1 D4.1a, January 2010 ESD implementatin in the Netherlands Implementatin f the Directive n energy efficiency and energy services 2006/32 EC is the respnsibility f the Ministry f Ecnmic Affairs. All ESD requirements are effectively in place, hwever the legal basis fr certain elements are in the adptin prcess. The draft law Rules regarding Energy Efficiency (Law n the implementatin f EC-directives energy efficiency), which is currently under review, serves nly t cdify the Dutch practice int legislatin. Legal cntext The draft law was apprved by the 2 nd Chamber n 3 July It was debated in the 1 st Chamber n 24 March The vte n the prpsal has been put n hld, awaiting a nvelle (draft law t imprve a draft law that is already under cnsideratin f the 1 st Chamber). Cncerns regarding privacy f end-users, especially in relatin t remte reading f smart meters, have frced the 1 st Chamber t pstpne the vte n the prpsal. One element f the prpsal will be adapted; the legal penalties fr the refusal t cperate with the instalment f smart meters will be withdrawn. The prpsal will nw be taken int cnsideratin tgether with the prpsal n the imprved functining f the electricity and gas market.at the time f writing n new date had been set. Status f the implementatin In practical terms the Netherlands has reached full implementatin f the ESD requirements. Frmal transpsitin remains utstanding. Full transpsitin will ccur n the passing f the prpsed draft legislatin entitled: Rules regarding Energy Efficiency (Law n the implementatin f EC-directives energy efficiency), which cdifies implementatin. The fllwing table identifies the ESD articles cvered by the prpsal: Article 4: Energy Savings Targets As f 2008, NLAgency, frmerly SenterNvem, has been mnitring the prgress twards achieving the natinal indicative energy savings target and peridically reprts t the Ministry f Ecnmic Affairs. Results in relatin t the intermediate indicative target will be published in the 2 nd NEEAP. Article 5 Energy end-use efficiency in the public sectr

2 Several measures are in place in the Netherlands, crrespnding t the list f pssible measures set ut in Annex VI. The prgramme Sustainable Operatins - Gvernment (Duurzame Bedrijfsvering Overheid, DBO) sets criteria regarding sustainable prcurement. Fr a large number f prduct grups (at the mment: 52 grups), a set f criteria is available aiming at the mst imprtant aspects f sustainability fr this grup. The aim f the prgramme is t achieve 100% sustainable prcurement by the ministries in Municipalities have the ambitin t achieve 75% in 2010 and 100% in Mre infrmatin can be fund via the website: (in Dutch nly) The administrative, management and implementing respnsibility fr the DBO prgramme has been assigned t NLAgency, the Dutch Agency fr sustainability, innvatin and internatinal business cperatin. Article 6 Energy distributrs, distributin system peratrs and retail energy sales cmpanies As f 2008, NLAgency has been mnitring and reprting n the prgress f achieving the natinal indicative energy savings target. This task is carried ut in clse cperatin with the Energy Research Center in the Netherlands (ECN). T gather data n aggregated energy cnsumptin frm distributrs, distributin netwrk wners and energy suppliers, existing surces and reprting requirements are used whenever pssible, this in rder t keep the administrative burden t a minimum. Where available data is insufficient, r inadequate, market actrs can be bliged t prvide the data required fr reprting. Infrmatin submitted will be used fr mnitring purpses nly. The Netherlands has chsen t transpse article 6, part 2 under b, but als implements cmplementary measures under article 6, part 2 a. Vluntary Agreements (VA) are the main tl fr implementatin in the Netherlands. The subsidy is available t wnersccupiers (maximum 200, cstf advice ranges between 150 and 300) VAT reductin frm 19% t 6% Owners-ccupants can apply fr a subsidy fr insulating glass, including instalment. The subsidy is available fr hmes built befre 1995, with a maximum f At least 5m 2 f glass shall be installed and instalment must be in cmpliance with the rules set in the Nederlandse Praktijkrichtlijn (NPR) Energy saving lans prvides lw interest lans t private hme wners fr investments in energy efficiency. The State guarantees the lan, which runs fr a maximum f 15 years. This can be cmbined with ther measures. Fiscal incentive fr private funds that are 2

These may include sustainable husing, renewable energy, eclgical agriculture and nature and frestry prjects and is pen t wner-ccupiers fr the imprvement f energy efficiency f their hmes. There is n minimum lan size. Running perid is 15 years. The Energy Investment Tax rebate is a fiscal measure. It is pen t businesses wanting t invest in energy saving techniques and the use f renewable energy in their enterprise. Article 6 f the Directive mentins that the use f VAs can be an alternative t the measures listed underarticle 6, part 2(a), as lng as they have the same effect as these measures. In rder t verify this, VAs have t be assessed, supervised and fllwed up. The Netherlands cmplies with Article 6 part 2 (b) by undertaking the fllwing actins: The Cvenant Benchmarking, which is an agreement between the gvernment and the energy intensive industry fr imprved efficiency f energy in installatins. Mre with Less is the cvenant between the Ministry f Ecnmic Affairs, the Ministry fr Husing and market actrs, wh agreed that by millin existing buildings shuld be 30% mre energy efficient. On 9 Nvember 2009, a new public campaign was launched n saving energy in the hme ( The cvenant Energy saving in the scial husing sectr aims, amng ther ambitins, t save 24 PJ ver the perid , by investments in the scial husing stck. Lng Term Agreements (LTAs), the Dutch term used fr Vluntary Agreements and synnymus with VAs, require participating cmpanies t develp an energy saving plan, t implement this plan and t reprt n prgress f its implementatin. They als have t create an energy management system and register the use f energy. The Netherlands has been using LTAs since 1992, invlving a large number f sectrs. In 2000, the first series f LTAs was cncluded successfully. In the perid 1989 t 2000, energy savings f 22.3% were achieved. In April 2008, an agreement between the building sectr and the Dutch gvernment was signed n saving energy in new cnstructin (Spring Agreement Lente akkrd). This aims at 50% mre energy efficiency in new buildings by 2020, cmpared t 2007 and 25% in The sectr has the bligatin t aim fr energy neutral buildings in Article 9 Financial instruments fr energy savings A mdel cntract fr energy services can be fund here: 3

4 Article 12 Energy audits Besides the energy certificate fr buildings, established under Directive 2009/91/EC, the fllwing energy audit measures are in place in the Netherlands: EPA Custmized Advice Energy savings scut (nline tl) Installatin perfrmance scan (standardized instrument) The EPA custmized advice prvides insight n cnstructinal and installatin imprvement measures, fr husing as well as the utility sectr. The difference between the custmized advice and the cmpulsry energy label is that mre attentin can be paid t the specific situatin (hence custmized advice ). Only a certified auditr can perfrm the EPA custmized advice. The energy savings scut is a free nline tl, which identifies pssible energy saving measures in husing and utility buildings in a cuple f steps. It als shws the financial benefit f each set f measures. The calculatins n which the tl is based are based n the calculatin methdlgy f the energy label and custmized advice. Anther tl is the standardized installatin perfrmance scan, which prvides insight int pssible imprvements t climate installatins in buildings. Imprvements made n the basis f the utcme f the scan can lead t reduced energy cnsumptin, as well as a lwer risk f malfunctining. Article 13: Metering and infrmative billing f energy cnsumptin Distributin netwrk wners and energy suppliers already ffer cmpetitively priced, individual, digital and smetimes smart metering devices t final cnsumers. Billing accurately reflects energy cnsumptin. Billing ccurs at least annually. Additinal effrts The prgramme Clean and Efficient ( Schn en Zuinig ) describes the climate gals fr the Netherlands. The targets f this climate plicy are: A reductin f greenhuse gas emissins by 30% cmpared t 1990 A rate f energy efficiency imprvement f 2% per year A share f renewable energy f 20% in In this prgramme six ministries wrk tgether, ensuring varius plicy areas are integrated and fcused n achieving a sustainable energy system within a few decades. Future planning At the time f writing n adptin date fr the draft implementing law in the 1 st Chamber had been set. Reprting n implementatin will fllw the requirements as stipulated in the Directive. In 2010 a review f the Clean and Efficient prgramme will take place. If the results f this review are negative, additinal measures and plicies will be develped. 4

5 The evaluatin f the first NEEAP is in prgress. The Netherlands cntinuusly review Energy Efficiency imprvement measures, as well as explre new measures and instruments. The preparatry prcess fr develpment f the 2 nd NEAAP has started.
