1 POLICE STAFF JOB DESCRIPTION SECTION 1 JOB TITLE Principal Solicitor (Contracts/Commercial) REPORTS TO (Interim) Head of Legal Services REF NO R4/18 DIVISION/DEPARTMENT Legal Services WORK LOCATION Dalmarnock, Glasgow GRADE Band J SECTION 2 JOB PURPOSE To assist the (Interim) Head of Legal Services in the effective management and delivery of a comprehensive range of legal services to Police Scotland and the Scottish Police Authority, in particular legal work associated with contracts/commercial and property conveyancing; and to deputise for the (Interim) Head of Legal Services in his/her absence in respect of Contracts/Commercial matters. SECTION 3 ACCOUNTABILITIES AND MAIN RESPONSIBILITIES 1. To assist the (Interim) Head of Legal Services in the effective management and delivery of legal services by provision of legal advice and guidance to the Chief Constable and Senior Management of Police Scotland; and the execution of legal work, particularly that of a contracts/commercial/property type, especially that of a complex or important nature. 2. To lead a Contracts/Commercial team consisting of Senior Solicitor (Contracts/Commercial), a Senior Solicitor (Conveyancing) and two Solicitors (Conveyancing) in the delivery of:
2 a contracts/commercial service, providing specialist legal advice and support for all public procurement for Police Scotland and the Police Authority on contractual matters; legal advice and support for major Police Scotland projects; a property conveyancing service, attending to the legal work associated with the Police Authority's property ; and retention of its title deeds and contract documents. 3. To liaise closely with and provide legal advice to Police Scotland Divisional Commanders and Departmental Heads involved in contractual/commercial/property business for the Force/Police Authority especially in the area of public procurement, and to undertake all associated contracts related legal services work to ensure compliance with all relevant legislation and Force/Joint Board procedures. 4. To support the (Interim) Head of Legal Services in the legal supervision of the contractual/commercial/property business of the Force, including operating closely with the Deputy Chief Officer and senior officers of the departments of Finance, Procurement, Information Technology, Estates and related central support departments,, together with senior officers in the Police Authority as required. 5. To perform the various duties instructed on behalf of the Police Authority in terms of its Scheme of Delegated Functions, and Standing Orders relating to Contracts, as required by the (Interim) Head of Legal Services. 6. To provide legal advice to the Police Authority particularly as required in respect of contracts/commercial/property matters, and otherwise as may be required in support to the Force Executive or as requested by the (Interim) Head of Legal Services. 7. To represent the (interim) Head of Legal Services at any meeting or working group, as required and to participate as a member of Police Scotland governance boards, as required. 8. As required, to assist and advise the (Interim) Head of Legal Services in the selection and employment of staff in the Legal Services function. 9. To provide training or briefing to officers and staff of Police Scotland and, as may be required, the Police Authority on contracts/commercial/property matters as are relevant to their duties, and to liaise, as required, with Divisional Commanders/Heads of Departments to provide understanding and appreciation of the work of the contracts/commercial and property Team within Legal Services. 10. To monitor legal services associated with Contracts/Commercial and property matters provided to Police Scotland by private solicitors and counsel. 11. To deputise for the (Interim) Head of Legal Services in his/her absence, principally in regard to contracts/commercial/property matters but otherwise, as required. 12. Will be responsible for managing and assessing risk within all areas of managerial/supervisory responsibility.
3 The above accountabilities and responsibilities are not exhaustive, and the Jobholder may be required to undertake additional duties that are consistent with the level and grading of the role.
4 SECTION 4 LOCATION: Glasgow BAND: J ATTRIBUTES : ESSENTIAL : DESIRABLE : ATTAINMENTS EDUCATIONAL / OCCUPATIONAL PERSONAL QUALITIES SPECIAL APTITUDES CIRCUMSTANCES Educated to LLB Degree or equivalent. (Bachelor of Laws) with significant post-qualifying experience as a Scottish solicitor. Current unrestricted Practicing Certificate from the Law Society of Scotland. Effective negotiating and drafting skills demonstrating Property experience. Proven achievements in specific areas of Property legal work, demonstrating relevant experience of Property legal work of a complex or important nature at a senior level. DIPLP (Diploma in Legal Practice), preferably with Public Administration.
