3 September 9, 2014 Mr. Joe Nugent Director of Facilities & Planning Operations Cabrillo College C/o Mr. Jeff Wilden Project Manager Slatter Construction, Inc. 126 Fern Street Santa Cruz, CA Via Re: Pre-Renovation Hazardous Material Inspections of Buildings 1500, 1550, and 1600 at the Cabrillo College Located at 6500 Soquel Drive in Aptos, California M 3 Project Task 1 Dear Mr. Nugent: At your request, M 3 Environmental Consulting, LLC (M 3 ) conducted inspections for asbestos-containing material (ACM), lead-containing paint (LCP), and other hazardous materials in buildings 1500, 1550, and 1600 at the Cabrillo College located at 6500 Soquel Drive in Santa Cruz, California. It is to M 3 s understanding that the buildings are to undergo a future planned heating ventilation and air conditioning (HVAC) and lighting renovation project. Building renovation plans were provided to M 3 for sample location purposes. The buildings were occupied by school staff at the time of the inspections. The inspections were performed from August 18, 2014 to August 21, 2014 by Mr. Garrett Rodewald, California Certified Site Surveillance Technician (CSST) , California Department of Public Health (CDPH) Certified Lead in Construction Sampling Technician , and Environmental Technician with M 3, under the direction of Ms. Linda C. Arceo, California Certified Consultant (CAC) , California Department of Public Health (CDPH) Inspector/Assessor. 532, and Director of Environmental Services with M 3. The asbestos inspection was performed to identify ACM that will be impacted by the planned renovation project. The Monterey Bay Unified Air Pollution Management District (MBUAPCD) Rule 424 requires a comprehensive survey be conducted for ACM prior to any planned renovation or demolition activity in accordance with the Environmental Protection Agency (EPA) National Emission Standards for Hazardous Air Pollutants (NESHAP) regulation (Title 40 Code of Federal Regulations [CFR] Part 61 Subpart M). The purpose for the collection of paint chips and bulk samples was to determine the location of leadcontaining materials prior to planned renovation activities to comply with the California Occupational Safety and Health Administration (Cal/OSHA) Construction Lead Standard (Title 8 CCR Section ) requirement for worker protection. The purpose of determining if polychlorinated biphenyls (PCB) ballasts, fluorescent light tubes, and mercury containing switches were present was for proper disposal purposes. Inspection The following services were performed during this survey: 9821 Blue Larkspur Lane, Suite 100, Monterey, CA P: F:

4 Conducted walk through inspections of the buildings to delineate the scope of work, and to sample suspect ACM from throughout the interior, exterior, and roof of the buildings. The inspections were non-destructive in nature, in that we did not sample behind hard walls or above ceilings. Analyzed collected samples in an American Hygiene Association-accredited laboratory using polarized light microscopy (PLM) according to the Environmental Protection Agencyrecommended method. Lead in Paint Paint chip or bulk samples were collected from selected components from throughout the buildings and analyzed to determine if they contain detectable levels of lead prior to activities that may impact them, as the California Occupational Safety and Health Administration (Cal/OSHA) lower threshold for lead in paint is anything above laboratory detection. Submitted paint chip and bulk samples to a laboratory accredited under the National Institute of Standards and Technology's (NIST) National Voluntary Lab Accreditation Program (NVLAP) and certified by the State of California CDPH Environmental Laboratory Accreditation Program (ELAP). Samples were analyzed in accordance with EPA Method-SW Flame Atomic Absorption Spectrometry (FAA). Other Hazardous Materials Conducted an inspection for other hazardous materials, including, polychlorinated bi-phenyls (PCB) light ballasts, fluorescent light tubes, and mercury containing switches. Building Description Building 1500 The subject structure was a two-story, wood-framed school building on a concrete slab. The first floor consisted of a reception area, offices, conference rooms, teacher/staff break room, storage rooms, janitor s closet, restrooms, a pre-school, toddler center, and recently constructed Margo Lynn Trombetta Infant Center. The pre-school (1500), toddler center (1501), and new infant center (1502) all included classrooms, observation areas, nap rooms, kitchens, restrooms, and laundry rooms. The second floor consisted of classrooms, conference rooms, offices, storage room, restrooms, janitor s closet, and electrical closet. A mezzanine was located in the attic space, accessible through the second floor electrical closet. The building s water heater and heating ventilation and air conditioning (HVAC) system and ductwork were located in the mezzanine. Additional boiler units were located in the first floor, exterior entry boiler room (1554) and the Trombetta Center (1502) interior boiler closet. The windows were single-paned, aluminum-framed throughout. Heat was supplied to the building via forced-air heating and several individual room wall heaters. HVAC system ductwork with fiberglass insulation was noted in the ceiling cavities throughout the building. Interior building finishes consisted of carpet, vinyl floor tile (VFT), resilient sheet flooring (RSF), ceramic floor tile (CFT), ceramic wall tile (CWT), brick and mortar, wallboard/joint compound (WB/JC) with and without texturing, lay-in acoustic ceiling panels (ACP), and acoustic ceiling tiles (ACT). The exterior of the building was composed of brick and mortar, concrete, and stucco. Transite TM wall panels were located under the windows throughout the 2 nd floor exterior. Exterior faux wood siding was noted around the Trombetta Center addition on the west end of the building. The roof was composed of composition shingle with various penetrations and associated mastics. 5 Building 1550 The subject structure was a single-story, wood-framed school building on a concrete slab. The building consisted mainly of teacher/staff offices, with a reception area, kitchenette, and electrical room. Two separate offices stood adjacent to the building, connected by a covered walkway. The windows were single-paned, aluminum-framed throughout. Heat was supplied to the building via forced air heating. The building s HVAC unit and water heater were located in the exterior entry electrical room. The HVAC system ductwork with fiberglass insulation was noted in the ceiling cavities throughout the building. Interior finishes consisted of carpet, VFT, brick and mortar, WB/JC with and without texturing, and ACT. The exterior was composed of brick and mortar, and stucco. The roof was composed of composition shingle with various penetrations and associated mastic. Building 1600 The subject structure was a single-story, wood-framed school building on a concrete slab. The building consisted of classrooms, offices, restrooms, and a janitor s closet. A safe was located in classroom 1605, however no access was granted. A mezzanine was located in the attic space, accessible through the janitor s closet. The building s water heater and HVAC system and ductwork were located in the mezzanine. The windows were single-paned, aluminum-framed throughout. Heat was supplied to the building via forced air heating. The HVAC system ductwork with fiberglass insulation was noted in the ceiling cavities throughout the building. Interior finishes consisted of carpet, VFT, CFT, CWT, brick and mortar, WB/JC with and without texturing, and lay-in ACP. The exterior of the building was composed of brick and mortar, concrete, and stucco. Transite TM wall panels were located under the windows throughout the exterior. The roof was composed of composition shingle with various penetrations and associated mastic Sampling and Analysis Bulk Sampling A total of 212 ACM bulk samples were collected and analyzed by Polarized Light Microscopy (PLM) using the Environmental Protection Agency (EPA) Method (EPA/600/R-93/116, July 1993) Method for the Determination of in Bulk Building Materials. The laboratory results of the materials sampled during field investigation are presented as estimated percentages of asbestos by types (e.g. amosite, chrysotile, crocidolite), as well as types of non-fibrous fibrous materials or non-detect (ND). Lead Bulk Sampling A total of 117 bulk samples of suspect lead containing materials were collected, and analyzed by the laboratory in accordance with EPA Method 600/R-93/200 and analyzed in accordance with EPA Method- SW Flame Atomic Absorption Spectrometry (FAA). Results are presented in percent lead by weight (wt%) for paint, parts per million (ppm) for bulk, and below the reporting limit (BRL) if non-lead containing. All samples were analyzed by EMC Labs Inc. in Phoenix, Arizona Results The laboratory results, chains of custody of the materials sampled during the field investigation, and floor plans with sample locations are included in the attached appendices. Standards and Guidelines Federal Regulations The USEPA National Emissions Standards for Hazardous Air Pollutants (NESHAP), Title 40 Code of Federal Regulations [CFR] Part 61, Subpart M regulation, applies to certain demolition and renovation projects in facilities containing ACM. The NESHAP rule usually requires that all friable ACM and some categories of nonfriable ACM be removed before a building is demolished, and may require localized removal before or as part of a renovation. For renovation projects where friable ACM will be disturbed, the NESHAP rule may require appropriate work practices or procedures for the control of emissions. The following USEPA NESHAP definitions of ACM are very important in interpreting which NESHAP requirements may apply to your building: -containing material (ACM): Any material that contains more than 1% asbestos as determined using PLM analysis Friable ACM: Any material containing more than 1% asbestos, determined using PLM analysis, that when dry, can be crumbled, pulverized, or reduced to powder by hand pressure. Category I nonfriable ACM: -containing packings, gaskets, resilient floor covering, and asphalt roofing products containing more than 1% asbestos as determined using PLM. Category II nonfriable ACM: Any material excluding Category I nonfriable ACM, containing more than 1% asbestos as determined using PLM that, when dry, cannot be crumbled, pulverized, or reduced to powder by hand pressure. Regulated asbestos-containing material (RACM): (1) friable ACM; (2) Category I nonfriable ACM that has become friable; (3) Category I nonfriable ACM that will be or has been subjected to sanding, grinding, cutting, or abrading; or (4) Category II nonfriable ACM that has a high probability of becoming or has become crumbled, pulverized, or reduced to powder by the forces expected to act on the materials in the course of demolition or renovation operations regulated by NESHAP. 17 It is Category I nonfriable ACM that is in good condition and is not friable. It is on a facility component that is enclosed in concrete or other similarly hard material and is adequately wet whenever exposed during demolition. It was discovered after demolition began, and as a result, cannot be safely removed. If not removed, the material must be kept wet until disposal. It is Category II nonfriable ACM and the probability is low that the material will become crumbled, pulverized, or reduced to powder during demolition. NESHAP also requires that the USEPA or the state (if the state has been delegated authority under NESHAP) be notified before a building is demolished, or before certain renovations impacting RACM begin. State Regulations The State of California has specific regulations regarding asbestos. California standards for the workplace are issued primarily by the California Occupational Safety and Health Administration (Cal/OSHA). Specific asbestos requirements are contained in Title 8 of the California Code of Regulations (CCR) and in the California Health and Safety Code. Under Cal/OSHA, an ACM means any material containing 1% asbestos. Any manufactured construction materials (friable and non-friable) containing more than 0.1% asbestos by weight are defined as asbestos containing construction material (ACCM). The ACCM designation is applicable only to reporting (user registration, temporary worksite notification, and incident reporting). The removal or disturbance of 100 square feet or more of ACM must be performed by a contractor certified by the California Contractors State License Board to conduct asbestos-related work and/or an employer/contractor registered with the California Division of Occupational Safety and Health (DOSH) to perform asbestos-related work. Monterey Bay Unified Air Pollution Control District The MBUAPCD under Rule 424, has adopted regulations and policies to implement the asbestos demolition and renovation requirements developed by the USEPA under the NESHAP regulation. An asbestos notification must be submitted to the MBUAPCD at least ten working days prior to (1) any regulated demolition, or (2) any renovation disturbing at least 160 square feet of RACM, 260 linear feet of asbestos-containing pipe insulation, or 35 cubic feet of RACM (where the length or area could not be measured previously) from facility components. Point Counting Friable materials that were determined to contain low concentrations asbestos by PLM visual estimation may be point counted to further quantity the asbestos concentration. If the these materials are not point counted, they must be assumed to be greater than 10% asbestos and a RACM, and in accordance with the NESHAP, must be disposed of in a landfill that accepts friable asbestos waste (Class I landfill). te: The lower limit of reliable detection for asbestos using the PLM visual estimation analytical method is one percent (1%) by volume. When less than 1% appears in this report, it should be interpreted as meaning that asbestos was present in the sample, but the exact percentage is unknown. Any sample can be subjected to the more stringent Point Count Method of analysis to more precisely determine the actual asbestos content. However Cal/OSHA states that employers performing construction activities on materials containing any detectable asbestos must comply with all applicable provisions of 8 CCR 1529 (Title 8, section 1529, California Code of Regulations). Therefore, those non-friable materials which fall outside the NESHAP definition of an ACM are regulated by Cal/OSHA, and should be handled as ACM's by qualified personnel. Additionally, those materials which may fall below the Cal/OSHA limit of 0.1%, but still contain some detectable levels of asbestos, would also be subject to the Cal/OSHA regulations. 18 Class I, II, III, or IV asbestos work. For the purposes of reporting and contractor registration, Cal/OSHA defines an asbestos containing construction material (ACCM) as one which contains more than one tenth of one percent (0.1%) asbestos by weight. Lead in Paint Federal OSHA and Cal/OSHA do not define an amount of lead in a product that triggers their regulations. The OSHA Lead Standard applies based upon worker exposure to lead during the work performed. This is interpreted in the industry to mean that the regulation must be followed when there is any "detectable" lead in the product. With respect to lead related tasks, until the employer performs an employee exposure assessment and documents that the employee performing the task is not exposed above the Permissible Exposure Limit (PEL) of 50 ug/m3, the employer shall treat the employee as if the employee were exposed above the PEL for the trigger tasks outlined in the OSHA Lead Standard. Hazardous Waste Criteria Waste Reduction The Resource Conservation and Recovery Act (RCRA) requires that solid waste containing hazardous material as identified by the EPA be properly disposed in accordance with EPA's regulations 40 CFR 261. RCRA requires, relative to the presence of lead in waste, testing of the solid waste to determine the level of toxicity present. The test is termed the Toxicity Characteristic Leaching Procedure (TCLP), and it determines the leaching potential of the known hazardous constituent (lead) from the waste to be disposed. As a result of the TCLP test, if the leachable waste under RCRA is greater than 5.0 milligrams per liter (mg/l), the solid waste must be disposed as hazardous waste under RCRA requirements and Department of Transportation (DOT) regulations. When waste is generated in California, at a minimum it is required to follow the California EPA testing requirements. The characteristics for hazardous waste have been promulgated in the California Code of Regulations (CCR), Title 22, Section as the total threshold limit concentrations (TTLC). In California the waste is considered hazardous if any sample results exceed the TTLC of 1,000 milligrams per kilogram (mg/kg). If there is less than 1,000 mg/kg of solid lead, the waste extraction test (WET) is performed. If the results exceed the soluble threshold limit concentrations (STLC) of 5 mg/l, the waste is considered hazardous in California. The WET is more stringent than TCLP. In California, it is not necessary to do the TCLP since if the waste fails the WET as it will always fail TCLP. If the waste is to be disposed of outside of California, then TCLP must be done. TCLP is also performed because Federal RCRA requires hazardous waste be stabilized before being buried. Lead waste is normally stabilized by mixing with cement kiln dust. This is performed by a waste management firm, treatment site, or waste site. Since this is a Federal requirement, if waste passes the Federal tests (TCLP), but fails the WET, it is considered a hazardous waste in California but does not need to be stabilized. Discussion NESHAP and the MBUAPCD regulations require that regulated ACM (friable and greater than 1% asbestos) be removed from the building prior to demolition or renovation and be disposed of as hazardous waste NESHAP regulations require that regulated ACM (greater than 1%) be removed from the building prior to demolition or renovation that will impact these materials. In addition, Cal/OSHA regulations apply to asbestos related work involving materials containing asbestos at concentrations of more than 0.1%. Certain aspects of Cal/OSHA regulations may apply when material(s) containing any amount of asbestos are involved. 19 The Cal/OSHA definition in Title 8 CCR 1529 of an asbestos containing material (ACM) is one which contains 1% asbestos, and any work which disturbs ACM or presumed ACM is defined by Cal/OSHA as Class I, II, III, or IV asbestos work. For the purposes of reporting and contractor registration, Cal/OSHA defines an asbestos containing construction material (ACCM) as one which contains more than one tenth of one percent (0.1%) asbestos by weight. Lead There are building materials that contain detectable concentrations of lead. All building components similar to those determined to contain lead should be treated as lead containing. It is M 3 s opinion that a paint film containing any detectable concentration of lead must be viewed as a potential source of lead exposure and health hazard, and should be properly abated or managed in-place in accordance with current guidance available. Other Hazardous Materials There are mercury containing fluorescent lighting tubes and switches present. All Universal Waste handling, labeling, shipping, and disposal must be performed to the current standards promulgated in California Code of Regulations, Title 22. Division 22, Chapter 23. Recommendations Lead Conduct PLM point counting to 400 points on WB/JC samples determined to have low concentrations of asbestos by the PLM visual estimation technique. If this material is point counted to 400 points and the result is less than 1% asbestos, it may be disposed of as nonhazardous material. However, some Cal/OSHA regulations will apply for removal operations such as removal and disposal of non-hazardous waste by a California licensed asbestos abatement contractor using proper engineering control (negative pressure containments) and worker protection (disposable suits and respirators). Prior to demolition or renovation activities that will impact the materials identified in this report as asbestos containing or assumed to be asbestos containing must be removed and disposed of by a registered asbestos abatement contractor using proper engineering controls and worker protection. If any other suspect ACM not identified in this report is found during any demolition or renovation, work should cease and additional sampling and analysis should be performed to determine if the materials contain asbestos. Contractors and others responsible for any renovation/demolition activities on the property should be notified as to the presence of the asbestos so that compliance with regulatory requirements may be met in any planning and bidding phases. All other interior and exterior paint in good condition (not peeling from the substrate) may remain in place during demolition. Lead related activities should not include the use of wire brushing, flame torching, dry scraping, sanding, stripping, abrasive methods, or the use of heat guns unless proper engineering controls and worker protection are in place. At the time of removal of any LCP, samples of the lead containing/contaminated waste should be collected and analyzed by the TTLC, STLC and TCLP in order to determine whether wastes are classified as non-hazardous solid or hazardous waste in California or as defined under the RCRA before transportation and disposal to either a Class I, II, or III landfill. Contractors bidding for renovation work should be compliant with the requirements of the Cal/OSHA Lead in Construction Standard (Title 8 CCR ) for training, medical surveillance, and worker protection and the lead standard from the Environmental Protection Agency (EPA) Renovation, Repair and Painting Rule (RRP) 40 CFR [Code of Federal Regulations] Part 745. Lighting and Mercury Waste Mercury containing fluorescent light tubes are Universal Waste. The tubes, in any quantity, must be considered hazardous waste. Uniform hazardous Waste Manifest is required, but documentation must be provided demonstrating the tubes were managed properly. Tubes may be taken to Household Hazardous Waste Collection Facility for disposal. Fluorescent lighting ballasts may contain polychlorinated biphenyls (PCBs) and mercury. All ballasts should be removed and disposed of as hazardous waste. Environmental Consulting The use of M 3 or another qualified environmental consulting firm to assist in the design of hazardous material abatement specifications, observe abatement activities, conduct area air monitoring during abatement, visual inspections, and conduct air clearances after abatement/removal activities. Limitations A reasonable effort is made by M 3 personnel to locate and sample suspect materials. However, for any facility the existence of unique or concealed hazardous material debris is a possibility. M 3 does not warrant, guarantee or profess to have the ability to locate or identify all hazardous material in a facility. M 3 s hazardous material testing, results are applicable for the time that testing was conducted and for the condition of surfaces at the time they were tested. During demolition/renovation operations, materials may be uncovered which were not identified during our assessment. Personnel in charge of demolition/renovations should be alerted to note materials uncovered during these operations, which differ substantially from those included in this assessment. M 3 does not guarantee or warrant that the areas surveyed are safe, nor does M 3 s involvement in this property relieve the Owner of any continuing responsibility of providing a safe environment.
