The Commission s core roles include reviewing and assessing applications for industry activity, consulting with First Nations, ensuring industry complies with provincial legislation and cooperating with partner agencies. The public interest is protected through the objectives of ensuring public safety, protecting the environment, conserving petroleum resources and ensuring equitable participation in production. PURPOSE OF POSITION The position of Heritage Conservation Program Assistant (HCPA) provides technical support for the archaeological component of oil and gas applications and operations within the archaeology unit of the Commission. The archaeology unit consists of the Heritage Conservation Program Manager (manager) and the Cultural Heritage Resource Officer (resource officer) and the HCPA. The processes within the archaeology unit are guided by the Heritage Conservation Act (HCA) (RSBS 1996 Chap 187) and the Oil and Gas Activities Act (OGAA). Specific agreements and documents that support this legislation are the Protocol Agreement between the Commission and the Archaeology Branch of the Ministry of Forests, Lands and Natural Resource Operations (FLNRO), the Commission s Archaeology Guidelines, the Archaeology Audit Program Procedure Manual and a specified enactment for the HCA (section 12). NATURE OF WORK AND POSITION LINKS The functions of the archaeology unit ensure oil and gas clients and archaeologists working in the oil and gas industry are in compliance with and support the Heritage Conservation Act (HCA) (RSBS 1996 Chap 187) and the Oil and Gas Activities Act (OGAA). 3 apply to the archaeological component of oil and gas applications and operations for all of British Columbia. The position is responsible for sharing information with Commission staff and providing advice and direction to clients, agents and stakeholders regarding application and submission processes. The HCPA also provides information and tracks report submission to the Ministry of Forests, Lands and Natural Resource Operations. This position provides information, coordinates schedules, and attends oil and gas client audits as part of the performance-based review process for archaeology at the Commission. SPECIFIC ACCOUNTABILITIES / DELIVERABLES Oil and Gas Application Activities Commission Guidelines for Archaeology and OGAA Directs all incoming archaeological documents to the appropriate area for the required review Reviews archaeological paperwork component of well and pipeline applications and inputs into IRIS/Kermit Identifies application specific deficiencies as they relate to the Archaeological Assessment Information Form (AAIF) and informs clients and agents (applicants) and archaeologists of changes required to comply with relevant permits, guidelines and Commission policy. Requests any additional data/information from clients and agents (applicants) and archaeologists (such as archaeology impact assessment (AIA) reports) that may be required for the review of application documents Translates recommendations from archaeologists for archaeology site management into appropriate conditions for approval of oil and gas permits Ensures oil and gas clients have met the reporting aspects of the terms and conditions specified in permits and guidelines Provide assistance to other Commission staff for application processes and compliance and enforcement issues. Monitors weekly work ledgers within IRIS database Archaeology Audit Program: Archaeology Audit Program Procedure Manual Requests audit sample from Commission s operational Analysis and Audit unit, based on parameters set out by the program manager Creates all supporting blank recording tables based on established parameters Schedules all audit appointments for document and field audits directly with clients, agents and construction supervisors and records all communications with auditee contacts into spread sheet Researches and prepares deficiency reports for audited clients indicating all outstanding permit and guideline requirements in preparation for their audit Arranges auditor s visits to Fort Nelson or other out-of-town locations (bookings of truck, cell phone, SPOT, hotels, meeting places on site, etc.) Compiles and organizes audit packages for document audits, which includes all questionnaire modules, all relevant AIA reports, AAIFs, commission file and any advance submissions provided by the auditee. Compiles and organizes audit packages for field audits (similar to document audit), but also obtains maps with project locations, all archaeology site locations related to the audited Page 2 of 6
4 project, access route, construction plan maps, site inventory forms, reports and auditee names with confirmed means of contact during travel. If required, arranges with the auditee for helicopter access for auditor to remote locations Supports manager and resource officer (auditors) during document and field audits by recording proceedings, organizing required paperwork into individual files and transcribing all recordings into appropriate tables and data bases. If HCPA cannot attend field or office audit, arrange for other commission staff member to be present and coordinates commission employees schedules Engages First Nations, provides information packages for audit and invites participation in all field audits Heritage Conservation Act (HCA) Section 14 (Protocol Agreement with the Archaeology Branch) Examines archaeologist s information from forms and reports and compares oil and gas application with Heritage Conservation Act section 14 permit conditions to ensure permits are valid for date, the area of development and the developer/oil and gas client Organizes and tracks permit applications and permits issued under section 14 of the Heritage Conservation Act Requests missing information from archaeologists such as client certifications and project notifications that, without submission, constitutes a breach of permit conditions Submits reconciliation reports of section 14 permit holders submissions and deficiencies to manager and resource officer; these reports are required for review of final reports by manager and resource officer Proposes required data keeping system upgrades to accommodate changing needs of the archaeology unit. Included capabilities are manipulation and redesign suggestions for the Access archaeology data base, improved electronic submission processes for clients and archaeologists, and other process improvements that would facilitate efficiency to the unit s day-to-day information flow Section 12 (specified enactment under OGAA) Creates appropriate permit application documents for section 12 applicants and distributes to the First Nation Liaison Officers for delivery to First Nations communities Distributes final application and permit documents for permits issued under section 12 of the Heritage Conservation Act. Reporting Out: Provide quarterly and annual statistics of archaeology department to the Director of First Nations Relations group. Statistics are gathered through the archaeology internal database and spreadsheets and includes non-compliance reports, section 12 applications, section 14 applications and reports, reviews for all applications (IRIS/Kermit), AIA reviews and data entry, education events, field visits and field inspections. Prepares requests and in some instances, business cases for IT department for reporting out of IRIS and Kermit programs relating to all archaeology business Confidentiality: Compiles confidential and relevant material for enforcement investigations as it pertains to breaches in legislation (HCA or OGAA) Page 3 of 6
5 May be compelled to provide evidence or relate chain of events as it relates their involvement in a file for which a non-compliance has been found. This may include written and/or verbal statements to Manager of Enforcement and possibly as a legal witness (court) Keeps confidential records and proceedings of oil and gas client audits Keeps confidential breaches of HCA by oil and gas clients or archaeologists Other duties as required: Meeting minutes of the First Nations Relations (FNR) group of the Operations Division (monthly safety/staff meetings) Scheduling and responsible for action item follow-ups Assistance as required for Director of FNR Maintenance of all filing systems, digital and paper, for the archaeology department, which includes section 14 permits, section 12 permits, AIAs, non-compliance files, archaeology audit files and Archaeology Branch section 14 reports.
