Agent Authrizatin Frm Intrductin The fllwing guide has been develped t assist hmewners in btaining a building permit fr a deck. The Ontari Building Cde Act requires a permit t be btained prir t cnstructing a deck if any f the fllwing situatins ccur: The deck is attached t any structure, including a Single Family Dwelling (huse), regardless f the height abve grade r the area f the deck, The prpsed detached deck will ccupy an area greater than 10m 2 (107 ft 2 ) r; The deck serves an entrance/exit. All detached decks must be a minimum f 2m away frm a structure (as per the Twnship s Zning By-law). The clsest part f any deck must be a minimum f 1.5m frm any septic tank and 5m frm any septic bed. Applicants are encuraged t cntact the Building Department prir t applying fr a permit t discuss the requirements fr their specific prject. Once an applicatin is received it will be reviewed by staff fr sufficiency f cmpletin. If the applicatin is nt accmpanied by the plans, specificatins, infrmatin and dcuments as utlined in this infrmatinal pamphlet, the applicant will be ntified within 2 business days, f the utstanding infrmatin required. Incmplete applicatins will be placed n hld until all f the required infrmatin is received. Cmplete applicatins will be reviewed within 10 business days. Zning By-law Requirements The setbacks frm the edge f the deck r edge f the stairs (where applicable) and maximum permitted lt cverage are prescribed by the Lyalist Twnship Zning By-Law Permit Fees Building permit fees fr decks are calculated at $11 per $1,000 f cnstructin cst. Cnstructin cst is calculated at $25 per square ft f uncvered deck (including stairs) and $40 per square ft f cvered deck (including stairs). The minimum building permit fee f $100 applies t all decks. A $200 fee will be added t any deck that is started withut a permit. 3 Additinal Apprvals & Design Cnsideratins Apprvals frm Other Agencies In sme circumstances, apprvals are required frm ther agencies befre the Twnship is able t issue a building permit. Applicants are encuraged t cntact the Building Department prir t applying fr a permit t determine if ther apprvals may be required fr a specific prject. Cataraqui Regin Cnservatin Authrity Apprval may be required frm the CRCA if yur prject is within 15m f a fldplain; 50m f the tp f bank f a water curse; 120m f a Prvincially significant wetland r 30m f all wetlands great than 0.5ha. Please cntact Jim Sva, Planner, at , ext. 144, fr additinal infrmatin. Design Cnsideratins The hmewner is permitted t design their deck withut being qualified under the Ontari Building Cde. If the deck is greater than 55m 2 and designed by any designer ther than the hmewner, the designer must be qualified under the Ontari Building Cde with a BCIN r be an Architect r an Engineer. Design Drawings Prvided by Building Material Suppliers Design drawings prvided by building material suppliers ften lack all f the details necessary t apprve the permit, hwever; they may be mdified t include all relevant infrmatin. Please ensure that drawings cntain all f the necessary infrmatin n the plan and crss sectin befre submitting yur applicatin t avid delays. Guards Guards are nt required n a deck if the walking surface f the deck is less than 600mm abve adjacent grade (adjacent grade must extend a minimum f 1.2m away frm the deck). If a guard is required it must be cnstructed t meet the requirements f SB-7 f the 2012 Ontari Building Cde. Guards nt meeting the SB-7 must have a Building Material Evaluatin Cmmissin (BMEC) ruling, r be reviewed by an Ontari Prfessinal Engineer. Guards must be 900mm abve the deck fr decks up t 1.8m abve grade and 1070mm fr decks abve 1.8m. When purchasing a guard r railing system, be sure t ask fr the details f the height f the guard abve the deck surface, detail f the deck t huse cnnectin, and cnfirmatin that the prduct is apprved fr use in Ontari. Prprietary Prducts and Materials Nt all prducts r materials sld are apprved fr use in Ontari. PVC r cmpsite decking and guard systems must have a BMEC authrizatin t be used in Ontari. Steel, aluminum and glass railing systems must be designed in accrdance with structural requirements f Part 4 (Div. B) f the Ontari Building Cde. Generally this requires the design t be apprved by an Ontari Prfessinal Engineer. All applicatins prpsing the use f materials r system nt specifically allwed fr under Part 9 (Div. B) f the Ontari Building Cde must submit the applicable manufacturer's installatin manual and engineering data, BMEC apprval and/r a design stamped by an Ontari Prfessinal Engineer. Please check int these items befre purchasing r planning t use any f these prducts.
