1 MID SUSSEX DISTRICT COUNCIL JOB DESCRIPTION JOB TITLE: POST NO: BUSINESS UNIT: RESPONSIBLE TO: RESPONSIBLE FOR: Divisional Leader Commercial Services and Contracts COTD096 Commercial Services and Contracts Assistant Chief Executive Team Managers for Commercial Services and Contracts MAIN PURPOSE: Be responsible for development, management and delivery of the Council s Contract Services, including Waste, Leisure and Landscapes. Lead on the development of all Contract Services related strategies and oversee and co-ordinate their delivery. Negotiate and manage large contracts ensuring that value for money, a focus on customer and quality of service are secured at all times. Build effective stable working relationships with partners and represent the Council at County and Regional service related meetings. Implement Business Continuity and Emergency Plan events and redirect resources where necessary. Maximise income opportunities and generate a surplus on commercially related activities. MAIN DUTIES/RESPONSIBILITIES: Corporate 1. Provide strategic leadership, direction and management for the Council's Commercial Services and play a leading role within the Business Unit team. 2. Support the Assistant Chief Executive in their leadership of the officers of the Council and the elected members in their political leadership of the Council. 3. Advise the Council and the Senior Leadership Team on new policy areas and legislation relevant to the service. 4. Develop excellent working relationships with Members and help foster high levels of trust and confidence between Members and officers, particularly with the relevant portfolio holders. 5. Lead and promote multi-disciplinary working across the Council on major projects. 6. Contribute to the formulation of the Council s budget and corporate plan and delivering the service within its budget.

2 7. Ensure the service plan for Commercial Services is prepared well and be responsible for its delivery to maximise efficiency and develop effective performance and quality management. 8. Ensure budget and resource management reflects corporate thinking and aspiration and delivery is within agreed parameters. 9. Maximise the effective use of resources within the Division and ensure it contributes to the achievement of the Council s corporate objectives. 10. Drive continuous performance and service improvement. Manage performance and take swift action to rectify problems by identify improvements required. 11. Modernise and transform service delivery in your areas to meet the demands of the service and the Council s long term development plans. 12. Ensure services are provided to the highest possible standard for the resources provided and place the customer and the community at the centre of everything the Council does. 13. Identify strategic and operational risk factors that might compromise achievement of key objectives or performance and put in place solutions to ensure delivery. Play a key role in implementation of Emergency and Business Continuity Plans relating to the Division. 14. Promote implementation of new working practices. 15. Enhance personal performance by continuously developing own knowledge and skills and optimising own resources to meet personal objectives. 16. Manage and mentor the Team Leaders within the Service to ensure personal and professional development techniques. 17. Deploy resources effectively through planning, project management and monitoring processes. 18. Improve the capacity, skill base, and succession planning arrangements for officers within the Service to enable sustainable performance improvements. 19. Promote a style of management, which encourages staff empowerment and personal responsibility in order to maximise the potential of all staff in the Service. Service Specific 20. Promote and manage effective partnership working with external partners/stakeholders/community/groups/customers. 21. Work in conjunction with the Council s communication team to promote and publicise marketing campaigns and the activities, achievements and performance of the Division. 22. Identify, manage and negotiate contractual relationships, demonstrating a broad range of commercial skills, with an ability to resolve difficulties through negotiation and leadership. 23. Analyse and manage supplier performance using agreed performance measurement methods and informing stakeholders. 24. Assess effectiveness of contracts and identify whether they are still appropriate to meet variation in requirements from tenders 25. Take an entrepreneurial approach, identifying and exploiting opportunities, with a broad understanding and appreciation of markets and commercial practice.

3 26. Identify local commercial opportunities and ensure they are exploited. 27. Renegotiate fundamental contract terms or termination of contracts, appropriately and legally where necessary. Facilitate procurement process where appropriate. 28. Identify, develop and lead best practice in contract management across the Council and to foster a safety first approach to contract management and taking specific regard of Health and Safety Executive recommendations and industry best practice. 29. Anticipate market trends to strategically position the service so that emergent and future markets can be exploited. SPECIAL CONDITIONS: The Local Democracy, Economic Development and Construction Act 2009 changed the approach to identifying posts which are politically restricted under Section 2 of the Local Government and Housing Act 1989 (LGHA). This post is so restricted as a specified post. Specified posts are automatically subject to restrictions on public political activity and as such, there is no right of appeal. By the nature of this post the hours of work must be flexible, and may, on occasion, be in excess of those normally laid down. Occasional evening work and other work outside of normal office hours forms an integral part of the job, and this has been taken into account when determining the salary for the job. It is a requirement of the post that the postholder holds a current driving licence enabling him/her to drive a car, and in this connection you must ensure that your insurance cover includes use for your employers business. The Council operates a Local Lump Sum Car Allowance Scheme which is comparable with the NJC National Car Allowance Scheme. Eligibility to receive a car allowance will be based on the requirement for essential car usage to undertake the duties of your post and no less than annual mileage of 250 miles, which will be recorded and verified by your designated line manager on a monthly basis. It is a requirement that all essential car users receiving a lump sum payment submit up to date mileage information, on a monthly basis, so that the Payroll Manager is able to process correct information to the HMRC at year end. Failure to record and report mileage undertaken to your employer may forfeit your right to receive a car allowance. Your eligibility to receive a car allowance will be reviewed on an annual basis by your Head of Service in conjunction with the Head of Finance. The Council reserves the right to review, amend or withdraw the car allowance subject to consultation with you. A period of three months notice to terminate the status and associated allowance will be given to any employee who no longer meets the required criteria. There will be no entitlement to any further car allowance.

Work Experience Managing large or multiple local government contracts Experience of working, at a senior level. Experience of key performance indicators (KPIs) and monitoring supplier performance against these. Experience of managerial experience working in a political environment and alongside elected members. DESIRABLE Post graduate qualification: MBA; MSc/MA or equivalent in relevant professional qualification areas. Experienced in negotiating agreements in SLAs and engaging effectively at Board level with key suppliers. Experience of working with partner organisations. Local Government background and a sound understanding of current issues. Special Aptitude/Skills Able to demonstrate outstanding leadership skills, communication, interpersonal and negotiation skills. Able to communicate effectively and confidently at Council, public and stakeholder meetings. Able to motivate and inspire the teams you lead.
