1 SUN PEAKS MOUNTAIN RESORT MUNICIPALITY Minutes of the Regular Council meeting of the Sun Peaks Mountain Resort Municipal Council held on Monday, August 15, 2011 commencing at 7:00 p.m. in the Sun Peaks Municipality Office, Sun Peaks, B.C. Present: Regrets: Also: Mayor A. Raine Councillor M. Forster Councillor D. Alexander Councillor M. Pozza Councillor I. Popig Byron Johnson, Chief Administrative Officer Nicky Braithwaite, Finance Officer 1. CALL TO ORDER Meeting called to order at 7:07 PM. 2. INTRODUCTION OF LATE ITEMS - None 3. APPROVAL OF THE AGENDA Moved by Councillor Alexander, seconded by Councillor Pozza: THAT the agenda be approved as presented. 4. ADOPTION OF MINUTES a. Regular Council Meeting Minutes - July 18, 2011 The fire department report under item 7 should read '...however, it is possible'. The second part of the motion under item 9 should read '...and/or cash funding as required'. Moved by Councillor Forster, seconded by Councillor Pozza: THAT the Regular Council meeting minutes of July 18, 2011 be adopted as amended. \\ \data\sun peaks resort municipality\minutes\minutes - regular council docx
2 b. Special Council Meeting Minutes - August 3, 2011 Item '1' should read 'The meeting was called to order at 2:30 PM'. Moved by Councillor Alexander, seconded by Councillor Pozza: THAT the Special Council Meeting Minutes of August 3, 2011 be adopted as amended. 5. BUSINESS ARISING FROM MINUTES - None 6. PRESENTATIONS AND DELEGATIONS - None 7. REPORTS a. Mayor and Council Reports Mayor Raine reported that he has attended the following meetings: July 21 - Airshed meeting representing the TNRD dealing with the City of Kamloops Airshed committee which reviewed the new Ajax mine proposal. - BC Transit meeting with proposals of potential weekly service to Clearwater, Barriere and Logan Lake. Service to Sun Peaks is not included at this time. - Liberal Party Rural Caucus was in attendance in the resort and met with several residents and some members of Council. Aug 2 - Met with Minister Bell. Aug 4 - Met with Community Sport and Cultural Development Deputy Minister Don Fast b. Advisory Body and Committee Reports - None c. Staff Reports i Fire Department Report CAO Johnson reviewed the report submitted to Council. Mayor Raine thanked the fire department for their response to the August 10th forest fire and noted that prior to incorporation this area was outside of their jurisdiction and they may not have been able to respond. It was also noted
3 by Council Pozza that Chief Stoner is doing much of the training himself. The EMR program is to commence in mid-september. ii Administrative Report 8. BYLAWS CAO Johnson reviewed the report submitted to Council. a. First and Second Reading: Bylaw No Animal Control CAO Johnson reviewed the draft bylaw submitted to Council. Council agreed that the number of pets permitted would not be regulated at this time. Council discussed contravention fines and directed staff to research other municipal fine structures in this regard. Moved by Councillor Pozza, seconded by Councillor Forster: THAT Animal Control Bylaw No. 0020, 2011 is given first and second reading. b. First Three Readings: i Firearms Bylaw Repeal Moved by Councillor Forster, seconded by Councillor Pozza: THAT Discharge of Firearms Bylaw No. 0006, 2010 Repeal Bylaw No. 0019, 2011 is given first three readings. ii TNRD Elections Bylaw Repeal Moved by Councillor Alexander, seconded by Councillor Forster: THAT Sun Peaks Other Voting and Election Procedure Bylaw No. 2290, 2009 Repeal Bylaw No. 0020, 2011 is given first three readings.
4 9. NEW BUSINESS a. Municipal Auditor General Survey CAO Johnson explained the purpose of the Municipal Auditor General role proposed by the province and reviewed the suggested responses submitted to Council. Council supported the direction and suggestions presented by CAO Johnson. 10. CORRESPONDENCE AND INFORMATION ITEMS a. TNRD Board of Director s Report This report will be included with regular council meeting packages. 11. NOTICE OF MOTION - None 12. QUESTIONS FROM THE PUBLIC Renate Kals: All dogs should be kept on a leash within the resort. A: Dogs not kept on a leash must be under the control of its possessor except in mandatory leash areas. Renate Kals. Will there be fines related to this bylaw? A: Yes Vladimir Grebenyuk: Is the OCP process delayed due to the First Nations case? A: Yes. Council hopes to move forward soon. Vladimir Grebenyuk: The cost of enforcing the animal control bylaw could be prohibitive. A: Could potentially share this bylaw enforcement with another community Vladimir Grebenyuk: What about animals that are causing a noise disturbance on their own property. A: There are provisions within the noise bylaw to regulate this issue. Vladimir Grebenyuk: does the animal control bylaw address leaving trash that attracts bears? A: Complaints of trash being left out has been dealt with by contacting the home owner. Renate Kals: Do you expect the next bylaw officer to be a resident of Sun Peaks? A: The advertisement will be made publically and the best person will be hired.
