22 Environmental Conditions Agreed to by the Hampton Iona Community Group and the Ministry of Transportation, Ontario Condition #1: The construction site required for the bridge rehabilitation will be designed so that no trees will be included within the construction site. Mitigation #1: We agree that no trees will be included within the temporary construction site. In addition, those trees in close proximity to the site will be provided with protection. A bid item, barrier for tree protection, will be included in the contract and the trees requiring this protection will be identified on the drawings.
23 Environmental Conditions Agreed to by the Hampton Iona Community Group and the Ministry of Transportation, Ontario Condition #2: The size of the construction site will be approximately 75 m x 150 m as indicated in your public notification of June 4, 2005 and in the location noted in the same public notification. Mitigation #2: We agree to the size constraint in your , however I should clarify that in the PIC Meeting I further constrained the area to that bounded by Island Park Drive to the east, the Queensway to the south, the recreational path to the north and a dimension of approximately 80 m from the existing edge of pavement. This area is significantly less than the 75 m x 150 m indicated in the notice. We continue to refine the needs of the project and we will continue to review this area and ensure that the footprint is as small as possible within the limits identified.
24 Environmental Conditions Agreed to by the Hampton Iona Community Group and the Ministry of Transportation, Ontario Condition #3: Any area of the park that is used (and we define the entire area of Hampton Park including the field adjacent to the Queensway as park) will be returned to its current condition. Should any trees be killed during construction, they will be replaced by trees of a comparable age. The Ministry of Transportation will commit to take care of any replacement trees until they are fully established and should any replacement trees die, they in turn will be replaced. Mitigation #3: We agree that any area disturbed by construction activity will be returned to its preconstruction condition. Furthermore we will complete a precondition survey of the site with the property owner (NCC) and document the preconstruction condition. A similar post-construction survey will be conducted after the contractor has completed reinstatement to ensure that the preconstruction conditions have been achieved. The Ministry will ensure that any trees planted, as mitigation in this project, will be warranted until they are established.
25 Environmental Conditions Agreed to by the Hampton Iona Community Group and the Ministry of Transportation, Ontario Condition #4: An 8 to 10 foot fence will be erected around the entire work site. Mitigation #4: A solid wood fence, 8 to 10 feet tall, will be erected around the temporary construction site. The Ministry will further require that this fence be painted. Both the final height of the fence (minimum 8 feet) and the colour of paint will be proposed during detail design for public comment.
26 Environmental Conditions Agreed to by the Hampton Iona Community Group and the Ministry of Transportation, Ontario Condition #5: The work will be completed within one construction season. Mitigation #5: The temporary construction site will only be used for one construction season.
27 Environmental Conditions Agreed to by the Hampton Iona Community Group and the Ministry of Transportation, Ontario Condition #6: The above five conditions will form part of i) the tender specifications that are issued and ii) the signed contract. The tender documents and the relevant sections of the commercial contract will be provided to Hampton Iona for our inspection. Mitigation #6: The above five (5) conditions will be included in the contract documents (operational constraints, specifications, tender, and drawings, as appropriate). The parts of the contract that reference these conditions shall be made available to HICG executive for review prior to tendering. A copy of the contract will be provided to HICG after award of the contract. These conditions will also be made available at the PIC during detail design for the Island Park bridge replacement.
28 Environmental Conditions Agreed to by the Hampton Iona Community Group and the Ministry of Transportation, Ontario Condition #7: The Ministry of the Environment will be advised that these are the conditions that have been agreed upon in order for us to withdraw our bump-up request. Mitigation #7: All conditions and commitments agreed to herein will be further documented in the Design and Construction report required for the project as part of the environmental approval process.
