(Trow) was retained by DCR Phoenix Development Corporation Limited to complete a Phase I Environmental Site Assessment (ESA) on 256 Rideau Street and 211 Besserer Street in Ottawa, Ontario. For the purpose of this report the properties are here after referred to as the subject site. The work was completed in accordance with the general requirements of CSA Standard Z768-1, November 21, which outlines the protocol for Phase I Environmental Site Assessments. As per Z768-1, the scope of work included a review of available historical land use and occupancy records, a visual inspection of the site and surrounding properties; and interviews with person(s) having knowledge of past and present site activities. Intrusive sampling and analysis were not part of the scope of work for this environmental investigation. Please note that general environmental management practices were reviewed as part of this assessment insofar as they could impact the environmental condition of the Site; however, a detailed review of regulatory compliance issues was beyond the scope of our investigation. The following summarizes the findings related to the Site. The Site is currently developed with a 3 storey light commercial building which is currently used for fur retail, repair, storage, and restyling. The building is timber framed construction with a brick exterior and a shingled roof. The rear portion of the site (fronting onto Besserer Street) is used as a parking lot. This area was previously occupied by residential houses. There is a potential that construction debris associated with the house demolition may be present in this area. A geotechnical investigation is currently being conducted on the Site by Trow. Four boreholes have been advanced on the Site as part of this investigation. A suspected underground storage tank (UST) was encountered on-site at the northwest corner of the property during the drilling program. This UST is considered to be an area of potential environmental concern (APEC). Trow recommends that this UST be removed from the Site. According to a historical fire insurance plan of the area and a property use directory file search a retail fuel sales outlet was present at 244 / 246 Rideau Street, approximately 3 m west of the site from 1936 to This retail fuel sales outlet is considered to be an APEC due to its proximity to the Site. The on-site building was constructed before 19 therefore there is the potential that special attention substances are present within the building. Prior to any renovations or demolition of the building, a designated substances survey (DSS) should be completed to identify any designated substances that may be present in the building. Based on the information gathered during the completion of this Phase I ESA, a Phase II ESA is recommended for the Site. Trow recommends that the suspected UST encountered during the geotechnical drilling program be removed from the Site. Trow recommends that prior to any renovations or demolition of the building, a designated substances survey (DSS) should be completed to identify any designated substances that may be present in the building. (Trow) was retained by DCR Phoenix Development Corporation Limited to complete a Phase I Environmental Site Assessment (ESA) on 256 Rideau Street and 211 Besserer Street in Ottawa, Ontario (Appendix A, Figure 1 and Figure 2). For the purpose of this report the properties are here after referred to as the Site. The work was completed in accordance with the general requirements of CSA Standard Z768-1, November 21, which outlines the protocol for Phase I Environmental Site Assessments. As per Z768-1, the scope of work included a review of available historical land use and occupancy records, a visual inspection of the site and surrounding properties; and interviews with person(s) having knowledge of past and present site activities. 1.1 Objective The objective of this Phase I ESA was to identify potential sources of environmental concern to the subject site. Trow understands that DCR Phoenix Development Corporation Limited intends to purchase and develop the property. This Phase I ESA is being conducted for due diligence purposes. 1.2 Scope of Work A Phase I ESA is a non-intrusive investigation and involved the following components: i) a records review component; ii) an interview component; and, iii) a detailed site inspection. The records review component is intended to compile background information regarding the site. Sources of information that were consulted include historical aerial photographs and geological maps. As part of the interview component, various regulatory authorities (i.e., Ontario Ministry of Environment (MOE) and Technical Standards and Safety Authority) were contacted for any information they may have on the property. These file searches can take several weeks to months to complete and therefore any pertinent information received after the completion of the Phase I ESA that affects the findings will be forwarded to the client. The detailed site inspection component was conducted to identify the potential presence of surface or subsurface environmental contaminants. Visual signs of subsurface contamination were made by examining things like vegetation stress, staining, surface depressions, etc. 1

Site Description The Site is located at 256 Rideau Street and 211 Besserer Street in Ottawa, Ontario (Appendix A, Figure 2). According to the City of Ottawa, the site consists of two different properties, 256 Rideau Street and 211 Besserer Street. 256 Rideau Street is legally described as PLAN 6 LOT 7 E62 and has an area of 6138 ft 2 (57 m 2 ). 211 Besserer Street is legally described as PLAN 6 LOT 7 BESSERER N PLAN; 4R 919 PTS and has an area of 5634 ft 2 (523 m 2 ). The total site area is 1,93 m 2 and is rectangular in shape. The Site is currently developed with a 3 storey light commercial building which is currently used for fur retail, repair, storage and restyling (Appendix B, Photographs 1 & 2). The building is timber framed construction with a brick exterior and a shingled roof. According the to the Historical Environmental Reporting System (HEIRS) search conducted for the Site the on-site building was constructed in the 188 s. The Site is bounded to the north by Rideau Street followed by a light commercial area, to the east by a parking lot followed by light commercial/residential area, to the south by Besserer Street followed by a residential area and to the west by a parking lot followed by a light commercial area. The Site is serviced by municipal water and wastewater services, Ottawa Hydro and natural gas. 2

Records Review / Land Use History 3.1 Aerial Photographs Aerial photographs were available from various years between 1944 and 21 and were examined in an effort to review the historical land use at the subject site and adjacent properties. The 1944 aerial photograph shows the general area surrounding the site is developed with residential and commercial properties. Due to poor clarity and the scale of the aerial photograph, features of the site could not be distinguished. A railway station with several rail spurs is visible approximately 4 m west of the Site. The current site building is visible in the 1956 aerial photograph. Several buildings which appear to be commercial are located to the west and north of the Site. The railway station remains visible west of the Site. The 1966 aerial photograph shows the subject unchanged. A large building, possibly an apartment building / commercial building, is visible on the adjacent property to the west. The railway station remains visible approximately 4 m west of the Site. A retail fuel sales outlet is visible at the corner of Rideau Street and King Edward Avenue. This retail fuel sales outlet is further discussed in Section 3.2 of this report. The 1974 aerial photograph shows the Site remains unchanged. The area covered by this aerial photograph does not cover the property on which the railway station was located. The general area surrounding the site remains unchanged. The railway station which was visible in the earlier photographs is no longer visible. The 1984 aerial photograph shows the Site and surrounding area remain largely unchanged. The 1994 aerial photo shows the commercial building which was located on the adjacent site to the west is no longer visible; a parking lot appears to be present at this location. The 2 and 21 aerial photograph shows the Site and surrounding area remains largely unchanged. There were no areas of potential environmental concern (APECs) identified in the aerial photographs. A retail fuel sales outlet was observed to be present at the corner of Rideau Street and King Edward Avenue in the 1966 and subsequent aerial photographs. This retail fuel sales outlet is further discussed in Section 3.2 of this report. 3.2 HEIRS and EcoLog ERIS A request for file search was submitted to HEIRS (Historic Environmental Information Reporting System) (formerly Insurers Advisory Organisation) regarding the site and immediate adjacent properties. A fire insurance plan created in 1956, property underwriters reports from 23, 22, 1999, 1989 and 1983 and property underwriters plans from 1989 and 1985 were located as part of the HEIRS database search. The 1956 fire insurance plan indicated the subject site was occupied by Dworkin Furs at that time. The outline of the building detailed in the fire insurance plan is very similar to the outline of the present day Site building. Two residential buildings appear to be present on the southern 3

These buildings have since been demolished and this portion of the site is used as a parking lot. There is a potential that construction debris associated with the demolition of the former structures might be present in this area. Two retail fuel sales outlets are visible on the fire insurance plan. A retail fuel sales outlet is located at 29 Rideau Street, approximately 4 m east of the site. A retail fuel sales outlet is also visible at 246 Rideau Street, approximately 3 m west of the Site. An automotive repair garage is visible at 274 Rideau Street approximately 3 m east of the Site. A printing company is also visible at 291 Rideau Street, approximately 7 m northeast of the Site. The former retail fuel sales outlet located at 29 Rideau Street, approximately 4 m east of the site is considered to be an APEC due to its proximity to the Site. The former retail fuel sales outlet located at 246 Rideau Street, approximately 3 m west of the site is considered to be an APEC due to its proximity to the Site. The former automotive repair garage at 274 Rideau Street approximately 3 m east of the Site is considered to be an APEC due to its proximity to the Site. The 23 property underwriters report recovered as part of the HEIRS database search indicated that a small amount (1 4 L) of dry cleaning solvent was stored on the second floor of the building and used for spot cleaning of fur garments. The use of very small amounts of dry cleaning solvents at the premises is not considered to be an APEC. EcoLog Environmental Risk Information Services (or EcoLog ERIS) is an environmental database and information service provider. Trow requested that EcoLog ERIS conduct a site search of forty-nine environmental databases of the site. The EcoLog ERIS Site Report is provided in Appendix C. The retail fuel sales outlet (Petro Canada) located at 292 Rideau Street, approximately 1 m east of the Site, is listed as having a UST located on the property. The UST is used to store gasoline, is of single walled fibreglass construction, has a capacity of 25, L and was installed in 199. The UST located at 292 Rideau Street is not considered to be an APEC due to its cross gradient direction from the Site in terms of inferred direction of groundwater flow. A small unknown amount of gasoline is listed as having been spilled at 292 Rideau Street, approximately 1 m east of the Site, in In L of gasoline is listed as having been spilled at 292 Rideau Street. In the year 2 15 L of gasoline is listed as having been spilled at 292 Rideau Street. In L of gasoline is listed as having been spilled at 292 Rideau Street. These spills are not considered to be APEC due to their distance from the Site and their cross gradient direction from the Site in terms of inferred direction of groundwater flow. The property located at 35 King Edward Avenue is also listed as having several USTs present on the property. However, due to the distance of 35 King Edward Street from the Site, and its down-gradient direction from the Site in terms of inferred direction of groundwater flow, the USTs located at 35 King Edward are not considered to be an APEC. The property located at 35 King Edward Avenue is also listed as a contaminated site on federal land. This issue is discussed further in Section 3.8 of this report. 4

10 256 Rideau Street & 211 Besserer Street, Ottawa, Ontario Phase I Environmental Site Assessment OTT-2695-A Fifty six Ontario Regulation 347 waste generators were listed to be present with 25 m of the Site. However no significant waste generators were identified to be present in close proximity and up-gradient from the Site in terms of inferred direction of groundwater flow and as such none of the waste generators are considered to be APECs. 3.3 Property Use Directories The City of Ottawa Municipal Directories covering the years 194 through 28 were reviewed at 1 year intervals at the National Library of Canada to determine the historical property use on the subject site and adjacent lands. The following pertinent information was identified as part of the property use directory search: 256 Rideau Street was listed as present in all property use directories. Prior to 1936, the Site was listed as residential. After 1936 the Site was listed as Dworkin Furs for every directory searched. A retail fuel sales outlet is listed as having been present at 292 Rideau Street from 1924 to the present day. Due to its location, this retail fuel sales outlet is not considered to be an APEC, as discussed in Section 3.2 of this report. A retail fuel sales outlet is listed as having been present at 29 Rideau Street from 1936 to This retail fuel sales outlet is considered to be an APEC, as discussed in Section 3.2 of this report. An automotive repair garage is listed as having been present at Rideau Street from 1924 to 1948, located approximately 3 m north of the Site, and is considered to be an APEC due to its proximity to the Site. 3.4 Regulatory Information and Interviews Regulatory Information The appropriate regulatory agencies at the provincial and municipal level were contacted to obtain information regarding environmental permits, past or pending environmental control orders or complaints, outstanding environmental regulatory non-compliance issues. A letter was forwarded to the MOE requesting information concerning the Site. Trow also contacted the Technical Standards and Safety Authority (TSSA) and requested a search of the TSSA computer database (covering 199 to present) for records of fuel storage on the Site. 5

No response from the MOE has been received to date. Although not anticipated, the client will be contacted regarding the receipt of any pertinent information, if received. The regulatory requests are located in Appendix C Interview Trow was able to interview the manager of the Dworkin Furs, Mr. Jay Schroff, during the site visit in order to get background information on the subject site and its present operations. This information has been integrated into the report. Mr. Schroff has been with the company since 1975 and is familiar with the history of and operations conducted at the Site. 3.5 Prior Environmental or Geotechnical Reports A geotechnical investigation is currently being conducted on the Site by Trow. Four boreholes have been advanced on the Site as part of this investigation. A suspected UST was encountered on-site at the northwest corner of the property during the drilling program. This UST is considered to be an APEC. 3.6 Geological and Soil Maps The following information sources were reviewed to determine the nature of the subsurface materials at the site: 1. Generalized Bedrock Geology Ottawa-Hull, Ontario-Quebec: Geological Survey of Canada, Map 158A. Scale 1:125,, Surficial Geology Ottawa, Ontario: Geological Survey of Canada, Map 156A. Scale 1:5, Based on the information provided in the available surficial and bedrock geology maps, the site is underlain by till and then underlain by ordovician aged limestone with shaly partings of the Ottawa Formation. 3.7 Company Records Company records were not available to be reviewed during the course of this Phase I ESA. 3.8 Land Use Documents A review of the following publications was carried out as part of this Phase I ESA Update. 1. MOE - Inventory of Coal Gasification Plant Waste Sites in Ontario (June 1991); 2. MOE - Waste Disposal Site Inventory (June 1991); 3. Intera - Mapping and Assessment of Former Industrial Sites, City of Ottawa (July 1998); and, 6

Golder Associates Old Landfill Management Strategy, Phase I Identification of Sites, City of Ottawa, Ontario (October 24). According to Old Landfill Management Strategy, Phase I Identification of Sites, City of Ottawa, Ontario (Golder Associates, October 24) a former waste disposal facility is located at the intersection of York Street and King Edward Avenue, approximately 2 m north of the Site. The waste disposal facility is estimated to have been.4 m in area and operated for an unknown period of time. This former waste disposal facility is not considered to be an APEC due to its distance from the Site and its down-gradient direction from the Site in terms of inferred direction of groundwater flow. According to Intera - Mapping and Assessment of Former Industrial Sites, City of Ottawa (July 1998) the following former industrial sites were located in the vicinity of the Site: A former iron foundry was located at 19 Stewart Street, approximately 2 m southwest of the Site. The foundry operated from 1885 to 1915 and is classified as having a hazard ranking of medium. This foundry is not considered to be an APEC to the Site due to its distance from the Site, A former iron foundry was located at 96 Nelson Street, approximately 3 m north of the Site. The foundry operated from 192 to 195 and is classified as having a hazard ranking of medium. This foundry is not considered to be an APEC to the Site due to its distance from the Site and its down-gradient direction from the Site in terms of inferred direction of groundwater flow, and, A felt and gravel roofing manufacturer operated at 124 George Street in the 189s, approximately 25 m west of the Site. This operation is not considered to be an APEC to the Site due to its distance and its cross gradient direction from the Site. The MOE - Inventory of Coal Gasification Plant Waste Sites in Ontario (June 1991) indicates that a former coal gasification plant is located at 35 King Edward Avenue, approximately 14 m north of the Site. This former coal gasification plant operated from 1854 to 1915 and is not considered to be an APEC due to its down-gradient direction from the Site in terms of inferred direction of groundwater flow. The review of the above publications did not present any areas of potential environmental concern to the subject site. 3.9 Utility Company Records Utility company records were not available to be reviewed during the course of this Phase I ESA. 3.1 Public Health Concerns No conditions of public health concern were observed on the site. 7

Visual Site Assessment 4.1 Subject Site On November 22, 21 Mr. Darragh Kilroy B.Eng., of Trow conducted the site visit in accordance with Trow s internal health and safety protocols and the Ministry of Labour Health and Safety Regulations. The purpose of the site visit was to assess the current conditions of the site. The general environmental management practices at the site were reviewed as part of this assessment insofar as they could impact the environmental condition of the property; however, a detailed review of regulatory compliance issues was beyond the scope of Trow s assessment. Observations of the subject property and surrounding properties were conducted. The observations were recorded by walking over the grounds at the site. Adjoining properties were observed from within the grounds of the site. Site photographs are presented in Appendix B Property Use The Site is currently developed with a 3 storey light commercial building which is currently used by Dworkin Furs Limited for fur retail, repair, storage and restyling. Cleaning of furs is not conducted on-site; however spot cleaning of small stains, using alcohol, may be carried out on some fur garments. Dying of furs is not conducted on-site Buildings and Structures A 3 storey light commercial building, with basement, which is currently used for fur retail, repair, storage and restyling is located on the Site. The building is timber framed construction with a brick exterior and a shingled roof. According to the Historical Environmental Reporting System (HEIRS) search conducted for the Site the on-site building was constructed in the 188 s. The on-site building is serviced by municipal water and wastewater services Limitations at the Site No limitations were encountered during the site visit Chemical Inventory, Storage and Handling There were no chemicals observed on-site at the time of the Site visit Storage Tanks and Containers The presence/absence and condition (if present) of underground storage tanks (USTs) and aboveground storage tanks (ASTs) at the site were assessed during the site visit. As mentioned earlier, a geotechnical investigation is currently underway for this property. During the drilling of one of the boreholes in the northwest portion of the site, an abandoned UST was encountered. There were no previous records indicating the presence of this UST. 8

14 256 Rideau Street & 211 Besserer Street, Ottawa, Ontario Phase I Environmental Site Assessment OTT-2695-A There were no storage tanks observed on the subject site or immediately adjacent to it during the site visit. During the site visit, Mr. Jay Schroff indicated that no ASTs or USTs were located on the Site Special Attention Substances The on-site building was constructed before 19 therefore there is the potential that special attention substances are present within the building. The common use of potential friable (breakable by hand) asbestos-containing materials (ACM) (pipe/boiler insulation and fireproofing) in construction generally ceased voluntarily in the mid-197s. However, in Ontario, the spray application of asbestoscontaining fireproofing was not prohibited until As the building was constructed before 19, there is a potential for ACM to be present within the subject building. However, no ACMs were identified during Trow s site visit. As a best practice, prior to any renovations or demolition of the building, a designated substances survey (DSS) should be completed to identify any ACMs that may be present in the building. The past use of polychlorinated biphenyls (PCB) in electrical equipment, such as transformers, fluorescent lamp ballasts, and capacitors, was common. The federal Environmental Contaminants Act, 1976, prohibited the use of PCB in heat transfer and electrical equipment installed after September 1, 1977, and in transformers and capacitors installed after July 198. In addition, storage and disposal of PCB waste materials is regulated. Potential sources of PCBs observed during the site visit were limited to a transformer located in the basement of the building (Appendix B, Photograph 9) and fluorescent light ballasts located throughout the building. In 1976, the lead content in interior paint was limited to.5% by weight under the federal Hazardous Products Act. Lead is also associated with plumbing solder and old pipes as well as other lead-based products such as wall shielding (x-ray rooms). The potential for lead in building materials exists in the site building. The sale and installation of urea formaldehyde foam insulation (UFFI) as thermal insulation began in approximately 197, and continued until December 198 when it was banned under the federal Hazardous Products Act. UFFI was installed in both new and existing buildings during this period. No evidence of UFFI, such as patched holes in the walls, was identified during the site visit. The 1975 Hazardous Products Act prohibits the use of mercury in decorative or protective coatings applied on toys, equipment and other products for use by a child in learning or play. In 1991, a voluntary agreement between Health Canada and the Canadian Paint and Coatings Association resulted in the removal of mercury compounds from interior latex paints. In accordance with the Surface Coating Materials Regulations, the concentration of total mercury present in a surface coating material must not be more than 1 mg/kg (1 ppm). Fluorescent light fixtures and thermostats, located throughout the building, were identified as potential sources of mercury. 9

15 256 Rideau Street & 211 Besserer Street, Ottawa, Ontario Phase I Environmental Site Assessment OTT-2695-A There is no occupational or environmental concern associated with mercury in its current state and condition. Exposure to mercury is regulated under Ontario Regulation 844/9 (amended to O. Reg. 11/4). However, all mercury containing equipment/materials should be removed and re-used/recycled or disposed in accordance with applicable legislation if it will be taken out of service as a result of renovations. In 1994, the federal government filed the Ozone-Depleting Substances (ODS) Regulations to amend controls on production and consumption of chlorofluorocarbons (CFC), halons, carbon tetrachloride, and methyl chloroform. Existing equipment that could contain potential ODS are anticipated to be limited to two compressors located in the basement, several refrigerators and air conditioning units. Prior to renovations or demolition of the subject building, all potential ODS should be handled by a licensed contractor. Concrete was present within the site building. This material commonly contains silica, and as such, silica is a designated substance that could be encountered during renovation or demolition work. Prior to any renovations or demolition of the buildings, a DSS should be completed to identify the silica containing building materials that may be present in the buildings. Moulds and fungi are found in nature and are necessary for the breakdown of leaves, wood and other plant debris. These micro-organisms can enter a building directly or by their spores being carried in by the air. All moulds require both a source of nutrients and humidity to survive and flourish. Generally, nutrients are not a limiting factor and, when moisture is high, mould will grow on wood, drywall, upholstery, fabric, wallpaper, drapery, ceiling tiles, and carpeting. In modern buildings, moisture is present as the result of: flooding, leaks in the roof or plumbing, sealed buildings that do not allow excess moisture to escape, sources such as cooking facilities, showers, etc., or excess humidity. Mould growth was not observed in the Site building at the time of the site visit Unidentified Substances No unidentified substances were noted during the site visit Drains and Sumps There were no sumps observed on the site during the site visit Building Heating and Cooling Systems The building is presently heated and cooled via a natural gas fired boiler Air Emissions There are presently no air emissions associated with the site. 1

16 256 Rideau Street & 211 Besserer Street, Ottawa, Ontario Phase I Environmental Site Assessment OTT-2695-A Odours No odour considered offensive or noxious was encountered during the site visit Noise No noise associated with the site was encountered during the site visit Sewage and Wastewater Disposal The site is presently serviced by the municipal storm sewer system Liquid Chemical Waste Generation, Storage & Disposal No liquid waste generation is presently associated with the site Solid Waste Generation, Storage & Disposal No significant waste was observed on the site at the time of the site visit Topographic, Geologic and Hydrogeologic Conditions The Site was noted to be approximately flat and at the same elevation as the surrounding properties. The Rideau River joins the Ottawa River approximately 9 m north of the Site. The inferred direction of groundwater flow in the general area is northward towards the Ottawa and Rideau Rivers Water Courses, Ditches and Site Drainage Site drainage is provided via the storm sewer drain located on Rideau Street Abandoned and Existing Wells and Potable Water Sources No wells were observed on the site at the time of the site visit. Monitoring wells were observed to be present on the neighbouring property to the west of the Site at the time of the Site visit Fill Materials The Site was noted to be approximately flat and at the same elevation as the surrounding properties therefore no significant amounts of fill are expected to be present on the Site Stained Materials No stained materials were observed during the site visit Stressed Vegetation No stressed vegetation was observed during the site visit. 11

Access to the Site is provided via Rideau Street and Besserer Street. Parking is provided by the on-site parking lot Pits and Lagoons There were no pits or lagoons observed on-site at the time of the site visit Other Issues No other issues were noted during the site visit. 4.2 Adjacent Properties The conditions of the adjacent properties were observed at the time of Trow s site visit as could be observed from the site or from adjacent roads. The findings of the adjacent property visual reconnaissance are as follows: South: Besserer Street followed by a residential area. North: Rideau Street followed by a light commercial / residential area. West: A parking lot followed by a light commercial area. Groundwater monitoring wells were observed to be present on the adjacent property to the west of the Site. East: A parking lot followed by a hotel and light commercial buildings. A retail fuel sales outlet is located at the intersection of King Edward Avenue and Rideau Street, approximately 1 m east of the Site (Appendix B, Photograph 6). This retail fuel sales outlet is not considered to be an APEC due to its distance from the Site and its cross gradient direction from the Site in terms of inferred direction of groundwater flow. 12

Conclusions and Recommendations The following summarizes the findings related to the Site. The Site is currently developed with a 3 storey light commercial building which is currently used for fur retail, repair, storage, and restyling. The building is timber framed construction with a brick exterior and a shingled roof. The rear portion of the site (fronting onto Besserer Street) is used as a parking lot. This area was previously occupied by residential houses. There is a potential that construction debris associated with the house demolition may be present in this area. A geotechnical investigation is currently being conducted on the Site by Trow. Four boreholes have been advanced on the Site as part of this investigation. A suspected underground storage tank (UST) was encountered on-site at the northwest corner of the property during the drilling program. This UST is considered to be an APEC. Trow recommends that this UST be removed from the Site. According to a historical fire insurance plan of the area and a property use directory file search a retail fuel sales outlet was present at 244 / 246 Rideau Street, approximately 3 m west of the site from 1936 to This retail fuel sales outlet is considered to be an APEC due to its proximity to the Site. According to a historical fire insurance plan of the area and a property use directory file search, a former automotive repair garage was located at Rideau Street, approximately 3 m east of the Site, from 1948 to This automotive repair garage is considered to be an APEC due to its proximity to the Site According to a historical fire insurance plan of the area and a property use directory file search a retail fuel sales outlet was present at 29 Rideau Street, approximately 4 m east of the site, from 1936 to This retail fuel sales outlet is considered to be an APEC due to its proximity to the Site. The on-site building was constructed before 19 therefore there is the potential that special attention substances are present within the building. Prior to any renovations or demolition of the building, a designated substances survey (DSS) should be completed to identify any designated substances that may be present in the building. Based on the information gathered during the completion of this Phase I ESA, the following recommendations are provided: Phase II ESA to address APECs described above; Designated Substances Survey is to be completed prior to renovation or demolition; and, The abandoned UST should be removed and the underlying soil should be addressed for impact. 13

Limitations The information presented in this report is based on information provided by others and visual observations as identified herein. This type of limited investigation is designed to provide information to support an overall Phase I Environmental Site Assessment (ESA) of the current environmental conditions of the site. Sampling and analysis of soils, groundwater, and other material was not carried out as part of this investigation. The findings cannot be extended to portions of the site, which were unavailable for direct observation at the time of Trow's observations. The role of the site assessor is to document evidence of contamination and not to judge the acceptability of risks associated with contamination (Clause.2.7 of CSA Z768-1). To further reduce or eliminate uncertainty would require a Phase II investigation. It should be noted that some of the information and resultant conclusions of a Phase I are time sensitive. Achieving the objectives stated in this report has required us to arrive at conclusions based upon the best information presently known to us. No investigative method can completely eliminate the possibility of obtaining partially imprecise or incomplete information; it can only reduce the possibility to an acceptable level. Professional judgment was exercised in gathering and analyzing the information obtained and in the formulation of the conclusions. Like all professional persons rendering advice, we do not act as absolute insurers of the conclusions we reach, but we commit ourselves to care and competence in reaching those conclusions. It should also be noted that current environmental guidelines and regulations are subject to change, and such changes, when put into effect, could alter the conclusions and recommendations noted throughout this report. The conclusions and recommendations noted throughout this report reflect existing site conditions with respect to the current environmental condition of the site at the time of this assessment summary. Compliance of past owners with applicable environmental regulations was not within the scope of this Phase I ESA summary. It is possible that unexpected environmental conditions may be encountered on the site, which has not been explored within the scope of this Phase I ESA summary. Should such an event occur, Trow should be notified in order that we may determine if modifications to our conclusions are necessary. Provincial Government Source Databases: Abandoned Aggregate Inventory Up to Sept 22 AAGR The MAAP Program maintains a database of all abandoned pits and quarries. Please note that the database is only referenced by lot and concession and city/town location. The database provides information regarding the location, type, size, land use, status and general comments. Aggregate Inventory Up to Jun 21 AGR The Ontario Ministry of Natural Resources maintains a database of all active pits and quarries. Please note that the database is only referenced by lot\concession and city/town location. The database provides information regarding the registered owner/operator, location, status, licence type, and maximum tonnage. Abandoned Mines Information System AMIS The Abandoned Mines Information System contains data on known abandoned and inactive mines located on both Crown and privately held lands. The information was provided by the Ministry of Northern Development and Mines (MNDM), with the following disclaimer: the database provided has been compiled from various sources, and the Ministry of Northern Development and Mines makes no representation and takes no responsibility that such information is accurate, current or complete. Reported information includes official mine name, status, background information, mine start/end date, primary commodity, mine features, hazards and remediation. Borehole 1875-Sept 21 BORE A borehole is the generalized term for any narrow shaft drilled in the ground, either vertically or horizontally. The information here includes geotechnical investigations or environmental site assessments, mineral exploration, or as a pilot hole for installing piers or underground utilities. Information is from many sources such as the Ministry of Transportation (MTO) boreholes from engineering reports and projects from the 195 to 199 s in Southern Ontario. Boreholes from the Ontario Geological Survey (OGS) including The Urban Geology Analysis Information System (UGAIS) and the York Peel Durham Toronto (YPDT) database of the Conservation Authority Moraine Coalition. This database will include fields such as location, stratigraphy, depth, elevation, year drilled, etc. For all water well data or oil and gas well data for Ontario please refer to WWIS and OOGW. Certificates of Approval 1985-Sept 22* (for current CofA info please check the EBR Database) CA This database contains the following types of approvals: Certificates of Approval (Air) issued under Section 9 of the Ontario EPA; Certificates of Approval (Industrial Wastewater) issued under Section 53 of the Ontario Water Resources Act ( OWRA ); and Certificates of Approval (Municipal/Provincial Sewage and Waterworks) issued under Sections 52 and 53 of the OWRA. For more current Certificate of Approval information please see the EBR database, which will include information such as 'Approval for discharge into the natural environment other than water (i.e. Air) (EPA s.9)', and Approval for sewage works (OWRA s.53(1)). TSSA Commercial Fuel Oil Tanks 1948-Aug 21 CFOT Since May 22, Ontario developed a new act where it became mandatory for fuel oil tanks to be registered with Technical Standards & Safety Authority (TSSA). This data would include all commercial underground fuel oil tanks in Ontario with fields such as location, registration number, tank material, age of tank and tank size.

92 Coal Gasification Plants 1987, 1988* COAL This inventory of all known and historical coal gasification plants was collected by the Ministry of Environment. It identifies industrial sites that produced and continue to produce or use coal tar and other related tars. Detailed information is available and includes: facility type, size, landuse, soil condition, site operators/occupants, site description, and potential environmental impacts. This information is effective to 1988, but the program has since been discontinued. Compliance and Convictions 1989-Oct 21 CONV This database summarizes the fines and convictions handed down by the Ontario courts beginning in Companies and individuals named here have been found guilty of environmental offenses in Ontario courts of law. Drill Holes DRL The Ontario Drill Hole Database contains information on more than 113, percussion, overburden, sonic and diamond drill holes from assessment files on record with the department of Mines and Minerals. Please note that limited data is available for southern Ontario, as it was the last area to be completed. The database was created when surveys submitted to the Ministry were converted in the Assessment File Research Image Database (AFRI) project. However, the degree of accuracy (coordinates) as to the exact location of drill holes is dependent upon the source document submitted to the MNDM. Levels of accuracy used to locate holes are: centering on the mining claim; a sketch of the mining claim; a 1:5, map; a detailed company map; or from submitted a Report of Work. Environmental Registry 1994-Oct 21 EBR The Environmental Registry lists proposals, decisions and exceptions regarding policies, Acts, instruments, or regulations that could significantly affect the environment. Through the Registry, thirteen provincial ministries notify the public of upcoming proposals and invite their comments. For example, if a local business is requesting a permit, licence, or certificate of approval to release substances into the air or water; these are notified on the registry. Data includes things like; Approval for discharge into the natural environment other than water (i.e. Air), Permit to Take Water (PTTW), Certificate of Property Use (CPU), Approval for a waste disposal site, Order for preventative measures.(epa s. 18), Order for conformity with Act for waste disposal sites.(epa s. 44), Order for remedial work.(epa s. 17) and many more. TSSA Fuel Storage Tanks Current to Jun 21 FST The Technical Standards & Safety Authority (TSSA), under the Technical Standards & Safety Act of 2 maintains a database of registered private and retail fuel storage tanks in Ontario with fields such as location, tank status, license date, tank type, tank capacity, fuel type, installation year and facility type. Ontario Regulation 347 Waste Generators Summary 1986-Oct 21 GEN Regulation 347 of the Ontario EPA defines a waste generation site as any site, equipment and/or operation involved in the production, collection, handling and/or storage of regulated wastes. A generator of regulated waste is required to register the waste generation site and each waste produced, collected, handled, or stored at the site. This database contains the registration number, company name and address of registered generators including the types of hazardous wastes generated. It includes data on waste generating facilities such as: drycleaners, waste treatment and disposal facilities, machine shops, electric power distribution etc. This information is a summary of all years from 1986 including the most currently available data. Some records may contain, within the company name, the phrase See & Use followed by a series of letters and numbers. This occurs when one company is amalgamated with or taken over by another registered company. The number listed as See & Use, refers to the new ownership and the other identification number refers to the original ownership. This phrase serves as a link between the 2 companies until operations have been fully transferred. Mineral Occurrences 1846-Oct 29 MNR In the early 7 s, the Ministry of Northern Development and Mines created an inventory of approximately 19, mineral occurrences in Ontario, in regard to metallic and industrial minerals, as well as some information on building stones and aggregate deposits. Please note that the Horizontal Positional Accuracy is approximately +/- 2 m. Many reference elements for each record were derived from field sketches using pace or chain/tape measurements against claim posts or topographic features in the area. The primary limiting factor for the level of positional accuracy is the scale of the source material. The testing of horizontal accuracy of the source materials was accomplished by comparing the planimetric (X and Y) coordinates of that point with the coordinates of the same point as defined from a source of higher accuracy. 2

93 Non-Compliance Reports 1992(water only), NCPL The Ministry of the Environment provides information about non-compliant discharges of contaminants to air and water that exceed legal allowable limits, from regulated industrial and municipal facilities. A reported non-compliance failure may be in regard to a Control Order, Certificate of Approval, Sectoral Regulation or specific regulation/act. Ontario Oil and Gas Wells 18-Feb 21 OOGW In 1998, the MNR handed over to the Ontario Oil, Gas and Salt Resources Corporation, the responsibility of maintaining a database of oil and gas wells drilled in Ontario. The OGSR Library has over 2,+ wells in their database. Information available for all wells in the ERIS database include well owner/operator, location, permit issue date, well cap date, licence no., status, depth and the primary target (rock unit) of the well being drilled. All geology/stratigraphy table information, plus all water table information is also provide for each well record. Ontario Inventory of PCB Storage Sites 1987-Oct 24 OPCB The Ontario Ministry of Environment, Waste Management Branch, maintains an inventory of PCB storage sites within the province. Ontario Regulation 11/82 (Waste Management - PCB) and Regulation 347 (Generator Waste Management) under the Ontario EPA requires the registration of inactive PCB storage equipment and/or disposal sites of PCB waste with the Ontario Ministry of Environment. This database contains information on: 1) waste quantities; 2) major and minor sites storing liquid or solid waste; and 3) a waste storage inventory. Pesticide Register 1988-Jan 21 PES The Ontario Ministry of Environment maintains a database of all manufacturers and vendors of registered pesticides. Private and Retail Fuel Storage Tanks * PRT The Fuels Safety Branch of the Ontario Ministry of Consumer and Commercial Relations maintained a database of all registered private fuel storage tanks and licensed retail fuel outlets. This database includes an inventory of locations that have gasoline, oil, waste oil, natural gas and/or propane storage tanks on their property. The MCCR no longer collects this information. This information is now collected by the Technical Standards and Safety Authority (TSSA). Ontario Regulation 347 Waste Receivers Summary REC Part V of the Ontario Environmental Protection Act ( EPA ) regulates the disposal of regulated waste through an operating waste management system or a waste disposal site operated or used pursuant to the terms and conditions of a Certificate of Approval or a Provisional Certificate of Approval. Regulation 347 of the Ontario EPA defines a waste receiving site as any site or facility to which waste is transferred by a waste carrier. A receiver of regulated waste is required to register the waste receiving facility. This database represents registered receivers of regulated wastes, identified by registration number, company name and address, and includes receivers of waste such as: landfills, incinerators, transfer stations, PCB storage sites, sludge farms and water pollution control plants. This information is a summary of all years from 1986 including the most currently available data. Record of Site Condition 1997-Sept 21, Oct 24-Oct 21 RSC The Record of Site Condition (RSC) is part of the Ministry of the Environment s Brownfields Environmental Site Registry. Protection from environmental cleanup orders for property owners is contingent upon documentation known as a record of site condition (RSC) being filed in the Environmental Site Registry. In order to file an RSC, the property must have been properly assessed and shown to meet the soil, sediment and groundwater standards appropriate for the use, such as residential, proposed to take place on the property. The Record of Site Condition Regulation (O. Reg. 153/4) details requirements related to site assessment and clean up. Information available includes Registration Number, Filing Owner, Property Address, Filing Date and Municipality. 3

94 Ontario Spills 1988-Jun 21 SPL This database identifies information such as location (approximate), type and quantity of contaminant, date of spill, environmental impact, cause, nature of impact, etc. Information from was part of the ORIS (Occurrence Reporting Information System). The SAC (Spills Action Centre) handles all spills reported in Ontario. Regulations for spills in Ontario are part of the MOE s Environmental Protection Act, Part X. Wastewater Discharger Registration Database SRDS Information under this heading is combination of the following 2 programs. The Municipal/Industrial Strategy for Abatement (MISA) division of the Ontario Ministry of Environment maintained a database of all direct dischargers of toxic pollutants within nine sectors including: Electric Power Generation; Mining; Petroleum Refining; Organic Chemicals; Inorganic Chemicals; Pulp & Paper; Metal Casting; Iron & Steel; and Quarries. All sampling information is now collected and stored within the Sample Result Data Store (SRDS). Waste Disposal Sites - MOE CA Inventory 197-Sept 22 WDS The Ontario Ministry of Environment, Waste Management Branch, maintains an inventory of known open (active or inactive) and closed disposal sites in the Province of Ontario. Active sites maintain a Certificate of Approval, are approved to receive and are receiving waste. Inactive sites maintain Certificate(s) of Approval but are not receiving waste. Closed sites are not receiving waste. The data contained within this database was compiled from the MOE's Certificate of Approval database. Locations of these sites may be cross-referenced to the Anderson database described under ERIS s Private Source Database section, by the CA number. For more current information for Waste Disposal Sites please see the EBR database, which will include information such as 'Approval for a waste disposal site (EPA s.27)' and 'Approval for use of a former waste disposal site (EPA s.46)'. Waste Disposal Sites - MOE 1991 Historical Approval Inventory Up to Oct 199* WDSH In June 1991, the Ontario Ministry of Environment, Waste Management Branch, published the "June 1991 Waste Disposal Site Inventory", of all known active and closed waste disposal sites as of October 3st, 199. For each "active" site as of October 31st 199, information is provided on site location, site/ca number, waste type, site status and site classification. For each "closed" site as of October 31st 199, information is provided on site location, site/ca number, closure date and site classification. Locations of these sites may be cross-referenced to the Anderson database described under ERIS s Private Source Database section, by the CA number. Water Well Information System 1955-Sept 21 WWIS This database describes locations and characteristics of water wells found within Ontario in accordance with Regulation 93. It includes such information as coordinates, construction date, well depth, primary and secondary use, pump rate, static water level, well status, etc. Also included are detailed stratigraphy information, approximate depth to bedrock and the approximate depth to the water table. Federal Government Source Databases: Environmental Effects Monitoring * Diagram Identifier: EEM The Environmental Effects Monitoring program assesses the effects of effluent from industrial or other sources on fish, fish habitat and human usage of fisheries resources. Since 1992, pulp and paper mills have been required to conduct EEM studies under the Pulp and Paper Effluent Regulations. This database provides information on the mill name, geographical location and sub-lethal toxicity data. Environmental Issues Inventory System * EIIS The Environmental Issues Inventory System was developed through the implementation of the Environmental Issues and Remediation Plan. This plan was established to determine the location and severity of contaminated sites on inhabited First Nation reserves, and where necessary, to remediate those that posed a risk to health and safety; and to prevent future environmental problems. National Defence & Canadian Forces Waste Disposal Sites 21-April 27 NDWD The Department of National Defence and the Canadian Forces maintains an inventory of waste disposal sites located on DND lands. 96 National Environmental Emergencies System (NEES) NEES In 2, the Emergencies program implemented NEES, a reporting system for spills of hazardous substances. For the most part, this system only captured data from the Atlantic Provinces, some from Quebec and Ontario and a portion from British Columbia. Data for Alberta, Saskatchewan, Manitoba and the Territories was not captured. However, NEES is also a repository for all previous Environment Canada spill datasets. NEES is composed of the historic datasets or Trends which dates from approximately 1974 to present. NEES Trends is a compilation of historic databases, which were merged and includes data from NATES (National Analysis of Trends in Emergencies System), ARTS (Atlantic Regional Trends System), and NEES. In 21, the Emergencies Program determined that variations in reporting regimes and requirements between federal and provincial agencies made national spill reporting and trend analysis difficult to achieve. As a consequence, the department has focused efforts on capturing data on spills of substances which fall under its legislative authority only (CEPA and FA). As such, the NEES database will be decommissioned in December 24. National PCB Inventory NPCB Environment Canada s National PCB inventory includes information on in-use PCB containing equipment in Canada including federal, provincial and private facilities. All federal out-of-service PCB containing equipment and all PCB waste owned by the federal government or by federally regulated industries such as airlines, railway companies, broadcasting companies, telephone and telecommunications companies, pipeline companies, etc. are also listed. Although it is not Environment Canada s mandate to collect data on non-federal PCB waste, the National PCB inventory includes some information on provincial and private PCB waste and storage sites. National Pollutant Release Inventory NPRI Environment Canada has defined the National Pollutant Release Inventory ( NPRI ) as a federal government initiative designed to collect comprehensive national data regarding releases to air, water, or land, and waste transfers for recycling for more than 3 listed substances. Parks Canada Fuel Storage Tanks 192-Jan 25 PCFT Canadian Heritage maintains an inventory of all known fuel storage tanks operated by Parks Canada, in both National Parks and at National Historic Sites. Transport Canada Fuel Storage Tanks 197-March 27 TCFT With the provinces of BC, MB, NB, NF, ON, PE, and QC; Transport Canada currently owns and operates 9 fuel storage tanks. This inventory will also include The Pickering Lands, which refers to the 7,53 hectares (18,6 acres) of land in Pickering, Markham and Uxbridge - owned by the Government of Canada since Properties on this land has been leased by the government since 1975, falls under the Site Management Policy of Transport Canada, but administered by Public Works and Government Services Canada. Private Source Databases: Anderson s Waste Disposal Sites 186s-Present ANDR The information provided in this database was collected by examining various historical documents which aimed to characterize the likely position of former waste disposal sites from 186 to present. The research initiative behind the creation of this database was to identify those sites that are missing from the Ontario MOE Waste Disposal Site Inventory, as well as to provide revisions and corrections to the positions and descriptions of sites currently listed in the MOE inventory. In addition to historic waste disposal facilities, the database also identifies certain auto wreckers and scrap yards that have been extrapolated from documentary sources.
