Wolfenden addressed the Board noting there were two survey pins located on the property line and that there was a misunderstanding where their pin was located. He has tried to contact the neighbour to discuss but has been unable to. Lot 1, Plan KAP60766, District Lot 3546, ODYD N Westside Road Central Okanagan West Electoral Area Voting Entitlement: Custom Vote Electoral Areas, West Kelowna Fringe Area 1 Director, 1 Vote Purpose: To consider a request for a one-year extension to File: Z14/04 (Land Use Contract Amendment Bylaw No , Zoning Amendment Bylaw No , Official Community Plan Amendment Bylaw No ). Executive Summary: The Regional Board has not yet considered the above noted application due to the absence of provincial agency support with respect to key servicing issues. The intent of the associated bylaw amendments is to allow subdivision of the existing development into 36-single family residential lots. While the proponents have recommended alternative solutions to address the servicing issues, the proposal has been unable to gain support from the Ministry of Municipal Affairs and Housing, and the Interior Health Authority to date. The proponents have requested a one-year extension for Application Z14/04 representing the third extension request for this application. 33 Regional Board Report Extension Request for Application Z14/04 Page 2 Implications of Recommendation: Policy: Not approving the extension complies with Development Applications Procedures Bylaw No Background: On September 10, 2015, and September 8, 2016, the Regional Board granted one-year extensions to the LUC/OCP/Zoning amendment application (File: Z14/04). Other than the two extensions, the amending bylaws have not been considered by the Regional Board due to outstanding issues which include the absence of provincial agency support with respect to key servicing issues. The development proponents have been unable to gain support from the Ministry of Community, Sport and Cultural Development or Interior Health Authority (IHA). At time of the Regional Board approving the previous extension requests, the proponents were working on an alternative solution to address the servicing issues that they anticipated would receive provincial agency support (see attached Request for Extension 2016). Subsequent to the 2016 extension, IHA advised on September 30, 2016 and August 17, 2017, that Interior Health does not support the proposed subdivision as submitted as it does not meet Interior Health's onsite sewerage dispersal system requirements for subdivision (see attached). Project description: The subject property is currently regulated under Land Use Contract No. 258, which permits subdivision of the parcel into 42 vacation home sites. The parcel has been partially developed; the proponents are pursuing the Z14/04 application as they wish to permit full-time occupancy and to subdivide the parcel into 36 separate titles. The bylaw amendments are subject to the servicing parameters identified in Subdivision Servicing Bylaw No (formerly Subdivision and Development Servicing Bylaw No. 704); therefore, a Development Variance Permit Application (RDCO File: VP-14-02) has also been submitted in conjunction with the Z14/04 Application to vary servicing requirements. The request for a one-year extension has also been made with respect to the Development Variance Permit Application addressed via a separate staff report. Development Applications Procedures Bylaw No. 944: Applications that have not been approved or rejected within twelve (12) months after the application date will be of no force and effect. Unless the Regional Board passes a resolution to extend the deadline up to one-year, a new application will be required in order to proceed. Conclusion: Subsequent to August 17, 2017, the applicant has been corresponding with IHA requesting an appeal of the decision. In recognition that the previously approved extension expires on September 8, 2017, and due to uncertainty with the timeline for the IHA appeal process, Planning staff has no difficulty with supporting an additional extension of the LUC/OCP/Zoning amendment application and associated variance application. Alternatives: THAT the Regional Board not approve a one-year extension for Application File: Z14/04. 31

Extension request reminder Jennifer, please be advised that we wish to have our applications extended for a year and we will arrange to have the $300 fee paid immediately. This file has been delayed only because John Beaupre at Interior Health would not support the application. Otherwise we believe that we could find a way to work with all other issues. John Beaupre is no longer with Interior Health. While the change from our current Paper Subdivision has to go through a process that involves IHA the actual change of status to a Stratified Subdivision makes absolutely no change to our sewage systems as they are substantially already in place. John Beaupre s lack of support was his personal judgement. IHA has now rearranged how these applications are handled, and a new agency Healthy Built Environment under Interior Health has been established and we are in the process of having the file re-reviewed. We are hopeful that the new person will recognize that the change of status from LUC to Strata has no effect on the sewage systems. This letter is in response to your dated August 14, 2017 requesting reconsideration of Environmental Health Officer, John Beaupre s recommendation of non-support dated September 30, 2016 to the Ministry of Transportation and Infrastructure on the above-noted subdivision application. As you are aware, John Beaupre has now retired. I have reviewed the file and have come to a similar conclusion as John Beaupre regarding his recommendation of non-support. Given that there has been no new information provided with regards to this subdivision application, we are unable to provide a new referral response at this time. The Interior Health Authority has a formal process to respond to complaints and requests for decision reviews. I have attached a handout on how to request a decision review, for your information. 41 Regional Board Report Extension Request for Application VP Page 2 Implications of Recommendation: Policy: Not approving the extension complies with Development Applications Procedures Bylaw No Background: On September 10, 2015, and September 8, 2016, the Regional Board granted one-year extensions to the Application along with the associated LUC/OCP/Zoning amendment application (File: Z14/04). Other than the two extensions, the application has not been considered by the Regional Board due to outstanding issues which include the absence of provincial agency support with respect to key servicing issues. The development proponents have been unable to gain support from the Ministry of Community, Sport and Cultural Development or Interior Health Authority (IHA). At time of the Regional Board approving the previous extension requests, the proponents were working on an alternative solution to address the servicing issues that they anticipated would receive provincial agency support (see attached Request for Extension 2016). Subsequent to the 2016 extension, IHA advised on September 30, 2016 and on August 17, 2017, that Interior Health does not support the proposed subdivision as submitted as it does not meet Interior Health's onsite sewerage dispersal system requirements for subdivision. Development Applications Procedures Bylaw No. 944: Applications that have not been approved or rejected within twelve (12) months after the application date will be of no force and effect. Unless the Regional Board passes a resolution to extend the deadline up to one-year, a new application will be required in order to proceed. Conclusion: Subsequent to August 17, 2017, the applicant has been corresponding with IHA requesting an appeal of the decision. In recognition that the previously approved extension expires on September 8, 2017, and due to uncertainty with the timeline for the IHA appeal process, Planning staff has no difficulty with supporting an additional extension of the variance application and associated LUC/OCP/Zoning amendment application. This file has been delayed only because John Beaupre at Interior Health would not support the application. Otherwise we believe that we could find a way to work with all other issues. John Beaupre is no longer with Interior Health. While the change from our current Paper Subdivision has to go through a process that involves IHA the actual change of status to a Stratified Subdivision makes absolutely no change to our sewage systems as they are substantially already in place. John Beaupre s lack of support was his personal judgement. IHA has now rearranged how these applications are handled, and a new agency Healthy Built Environment under Interior Health has been established and we are in the process of having the file re-reviewed. We are hopeful that the new person will recognize that the change of status from LUC to Strata has no effect on the sewage systems.
