1 Council Minutes Page 1 of 5 Tuesday, April 5, CALL TO ORDER Mayor Kraemer called to Order at 4:00 p.m. on Tuesday, April 5, 2011 the Special Meeting of the Council of The Corporation of the Municipality of Kincardine in the Council Chambers at the Municipal Administration Centre. Carried. 4.2 Committee of the Whole Discussion Councillor Couture assumed the Chair. (A) CBO Subject: Policies and Procedures for Wind Development Report Summary: To adopt Policies and Procedures to guide development of Wind Generation Systems within the Municipality of Kincardine. The policies will establish clear protocols and direction for wind energy development. The increase setbacks, the mandatory burying of the electrical lines and the requirement for securities are all an integral part of the policy. Origin: Council Existing Policy: Green Energy and Economy Act Analysis: January 12, 2011, County of Bruce, Agriculture, Tourism and Planning Committee (ATP) presented a Draft County of Bruce Wind Farm Protocol to Council. Draft protocols went to all lower tier municipalities in the County for comment. The aim of the Protocol is to give Planning staff direction on how they are to engage with wind farm developers and what development policies they are to use. On January 26, 2011, Council passed a resolution, to forward their comments to the County of Bruce which included increased setbacks, allowances for airport expansion, unfiltered electricity from the wind turbines to the substation be located underground and shielding of the warning lights on the top of the turbines. At the ROMA Conference on February 28, 2011, Members of Council presented the municipal draft protocols, to Brad Duguid, Minister of Energy along with the attached maps showing: existing and future planned projects; increased setback requirements from Primary and Secondary Urban areas and airport restricted area. With the continued citizen concerns, Council wants to establish clear protocols and direction for Wind Energy development in the
3 Council Minutes Page 3 of 5 Tuesday, April 5, 2011 Municipality that will not put the municipality in direct conflict with Provincial legislation and still protect the interests of the residents of the municipality. Lastly the Municipality of Kincardine will ensure that the project agreement between the developer and the Municipality contains the requirement for securities to secure obligations under the agreement. Please find attached a draft policy protocol for Council review, along with maps of proposed setbacks for reference purpose only. The policies were developed by sharing information with our surrounding municipalities. Community Plan Considerations: N/A Financial Considerations: N/A Options: 1. THAT Council adopt the Wind Generation System Development Policy. 2. THAT Council adopt the Wind Generation System Development Policy with modifications. 3. THAT Council not adopt the Wind Generation System Development Policy at this time. Preferred Option: Option # 1 - to establish policies for Wind Generation System development that will protect the interests of the residents of the municipality and provide direction for development. To be considered at the April 13, 2011 Council meeting. CAO s Comments: I concur. Delegations 1) Patti Richards indicated she believes the ongoing Industrial Wind Turbine development in our community poses great risk to our long term financial security and viability. She asked Council to develop a comprehensive decommissioning plan with Enbridge, to have a Councillor from the Inter- Municipal Wind Turbine Working Group work with staff on this, to ask proponents to pause process and engage in meaningful consultation with the Municipality and residents. 2) Rachel Thompson asked Council to enact a temporary moratorium citing health concern issues and property assessment impacts. 3) Barbara Ashbee cited reports on, and her own family s personal health issues resulting from, wind turbines.
4 Council Minutes Page 4 of 5 Tuesday, April 5, ) Eric Monrad, Leaderwind, spoke on decommissioning (plan is mandated, can be financially favourable), impact of proposed setbacks (very restrictive and possibly prohibitive). 5) Gordon Barr, Inverhuron & District Ratepayers Association, provided results of survey of Inverhuron ratepayers on several questions relating to wind turbines reflecting that approximately 75% do not want any more wind turbines. 6) Bob Wilson, Tiverton & District Ratepayers Association, enquired about the lawyers who provided legal advice to the Municipality on this matter and asked that Council approve a moratorium for wind farms until Municipality demonstrates appropriate and conscientious due diligence and adopts a Wind Generation Policy legally established which addresses all setbacks. Written Submissions 1) Ian MacRobbie, Enbridge, addressed concerns, raised at the March 16 meeting, relating to the Underwood and Crickshank wind farms, noting they are concerned about health-related issues and will continue to respond to all operations-related complaints. 2) Paul Austin, Acciona, provided comments on the draft policy and encouraged a collaborative effort to engage the community in both development of the policy and for projects. 3) Peter & Lynne DiCocco voiced concerns about potential project within the airport exclusionary zone, the difficulty in securing details on the proposed project and the need to protect the airport and its growth. 4) Ralph Splettstoesser encouraged proponents and opponents to be respective of the opinions of others, compared the energy production costs of nuclear compared to wind, and noted risks associated with nuclear power. The Committee of the Whole discussed: the proposed setbacks in the draft policy and whether they are reasonable/workable/ prohibitive/sufficient; decommissioning plans must keep in mind that value of salvage materials may fluctuate; the impacts on birds and other animals plus migratory routes; need to address health issues; work with other municipalities on the issues; approval of works on municipal roads; who completes the site review. Mayor Kraemer assumed the Chair. Discussion continued: wind companies spend substantial amounts on promotion but provide little in community grant; need to work within the law and have a workable solution; time frames for documents under the agreement to be submitted; impose moratorium until studies are done; working with other municipalities through the Inter-Municipal Wind Turbine

COW RECOMMENDATION concur with word changes to indicate that Council will approve works in the roads through the agreement and to clarify who will complete site review; time frame for documents, required under the agreement, to be submitted to be 60 days; metre setbacks to be 3,000 rather than 2,750, 2,750 rather than 1,750 and 800 rather than 750 with revised policy to be considered at the April 13, 2001 meeting of Council.
