3 Ref: BLMCL/MD/JPR/13-14/33 Dated: 23-Sep-2013 Tender Notice Sealed tender is invited from the reputed NGOs/Organizations having vast knowledge, experience and credibility of undertaking Social Audit/Social Impact Assessment for the following work at Kapurdi and Jalipa Lignite blocks. Tender documents are also available to the prospective bidders on portal for viewing and downloading. The bidders, in their own interest are requested to read very carefully the bid document before submitting the bid up to the time & date as specified above. The bidders downloading the bid from the portal will be required to deposit a bank draft of Rs. 500/- drawn in favour of Barmer Lignite Mining Company Limited payable at Jaipur. Such bank draft will be enclosed with documents in Envelop-I. The tender will be received up to 3:30 PM of and opened on same day at 5:00 PM in the Jaipur Office. The EMD should be deposited in the form of Bank draft drawn in favor of Barmer Lignite Mining Company Limited payable at Jaipur. Tender without EMD will be summarily rejected. Tender should be submitted in two parts i.e. Envelop-I & Envelop-II duly superscribed with NIT Nos. Envelop -I will contain the technical offer and EMD Bank Draft while Envelop-II will contain the commercial offer (Price Bid). Both envelops will further be enclosed in a single Envelop which will be super scribed with name and address of tenderer, tender number along with date of opening. Page 3 of 10

4 Ministry of Coal, Govt. of India in the year 2006 has allotted two lignite blocks to Rajasthan State Mines & Minerals Limited (RSMML) for mining of lignite on the condition that mining shall be carried out by RSMML or a separate company to be created with participation of RSMML provided that the separate created company is a Govt. Company eligible to do lignite mining in line with the provisions of Coal (Nationalization) Act, RSMML formed a Joint Venture company with RajWest Power Limited named Barmer Lignite Mining Company Limited (BLMCL) for carrying out mining operations in Kapurdi & Jalipa lignite blocks. Land for these blocks has been acquired by RSMML through Land Acquisition Act, R&R though a state subject, was linked to land acquisition through Govt. of Rajasthan (NRRP 2007 also permits such settlement of R&R vide its point no which reads as following The affected families may be given the option to take a lump sum amount in lieu of one or more of the benefits specified in paragraphs 7.2 to 7.19, the amount being determined by the appropriate Government after consultation with the requiring body). In the year 2009, Govt. of Rajasthan in consultation with representatives of local population and RSMML fixed a rate of Rs Lacs per Bigha of land for Kapurdi Lignite Block which included price for land, solatium, interest on delayed payment, standing trees etc. but did not include the compensation for permanent structures over such land. The payment towards the above said permanent structures was separately assessed and paid in addition to the above. Acquisition was made through 272 Land Acquisition Prakarans (Cases) spread over the 7 villages in Barmer district of Rajasthan. In Kapurdi block, mine development was started in 2010 and almost all khatedari land owners have vacated their establishments and shifted almost within a range of 10 Kms radius. In the year 2011, Govt. of Rajasthan in consultation with representative of local population of Khatedars and RSMML fixed a rate of Rs Lacs per bigha of land for Jalipa lignite block which included price for land, solatium, interest on delayed payment, standing trees etc. but did not include the compensation for permanent structures over such land. The payment towards the above said permanent structures was separately assessed and paid in addition to the above. This acquisition was made through the 417 Land Acquisition Prakarans (Cases) spread over the 7 villages in Barmer district of Rajasthan. In case of Jalipa acquisitions, Khatedars of 92% of the total khatedari land have accepted the award money at the rate of Rs. 3 Lacs per bigha. Some of the khatedari land owners have migrated but majority of them is still within the Jalipa lignite block area. Page 4 of 10

The terms of reference will be as below: 1. Changes in earnings from agriculture land as crop revenues, other businesses associated in the then villages, handicrafts, artisans/folk musicians, livestock. 2. Gains of families by way of alternative sources of income. 3. Gains of families by way of alternative employment opportunities in Kapurdi/ Jalipa projects or other ancillary projects. 4. Gains of families by other indirect employment opportunities. 5. Socio, economic and cultural study of the community in the light of compensation package. 6. Changes in standard of living. 7. Educational growth, institutions, subjects chosen and planning for career in academics and professions. 8. Impact of displacement on family fabric and socialization. 9. Kind of social work they are in need and their aspirations/road map for CSR. 10. Changing scenario of Gender and equity after the acquisition. 11. Adoption of modern agriculture technique in farming and modern architecture in the construction of houses. 12. Addressing the issues of sanitation, environment, female education, cleanliness and public health. 13. Quality of connectivity to residential area before and after land acquisition. 14. Daily distance travelled by villagers specially ladies to collect water before and after acquisition. 15. Adult literacy rate, both sexes 16. Average annual population growth rate 17. Terms and Conditions of EMD: The Earnest Money to be deposited will not carry any interest. Terms and Conditions of NIT: Envelop No. I should contain following: 1. EMD 2. A certificate towards unconditional price bid. 3. Attested copy of Articles of Association / Proprietary Certificate / Partnership Deed, as applicable. 4. Photo copy of Power of Attorney / Board Resolution authorizing the person to represent the NGO / Organization. 5. Service Tax Registration Certificate. 6. Copy of PAN card and latest Income Tax Return. 7. Copy of registration with Govt. of Rajasthan and / or Govt. of India. 8. In case of downloading of the tender document from BLMCL portal, a bank draft of Rs. 500 drawn in favour of Barmer Lignite Mining Company Limited payable at Jaipur. 9. Proof of Experience as per the Bidder s Qualification criteria mentioned below. The bidder shall enclose the copies of earlier Work Orders, Completion Certificates, Bill Copies etc. Bidder s Qualification: The bidder must have in its own name successfully completed similar works in India during last 3 years. Eligibility should be the following: (a) Three similar completed works each costing not less than Rs Lacs. OR (b) Two similar completed works each costing not less than Rs Lacs. Page 7 of 10

8 Other Instructions to Bidders: 1. All document enclosed in Part-I must be legible, duly stamped with their company / firm seal and signed properly by the person authorized by the NGO / Organization for submission of the bid. 2. Part-II should contain price bid only, duly printed or typed. Hand written bids will not be accepted. Price bid should be submitted in the proforma enclosed as Annexure-A. 3. Price Bids will be considered only in the prescribed form. Bids not submitted in the prescribed format will be summarily rejected. Also, bidders should refrain from providing the information which is not relevant. 4. All the communication / correspondence including the bid document (Part I & Part - II) must be signed and stamped on each page by the designated authorized representative of the bidder failing which the bid will be summarily rejected. 5. BLMCL reserves the complete right to accept or reject in part or full any or all the offers without assigning any reasons whatsoever. No further discussion / interaction will be held with the bidders whose bids have been disqualified / rejected by BLMCL. 6. In case, any dispute arises with regard to interpretation / omission / error in this document, bid submitted, other documents; the decision of the Managing Director, BLMCL will be final and binding upon the bidders. 7. Interested bidders may obtain further information from the office of the Associate Vice President, BLMCL, Barmer or from Jaipur Office of BLMCL, on any working day from to between 9:30 AM to 6:00PM. 8. Bid shall be kept valid for 60 days from the last date of submission of the bid. Bid with validity for shorter period shall be liable for rejection. The bid shall be a non-conditional bid and a certificate to the effect shall be signed and included in the bid documents. 9. The bidder shall ensure that bid is furnished / submitted strictly in the prescribed manner. 10. Part-II of the bid will be opened only of such bidders who qualify after opening of Part I. Part-II of such bidders, who do not qualify after opening of Part-I, shall not be opened under any circumstances and will not be returned to the bidder. Page 8 of 10

9 Submission of Report: A draft report according to Terms of Reference is required to be submitted within 60 days of the issue of Work Order. The draft report must be in softcopy only in editable format. After finalization and approval of draft report by BLMCL, final report shall be required to be submitted within 5 working days in softcopy as well as 3 nos. of hardcopies of such finalized report. Terms of Payment: 1. No advance will be paid % of the contract price shall be payable on submission of draft report within 15 days of such submission. 3. The balance 50% of the contract price shall be payable on submission of final report on the basis of bills duly certified by authorized representative of BLMCL within 30 days of such submission. Duties and Taxes: The price quoted must be inclusive of all taxes. TDS will be deducted as per applicable laws. The successful bidder shall comply with all conditions of Minimum Wages Act, Workmen Compensation Act and any other statutory provision applicable at the time of execution of contract. In case of any dispute the matter would be referred to MD, BLMCL whose decision would be final and binding on both the parties.
