1 May 10, 2011 Minutes of the Public Meeting of the Corporation of the Municipality of Port Hope held on Tuesday May 10, 2011 at 6:00 p.m. in the Council Chambers, 56 Queen Street, Port Hope, Ontario. Collins, Director of Fire and Emergency Services There were 36 members in attendance. 1. INTRODUCTION: Councillor Ellis called the meeting to order stating the purpose of the public meeting is for the Planning and Development Committee to inform the public that the proposed Draft Plan of Subdivision application is to facilitate the development of 102 lots for 40 future semi-detached residential dwellings and 62 single detached dwellings and the purpose of the Zoning By-law amendment is to establish appropriate development standards to accommodate the proposed subdivision for lands located at Part of Lot 10, Concession 1, Registered Plan 39M-834, Blocks 50, 51 and Part of Block 52. 2 2. ANY DECLARATIONS OF INTEREST FROM THE COMMITTEE MEMBERS None declared. 3. THE CLERK WILL NOW EXPLAIN THE STATUTORY NOTICE PROCEDURE S.C. Dawe, Municipal Clerk explained the statutory notice procedure confirming that notice was given in accordance with Section 34(12) of the Planning Act, R.S.O c.p.13, to all persons and agencies who were entitled to receive notice by first class mail and advertised in the local newspapers. In addition information pertaining to the proposed Draft Plan of Subdivision and Zoning By-law Amendment and location map were posted on the Municipality's Website. Notification details are contained within the Planner's Report and within File SU and ZB STAFF REPORT PRESENTATION 4.1 R. Warne, Director of Planning and Development Services reviewed the Planner's Report dated May 4, 2011 and highlighted the Background, Analysis, Circulation, Financial Impact and Conclusion. 5. CORRESPONDENCE None received. Letters and/or Comments from the Public S. C. 3 Confirmation and Reading of Written Submissions Made After the Printing of the Agenda S.C. Dawe, Municipal Clerk advised that a letter of objection signed by 31 residents of Williams Port as well as correspondence from Mr. Terry Hickey dated May 9, 2011 and Ron and Lois Frizzell dated May 5, 2011 have been received from members of the public post printing of the agenda. Agencies, Municipal Departments and Ministries In March 2011 the application was circulated to Staff and Agencies for comment as per the circulation schedule in the Planner's Report. Notification of a complete application including details of the Public Meeting scheduled for May 10, 2011 were posted in both the Northumberland News and the Northumberland Today on April 8, 2011 and April 15, Circulation responses received include Public Works/Engineering dated April 1, 2011 (Letter) and May 3, 2011 ( ), Building Department input provided during Development Team meetings, Parks, Recreation and Culture dated April 4, 2011, Fire and Emergency Services dated March 21, 2011 (Letter) and April 29, 2011 ( ), Haliburton Kawartha Pine Ridge District Health Unit dated March 22, 2011, Ganaraska Region Conservation Authority dated April 7, 2011, CN Rail dated March 31, 2011, CP Rail dated March 21, 2011, Veridian Connections dated March 30, 2011, Bell Canada dated April 6, 2011, Canada Post standard conditions of draft approval, Union Gas dated April 4, 2011, Kawartha Pine Ridge District School Board dated March 21, 2011 and AECL dated March 21, APPLICANT / AGENT TO RESPOND Applicant, Mr. Brad Smith of AON, Planning Consultant, Mr. Robert Dragicevic of Walker, Nott, Dragicevic Associates Limited and building developer Mr. Sean Mason of Mason Homes Limited were in attendance. Mr. Sean Mason provided a powerpoint presentation pertaining to the proposed development plan. Page 3 of 5

4 7. QUESTION PERIOD Questions by Council Councillor Austin regarding dimensions of parkette including proximity to roadway and maintenance and provisions of development charges by-law. Councillor Burns regarding type of fencing that may be erected and whether there will be fencing along the back yards of properties adjacent to Block "C". Deputy Mayor Gilmer regarding single access from Strachan Street to address emergency services access. Mayor Thompson regarding location of exit laneways and clarification on fencing requirements including along the easement/block "C". Councillor Turck regarding fire and emergency services response time and need for sprinkler systems to be installed in all houses and development charges. Mr. Sean Mason provided a verbal response to the concerns raised indicating that based on the separation distance of the dwellings sprinklers are not required or mandated by the Ontario Building Code; current development charges do not cover added costs for sprinkler systems, dwelling design is marketable and property would be developed in a manner that is responsive and attractive to the area; misconception that the Condo owners own the easement, but the fence and easement is legally owned by AON; and inclusion of covenants to address fencing issues including styles, materials and locations and to restrict back yard sheds and installation of sidewalks on Lakeshore Road. Mr. Brad Smith reported on the appeal period on Williams Port Little Creek and willingness to work with residents to relieve Condo Corporation from obligations to pay for the park, in exchange for relieving obligation to build it. 5 All interested parties who wish to make oral submissions this evening should approach the microphone and state your name and address for the record please. Peter Robinson, 15 Fenton Lane regarding increased density; traffic impact including access and second exit for regular traffic; target market is retirement/empty nesters which are contrary to the house styles that will attract families; pedestrian traffic safety concerns and requirement for installation of sidewalks on Strachan Street and Lakeshore Road. Mary Lepage, 15 Fenton Lane regarding clarification on letter received from Mason Homes pertaining to the term freehold/common element homes and statutory requirements under the Planning Act. If a person or public body that files a notice of appeal of a decision of the Municipality of Port Hope in respect of the proposed Zoning By-law and Draft Plan of Subdivision does not make oral submissions at a Public Meeting or made written submissions to the Municipality of Port Hope before the proposed Zoning By-law and Draft Plan of Subdivision is adopted, the Ontario Municipal Board may dismiss all or part of the appeal. 8. RECOMMENDED ACTION 8.1 Recommended Action Moved by Councillor Austin Seconded by Councillor Turck That consideration of Public Meeting submissions be referred to the Committee of the Whole Meeting following the Public Meeting.
