Cntext and when t raise a safeguarding cncern Infrmatin that may prevent r culd have a bearing n identifying where abuse r neglect may be taking place shuld always be shared with the Lcal Authrity and recrded when received. In many cases it may nt be apparent frm the infrmatin n its wn, whether this wuld need t be cnsidered as a safeguarding cncern, r if this may meet the three criteria (see belw) under the Care Act that trigger the Lcal Authrity s duty t undertake a safeguarding enquiry. Where it is unclear if infrmatin may warrant a safeguarding cncern being raised, this shuld always be shared with the Lcal Authrity and then assessed against any ther relevant infrmatin that the Lcal Authrity may hld r may need t seek. As nted abve, where it is unclear if the three criteria are met, cnsideratin shuld always be given t raising a safeguarding cncern. Fr example, where there may be a high risk t the persn r thers, where there is a lw level cncern that culd frm part f a pattern r where there is infrmatin relating t a Cause f Risk. This ensures an easily accessible histry f cncerns which can infrm future decisin making. Where infrmatin is received by the Lcal Authrity and it is unclear if the three criteria are met, adults services practitiners shuld cnsider recrding this infrmatin n the WSCC custmer recrd (Framewrki), in a way that will enable it t be included in future safeguarding reprts (see guidance belw regarding histry reprts). It is the Lcal Authrity s respnsibility t determine if this infrmatin shuld be cnsidered as a safeguarding cncern and whether an enquiry is needed. 2. Lcal Authrity decisin making regarding undertaking an enquiry (Duties and Pwers) Where there is a reasnable belief that a safeguarding enquiry is required the Enquiry Manager shuld ensure this is undertaken. The Enquiry Manager will need t determine whether this is being undertaken under the lcal authrity s Duty r Pwer t d s. The Enquiry Manager s decisin and ratinal regarding this must be clearly recrded and cmmunicated t all parties. The lcal authrity s duty t undertake an enquiry is triggered when the three criteria under S42 f the Care Act are met: An Adult wh has needs fr Care and Supprt (whether r nt any f thse needs are being met), and the adult may be experiencing, r is at risk f, abuse r neglect, and as a result f their care and supprt needs, the adult is unable t prtect themselves frm either the risk f, r the experience f, abuse r neglect. The lcal authrity s Pwer t undertake enquiries is set ut in paragraph Safeguarding - Care and Supprt Act Statutry Guidance 2016: Lcal Authrities may chse t undertake safeguarding enquiries fr peple where there is nt a S42 enquiry duty, if the lcal authrity believes it is Page 3

4 4 prprtinate t d s, and will enable the lcal authrity t prmte the persn s well-being and supprt a preventin agenda. The Lcal Authrity s Pwer t undertake enquiries is an ptin that it can cnsider, hwever it des nt have t be used. This will ften be where sme srt f actin needs t be taken and the S42 Enquiry Duty is nt triggered hwever the lcal authrity s respnsibility in relatin t preventin is triggered. Examples f where an enquiry may be apprpriate under the lcal authrity s Pwer, rather than its duty include: situatins where there is a high level f risk fr a persn/s with care and supprt needs, including fr example thse experiencing dmestic vilence; substance misuse; hmelessness; r self neglect. When an adult is deceased and there is a pssibility that abuse r neglect may have been a factr in this, initial infrmatin gathering under safeguarding prcedures must be undertaken t establish whether the lcal authrity has a duty under the Care Act regarding either: Sectin 44: a Safeguarding Adults Review fr the persn deceased; OR Sectin S42 fr anther adult/s As the fcus f the lcal authrity s duty under S42 is t prduce a safeguarding plan, in cnjunctin with the Adult, t safeguard them against further abuse and/r neglect, this duty cannt apply when the persn wh was the subject f the abuse r neglect is deceased, and there is n ther Adult at risk f abuse r neglect. The Enquiry Manager s decisin and ratinal must be clearly recrded and cmmunicated t all parties. This will require particular sensitivity in relatin t the relatives / friends f an adult wh is deceased. 3. Rle f the Enquiry Manager On receipt f a safeguarding cncern that triggers a safeguarding enquiry, a named prfessinal within the Lcal Authrity with the apprpriate skills, experience, knwledge and training will be identified by adults services t undertake the rle f Enquiry Manager (EM). Their rle is t have management respnsibility fr decisins and ensure the Lcal Authrity cmpletes its Duty/Pwer under the Care Act. The Lcal Authrity s Duty/Pwer f enquiry cntinues until it decides what actin is necessary t prtect the adult, and by whm, and assures itself that this actin has been taken. This decisin is the respnsibility f the EM. The EM is respnsible fr identifying and supervising Enquiry Officers (EOs) frm WSCC adults services and prviding clinical supervisin t Enquiry Officers with a scial care backgrund r qualificatin. Where the Enquiry Manager determines it is necessary t cause an enquiry t be made by a practitiner frm anther agency r rganisatin, that rganisatin is respnsible fr identifying an EO with the apprpriate skills, experience and training t undertake the rle. This shuld be in discussin and agreement with the EM. Page 4

5 5 The EM must ensure all EOs are clear regarding their rle, including timescales and requirements fr the enquiry. The EM must satisfy themselves that the enquiry respnse prvided by the EO (regardless f what rganisatin the EO wrks fr) enables the Lcal Authrity t discharge its Duty/Pwer. The EM must ensure cncerns are respnded t prprtinately and apprpriately. The EM is respnsible fr ensuring the verall risks t the adult and any identified thers are managed, and that all respnses t the cncern are crdinated effectively, using a making safeguarding persnal apprach, which keeps the adult and the utcmes they wish t achieve at the centre f the respnse. 4. Rle f the Enquiry Officer The Enquiry Officer (EO) liaises directly with the adult/representative. The EO talks t them / their representative regarding what they want t happen in relatin t the cncern; hw they think the situatin is best apprached and ensures they are kept fully invlved, infrmed and at the centre f the safeguarding respnse thrughut. The adult/representative will be supprted by the EO t identify utcmes they want t achieve, which will be kept under cntinuing review thrughut the Enquiry. An EO must have relevant skills and experience relating t the cncern, and can be frm any discipline r rganisatin i.e. Occupatinal Therapist, Nurse Practitiner, Prvider Manager, Husing Manager, r Plice Officer. An enquiry may need t have ne r mre EOs. The EO will usually be respnsible fr recrding details f the Enquiry in the frm f an Enquiry Summary. Please refer t Appendix 1 fr guidance n cmpletin f a S42 Enquiry Summary. 5. Making Safeguarding Persnal Making Safeguarding Persnal is the apprach taken t supprt and empwer adults t make chices and have cntrl f hw they live their lives. The pints belw shuld be cnsidered: Gaining cnsent and agreement frm the adult where able. If there are capacity issues, that have been assessed and are decisin specific, r the adult is cnsidered t have substantial difficulty being invlved, cnsideratin f whether a suitable advcate r representative may be required and shuld be ffered t the persn. Identify the adult s r representative s views f the cncerns and their wishes at the earliest pint pssible. Identify what utcmes they wuld like t achieve and review these utcmes when actins have been taken. Respnd t safeguarding cncerns quickly, taking prprtinate actin. Use the least intrusive respnse apprpriate. Page 5

Timescales Respnse times fr cntacting the adult when a safeguarding cncern is received: where there is significant risk, s/he shuld be cntacted within 24hrs; and fr all ther safeguarding cncerns cntact shuld be made with him/her within 3 wrking days. A principle f n delay applies t all safeguarding adults wrk. The time frames that apply nce a safeguarding enquiry has been triggered, must be determined by the Enquiry Manager, taking accunt f the utcmes the adult/their representative wishes t achieve and ther relevant factrs, including risks fr the adult r thers. The ratinale fr this shuld be clearly recrded and cmmunicated with all parties invlved. Time frames shuld be regularly reviewed with the adult / their representative t take accunt f the dynamic nature f safeguarding adults wrk. 7. Making initial cntact with the adult regarding a cncern Cnsideratin and evaluatin f infrmatin available shuld infrm the decisin regarding hw best t, and wh, shuld cntact the adult. Cntact by telephne may be apprpriate hwever this shuld be cnsidered alngside: the adult s situatin and ptential risks t them; the nature f the cncern; the persn s knwn / unknwn cmmunicatin needs and mental capacity; the level f infrmatin knwn regarding their circumstances generally. Telephne cmmunicatin gives n pprtunity fr gathering bservatinal infrmatin regarding a persn s envirnment, appearance, facial expressin r bdy language, r wh else may be present at the time f the call. Depending n the nature f the cncern and the individual s knwn r unknwn circumstances it is essential t be assured that the frm f cntact decided upn will nt ptentially place the persn at increased risk. Face t face cntact with the persn may be the preferred apprach; hwever this als needs t be prprtinate. There will need t be cnsideratin f wh talks t the adult. This may be a persn wh knws them well, r may need t be smene wh has previusly nt wrked with the persn depending n the nature f the cncern. Cntact shuld be directly with the persn unless there are clear reasns fr nt ding s, in which case cnsideratin shuld be given t wh wuld be a suitable representative, based n the nature f the cncern and any recent arrangements/cnsent regarding invlvement. 8. Safeguarding Plan/Prtectin Plan A Safeguarding Plan refers t any actins taken r recmmended t safeguard the individual r address risks. This shuld be started at the earliest pprtunity, with full invlvement f the adult/their representative where pssible and in line with their desired utcmes/wishes. The Safeguarding Plan will develp as further infrmatin is knwn and can change ver time. Page 6

7 7 A Prtectin Plan refers t ther wider actins fr agencies r rganisatins and that are nt cvered by a safeguarding plan agreed with and fr an individual. This can als be used t recrd actins where the individual has declined t be invlved but there remains cncern abut high level f risk and agencies/ rganisatins have n-ging respnsibilities. All Safeguarding and Prtectin plans shuld have clear agreement fr mnitring and reviewing actins and wh is respnsible fr these. 9. Multi-Agency Infrmatin Sharing and Risk Assessment The Safeguarding Adult s Prcedures are in place t enable strng multi-agency partnership wrking with timely and effective respnses t, and preventin f, abuse r neglect. The Safeguarding Adult s Bard have agreed a Multi-Agency infrmatin sharing prtcl in line with Care Act Guidance. Effective infrmatin sharing acrss agencies enables rbust assessment f risk. See Appendix 2 - West Sussex Risk Assessment Tl fr where there are Safeguarding Cncerns relating t a service: 10. Key Stages Infrmatin gathering The purpse f infrmatin gathering is t: Identify risks t the adult and thers Establish severity and frequency f the abuse r neglect (cnsider patterns) Identify the persn r service thught t be the cause f risk (CR) What actin has already been taken What actin needs t be taken t ensure the adult/thers are safe, Cnsider whether ther peple (family members, friends r prfessinals) have relevant infrmatin Identify whether abuse r neglect was intentinal r nt, as this may affect the respnse Where it is thught that a crime may have been cmmitted, cnsideratin must be given t whether Plice/APT shuld be infrmed. Gather infrmatin t establish whether 3 criteria are met, and whether a Safeguarding Enquiry is needed. All infrmatin gathered shuld be recrded Decisin Making by the Lcal Authrity See the sectin abve which explains the Lcal Authrity s duty and pwer t undertake Safeguarding Enquiries. Page 7

8 8 Safeguarding Enquiry Purpse f the Enquiry establish facts ascertain the adult s view and wishes assess the needs f the adult fr prtectin, supprt and redress and hw they might be met prtect frm the abuse and neglect, in accrdance with their wishes Ensuring that the persn/service thught t be the cause f risk has had the pprtunity t respnd t cncerns, where apprpriate. make decisins as t what fllw up actin shuld be taken with regards t the persn r rganisatin respnsible fr the abuse and neglect, and Enable the adult t achieve reslutin and recvery. Decisin regarding actins: Once a decisin has been made by the Lcal Authrity that a Safeguarding Enquiry is needed, there needs t be a decisin abut what, if any, actins are needed. An Enquiry is any respnse r actin taken t address a safeguarding cncern. The actin taken r instigated by the lcal authrity in respnse t a cncern that abuse r neglect may be taking place can range frm a cnversatin with the adult right thrugh t a multi-agency plan. The decisin regarding what actins are needed will be based n many factrs, including: the views and wishes f the Adult/Representative; any Mental Capacity issues that relate t the Safeguarding cncern; the ability f the Adult s netwrks t increase the supprt they ffer; the impact f any interventin n the adult, including imprtant relatinships; the ptential f increasing risk t the adult and/r thers; infrmatin/risk relating t the persn/service thught t be the cause f risk (CR); Enquiry Actins: The Enquiry Manager will need t decide what actins are needed t supprt the adult t achieve their wishes and t address risk. There shuld be cnsideratin f Multi-Agency infrmatin sharing and f ther prcesses which culd frm part/all f the Enquiry. The EM will need t ensure c-rdinatin and feedback f all prcesses relating t/infrming the Enquiry and clear expectatins f partner agencies and rganisatins shuld be set ut regarding their respnsibilities in relatin t this. Other prcesses that culd be cnsidered: Serius Incident (SI) prcess Review f adult s care and supprt needs/supprt plan Carer assessment Cntinuing Health Care Review Mving and handling assessment Criminal investigatin Disciplinary Prcedures Capability Prcedures Crner s inquest Best Interests prcess/dls Cmplaints plicy Cntractual Review CQC Emergency Planning Health & Safety Page 8

9 9 Causing thers t make enquiries: Other agencies (e.g. health, private care prviders, husing) have a respnsibility t respnd when the Lcal Authrity requests them t undertake an enquiry, this includes respnsibility fr advising the Lcal Authrity if they are nt intending t undertake an enquiry, fr example the plice regarding a plice investigatin. Organisatins and agencies asked t make enquiries by the Lcal Authrity have a respnsibility t take actins frward in a timely way and t feedback updates as agreed regarding prgress. There is an Enquiry Summary Frm (wrd template) available n Cnnect t Supprt in the Prfessinal Zne. This template, alng with guidance can be accessed by Enquiry Officers wh cannt access Framewrki. The Enquiry Manager shuld give clear guidance and expectatins t any Enquiry Officer r Organisatin wh is being caused t make enquiries. Large scale enquiries Where there are cmplex, large scale enquiries this will need careful crdinatin by the EM. Cnsideratin shuld be given t escalatin and Emergency Planning prtcls. The Safeguarding Adults Unit shuld be advised and engaged fr supprt. Refer t the OSAR recrding guidance within the Framewrki Guidance dcument fr Safeguarding Adults. The Emergency Planning Prtcl is used fr the crdinating and planning f a respnse shuld residents need t be mved in an emergency due t a hme clsure. It is nt a substitute fr safeguarding planning meetings which have a fcus n discussing individual s needs, risks and actins required t supprt them. Cncluding the Enquiry The Enquiry Officer shuld cmplete an Enquiry Summary with details f the Enquiry including the views f the Adult, whether their desired utcmes have been achieved and whether risk has been addressed. The Enquiry Manager will need t ensure that all relevant parties have received feedback, and satisfy him/herself that the Enquiry has respnded t the desired utcmes f the Adult, addressed risk fr the Adult and/r thers, and taken any actin required in relatin t the Persn r Service thught t be the Cause f Risk (CR). The Enquiry Manager has respnsibility fr determining that the Lcal Authrity s duty/pwer under the Care Act has been discharged. Checklist fr Cmpleted Enquiries A safeguarding enquiry can be cncluded nce the lcal authrity has cnsidered that the fllwing has taken place: 1. Where a safeguarding plan is in place that it is in line with the desired utcmes f the adult. This includes enabling the adult t live with risk if they chse t d s with mnitring arrangements t supprt the adult such as arrangements fr cmmunicatin and infrmatin sharing, particularly where a number f agencies r supprt netwrks may be invlved. 2. The enquiry has included the views, wishes and best interests f the adult and has been centred n their desired utcmes. Page 9

10 10 3. The persn/rganisatin thught t be the surce f risk has had an pprtunity t give their views and respnd t the cncern. 4. Relevant infrmatin has been gathered and evaluated t supprt r discunt the cncern s that the cause f this can be identified t prevent future abuse where pssible. 5. The enquiry has been thrughly cmpleted including identifying the categry f suspected abuse that was respnded t. 6. Cmmunicatins with Cmmissiners that have respnsibilities twards the adult r invlved in the enquiry have been established. Where the service prvider is the fcus f the cncern, the Enquiry Manager has advised the Cmmissiner/Cntract teams f this and Care Quality Cmmissin. 7. Infrmatin has been shared where apprpriate and as necessary including any wider actins that are recmmended. 8. Where there has been a serius injury r death f an adult, a Safeguarding Adult Review was cnsidered. 9. If the persn wh is thught t have caused the risk, is an emplyee/student/vlunteer f WSCC, refer t the Safeguarding Adults Unit (the functins that were included under the DASM title have nw returned t the SAU Respnsibility). 10. Any recmmended further actins including referrals t prfessinal bdies such as the Disclsure & Barring Service have been addressed. 11. Arrangements are in place t ensure that the adult, their representative r any ther persn r rganisatin thugh t be the surce f risk received individual feedback regarding the findings f the enquiry. This checklist shuld als be used by agencies and rganisatins the Lcal Authrity has requested t undertake a Safeguarding Enquiry t cnsider if it has cncluded its enquiry apprpriately and has cvered all the areas required in rder t discharge its wn duty in relatin t this. Other Key Issues Cause f Risk (COR) While the fcus f safeguarding is the adult, it is imprtant that all individuals affected have their rights prtected (this includes the named COR). They shuld be apprpriately invlved in a practive, balanced, prprtinate and transparent apprach t the safeguarding enquiry. The COR shuld be given a fair pprtunity f reply in relatin t the specific cncerns raised, unless there are exceptinal circumstances why nt. This shuld be balanced against the Adult s views and wishes, and risks t them r thers. The Enquiry Manager will need t give careful cnsideratin t: if there is plice invlvement the particular set f circumstances fr the adult the nature f the cncerns raised the risks (what they are and t wh these relate) the relatinship f the COR t the individual ( i.e. are they an emplyee/partner/relative/vlunteer/student/neighbur Page 10

11 11 Each prcess criminal, persnnel /HR, safeguarding is distinct and needs t be undertaken and cncluded in line with their wn separate guidance. Fr West Sussex Cunty Cuncil staff, please refer t draft internal guidance. Respnsibility fr referral s t Disclsure and Barring Service (DBS) and any prfessinal bdies (HCPC/NMC/GMC etc.) is als separate fr each rganisatin. The COR needs t be clearly advised when each distinct prcess cncludes, and f any specific utcme r actins that will be taken, r referrals that will be made. Fr mre infrmatin please refer t the Safeguarding Cause f Risk Practice Guidance. Safeguarding Discussins & Meetings The adult shuld be invlved in discussins and meetings unless there is gd reasn fr nt ding s. Cnsideratin shuld be given t hw these cnversatins r meetings can be held in the mst persn-centred and empwering way, taking accunt f the adult s individual needs and situatin. Multi-Agency Safeguarding Meetings shuld be held when necessary and wuld usually be chaired by the Enquiry Manager. As stated abve, the Adult and/r Representative shuld be included unless there is gd reasn nt t. Please refer t the sectin n safeguarding meetings in the SSAPP (sectin 3.3) which cntains detailed infrmatin regarding this. Adult Safeguarding Ntetakers are available t supprt with Safeguarding Meetings. 11. Quality The Care Act Guidance states that quality issues relating t care prviders shuld nt be dealt with by Safeguarding Adults prcedures. When a safeguarding cncern is raised, there needs t be cnsideratin f whether there are issues that relate t the quality f a care prvider. Smetimes there will nly be a quality issue and smetimes there will be the need fr a Safeguarding Enquiry relating t a cncern f abuse r neglect fr an individual, and there will be quality issues that need respnding t. Where there is infrmatin that relates t the quality f care prviders, infrmatin shuld be shared with relevant partners, including CQC, WSCC Cntracts, Cmmissiners (CCG and/r thers) and the prvider service shuld always be invlved at the earliest pprtunity. When necessary, a Safeguarding Meeting shuld be held t decide what actins will be taken frward by the relevant rganisatins. 12. Rle f Safeguarding Adults Unit The Safeguarding Adult s Unit (Independent Chairs and the Principal Manager fr Adult Safeguarding) prvides varius functins. Please refer t the Rles and Respnsibilities dcument fr full details f the rle f the unit. The Independent Chairs are available fr advice and guidance regarding peratinal casewrk, prcess and prcedure and can attend Safeguarding Meetings in an advisry capacity. The Unit shuld always be advised f safeguarding cncerns that relate t a death r serius injury / risk t an adult and high prfile r large scale enquiries (see Rles and Respnsibilities dcument fr mre detail).
