1 (ADDENDUM COVER SHEET) PURCHASING DIVISION BOARD OF COUNTY COMMISSIONERS BROWARD COUNTY, FLORIDA A D D E N D U M NO. 2 BROWARD COUNTY MAIN LIBRARY WIND MITIGATION (NON-SHELTERED MARKET) TO ALL PROSPECTIVE BIDDERS: DATE OF ADDENDUM: November 9, 2010 PLEASE NOTE THE FOLLOWING CHANGES, QUESTIONS & ANSWERS: 1. The bid due date remains the same; all bids are due by Wednesday, November 17, 2010 at 2:00 pm at the location listed in the bid document. The following are submitted written questions and answers: 2. Question: Will the Owner allow payment for off site stored materials for the new curtain wall, windows, aluminum and glass for the project? Background Info: Since there is limited on site storage and that the project schedule dictates that materials must be available early to be off the critical path to not put the building in jeopardy of weather related issues, the materials must be ordered far in advance of delivery and installation. Answer: Requirements for payment of stored materials is defined in Section "Contract", Article 6.3 "Payment for Stored Materials and Equipment". 3. Question: What is the minimum information you require submitted to get an RFI approval for use of our system? Answer: See Addendum No. 1 dated 11/01/10, for requirements. 4. Question 4-a: A8.0 door schedule calls for hardware group #11 on door 113 (automatic sliding entrance). Specification 3.7 K denotes #11 as being "Exterior Double Doors Auditorium". Please confirm if door 113 should be hardware group #1, not #11 as indicated. Answer 4-a: On Drawing Sheet A8.0 revise Hardware Group for Door #113 to read "#1", in lieu of that shown. Question 4-b: A8.0 door schedule calls for hardware group #6 on door 115. Sheet A1.1 denotes "staff entrance with card reader". Please confirm basis of design for the card reader so that proper pricing can be obtained. Page 1 of 10

2 Answer 4-b: For Door #115, the Card Reader is to be relocated from the existing door #113. On Drawing Sheet D1.1 at South Lobby doors add existing Card Reader (CR) on east side of door and add note "Remove and Relocate Card Reader to New Door #115, see A1.1." Question 4-c: Zone 4 and 5 wind load designations are shown in both the architectural and structural drawings. There are some discrepancies between the two, so please confirm which wind load designations will govern. Answer 4-c: Follow the Zone 5 locations shown on the structural drawings with one correction. On Structural Drawing Sheet S2.4 4 th Floor Plan at grid line B5 corner of glazing, add "Zone 5, 17'-0" Wide on both the north and east faces of the corner." 5. Question 5-a: Instructions to Bidders: Item 3, Submission of Sealed Bids states that one (1) compact disk of scanned bid document is to be submitted at the time of bid. Please confirm it would be acceptable to submit this CD within 48 hours of the bid deadline. Answer 5-a: No, the CD electronic copy should be submitted with the original bid submittal prior to the bid deadline. Question 5-b: Instruction to Bidders: Please advise whether or not we are required to submit a construction schedule with our bid. Answer 5-b: A construction schedule is not required to be submitted with the bid documents. Refer to Section "Contract, paragraph 2.1" for requirements of submitting the project schedule. Question 5-c: Instructions to Bidders: Please advise if both the bidder and the bidder s glass and glazing sub-contractor shall fill out the Questionnaire portion of the bid form and include in the Bid Package. Answer 5-c: The Questionnaire shall be filled out by the Bidder. If the Prime Contractor cannot satisfy the Qualifications and Experience requirements of the project, then those requirements shall be met by the glazing subcontractor. Question 5-d: Instruction to Bidders: Please confirm whether or not we are to include the cost of sales tax and usage tax for materials in our bid. Answer 5-d: Yes, the Contractor shall pay all applicable sales, use and other taxes, as indicated in Section 00800, Article 27 "Taxes". Question 5-e: Demolition Plans: Temporary construction barrier wall layouts shown on the demolition plans are shown to conflict with existing library book shelves. Please confirm that it is the Contractor s responsible to relocation and move back in place the bookshelves for installation of the temporary walls. Answer 5-e: Yes, the Contractor shall relocate furniture and equipment as required for installation of the temporary walls and move the same back in place when temporary walls are removed. Refer to "Furniture and Equipment Relocation" notes on Drawing Sheet A0.1 and D1.0 for additional information and requirements. Page 2 of 10

3 Question 5-f: Demolition Drawings: Temporary wall layout shown on Demolition drawings do not take into account that phases will have to be encapsulated during construction of each phase. Please confirm additional temporary construction barriers are to be added as necessary so each phase is encapsulated from the public where possible. Answer 5-f: On Drawing Sheet D1.0 under "Construction Barrier Notes" add the following note: "7. Construction Barrier shall encapsulate each phase of the work by running the construction barrier to an existing fixed building element, including a vertical mullion in the existing or new glazing system, or a column, wall, beam, etc. The construction barrier returns are not necessarily shown on the drawings. The Contractor shall include such construction barrier returns in his work, when installing the temporary walls. Question 5-g: A0.1, Spec 01270, Unit Price Schedule: Existing Note 3 on sheet A0.1 states that if during wire brushing the existing tube steel if more than 25% material occurs, then steel is to be replaced. However, this seems to conflict with the Unit Price schedule with states an exact quantity of structural repairs to include in your base bid. Please confirm that we are only to include the quantities found in Specification and listed in items 31, 32 and 33 of the Unit Price schedule in our bid. Answer 5-g: There is no conflict. Note #3 under "Existing Building" on Drawing Sheet A0.1 and the Unit Prices listed in the Unit Price Schedule in Section "Unit Prices" are exclusive of one another. Also, replace Specification Section "Unit Prices" with updated Section 01270R "Unit Prices" dated 11/08/10 attached to this Addendum. Page 3 of 4 was missing and is now included in the attached section. Question 5-h: Spec 01560: Specification section E states that it is only highly recommended that the Contractor employ a security guard to patrol the exterior construction zones and that they shall be present at least overnight and weekends when construction personnel are not present. Please be definitive and confirm that we are to include the costs for a security guard during all off hours for the duration of our project in our base bid. Answer 5-h: Section E is only a recommendation. If the Contractor elects to hire a security guard to patrol the exterior construction areas, the cost are solely the Contractors. Also, in Section 01560, add the following paragraph in 1.8 to read: "F. INTERIOR SECURITY a. During those hours the library is closed and the Contractor is performing work on the interior of the library, the Contractor shall hire a security guard to patrol the interior construction areas of the library. b. While it is not a requirement, it is suggested the security guard hired for the interior patrols be provided by the same vendor as the security guards hired by the library at the time of construction activities because they are most familiar with the library's procedures and policies. c. The cost of the interior security guard shall be borne entirely by the Contractor. Page 3 of 10

4 d. The library does have a security guard present in the security office located on the 1 st floor, 24 hours a day, 7 days a week, but they may not leave their post to patrol areas." Question 5-i: Demolition Drawings: Please advise if it is acceptable to the Library if the asbestos abatement work at Stair #1 occur during normal business hours, or if it will be required off-hours. Answer 5-i: No, per Drawing Sheet D1.0, "Asbestos Removal" notes, note #5d. The asbestos abatement work must be performed when the library is closed. Question 5-j: Demolition Drawings: Please provide the logic of the temporary construction barrier numbering system, i.e. CB-5 and what it refers to. These numbers don t appear to relate at all to phases A, B, C, etc Answer 5-j: The construction barrier numbers refer to the type of barrier which are listed in the "Construction Barrier Legend" shown on demolition drawings. Question 5-k: LS-2: Regarding the construction sign shown on sheet LS-2, please advise if we are to provide a specific amount of these signs, or just one by the main entrance. Answer 5-k: Provide one (1) Construction Sign shown on Drawing Sheet LS-2 and locate it along Andrews Avenue near the "Proposed Construction Staging Area" shown on Sheet SP1.0. Question 5-l: Spec 08441: Please confirm is the curtain wall test mock-up can also be reviewed and approved for visual acceptance by the architect. Answer 5-l: Yes, the test mock-up can also be reviewed and approved for visual acceptance by the Architect provided: 1. Test mock-up represents all the conditions and configurations required by the Architect for review and approval. 2. Test mock-up must be installed in strict accordance with the requirements of the project Specification. 3. Additional configurations of the mock-up may be required by the Architect for review and approval. Additional configurations may be used not only to confirm the system meets the project requirements, but set the standard for quality workmanship and the basis for final appearance. Question 5-m: A4.0 through A4.7: Please confirm if the curtain wall and sloped glazing mullion profiles shown on the drawings are to be strictly adhered. Answer 5-m: New glazing mullions shall have a 3" face width. The mullion depth is not a fixed dimension. Question 5-n: S4.3 and S4.4: Temporary wall details are shown on sheets S4.3 and S4.4. However, these details do not state address the following: a. Should the exterior of the wall be waterproofed? If so, please provide details and acceptable products to be used. Page 4 of 10

5 b. Should the exposed portion of the slab created after the removal of the existing curtain wall systems be waterproofed? c. Please advise if the interior drywall layer is to be painted. d. Please confirm how the interior drywall layer is to be painted. Answer 5-n: On Drawing Sheet D1.0, Detail #2/D1.0 "Zip Wall Containment Detail" shows the exterior side of the temporary partition to be painted and the interior drywall to be left unpainted. Also, on Detail #2/D1.0 add the following: 1. On the exterior side of the temporary partition install 6 MIL Visqueen vapor barrier to cover the plywood and all joints, taping it to adjacent surfaces. "Shiplap" pieces so to allow water to shed off the wall. 2. On portions of the concrete floor exposed on the exterior side of the construction barriers install 6 MIL Visqueen vapor barrier on floor, up the barrier wall at least 6 inches and draped over edge of floor slab. Over the Visqueen install 3/4" exterior grade plywood sheathing as a walking surface, anchored to the concrete floor below to prevent plywood from lifting up or from moving. Be careful to miss under-floor electrical duct in the concrete slab where it occurs. 3. When area is finished, remove plywood and Visqueen and patch holes in concrete slab to match. Question 5-o: S4.4: Please refer to section 1/S4.4 6 th Floor Terrace. Installation of the temporary construction barrier at the atrium will require scaffolding down to the 4 th Floor, between below, and require temporary closure of that portion of the library. Please advise if heavy duty debris netting can be installed in lieu of the structural steel and metal framed & sheathed temporary construction barrier. Answer 5-o: The Contractor is required to provide a barrier of sufficient strength around the scaffolding on the 4 th Floor to protect building occupants in adjacent areas from falling objects and from walking into the scaffolding. Question 5-p: S4.4: Detail 1/S4.4 shows plywood sheathing on the exterior side of the temporary construction barrier framing. However, since the plywood is directly the behind the curtain wall and the intent is for this wall to be installed prior to removal of the curtain wall, it will be impossible to install this plywood. Answer 5-p: We have two suggestions: Either assemble the temporary partition with the plywood attached prior to installing the partition in place - or - install the plywood on the interior side of the partition instead of the drywall. Question 5-q: S4.4: Please refer to detail 2/S4.4, which shows support angles welded to drywall framing track, both at the floor and ceiling conditions. For ease of removal and relocation, please advise if these angles can be bolted to the drywall framing. Answer 5-q: On Sheet S4.4 Section 2/S4.4 shows the head of the frame bolted and not welded to the support angle. Refer to details on Drawing Sheet S4.3 for additional information. Page 5 of 10

6 Question 5-r: S4.4: Please confirm what is referenced as steel channel at the base of wall on detail 2/S4.4 is actually light gage metal framing. Answer 5-r: Please refer to the temporary wall details #3, #4, #5 and #6 on Drawing Sheet S4.3 which specify the channel sizes and other specifics about the temporary walls. Question 5-s: Please confirm it will be acceptable to temporarily close off the area on the 4 th floor between column lines G and H and 4 and 5 for installation of scaffolding necessary for the construction of the atrium temporary construction barrier on floors 6 through 8. Answer 5-s: Yes, it is acceptable to temporarily close-off a portion of the 4 th Floor under the 6 th Floor South Terrace glazing for installation of scaffolding. Question 5-t: Since it is possible that scaffolding or equipment at the 4 th floor atrium floor will be required, please have the structural engineer provide the maximum allowable dead load per square foot for this slab. Answer 5-t: The maximum floor allowable deadload for the 5 th Floor area is 100 pounds per square foot (100 PSF). Question 5-u: Since it is possible that equipment will be required at both the exterior terraces, in particular the 6 th floor terrace on the south side, please have the structural engineer provide the maximum allowable dead load per square foot for this slab. Answer 5-u: The maximum allowable floor deadload for the terraces if 100 pounds per square foot (100 PSF). Question 5-v: A1.3, A1.4: At the south offices on the 3 rd and 4 th floors between column lines 3 and 4, the full height partitions as labeled as drywall partitions. From review on site, these partitions seem to be composed of a perimeter hollow metal framing with infill framing and drywall, which is not typical and will not be practical to cut /splice and match existing. Considering that approx. 6 sections of these partitions will have to be removed for installation of the temporary walls, please provide details of the finished wall extensions. Answer 5-v: Details for the partitions in questions are provided on Drawing Sheet A5.0, Details #1 through #7. 6. Question 6-a: Measurements of 1 0 for head and sill and 5 4 for enclosure panel on detail 5 / A4.1 seem to be incorrect. The proposed system profile is noted elsewhere as 3, not 1. This is probably just a typographic error on the Architectural drawings. Please clarify desired dimensions. Answer 6-a: Yes, dimensions (1'-0" and 5'-4") indicated on Sheet A5.1, Detail 5/A4.1 are typos; revise them to read 3", 11"±, 3". Question 6-b: Atrium where elevation W is located has interior return walls noted that Zone 5 is not required. By similar reasoning, are the returns beneath the canopy on the Northeast entrance considered Zone 4 walls? Please confirm that all alcove walls and similar recessed terraces are to be considered Zone 4 conditions. Page 6 of 10

7 Answer 6-b: I believe the reference is actually about the south side glazing on the 6 th Floor at the atrium glass wall. On the south side of the building the alcove walls are required to be Zone 4, nor Zone 5. Also, at the one alcove on the north side of the 4 th Floor between grid lines 3 and 4 at grids B and C the walls are to be Zone 5. The corner at grid A3 is required to be Zone 5 as shown on S2.4. Question 6-c: Per Elevation 3 / A4.5, the automatic sliding doors on the First and Second Floor Northeast Entrances are noted as partially being in Zone 4. The wind load in this Zone 5 condition is -108 PSF per the tributary area and chart. Currently the maximum wind load available on an automatic slider with a current Miami-Dade NOA is +80 / -80 PSF. Please advise. Answer 6-c: The doors in question, #103 and #203 at the northeast entrance are actually swinging doors, not sliding doors. Question 6-d: The specified glass manufacturer has noted that they are unable to warranty against breakage, as there are many causes for breakage outside of their control. Please advise. Answer 6-d: We agree. Specification 08800, 1.11 does not ask for a warranty against breakage. However, the glass manufacturer should provide a written review of the glazing Contractor's shop drawings. Review to include, but not limited to the application of their glass for the proposed application, ability of their glass to meet the performance requirements and ability of the system to protect their glass from delamination or stress cracks. Question 6-e: Viracon has noted they cannot meet glass deflection that will meet L/50 times the short side or 1 minimum stipulation universally, as deflection is dependent on glass size, construction and loads. Viracon does not have control over these factors in the project. Please advise. Answer 6-e: Provide structural calculations, signed and sealed by a Professional Engineer registered in the State of Florida, to note conditions, if any, that cannot meet this project requirements for Architect's review and consideration. Question 6-f: Viracon now uses 100% silicone (base polymer) setting/side blocks for all applications. Due to the variety of components and suppliers it is not possible for Viracon to provide compatibility testing. They note that the sealant manufacturer should perform testing of the compatibility of sealants in order to insure proper sealant selection. Answer 6-f: Agreed. However, sealant manufacturer must be provided with samples in sufficient time to provide an evaluation of the compatibility of the materials. Question 6-g: Viracon has noted they can provide information on float glass from suppliers but they cannot provide test reports from a qualified testing agency. Their insulating glass units are an engineered product and they will provide solar and optical performance data, based on LBL Window 5.2 program methodology. Their units meet IGCC CBA and IGCC E2190 level certification, which supersedes IGCC CBA but Viracon takes exception to providing additional reports from certifying agencies. No test reports are available for tinted/coated glass products. Viracon s published performance values are determined per Page 7 of 10

8 National Fenestration Rating Council (NFRC) 300 methodology and they are certified by the NFRC, but the NFRC does not issue test reports. Please advise if this is acceptable. Answer 6-g: Providing performance levels based on LBL's Window and certifications from IGCC and NFRC should be acceptable in lieu of the test reports. Question 6-h: Viracon makes every effort to provide glass from a consistent supplier for each project. Viracon notes that they reserve the right to utilize additional suppliers to ensure delivery commitments are met. In addition, Viracon has incoming specifications on all products. If warranted, Viracon will make necessary representation. Due to scope of work, however, Viracon notes that regular scheduled inspections are impractical. Please advise if this is acceptable. Answer 6-h: We are unaware of the referenced "regular scheduled inspection" requirement. Further, the intent of the single source requirement is for the glazing system manufacturer to use a single source such as Viracon. Question 6-i: Viracon has noted that their warranty term begins from date of manufacture only. Extended warranties are available at additional cost. Their warranties also cover defective material and workmanship only. Terms are 10 years for high performance coatings, 10 years for insulated glass, and 5 years for laminated glass. Please advise if this is acceptable. Answer 6-i: All warranties start at substantial completion of the project, not when products are manufactured or shipped. Warranty requirements are noted in Specification Section Glazing, paragraph 1.11 Warranty". 7. Drawing Sheet A0.1 and Sheet D1.0, refer to "Furniture and Equipment Relocation" notes. Add the following note to read: "7. Furniture and equipment encountered which is to be relocated by the Contractor when construction activities begin, may be different than what is shown on the Drawings herein. Library may have moved furniture and equipment in the time period between completion of the Drawings and start of construction. The Contractor is responsible to relocate furniture and equipment present in the areas of construction work at the time construction starts in each area whether or not that furniture and equipment is the same as depicted on the Drawings, at no additional cost to the Owner." 8. Drawing D1.0, refer to General Demolition Notes. Add the following note to read: "20. Contractor is responsible to provide protection on the interior of the freight elevator while moving construction materials and personnel. The freight elevator was recently refurbished with all new stainless interior. Any damage to the elevator resulting from moving construction materials and personnel shall be repaired at the Contractor's expense to the Owner's satisfaction." 9. Permitting Clarification: The following is a list of known required permits, their status and fees. Page 8 of 10

9 Permit and Agency Review and Approval Requirements a. Broward County Development and Environment Regulation Division: Building Permit Review: completed and permit received. Fee paid by the County. Tree Removal/Relocation License: License No. TP was issued on 9/22/10 and expires 9/22/12. Fee paid by the County. Asbestos Removal: According to Broward County "Environmental and Growth" website, the fee appears to be $ for removal of 421 to 3,000 square feet or linear feet of asbestos. Contractor shall verify the amount prior to submitting a permit. b. City of Fort Lauderdale, Building Department: Building Permit: Permit applied for and under review. Permit number: County paid a deposit of the permit fee in the amount of $2, There is a known balance of $10, due prior to issuance of this building permit. There may be additional permits required by the Fort Lauderdale Building Department for which we are not aware. Maintenance of Traffic Plans: The Contractor is responsible to obtain and pay for this permit from the Building Department. The fee is based on the amount of work to be performed and will be determined at the time of application. c. Contractor is responsible to verify all permitting requirements and apply for same in accordance with all applicable codes, ordinances, etc. 10. Drawing Sheet A0.1: Refer to "Order of Construction Notes" Add the following note to read: "16. As each phase or area of the work is completed and ready to be turned over to the library, the Architect and Owner will perform a punch list inspection of each area, thus providing the Contractor with a list of items to be addressed prior to returning that area to the library. The Contractor shall make such corrections noted on the phase punch list prior to turning the area back over to the library." 11. Question 11-a: Please advise who will be responsible to pay permit fee? If the owner is responsible to pay for all permit fees, its fine, otherwise it is better to establish an Allowance for Permits. Answer 11-a: Per Specification Section 00405, Broward County pays all County permits, licenses and fees and as per Specification Section 00800, 11.1, the Contractor pays all Non-County permits, licenses and fees. The Bidder is responsible to verify the permits and fees required and include those costs in their Bid. Question 11-b: Please clarify who will be responsible to pay the cost for Inspections and Testing? Answer 11-b: Refer to Specification Section "Quality Control", paragraph 1.7 "Inspection and Testing Laboratory Services". Question 11-c: As per specification section Summary of Work, Paragraph 1.5 regarding Security Requirements, Construction cannot be reproduced nor they can be shared or issued publically. Please advise how can we get the cost of different trades from our subcontractors without sharing and reproducing the project Documents. Page 9 of 10

10 Answer 11-c: Paragraph A of section 01110, 1.5 is revised as follows so as to delete restrictions against reproduction of documents: The revised paragraph A might be as follows: A. Contractor has been provided Construction Documents for the Broward County Main Library depicting Interior Partitions, Room Names and Department Areas. In doing so, it must be established that the issuance of all drawings presents a security threat. The Construction Documents provided cannot be reproduced nor can they be issued publicly. Chapter , Florida State Statues presents exemptions from inspecting or copying of Public Records. Section (3)(B), (3)(C) exempt Building Plans, Blueprints, Schematic Drawings from the "Public Record". The plans provided are shared in the strictest of confidence and may not be reproduced only for the purpose of bidding the project in any manner. Upon completion of the Contract Administration, the Broward County respectfully requests the return of the Plans issued as a part of this Contract. Returns shall be made to the office of the Architect. 12. Question: By reviewing the plans and scope of work for the above subject project it reveals the complexity of the project. The building is state-of-the art and because of it s uniqueness it is very important to Bid the project with great planning. Additionally, because of the security requirements as per specification section 01110, paragraph 1.5 it s very hard, difficult and time consuming to coordinate with subcontractors to get the pricing. We as a General Contractor believe that time given to prepare & submit bid document is not sufficient. In order to get the best value of the project and analyzed thoroughly Additional Time is required. This is also in the interest of the Owner to get a well analyzed, responsible and responsive bid. Therefore, I would like to request you to please extend bid due date for additional 2 weeks. I will really appreciate if you could please extend the Bid due date. 13. Answer: The bid due date remains the same; all bids are due by Wednesday, November 17, 2010 at 2:00 pm at the location listed in the bid document. This addendum SHOULD be acknowledged on the Bid Tender Form or returned with your invitation for Bid due Wednesday, November 17, 2010 at 2:00 pm. All "must" documents are considered a matter of responsiveness and shall be submitted at the time of bid. Failure of a Bidder to return the documents shall be cause for rejection of the bid. All other terms, conditions and specifications remain unchanged for. NAME OF COMPANY: Page 10 of 10

11 SECTION 01270R UNIT PRICES PART 1 - GENERAL 1.1 SECTION INCLUDES A. Measurement and payment criteria applicable to portions of the Work performed under a unit price payment method. B. Defect assessment and non-payment for rejected work. 1.2 AUTHORITY A. Measurement methods delineated in the individual specification sections complement the criteria of this section. In the event of conflict, the requirements of the individual specification section govern. B. Take all measurements and compute quantities. The Project Consultant and Owner will verify measurements and quantities. C. Assist by providing necessary equipment, workers, and survey personnel as required. 1.3 UNIT QUANTITIES SPECIFIED A. Contractor shall provide The Project Consultant and Owner with quantities indicated in paragraph 1.8 Schedule of Unit Prices, herein, and the Contractor shall enter the amounts on the Bid Tender Form, Section 00400, Article 00407, Schedule of Prices Bid. All materials and labor to be used in the project shall be accounted for and submitted before the start of construction. These Unit Quantities are for bidding and contract purposes only. Quantities and measurements supplied or placed in the Work and verified by the Project Consultant and Owner determine payment. B. If the actual Work requires more or fewer quantities than those quantities indicated, provide the required quantities at the unit sum/prices contracted. 1.4 MEASUREMENT OF QUANTITIES A. Measurement Devices: 1. Weigh Scales: Inspected, tested and certified by the applicable Florida or The Broward County Board of County Commissioners within the past year. 2. Platform Scales: Of sufficient size and capacity to accommodate the conveying vehicle. Stipulated Sum/Price Measurement: Items measured by weight, volume, area, or linear means or combination, as appropriate, as a completed item or unit of the Work. 1.5 PAYMENT A. Payment Includes: Full compensation for all required labor, Products, tools, equipment, plant, transportation, services and incidentals; erection, application or installation of an item of the Work; overhead and profit. B. Final payment for Work governed by unit prices will be made on the basis of the actual measurements and quantities accepted by the Project Consultant multiplied by the unit sum/price for Work which is incorporated in or made necessary by the Work. 1.6 DEFECT ASSESSMENT A. Replace the Work, or portions of the Work, not conforming to specified requirements. B. If, in the opinion of the Project Consultant and Owner, it is not practical to remove and replace the Work, the Project Consultant will direct one of the following remedies: 1. The defective Work may remain, but the unit sum/price will be adjusted to a new sum/price at the discretion of the Owner. 2. The defective Work will be partially repaired to the instructions of the Project Consultant, and the unit sum/price will be adjusted to a new sum/price at the discretion of the Owner. C. The individual specification sections may modify these options or may identify a specific formula or percentage sum/price reduction. D. The authority of the Project Consultant and Owner to assess the defect and identify payment adjustment, is final. 13 1.7 NON-PAYMENT FOR REJECTED PRODUCTS A. Payment will not be made for any of the following: 1. Products wasted or disposed of in a manner that is not acceptable. 2. Products determined as unacceptable before or after placement. 3. Products not completely unloaded from the transporting vehicle. 4. Products placed beyond the lines and levels of the required Work. 5. Products remaining on hand after completion of the Work. 6. Loading, hauling and disposing of rejected Products. 1.8 UNIT PRICES A. Unit Price No 1: Structural repair of existing steel curtain wall mullion supports along the first floor slab edge. 1. Description: Removal and replacement of structural steel curtainwall mullion support angles along the first floor slab edge, including removal and replacement of interior concrete floor topping and terrazzo finish. Drawing reference Detail #6 "Unit Pricing Typical Angle Fix" shown on Drawing Sheet S Unit of Measurement: a. Two (2) linear feet of steel angles ad detailed on Sheet S4.2, Detail "Unit Pricing Typical Angle Fix" with repairs shown. b. Replacement terrazzo floor finish shall match existing in all respects.
