. Simple things like choosing nonhazadous solvents can potect the envionment and educe the numbe of envionmental egulations you must comply with. Pollution pevention means thinking about the envionmental impact of you actions and tying to limit that impact. Why Pevent Pollution? When we geneate waste o pollution, we must safely and legally manage that waste o pollution. Whethe it is household tash o waste fom a business, managing wastes costs money. Usually the things we discad ae items we bought. A good example is pape towels. We buy them, use them once and then pay again to have them disposed. If we educe the amount of waste we geneate, we can save money. Reducing costs is a majo eason to pevent pollution. Hee ae a few othes: Impoved wok envionment and woke safety. Reduced liability. Inceased efficiency. Reduced egulatoy equiements. Impoved envionmental potection. Enhanced maketing and public elations oppotunities. 6 What can be done at hot mix asphalt plants? Thee ae many ways to pevent pollution at asphalt plants. Each of these guide sheets has suggestions on ways to pevent pollution. Hee ae a few geneal tips: Make a list of you wastes. Ty to find a way to eliminate each of them. Fo example, if you thow away pape towels, conside using washable shop towels. Include the cost of disposal when you make puchasing decisions. What looks like the least expensive option may cost moe because of disposal o othe management costs. Don't buy moe than you need. The leftoves may become waste. Puchase the lagest pactical containe, containes usually end up as waste, but don t puchase moe than you need. Puchase the least toxic o hazadous poduct available. Check the mateial safety data sheets fo poducts you puchase. If the poduct is toxic o hazadous, ask you supplie fo altenatives. Use the oldest items fist (fist-in, fist-out). If you do have excess o unneeded mateials, see if you supplie can take them back. Use dip pans and splash guads whee spills fequently occu. Fix leaks immediately. Keep wok aeas clean and well oganized to help pevent accidents. Stoe mateials in a way that keeps them fom being damaged. Inspect stoage aeas egulaly fo leaks. Make sue all items ae clealy labeled. Stoe poducts in oiginal containes. Stoe wastes sepaately and be sue they ae popely labeled to make it easie to euse o ecycle them. Stoe items that could leak in a place whee leaks will be contained and easily seen. Fo moe infomation call o wite to Missoui Depatment of Natual Resouces P.O. Box 176 Jeffeson City, MO Septembe 1999

7 Peventing Pollution at Hot Mix Asphalt Plants - Guide Sheet #3 404 Pemits and Wetlands Unde Section 404(a) of the Clean Wate Act, you must get a pemit fom the U.S. Amy Cops of Enginees (Cops) befoe putting dedged o fill mateials into any "wates of the United States" (U.S.). This includes wates used (o usable) as habitat by cetain bids o endangeed species o used to iigate cops sold in intestate commece. The following ae not geneally consideed "wates of the U.S.": Non-tidal dainage and iigation ditches Atificially iigated aeas Atificial lakes o ponds Atificial eflecting o swimming pools Wate-filled depessions except that wate-filled depessions such as those fomed fom quaying can be "wates of the U.S." if the constuction o excavation opeation is abandoned o completed and the body of wate meets the definition of "wates of the U.S." o the site has become a wetland. watebody as a "wate of the U.S." on a case by case basis. The Cops and EPA define wetlands as "Those aeas that ae inundated o satuated by suface o gound wate at a fequency and duation sufficient to suppot, and that unde nomal cicumstances do suppot, a pevalence of vegetation typically adapted fo life in satuated soil conditions. Wetlands geneally include swamps, mashes, bogs and simila aeas." The Cops detemines whethe an aea is a wetland and if an activity equies a pemit. The detemination is based on vegetation, soil and hydology. Befoe issuing a 404 pemit, the Cops will wok with the Depatment of Natual Resouces to get a wate quality cetification called a 401. This cetification is equied unde Section 401 of the Clean Wate Act and state law. 9 Peventing Pollution at Hot Mix Asphalt Plants - Guide Sheet #4 Ai Quality Issues The most common ai pollutants fom hot mix asphalt plants ae paticulate matte with a diamete of no moe than 10 micons (PM 10 ), sulfu dioxide (SO 2 ), nitogen oxides (NO x ), volatile oganic compounds (VOCs) and cabon monoxides (CO). To potect public health and the envionment, asphalt plants ae equied to take steps to potect ai quality. Thee ae seveal ways this is done. The majo ai quality issues affecting asphalt plants ae National Ambient Ai Quality Standads (NAAQS) New Souce Pefomance Standads (NSPS) Emissions Inventoy Questionnaies (EIQs) Constuction Pemits Opeating Pemits Potable Equipment Pemitting It is impotant that you undestand and follow the equiements that apply to you facility. Getting the equied pemits can take time. Remembe to plan ahead when bidding out a job that will equie a pemit. National Ambient Ai Quality Standads (NAAQS) These standads wee set by the U.S. Envionmental Potection Agency to limit the concentation of pollutants in the ai. The standads apply to PM 10, SO 2, NO x and CO, as well as to some othe pollutants. The impact of emissions fom each facility on ambient ai quality is estimated duing the constuction pemit eview. Facilities that have the potential to exceed the NAAQS will have additional equiements. New Souce Pefomance Standads (NSPS) A fedeal egulation called a New Souce Pefomance Standad applies to all hot mix asphalt plants that began constuction o modification afte a manufactue date of June 11, This standad limits the paticulate emissions fom you plant. To show that the asphalt plant will meet these emissions limits, you will need a pefomance test at you plant. Geneally, the test should be done within six months afte the plant gets an ai constuction pemit. A qualified fedeal o state obseve must witness the pefomance test. This means you will need to coodinate the testing date and time with the qualified obseve well in advance. Emissions fom hot mix asphalt plants ae limited to a ate not to exceed 90 mg/dscm, (milligams/dy standad cubic mete). Opacity fom the plant is not to exceed 20 pecent. (See guide sheet #6 fo moe infomation.) Emissions Inventoy Questionnaie By Apil 1 each yea, you must submit an Emission Inventoy Questionnaie and emission fees fo you asphalt plant to the Depatment of Natual Resouces o you local ai pollution contol agency. The EIQ includes pocess infomation, emission data and fee calculations. (See guide sheet #9 fo moe infomation.) 11 Peventing Pollution at Hot Mix Asphalt Plants - Guide Sheet #5 Ai Quality Constuction Pemits If you want to set up o change an asphaltic concete (hot mix asphalt) plant, you need an ai constuction pemit fom the Missoui Depatment of Natual Resouces (DNR) o local ai pollution contol agency office. You must have this pemit befoe you begin constuction, set up o modification of you asphalt plant. The most common ai pollutants fom hot mix asphalt plants ae paticulate matte (PM 10 ), sulfu dioxide (SO 2 ), nitogen oxides (NO x ), volatile oganic compounds (VOCs) and cabon monoxide (CO). PM 10 is paticulate matte with a diamete of no moe than 10 micons. National Ambient Ai Quality Standads (NAAQS) have been set to limit the concentations of PM 10, SO 2, NO x, and CO in the ai to potect public health. Asphalt plants set up, constucted o modified afte May 13, 1982, must have an ai constuction pemit. To get this pemit, you need to complete ai constuction pemit application foms and submit the foms to DNR o you local ai pollution contol agency, listed on the back of this guide sheet. Application foms include an Application fo Authoity to Constuct, and a Constuction Pemit Emissions Inventoy Questionnaie. Infomation equested on the foms include the location of the plant and a dawing o map of the site layout with the length and position of haul oads, stoage piles and plant equipment. You will need to list the pocess equipment that will be used, the date it was manufactued, the seial numbe and the ated design pefomance of each piece of pocess equipment. You will also be asked the expected annual asphalt poduction and fuel use. The application fee is $100, and you will be chaged a $50 pe hou pocessing fee. When DNR o the local ai pollution contol agency eceives a pemit application, the staff eviews it fo completeness. This is called the administative eview. Administative eview will take no moe than 30 days. Howeve, if the application is incomplete, the total time fom you oiginal submittal to final appoval may be longe. If the application is found to be incomplete, you will eceive a equest fo moe infomation. When that infomation is eceived, the administative eview may take up to an additional 30 days. Once the agency detemines that the application is complete, the staff will conduct a technical eview. 13 Peventing Pollution at Hot Mix Asphalt Plants - Guide Sheet #6 Ai Quality New Souce Pefomance Standad A fedeal egulation called a New Souce Pefomance Standad (NSPS) applies to all hot mix asphalt plants that commenced constuction o modification afte June 11, This standad limits the paticulate emissions to a ate not to exceed 90 milligams pe dy standad cubic mete (mg/dscm), and that the opacity fom the plant not to exceed 20 pecent. The opeation of an asphalt plant causes the emission of many diffeent pollutants. The most common pollutants emitted fom hot mix asphalt plants ae paticulate matte (PM10), sulfu dioxide (SO 2 ), nitogen oxides (NO x ), volatile oganic compounds (VOCs), and cabon monoxides (CO). PM10, is paticulate matte that has a diamete of no moe than 10 micons. National Ambient Ai Quality Standads (NAAQS) have been established to limit the concentations of PM10, SO 2, NO x and CO in the ambient ai to levels that will potect the public health and welfae. In ode to demonstate that the asphalt plant will comply with these emissions limitations, a pefomance test must be done, geneally within six months of the plant obtaining its ai constuction pemit (see Ai Quality Constuction Pemit guide sheet #5). The pefomance test must be witnessed by a qualified fedeal o state obseve. This means in ode to have a valid stack test pefomed, you will have to coodinate the stack testing date and time with the qualified obseve and pobably a consultant well in advance of the actual date of the stack testing. Commenced means, in this egulation, that an owne o opeato has undetaken a continuous pogam of constuction o modification o that an owne o opeato has enteed into a contactual obligation to undetake and complete, within a easonable time, a continuous pogam of constuction o modification. Constuction means fabication, eection o installation of an affected facility. 15 Peventing Pollution at Hot Mix Asphalt Plants - Guide Sheet #7 Ai Quality Opeating Pemits All asphaltic concete (hot mix asphalt) plants must complete an ai opeating pemit application and submit it to the Missoui Depatment of Natual Resouces (DNR) o appopiate local ai pollution contol agency. The most common pollutants fom hot mix asphalt plants ae paticulate matte (PM10), sulfu dioxide (SO 2 ), nitogen oxides (NO x ), volatile oganic compounds (VOCs) and cabon monoxide (CO). PM10 is paticulate matte with a diamete of 10 micons o less. The ai opeating pemit egulation has thee application levels o classifications: Basic Souces Intemediate Souces Pat 70 Souces The classification system is based on potential emissions, o the amount of emissions that would be geneated if a facility opeated at 100 pecent of its ated capacity 24 hous a day fo 365 days a yea. This is often called the Potential to Emit (PTE). The U.S. Envionmental Potection Agency set emission levels, called majo thesholds, above which a facility must follow cetain ules. Fo asphalt plants, the majo theshold fo PM10, SO 2, NO x, VOCs and CO is PTE of 100 tons pe yea o moe. Basic souces ae asphalt plants with potential ai emissions below the majo theshold levels. Intemediate souces have potential ai emissions above majo theshold levels, but actual ai emissions below these levels. If you plant has a PTE of 100 tons pe yea o moe of the listed ai pollutants, but won't actually emit that much, you may choose to apply as an intemediate souce. You do this by poposing in you application to estict poduction and by accepting estictions in you pemit that limit potential emissions. Pat 70 souces have potential emissions that ae above majo theshold levels. Pat 70 souces ae sometimes called Majo Souces. If you plant could potentially emit 100 tons o moe pe yea of any of the pollutants listed, it is a Pat 70 souce. Remembe, though, that if you will actually emit less than that, you can apply as an intemediate souce. If you PTE is less than 100 tons pe yea of the listed pollutants, you can choose to apply fo a basic, intemediate o Pat 70 pemit. Some small plants may choose to apply fo intemediate o Pat 70 pemits to allow fo expansion in the futue. MISSOURI DEPARTMENT OF NATURAL RESOURCES Pinted on ecycled, pocess-chloine-fee pape with 20% post-consume content. PUB *PUB000552*

16 If you PTE is ove 100 tons pe yea, you can choose to apply fo eithe an intemediate pemit, o a Pat 70 pemit. Howeve, if you ae coveed by the New Souce Pefomance Standads (NSPS) (if you plant was set up, constucted o changed afte June 11, 1973) and you eceive an intemediate pemit, you will need to upgade to a Pat 70 pemit by Novembe 15, This upgade equiement may change, so contact DNR o you local ai pollution contol agency befoe applying. If you ae applying fo a basic o intemediate pemit fo a new plant, the application is due no late than 30 days afte the plant begins opeating. Applications fo new Pat 70 pemits ae due within 12 months afte the plant begins opeating. If you have an asphalt plant and you have not submitted an application fo an opeating pemit, you need to do so as soon as possible. DNR's can help you decide what ules apply to you fo ai pemitting. 21 Peventing Pollution at Hot Mix Asphalt Plants - Guide Sheet #10 Antifeeze Antifeeze is usually made of ethylene glycol, coosion inhibitos and foam contolles. Ethylene glycol is toxic if ingested. It is paticulaly dangeous because animals and childen ae attacted to its sweet flavo. If they dink the ethylene glycol, it may cause coma o death. Some antifeeze is made of popylene glycol. This mateial is less hazadous to humans and animals than ethylene glycol. The used antifeeze fom a vehicle can hold contaminants that it picks up fom the vehicle engine. Fo example, used antifeeze may contain lead because the antifeeze has dissolved some of the lead solde in the adiato. Waste antifeeze is not cuently a listed hazadous waste unde the fedeal hazadous waste egulations. Howeve, it may be a hazadous waste because of contaminants it has picked up. The test to detemine if used antifeeze is a hazadous waste is called the Toxicity Chaacteistic Leaching Pocedue (TCLP). See guide sheet #14, Hazadous Wastes, fo moe infomation. Recent studies have shown that used antifeeze fom automobiles manufactued afte 1995 is not hazadous waste. This is pimaily because less lead is used in adiato constuction. Used antifeeze is moe likely to be hazadous if it was used in heavy equipment such as bulldozes and buses. This means that antifeeze fom late-model cas and tucks that has not been mixed with othe antifeeze o with othe hazadous wastes does not need to be tested. In this case, you may assume that it is not hazadous and need not test it. Howeve, used antifeeze fom heavy equipment o industial souces will need to be tested to see if it is hazadous waste unless you have some othe way of knowing that it is o is not hazadous. If you wish, you can assume the antifeeze fom you heavy equipment is hazadous without testing it. You would then need to dispose of it as hazadous waste. Thee ae seveal ways to safely and legally manage you used antifeeze: Recycle the antifeeze at you facility (on site ecycling). Send the antifeeze to someone else to eithe ecycle o dispose of it (off site ecycling o disposal). Dischage to public wastewate teatment plant if the plant has appoved the dischage. Recycling The Missoui Depatment of Natual Resouces (DNR) stongly encouages antifeeze ecycling. You can puchase o lease seveal types of antifeeze ecycling equipment. If you want to ecycle you hazadous waste antifeeze on site, you must notify DNR of you ecycling activities. If you ecycle 2,200 pounds o moe in a month, you need a esouce ecovey cetification. Fo moe infomation, contact DNR at MISSOURI DEPARTMENT OF NATURAL RESOURCES Pinted on ecycled, pocess-chloine-fee pape with 20% post-consume content. PUB *PUB000555*

22 If you ecycle antifeeze only fom late-model cas and tucks, you do not need a esouce ecovey cetification. You ecycling unit will ceate waste such as distillation esidues o used filtes. You must detemine if these wastes ae hazadous befoe disposal. See guide sheet #14, Hazadous Waste, fo moe infomation. If the esidue is nonhazadous and is not a liquid, it can be sent to the landfill with you egula tash. Liquid wastes cannot go to the landfill. Thee may be businesses that will bing equipment to you facility and ecycle you antifeeze on site. Again, if the antifeeze is fom late model cas and tucks, these companies do not need esouce ecovey cetification. If it is fom heavy equipment o olde vehicles, these companies will need esouce ecovey cetification to ecycle you antifeeze. Off site Recycling o Disposal. Thee ae companies that pick up used antifeeze fo off site ecycling o disposal. If you used antifeeze is a hazadous waste, the tanspote must have a Missoui license to tanspot hazadous waste, and the waste must have a hazadous waste manifest with it. Make sue the facility you send it to has a esouce ecovey cetification o a hazadous waste teatment, stoage and disposal pemit. Dischage to wastewate teatment plant (pouing it down the dain). If the dains at you facility go to a wastewate teatment plant, not a septic system, you may be able to pou antifeeze down the dain if you have pemission fom the plant. Pouing wastes down the dain is called a dischage. Some wastewate plants will not allow dischages of used antifeeze. Lage quantities can ham the teatment plant. The wastewate teatment plant may not be able to emove all the contaminants fom the used antifeeze. The contaminants then ente lakes, steams and ives. Remembe Antifeeze fom heavy equipment may be hazadous waste. Do Not dischage antifeeze to a wastewate plant without pemission. Do Not dischage any hazadous waste, including antifeeze, to a septic system. Do Not dispose of antifeeze on the gound, down stom dains o into steams o lakes. 23 Peventing Pollution at Hot Mix Asphalt Plants - Guide Sheet #11 Backflow Pevention Whethe you business uses wate fom the public wate supply o you have a pivate wate supply such as you own well, it is impotant that you avoid contaminating that wate souce. In some situations, wate, and any contaminants it has come into contact with, can flow backwads in a wate line. This can contaminate the wate in you building and even the entie wate supply. Backflow pevention devices pevent this poblem. If you have places whee the wate line comes into diect contact with a potential contaminant, the contaminant can tavel back into the wate line when thee is a change in pessue. This is called a coss-connection. Fo example, if pocess wate fom you equipment cleaning aea flows back into you wate system, you entie wate system could become contaminated with dit, soap and chemicals fom you dity equipment. Backflow pevention devices o assemblies ae installed in wate lines to keep this fom happening. They ae placed in wate lines enteing the building and at points in the wate system whee it connects to a potential souce of contamination. If you business is connected to a public wate Remembe supply, state egulations equie that you potect the public wate supply fom coss-connections within you pemises. If you opeation could cause contamination to the wate supply, you must have backflow pevention devices in place. Dinking wate egulations equie that the backflow pevention assembly be placed on the wate sevice line. It is a good idea to put additional backflow pevention devices at any location in you business whee contamination could occu. You local wate supplie may have additional equiements egading backflow pevention. Contact that office to find out. Even if you business is not connected to a public wate supply, you should install backflow pevention devices to potect you employees, you customes and youself fom the isk of contaminated dinking wate and to pevent pollution. The Missoui Depatment of Natual Resouces maintains a list of appoved backflow pevention assemblies. To get a copy, call the Technical Assistance Pogam at Peventing backflow into the wate system potects you and anyone using you wate supply. If you ae connected to a public wate supply system, you may be equied to have backflow pevention assemblies o devices. 25 Peventing Pollution at Hot Mix Asphalt Plants - Guide Sheet #12 Endangeed Species Endangeed species ae plants o animals fo which the pospect fo suvival of the species is in immediate jeopady. Thee ae laws to potect these species and, in some cases, thei habitat. This means that some activities may not be allowed in aeas whee endangeed species live. This may affect you if you ae planning to expand opeations o site a new facility. The Missoui Depatment of Consevation (DOC) is the agency esponsible fo collecting and managing infomation on the location and status of endangeed species in the state. Thee ae cuently 306 species of plants and animals that ae listed as State Endangeed. The fedeal list of endangeed and theatened species includes 20 species found in Missoui. The estictions affecting you depend on whethe the species is a plant o animal, whethe the land is pivate popety and whethe you eceive any fedeal funds. To contact DOC s Policy Coodination Section fo geneal infomation, call (573) The booklet, Endangeed Species in Missoui, gives a geneal discussion of the topic of ae and endangeed species. The annually updated Rae and Endangeed Species Checklist of Missoui is a efeence wok listing all of the cuent plants and animals of concen and giving both the fedeal and Missoui status. Thee may be times when you need to detemine if thee ae endangeed species on a popety, such as when you ae developing pemit applications fo a new o expanded site. To get an envionmental eview of a piece of popety, send a equest to DOC by mail. If thee ae no endangeed species associated with the popety, DOC will issue a lette stating so. Even if you ae not equied to have an envionmental eview fo endangeed species, you may wish to do so, paticulaly if you ae planning to puchase popety. When contacting DOC, it is impotant to clealy identify the location of the popety. The infomation should include as many of the following as possible: county, topogaphic quadangle map designation (if known), legal desciption (section, township, ange) and aceage, pemanent landmaks such as ives and oads, and a copy of a map of suitable scale with the location of the popety dawn in and labeled. The equest should be sent to Policy Coodination Section Attn: Policy Coodinato Missoui Depatment of Consevation P.O. 27 Peventing Pollution at Hot Mix Asphalt Plants - Guide Sheet #13 EPCRA and Tie II Repoting Many asphalt plants use and stoe hazadous mateials. These mateials can pose a seious isk to human health and the envionment, paticulaly if you have a fie, flood o othe emegency. Emegency espondes ae at paticula isk if they espond to an emegency whee these mateials ae stoed. In 1986, the fedeal govenment passed the Emegency Planning and Community Right-to- Know Act (EPCRA), sometimes called SARA Title III. Missoui also has its own Community Right-to-Know Law. These laws equie states, communities and businesses to wok togethe on emegency plans fo accidental chemical eleases, emegency notification pocedues, toxic emissions epoting and compiling an inventoy of hazadous chemicals fo planning and public eview. Missoui's law has epoting equiements fo hazadous mateials. It also equies makings on buildings, ooms and containes whee hazadous chemicals ae pesent. Makings ae to confom with National Fie Potection Association (NFPA) 704 standad. get a list of mateials egulated unde EPCRA. Depending on the type and quantity of mateial, you may need to Complete a Tie II Fom. Designate a facility coodinato to wok with the Local Emegency Planning Committee (LEPC). Notify DNR and the National Response Cente if you have a elease (spill). File a Fom R. Tie II Foms To get a list of substances that equie a Tie II fom and the theshold planning quantities, o to get a Tie II fom and instuctions, contact DPS at You need to complete a Tie II if you have an extemely hazadous substance ove the theshold planning quantity o ove 500 pounds, whicheve is lowe, o moe than 10,000 pounds of any hazadous chemicals fo which a mateial safety data sheet (MSDS) is equied unde Occupational Safety and Health Administation (OSHA's) Hazad Communication Standad. In Missoui, EPCRA, is administeed by both the Missoui Depatment of Natual Resouces (DNR) and the Missoui Depatment of Public Safety (DPS). To comply with EPCRA you need to find out if you have a egulated mateial in a egulated quantity. You can contact eithe DNR o DPS to If you need to submit a Tie II, you also must pay a fee. Fo asphalt plants, the fee will typically be $100, plus $20 fo each epoted chemical ove thee. Most of this money is used to suppot local effots to pevent and pepae fo chemical hazads and fo hazadous mateials taining. MISSOURI DEPARTMENT OF NATURAL RESOURCES Pinted on ecycled, pocess-chloine-fee pape with 20% post-consume content. PUB *PUB000558*

28 The Tie II fom with the fee is submitted yealy on Mach 1 to the Missoui Emegency Response Commission (MERC). You also must send copies of the Tie II fom to you Local Emegency Planning Committee (LEPC) and the appopiate local fie depatment. Facility Coodinato If you have an extemely hazadous substance in amounts ove the theshold planning quantity, you must choose a peson at you facility to wok with the LEPC. This peson will be the fist emegency contact listed in the Tie II fom. Spill Notification If you have a spill (elease) of an extemely hazadous substance o hazadous substance in excess of the epotable quantity, you must call DNR at (573) and call 911 (o appopiate emegency esponse numbe), and call the National Response Cente at You also must follow up with a witten epot to the MERC and LEPC discussing the esponse measues taken and health infomation. Fom R To get a list of toxic chemicals o a Fom R, contact DNR at You need to complete a Fom R if you facility has an SIC (Standad Industial Classification) Code that begins with the numbes 20-39; has moe than 10 employees, and manufactues, pocesses o othewise uses cetain toxic chemicals in excess of theshold quantities (25,000 o 10,000 pounds). Remembe If you have 10,000 pounds of a chemical needing an MSDS unde OSHA Hazad Communication Standad o if you have ove 500 pounds (o the theshold planning quantity) of an extemely hazadous substance, you must submit a completed Tie II fom to the fie depatment, the LEPC and the MERC. 29 Peventing Pollution at Hot Mix Asphalt Plants - Guide Sheet #14 Hazadous Waste Note: The fedeal equiements fo hazadous waste can be found in the Code of Fedeal Regulations, Title 40, Pat 260 though Pat 280 (40 CFR ). The Missoui Hazadous Waste Law is in the Revised Statutes of Missoui (RSMo), Sections The hazadous waste ules ae in the Code of State Regulations, Title 10, Division 25 (10 CSR 25). To get infomation on the egulations, call the Missoui Depatment of Natual Resouces (DNR) at o the fedeal govenment's Supefund/RCRA Hotline at Some activities at you asphalt plant may esult in the geneation of hazadous waste. It is vey impotant that you find out if you wastes ae hazadous and that you follow the law when managing the wastes. What is a Hazadous Waste? A waste is a mateial that you no longe use and will discad. It can be a solid, liquid o gas. A waste is hazadous if it has popeties that could be dangeous to human health and the envionment. Solvents and paints ae examples of wastes that could be hazadous. It is you esponsibility to find out if you waste is hazadous. A waste is hazadous if it is listed as a hazadous waste in the fedeal egulations; it exhibits a hazadous chaacteistic; it is a hazadous waste by Missoui law; o it is a mixtue of a listed hazadous waste and any othe waste. Listed Hazadous Waste The fedeal govenment publishes lists of hazadous wastes. Thee ae fou diffeent lists: the F list, the K list, the P list and the U list. Wastes that ae on the P list ae called "acutely hazadous" and ae egulated moe stictly than the othe types. Chaacteistic Hazadous Waste Some wastes that ae not on the lists may still be egulated hazadous wastes because they have chaacteistics that make them hazadous. Thee ae fou chaacteistics: Ignitable A waste with a flashpoint of less than 140 F, o solids that catch fie easily and bun so apidly they ceate a hazad. Some solvents ae ignitable. Coosive A waste with a ph less than o equal to 2.0 o geate than o equal to An example is battey acid. Reactive Wastes that ae nomally unstable, eact violently with wate, can explode o elease poisonous gases. Toxic Wastes with high concentations of cetain oganic chemicals, heavy metals o pesticides when tested by the Toxicity Chaacteistic Leaching Pocedue (TCLP). The chemicals consideed toxic ae included on a list in the fedeal egulations. Missoui-specific Hazadous Waste An individual state can egulate wastes as hazadous even if they ae not on the fedeal list. Fo example, in Missoui cetain dioxin wastes ae egulated at smalle quantities than in the fedeal ules. MISSOURI DEPARTMENT OF NATURAL RESOURCES Pinted on ecycled, pocess-chloine-fee pape with 20% post-consume content. PUB *PUB000559*

30 Mixed Waste If you mix any waste with a waste that is on the F, P, K o U list, all of it is hazadous, even if thee is only a vey small amount of listed hazadous waste in the mixtue. Is You Waste Hazadous? To find out if you waste is hazadous, check to see if it is on the lists of hazadous wastes o if it is a hazadous waste in Missoui. If it is not, you need to find out if it exhibits one o moe of the hazadous chaacteistics. Check the mateial safety data sheet (MSDS) o contact you supplie fo infomation. If you ae unsue if you waste is hazadous, you will need to have it tested in a laboatoy. Contact DNR at fo help with this. Managing Hazadous Wastes. Thee ae vey specific equiements fo managing hazadous waste fom you business. The equiements you must meet depend on what and how much waste you geneate. You need to know how much acutely hazadous waste (P-listed) and non-acute hazadous waste you geneate each month. You also need to know how much of each of these types of waste you accumulate at any one time. Use the following infomation to detemine you geneato status. See guide sheet #15, Hazadous Waste Management, fo moe infomation on how to label, stoe and dispose of you hazadous waste. What Type of Geneato Ae You? Thee ae thee types of geneatos: Lage Quantity Geneato (LQG), Small Quantity Geneato (SQG) and Conditionally Exempt Geneato (CEG). Hee ae some geneal guidelines to help you decide what type of geneato you ae: If you geneate in one month o accumulate at any one time moe than 1 kg (2.2 pounds) of acutely hazadous waste you ae an LQG. 1,000 kg (2,200 pounds) o moe of nonacute hazadous waste you ae an LQG. moe than 100 kg (about 220 pounds), but less than 1,000 kg (2,200 pounds) of non-acute hazadous waste and less than 1 kg of acutely hazadous waste you ae an SQG. no moe than 100 kg (220 pounds) of nonacute hazadous waste and less than 1 kg of acutely hazadous waste you ae a CEG. In Missoui, anyone geneating one gam o moe of dioxin waste (2,3,7,8- tetachloodibenzo-p-dioxin) is an LQG. If you ae a SQG o LQG you must egiste with DNR and get a geneato identification numbe. You also must follow egulations on stoage, tanspot, ecodkeeping and epoting. Call DNR fo moe infomation. Fo moe infomation call o wite to Missoui Depatment of Natual Resouces P.O.
