5 Six Good Faith Efforts Make sure that DBEs are aware of contracting opportunities through outreach and recruitment activities Make information available to DBEs by posting solicitations for bids for a minimum of 30 calendar days Firms competing for large contracts must consider subcontracting with DBEs Encourage contracting with a group of DBEs when a contract is too large for one firm to handle individually Use services and assistance of Small Business Administration and/or Minority Business Development Agency of the U.S. Department of Commerce If the prime contractor awards subcontracts, require the prime contractor to take the above steps

6 DBE Good Faith Documentation Shortly after the bid opening, the lowest responsible bidder is required to submit a summary of DBE good faith efforts including copies of publication to solicit DBE sub-contractors (for a minimum of 30 calendar days), dated communications ( , fax, telephone calls and meetings) with DBE subs, search of DBE subs, quotations from DBE subs, acceptance of quotations, reasons for rejection of quotations and other efforts.

7 DBE Certification Under DBE program, entities can NO longer self-certify. Contractors and sub-contractors must be certified at bid opening. Must be certified by one of the following: EPA; Small Business Administration; Department of Transportation; Tribal, State and Local governments or Independent private organization. Include proof of certification in your bid proposal. Attach a certification to Form (DBE Subcontractor Performance Form)

8 DBE Utilization There are 4 categories of DBE Utilization: Construction Supplies Equipment Services (business services, professional services, repair services and personnel services)

9 OCWD DBE Reporting OCWD is required to submit DBE Utilization Report (containing payments actually made to all participating DBEs) semi-annually to the SWRCB Deadline of DBE Utilization Report is April 10 and October 10 of each fiscal year

10 DBE Forms to be Included in Bid Proposal Include Form and Form in your Bid Proposal Make Copies of Form if More Than one DBE Sub-contractor will be Utilized Attach a DBE Certification to Each Form

15 Davis-Bacon Labor Compliance OCWD will discuss the weekly certified payroll requirements and other required documents of Davis-Bacon labor compliance program (a Federal labor compliance program) with the lowest responsive bidder after the bid opening.

16 American Iron and Steel Compliance OCWD will discuss compliance with the American Iron and Steel requirements with the lowest responsive bidder after the bid opening.
