Exhibit 4-2 Map The applicatin area bundary des nt appear t replicate the same bundaries as indicated in the preliminary Cncurrent DRI/Cmprehensive Develpment Master Plan (CDMP) Land Use Plan (LUP) map amendment applicatin. If the applicant is planning t file a CDMP amendment with the Department that is different in acreage r bundaries than the ADA, please explain what the differences between the tw applicatins will be and why they are necessary. The CDMP amendment applicatin encmpasses an area that is larger than the bundaries f the DRI-ADA. The CDMP amendment applicatin reflects the entire area that is inclusive f the adjacent sectin-line rad right-f-ways fr SW 136 th Street, SW 177 th Avenue and SW 152 nd Street. As part f the DRI, the Applicant has cmmitted t build SW 136 th Street and SW 152 nd Street, and has agreed t wrk with the FDOT t cnvey the land area needed fr the imprvements t SW 177 th Avenue. Questin 10 - General Prject 2. Pages 10-1 thru 10-4 The Department is still reviewing the sectin n Grwth Scenari and Land Availability and will prvide cmments by September 20, The Applicant has nted this cmment. N additinal cmments were received by September 20, 2006, nr have cmments been received thereafter. 3. Page 10-6 and Map J5A Bth have legends, which are missing the water land use categry as nted by the lakes shwn n the ADA plan. Als, the clrs n the map d nt cincide with the legend. Please revise. These maps have been revised based n the cmment abve and are attached. 4. Further we believe that blasting culd be an issue when the time cmes t cnstruct these lakes, which are in clse prximity t residentially develped areas t the east. Please explain if lake develpment will include blasting and what plan the develper has t prevent impacts t neighbring residential areas. Blasting will nt be used fr lake excavatin. 5. Additinally, the ADA s lcatin f a High Schl n the prpsed Urban Develpment Bundary (UDB) cnflicts with Plicy EDU-2A f the Educatinal Element f the CDMP that states that high schls shuld be lcated at least ne mile away frm the Urban Develpment Bundary (UDB). Placement f the elementary schl can be ¼ mile. Therefre, a re-siting f the schls needs t be addressed. The prpsed K-8 schls can nt be lcated mre than ½-mile frm the prpsed UDB and remain n the Prject site, and the prpsed high schl can nt be lcated 1 mile frm the prpsed UDB and remain n the Prject site. 2 Prject site. Furthermre, the prpsed high schl will prvide excess student statin capacity available t serve students utside the prpsed Prject attending ther vercrwded schls. Given the lack f available alternative sites in the area, vercrwding in existing facilities, and the fact that Plicy EDU-2A f the Educatinal Element f the CDMP states that high schls shuld be lcated at least ne mile away frm the UDB, the prpsed lcatin likely prvides the best slutin. The Applicant will wrk with the Miami-Dade Cunty Schl Bard and Miami-Dade Cunty t btain any permits r waivers necessary t cmply with Plicy EDU-2A. 6. Page The ADA indicates that the applicant wns the CSX RR ROW; hwever, Cunty recrds indicate that CSX RR Cmpany still wns this railrad right-f-way. Please explain this discrepancy. Except fr a small parcel f 1.53 acres wned by CSX Railrad east f SW 167 th Avenue, the Applicant wns the entirety f the ADA area. Cunty recrds are incrrect, and the Applicant is wrking with the Miami-Dade Cunty Prperty Appraiser t crrect this discrepancy. 7. Page 10-10, Table 10-2 This table shws a different figure fr railrad right-fway in the existing and prpsed Prject. Please explain the difference. Page and 15 - In the last paragraph a statement is made that the prject is lcated within an area designated as Agricultural. The applicant ges n t state that the Cunty thrugh the adpted CDMP, recgnizes that the area is an area mre apprpriate fr urban develpment. Please prvide data and analysis t supprt this assertin since plicy in the CDMP is t prtect agriculture as a viable industry. (CDMP Land Use Plicies LU-1P. LU-1S, and the Agriculture text). The statement that the area is an area mre apprpriate fr urban develpment is fund in the Adpted Cmpnents f the Miami-Dade Cunty Cmprehensive Develpment Master Plan n page I-64 in the sectin titled Ultimate Develpment Bundary. This sectin f the CDMP states: It is difficult t specify where and hw much f Miami-Dade Cunty s ttal area may ultimately be cnverted t urban develpment. This is due t uncertainty regarding lng-term rates f ppulatin and ecnmic grwth; husing and cmmunity preferences; availability and price f energy, water, agricultural and Miami-Dade Department f Planning and Zning Cmments Page 2

3 mineral resurces; and State, federal and internatinal influences. It is reasnably safe t assume, hwever, that the areas least suitable fr urban develpment tday will remain least suitable in the future. These areas include the remaining high-quality castal and Everglades wetlands areas in the Cunty, and the Nrthwest Wellfield prtectin area. The areas mre apprpriate fr, and mre likely t experience, sustained urban pressure are the heavily impacted, partially drained wetlands in the Biscayne-Snake Creek and Bird- Trail Canal Basins, the agricultural areas f suthwestern and sutheast Miami-Dade, and the impacted wetlands suth f Hmestead and Flrida City. When the need fr additinal urban expansin is demnstrated after the year 2015, such expansin shuld be carefully managed t minimize the lss f agricultural land and t maximize the ecnmic life f that valuable industry. Accrdingly, urban expansin after the year 2015 in the Suth Dade area shuld be managed t prgress westerly frm the Metrz area t Krme Avenue nrth f Eureka Drive, and n the west side f the US 1 crridr sutherly t Hmestead nly when the clear need is demnstrated. [emphasis added] 10. Page Please prvide data and analysis t demnstrate hw this area is nt cnducive t lng-term agriculture. This area has been in agricultural use fr decades. The Cunty has as a gal in its strategic plan t retain agriculture as a viable industry. See respnse t item 9, abve. In additin, a study prepared by Miami-Dade Department f Planning & Zning, dated September 4, 2002, revised Octber 9, 2002, and entitled Urban and Agricultural Land Use Trends & Prjectins: 1985, 1994, 2000, 2025, and 2050/ Miami-Dade Cunty, Flrida cncludes, in part, that between an estimated 28,500 acres will be surplus agricultural land in Miami-Dade Cunty. A cpy f this reprt is included as Attachment VII. Furthermre, a prtin f the Agriculture and Rural Area Study prpsed stripping certain farmlands f their develpment rights, at a cst t the Cunty f an estimated $130 millin dllars. A set f factrs were develped that priritize agricultural lands accrding t their imprtance: Percent f area within 1 mile in agricultural use, the mre the better; Percent f area within 1 mile in agricultural zning, the mre the better; Distance frm UDB, the further the better; Percent f perimeter adjacent t nn-agricultural use, the less the better; Size f parcel, the bigger the better; Histrical assets n site, yes being better; Availability f ptable water, the availability f public water being a negative; Availability f wastewater systems, the availability f being a negative; Distance t adequate rad systems, the farther the better; Distance t a fire statin, the farther the better; Distance t a public elementary schl, the farther the better; Percent f the site subject t inundatin, the mre the better. 4 Based n these factrs, any acreage currently lcated adjacent t the UDB wuld rank prly. Questin 14 Water 11. Map 14-1 This map shws that there are canals lcated inside the Tamiami Executive Airprt prperty. These shuld be remved frm the map in that they are nt significant water resurces. The nly canal in the area is running alng SW 157th Avenue t the west f the Airprt. This map has been revised t remve the canals frm Tamiami Airprt prperty. (See attached Revised Map 14-1) Questin 17 - Water Supply 12 Page Tables 17-1 The calculatins fr the table are inaccurate. The K-8 schls shuld be calculated at 15 gal/day/student and the High Schl shuld be calculated at 20 gal/day/student. Please revise the table t reflect these figures. 20 gal/day/student were used as per the WASD table fr schls with shwers. This is a cnservative rate fr K-8 schls. This table has been revised and included in attached Revised Questin Page 17-2 Please prvide data n the prpsed wastewater reuse facility. Please demnstrate with data and analysis the plan t prvide adequate water supply fr the prpsed develpment. The CDMP Capital Imprvement Element (CIE) currently des nt reflect any prjects prpsed t serve this new area. Please identify what water supply prjects will be added t the CIE. The prpsed satellite treatment facility will be lcated in clse prximity t the manifld frce main thrugh which the Prject's wastewater flw will be transmitted t existing WASD facilities. The lcatin f this manifld frce main has nt yet been determined. It is anticipated that the site will be apprximately ne half acre in size and the prpsed technlgy will be membrane filtratin. The 25% is a wrking percentage that is being used at this time in the absence f a preliminary design and/r lcal permitting requirements. 5 the existing cnsent agreement and the develpment cmmunity will d its part t ensure that this gal is achieved. The Cunty's ptable water demands are based n ppulatin prjectins. Mving the UDB will nt increase ppulatin; it nly affects the distributin f that ppulatin within the Cunty. The Applicant prpses Develpment Order (DO) cnditins linking the number f units t available and permittable water supply. Page 17-3 The applicant needs t better define their plans fr water cnservatin. The Cunty has recently adpted a Water Efficiency Plan aimed at maximizing water cnservatin effrts. The applicant needs t demnstrate with data and analysis hw it will achieve the gals set by the Water Efficiency Plan. We have reviewed the WASD Water Efficiency Plan and find n means f prviding data and analysis f the Applicant s ability t achieve the gals and bjectives f the Plan. The Applicant is cmmitted t the cncept f water cnservatin and has prpsed a satellite reuse facility. This facility will reduce nn-ptable demands frm the Biscayne Aquifer. The applicant must submit details regarding their plans fr reducing sewage flws by wastewater reuse. The prpsed satellite treatment facility will be lcated in clse prximity t the manifld frce main thrugh which the Prject's wastewater flw will be transmitted t existing WASD treatment facilities. The lcatin f this manifld frce main has nt yet been determined. It is anticipated that the site will be apprximately ne half acre in size and the prpsed technlgy will be membrane filtratin. The 25% is a wrking percentage that is being used at this time in the absence f a preliminary design and/r lcal permitting requirements. Final design will ccur during the permitting prcess. Althugh the perating entity fr the satellite facility has nt yet been determined, it is prpsed that the facility will be built by the develper and perated by WASD as part f their reginal facility, thereby prviding WASD with reuse credits fr their system. It is premature at this time t estimate the staffing requirements fr the peratin f the plant. Questin 21 Transprtatin 17. Page The land uses and scale f develpment prpsed and presented in Table 21.A1, DRI Develpment Prgram, in the DRI Applicatin fr Develpment Apprval (ADA) differs frm the land uses and scale f develpment presented in Table 21.B2, AM and PM Peak Hur Trip Generatin (p. 28), in the Transprtatin Appendices. Table 21.A1 specifies 1,257 dwelling units (DUs) fr single family detached, 2,436 DUs fr single family attached twnhuses, 3,248 DUs multifamily cndminiums, a 200-bed hspital. and a 67.6-acre park. Table 21.B2 in Appendix 21-1 specifies 2,100 single-family hmes, 2,100 twnhuses, 2,000 cndminiums, an 80-bed hspital, and a 46-acre park. Please address these discrepancies and revise the tables accrdingly. Table 21.B2 n page 28 f the Transprtatin Methdlgy Letter lcated in Appendix 21-1 reflected the develpment prgram and trip generatin at the time f the August 12, 2005 Pre-Applicatin Cnference. The develpment prgram fr the DRI was mdified several times between the Pre-Applicatin Cnference and the ADA submittal resulting frm detailed site planning and refinements t the cnceptual site plan fr the DRI. Table 21.B2 included n page in the respnse t Questin 21 reflects the prpsed develpment prgram cnsistent with Table 21.A1 fund n page 21-1, therefre n revisins t this table are needed. 18. Page Map J-5A, the Cnceptual Master Plan Circulatin Plan, illustrates a prtin f SW 167 Avenue thru the site as a cuplet. 8 prviding mbility nrth and suth in the regin. SW 172 Street is a half-sectin line radway and shuld be extended t SW 136 Street. Als, the plan shws SW 144 Street cnnecting t SW 177 Avenue (Krme Avenue). Plicy TC-4E f the Traffic Circulatin Supplement f the Cunty s Cmprehensive Develpment Master Plan (CDMP) states that... n cnstructin assciated with the furlaning, r ther capacity imprvement, f Krme Avenue utside the Urban Develpment Bundary shall ccur until FDOT has prepared, and the Bard f Cunty Cmmissiners has adpted, a detailed binding access t prperties frnting Krme Avenue primarily thrugh alternative street lcatins. Please revise this plan t remve the cuplet n SW 167 Avenue, extend SW 172 Avenue t SW 136 Street, and remve the SW 144 Street cnnectin t Krme Avenue. On September 13, 2006, the Applicant met with the Miami-Dade Cunty Department f Public Wrks, and reviewed the Cnceptual Master Circulatin Plan specifically addressing the prpsed n-site and ff-site radway imprvements fr the DRI. Public Wrks indicated n cncern with the cuplet design fr SW 167 Avenue, and supprted the extensin f SW 144 Street t Krme Avenue. The Applicant will extend SW 172 nd Avenue nrth t SW 136 th Street, hwever this radway extensin will have t crss the CSX crridr in lcatin where a rail crssing des nt exist tday. The Applicant will request the rail crssing, and will build the crssing if apprved. As part f the Krme Suth PD&E Study, FDOT is preparing an Access Management Plan fr Krme Avenue. The Applicant will crdinate with FDOT t determine when the Access Management Plan will be submitted t the Bard f Cunty Cmmissiners fr apprval per Plicy TC-4E f the Traffic Circulatin Subelement. 19. The Guidelines fr Urban Frm established in the Land Use Element f the CDMP (pp. I I-23) shuld be cnsidered fr the lcatin f different uses, their intensity and density and the intercnnecting netwrk f vehicular and pedestrian mvement. has been designed in accrdance with the planning principles utlined by the Guidelines fr Urban Frm as set frth by the CDMP. The cnceptual develpment plan has been created using the cunty sectin line and half-sectin line rads t prvide the rganizatinal structure fr the adjacent prject radways and the internal radway netwrk. The Prject is bunded by sectin line rads n the nrth, west and suth (SW 136 Street, SW 177 Avenue and SW 152 Street), and a half sectin line rad n the east (SW 162 Avenue). Internal radways include SW 172 Street, SW 167 Avenue and SW 144 Street (cunty sectin line and half sectin line radways), in additin t a netwrk f lcal circulatrs that imprve the cnnectivity f this mixed use cmmunity. All sectin line and half sectin line rads are cntinuusly intercnnected, including SW 172 nd Avenue which has been extended nrth t SW 136 th Street (pursuant t staff cmments), n bth sides f the existing CSX railrad crridr. The cnceptual develpment plan has been designed t accmmdate bicycle and pedestrian facilities within the n-site and adjacent radway crss sectins. s intercnnected radway netwrk and design chices ffer alternative mbility pprtunities t Prject residents and emplyees, and assists in mitigating traffic cngestin. s mixed-use, mixed-density design prgram (as delineated by the sectin line and half sectin line radways) ensures that the cmmunity ffers a variety f residential types and densities. 9 highest cncentratin f activity is at the intersectin f sectin line SW 167 th Avenue with sectin line SW 136 th Street and sectin line SW 152 nd Street. These tw activity ndes accmmdate the greatest cncentratin f retail and emplyment land uses supprted by the higher density residential develpment, directly cnsistent with the Guidelines fr Urban Frm. Cnversely, given the unique western bundary f the DRI at Krme Avenue, the intersectin f sectin line SW 177 th Avenue with sectin line SW 136 Street and sectin line SW 152 Street reflects lake area and pen space t be used as buffers adjacent t Krme Avenue, with lw density residential develpment extending eastward int the heart f the DRI. The nrthern edge f alng SW 136 th Street, is partially segmented by the CSX railrad crridr and is lcated near the Kendall-Tamiami Executive Airprt. These factrs have defined the industrial-flex space, medical ffice, and hspital uses that ccupy mst f the nrthern edge f the DRI. The railrad crridr has the ptential t becme a mass transit alignment serving the west Kendall area, making the SW 136 th Street crridr mst desirable and suitable fr ffice and emplyment uses. The highest density residential cmpnents in the DRI are situated alng SW 167 th Avenue, the sectin line rad that cnnects the tw activity ndes. This density allws fr a smth transitin frm the activity f the cmmercial centers t the calmer rhythms f the medium density single family attached twnhuses, lcated t the east and west f the cndminiums. Finally, the single family detached hmes are situated alng the western and eastern edges f. The eastern edge husing blends well with the already existing single family hmes built east f SW 162 nd Avenue, and acts as a buffer t the mre dense and active uses ccurring alng SW 167 th Avenue. s three schls are strategically placed in accrdance with the Guidelines fr Urban Frm. The tw primary schls (K-8) are lcated near the intersectins f half sectin line rads. The high schl, because f its larger size and heavier density, is situated alng the suthern sectin line rad, next t ne f the activity ndes. This lcatin prvides greater accessibility t the high schl frm the adjacent cmmunities lcated t the suth, east and west f the DRI. Parks and ther cmmunity centers are situated thrughut the entire Prject, usually lcated in clse relatinship t the quarter sectin line rads and lcal rads. Pedestrian rutes will travel alng and acrss these pen spaces as they cnnect the different activity ndes and residential centers f the develpment. The canals and water bdies that exist within will als remain easily accessible t the public, as they run parallel t the landscaped greenways lcated adjacent t s lcal rads. 20. Page Revise Map J-1B and Map J-2 (p. 13) f the Transprtatin Appendices t shw SW 120 Street frm SW 147 Avenue t theretical SW 157 Avenue as twlane radway segment, and SW 136 Street between SW 157 Avenue and SW 139 Avenue as tw-lane radway segment. By using the trip rate fr ITE LUC 230 t represent the trip generatin fr the cndminium units, the Applicant is prviding a mre cnservative analysis in the event that n rental units are prvided.
