1 RailCorp Position Description For more information check the Position Description Guide Section 1: Position Details Position Title: Contracts Manager Position Number : Classification (Grade): Group: Division: Business Unit / Location: Health Assessment Category: RC7 Engineering and Projects Projects Division ATP Program, Burwood Non Rail Safety Worker Date PD Finalised: (Enter as DD/MM/YYYY) PD Approved By (Position Title): PD Approved By (Position ID): GM Projects Division Section 2: Primary Purpose of Position RailCorp is commencing the introduction of the European Train Control System (ETCS), a standardised Automatic Train Protection (ATP) system already operational across Europe and elsewhere in the world. The Contracts Manager is responsible for managing all contracts associated with the implementation of the ATP Program. The Contract Manager will be required to oversee the initiation, development, procurement and execution of ATP contracts. The Contracts Manager is responsible for managing the development of tender and contract documentation and coordinating the procurement process through Strategic Procurement and Supply through to contract award. The Contracts Manager is responsible for ensuring that conduct of the contract is within the stated terms and conditions, supporting the smooth delivery of the program with respect to safety, time, cost, scope and quality guidelines. The Contracts Manager shall review all contractual documentation, identify and manage contractual issues, evaluate variation requests, manage claims and variations, monitor and report on progress of contracts and manage timely contract communication with both the Principal and contractors. The Contracts Manager must maintain full knowledge and understanding of program contracts details and status, to be in a position to make informed contract clarifications, changes, responses to issues arising and other actions required under the contracts. The culture is one that emphasises safety, compliance and probity whilst being customer focussed and quality driven creating a management environment that emphasises safety, compliance and probity The RailCorp executive team has specific responsibilities for creating a management environment that is accountable, has measurable outcomes, encourages and engages staff in the positive process of continual improvement of services, systems and processes. RailCorp requires all staff to behave in a way that will build an environment that is free of bullying and harassment. Automatic Train Protection (ATP) is a generic name used to describe trackside and train-borne systems designed to automatically prevent trains from over speeding or travelling beyond the end of their permitted movement authority. The ATP Program is a major RailCorp initiative to improve rail safety, stemming from Recommendation No. 32 of the Special Commission of Inquiry into the Waterfall Rail Accident. In August 2010 the NSW Government approved funding for the first phase of implementation of RailCorp s chosen ATP technology, the European Train Control System (ETCS). This initial ETCS implementation phase will fit trackside equipment to approximately 40% of the RailCorp network and to the OSCar and Tangara rolling stock fleets. The ATP Program team has been established within the Projects Division of the Engineering and Projects group manage the deployment of the ETCS system within the RailCorp network. Section 4: Reporting Relationships This Position Reports to: ATP Program and Support Manager Direct Reports: The number of direct reports for the position, along with the position titles of those direct report positions. Contracts Engineer Contracts Officer Section 5: Budget Responsibilities & Delegations Budget responsibility and financial delegations for the position: i.e. The $ amount that the position is authorised to spend. 3 Section 6: Key Working Relationships Key working relationships will need to be developed and maintained with diverse groups within RailCorp including: General Council - Legal Services Safety and Environment Finance and Corporate Services - Strategic Procurement and Supply - Finance and Administration, Asset Management - Business Services - Insurance and Claims Management Engineering and Projects - Projects Division, Commercial Strategy (Novo Rail) - Projects Division, Capital Portfolio Operations - Projects Division, Governance & Quality - Projects Division, Operational Risk (Safety and Environment) The key external focus of this position would include: Section 7: The Independent Transport Safety Regulator (ITSR) Treasury ETCS System Suppliers Rail Unions Other Rail organisations Special Conditions / Requirements Special requirements or conditions specific to the position: N/A Section 8: Key Accountabilities and Associated Tasks Contract Management Comply with Procurement, Safety and Environmental Policies, Procedures and instructions that apply to contracts and ensure all safety issues are addressed throughout the contract process. Manage contractual issues and documentation relating to program to ensure the smooth delivery of the Projects with respect to safety, time, cost, scope and quality guidelines Manage the contract risk by ensuring the risks are identified and mitigation activities are established and monitored Prepare tender documents and submissions in a format consistent with RailCorp policy and procedures Manage the variation and compliance process so that they can be handled in a timely, efficient and objective manner Ensure documentation is consistent with contractual agreements, project objectives and project timeframes Ensure all documentation prepared is consistent with Contract requirements and that they protect the interests of RailCorp Monitor, evaluate and report on contractor performance against contractual agreements and project plans and identify non-compliance or default Authoriser: GM HR Operations Page 3 of 7
4 Leadership Provide leadership by negotiating issues and identifying solutions with key internal and external stakeholders Staff Management Supervise staff / contractors (where applicable) to ensure that best practice is maintained in the scope and delivery of projects Foster and participate in a co-operative team environment Ensure implementation of a system of performance measurements to drive the effective and efficient utilisation of resources and achievement of agreed outcomes Monitor and manage group performance to enable ongoing improvement to outcomes Implement RailCorp s Performance Development Scheme Ensure all staff have the knowledge and skill to operate competently in a project management environment and provide for staff development and succession planning Observe RailCorp HR policies and procedures Ensure that Project and Contract Completion reports are provided as part of project finalisation Relationship Management Develop productive, professional working relationships with contractors that will ensure that the best result is delivered for both RailCorp and the Contractor Develop a constructive relationship with Contractors that is characterised by behaviours consistent with partnering and/or alliance and a team approach to delivering the project Identify and communicate to the relevant parties their contractual obligations in terms of the Rollingstock projects to ensure they are informed of project objectives, timeframes, schedules and costs constraints Provide feedback to the contractor and recommendations regarding corrective action or the issuing of claims Monitor and report on the progress of the contract in accordance with Contractual and established frameworks Reporting and Information Ensure full knowledge and understanding of the contract and its status, including contract clarifications, changes, issues arising and actions required under the Contract, with specific emphasis on the needs of RailCorp and provide advice on and communicate this information to relevant stakeholders. Ensure detailed progress reports are provided to the respective Project Control Groups to ensure their understanding of the status of the projects Advise Program Manager and Senior Project Managers on issues arising, contract clarifications and actions required under the contract Section 9: Safety Accountability All RailCorp staff are required to comply with the System Requirement, Safety Responsibilities, Authorities and Accountabilities, within the Safety Management System. 5 Section 10: Compliance Accountabilities All RailCorp staff are required to comply with all accountabilities specific to their position. Senior Managers are required to include specific KPI s from the Compliance KPI Matrix in their PDP. All RailCorp staff are required to comply with all accountabilities specific to their position and management level including the accountabilities outlined in the Management Accountability Framework. 6 Section 15: Experience Included here are essential and desirable experiences required for the position Extensive experience with tender creation and final presentation Extensive experience in contract preparation, tender management and procurement within a large government organisation of significant scale Extensive experience in the coordination, interpretation and review of internal and external legal, risk assurance, procurement and probity advice Extensive experience in ensuring government probity requirements are met Section 16: Behavioural Competencies Below are the essential behaviours that need to be demonstrated on a day-to-day basis. They describe how the work of the position needs to be completed. Other managers, team leaders and supervisors must promote RailCorp values and ethics. Be aware of and apply ethical standards at all times ensuring regular access to information to ensure currency in ethical knowledge Declare potential conflicts of interest. They must also demonstrate knowledge and awareness of RailCorp s probity and ethical standards Other managers, team leaders and supervisors are able to demonstrate ability to promote and monitor workplace practices and procedures to prevent and detect fraud and corruption Tertiary qualifications in a supply management related field, commerce, engineering or equivalent experience Demonstrated ability and experience in an operational contract role including tendering, administration or management for a minimum of 5 years Experience in managing tendering processes and providing specialist support to a complex tender evaluation Commercial awareness of contract terms and conditions Experience in coordinating the input of internal and external legal, probity, risk and procurement advisors and specialists to a complex tender Demonstrated ability to actively manage relationships with key internal and external stakeholders Exceptional issues management skills and the ability to anticipate and address contentious issues to finality before they become problems Authoriser: GM HR Operations Page 7 of 7
