The property is very difficult to build on and has caused numerous problems with the attempted landscaping. Mr. Iginla noted that since S:\CorpServices\AGENDAS AND MINUTES\2015\Council\Minutes\ DRAFT.docx Page 2 of 7
3 Regular Council Meeting Minutes February 3, 2015 the advertisement by the District for the Development Permit he has received numerous calls from residents in the community and his schedule at the property was published, subsequently followed by a break in at the home. The retaining wall in question along with the putting green was located on the property prior to the applicant s purchase. The contractor hired to do the landscaping based the location of the retaining wall on the location of the neighbour s retaining wall, assuming that it was within the property boundaries. It would appear that the neighbouring property is also encroaching into District right of way. The subsequent retaining wall construction is encroaching into the right of way and the applicant requested that the District enter into an encroachment agreement allowing the retaining wall to remain. Mr. Iginla offered to draft the encroachment agreement and pay for the removal of the retaining wall at any time as required by the District. Mr. Iginla noted that the removal of the wall would cause the driveway to collapse and that additional letters from the geo-tech were provided to District staff advising that their review of the wall wasn't required because of the dimensions of the wall being less than four feet THAT staff be directed to work with applicant of DP A2 (Iginla) to draft an encroachment agreement allowing the encroachment of the retaining wall on District property to include the following provisions: staff are permitted to access the encroachment area when required; a railing is to be installed at the top of the retaining wall; and the applicant be required to remove the retaining wall at their own cost at the request of the District. ii) Zoning Amendment (Oyama Zipline) Bylaw 882, st reading February 4, THAT Zoning Amendment (Oyama Zipline) Bylaw 882, 2014 be read a second time; AND THAT Zoning Amendment (Oyama Zipline) Bylaw 882, 2014 be forwarded to a Public Hearing; AND THAT Council authorizes the use of $12, from reserves collected for frontage improvements when subdivision of Lot 2, Section 31, Township 21, O.D.Y.D., Plan KAP84855 occurred; AND FURTHER THAT the $12, from reserves be applied to fund extended and off site services, specifically, safety improvements as identified by CTQ Consulting Report, titled, Oyama Lake Road Transportation Safety Review dated February 4, iii) Zoning Amendment Z (Behin) Lot 2, Sec 2 & 11, Twp 14, ODYD, Plan 25623; Old Mission Road; Roll: S:\CorpServices\AGENDAS AND MINUTES\2015\Council\Minutes\ DRAFT.docx Page 3 of 7
4 Regular Council Meeting Minutes February 3, THAT Zoning Amendment (Behin) Bylaw 915, 2015 be read a first and second time; AND THAT Zoning Amendment (Behin) Bylaw 915, 2015 be forwarded to a Public Hearing. iv) Zoning Amendment Z (Jemson) Lot 36, Sect. 25, Twp 20, Plan 808, Exc Plan 37983; Oyama Road; Roll: Tammy Jemson and Randy Kallstrom - Applicants Ms. Jemson noted that they are planning on planting haskap berries on the property and can provide evidence that they have purchased the plants and are moving forward with the planting. She also noted that the farm successfully sells eggs and they are not planning on leasing any portion of the property. The applicant also noted that camp sites on the property could be converted back to farm land easier than cabins on the property for agri-tourism That Zoning Amendment (Jemson) Bylaw 916, 2015 not be supported at this time. OPPOSED: Councillor Vader v) Zoning Amendment Z (G. Lewis) Lot 66 shown on Plan B13454; Sec 9 & 16, Twp 20, ODYD, Plan 521 (Exc Plans H18660 & KAP70483); Tyndall Road; Roll: Peter Lewis Applicant s Representative Mr. Lewis requested clarification on the five-metre wide road dedication and asked if that required dedication could be shared with the property across the road. Mr. Lewis was advised that his question was in relation to the next item, the Development Variance Permit for the same property THAT Zoning Amendment (G. Lewis) Bylaw 912, 2015 be read a first and second time; AND THAT Zoning Amendment (G. Lewis) Bylaw 912, 2015 be forwarded to a Public Hearing. vi) Development Variance Permit DVP (G. Lewis) Lot 66 shown on Plan B13454; Sec 9 & 16, Twp 20, ODYD, Plan 521 (Exc Plans H18660 & KAP70483); Tyndall Road; Roll: Peter Lewis Applicant s Representative In response to questions from Council Mr. Lewis noted that the reason the variance and zoning applications are concurrent is financially driven. 5 Regular Council Meeting Minutes February 3, THAT Development Variance Permit DVP be referred back to staff for further discussion with the applicant. vii) Development Variance Permit DVP (Gordon) Lot 2, Sec 20, Twp 20, ODYD, Plan 33177; Okanagan Centre Road West; Roll: THAT comments from the applicant for DVP be heard. Rick Howard Applicant s Representative Mr. Howard stated there will be LED lights, the size of a baby finger, 3 mm off the surface of the dock and flush with the flange. They are on a motion detector so only come on when they are in use. The lighting element is to delineate the sides of the dock so people do not fall off. The lighting is for navigation safety purposes and is required by Navigation Canada. He said there have been no complaints from neighbours. In response to questions from Council, he stated the owner has one pontoon boat and is considering getting another boat as he has grandchildren. He finished by stating the design meets Provincial and District bylaws THAT Development Variance Permit DVP for Lot 2, Section 20, Township 20, O.D.Y.D., Plan be approved, thereby varying Zoning Bylaw 561, 2007 Section (c) to allow for the construction of a four finger dock. Councillor Vader stated that, before we move too far forward, he would like to ensure staff is further involved in advising Council what the Public Art Advisory Commission s role would be regarding the Lake Country entrance signs. Youth Councillor Pearson wished everyone a Happy Valentine s Day. He said he and Youth Councillor Rattliff met with the Director of Infrastructure Services and picked out, after meeting with the graduating class, intersections to put street lights. They identified four areas: the intersection of Lodge and Sherman roads, the intersection of Davidson Road and Okanagan Centre Road East, Bottom Wood Lake Road near the arena entrance, and the bus stop at Okanagan Centre Road East and Oceola Road. 7 Regular Council Meeting Minutes February 3, 2015 Mayor Baker responded by saying it was permitted at the time because there was presumably going to be subsequent subdivision to the west that would require another entrance, but that has not occurred. The District thought there would be another entrance related to the construction of the new portion of Highway 97 but only an emergency egress was included. The District is attempting to address the issue with funding. Councillor Scarrow asked about the requirement for a taxpayer to buy a business licence and pay $50 a day to paint tattoos in the parks.
