2 Terms of Reference for Supply of office Stationery & Consumable Items under Framework Agreement BBC Media Action BBC Media Action ( works with people in developing and transitional countries to improve the quality of their lives through the innovative use of the media. Through its Media Development and Development Communications Groups, BBC Media Action works around the world to: Raise awareness of development issues among mass audiences and opinion-leaders. Influence awareness, attitudes and behaviour amongst less privileged communities through a wide range of educational programming. Build capacity in the media sector in developing and transitional countries. Objectives BBC Media Action requires good quantity of Stationery & Consumable items each year to run its regular operational activities. Throughout the year required quantity is quite robust; eg: estimated value 1.5 million Bangladesh Taka. Generally we procure the item as and when requirement basis. Now, we are planning to select a vendor for delivery of all our required Stationery & Consumable items for the whole year. Requirement & Specification Goods will receive as per our requirement specified in Schedule of Requirement attached as Annexure-A. Here, under this RFQ the vendor will supply goods as per specification as mentioned in the Item Description under Schedule of Requirement. 3 experience. Please also note that any other branded and/or model product of similar specifications will be acceptable and with is highly encouraged. Quotation preparation and enveloping: Financial offer to be completed using the provided specific Financial Offer Template and enveloped. The envelope should be sealed and marked as Supply of office Stationery & Consumable Items under Framework Agreement. Please include all your updated and valid company legal documents in the envelope- Trade License, TIN Certificate and VAT Registration. Quotation Submission: Sealed Quotation to be submitted on or before 03:00 PM on11 April 2016 and attention to: Procurement Officer, BBC Media Action, South Breeze Centre (5 th floor), House 5, Road 11, Block G, Banani, Dhaka 1213, Bangladesh. Contact Number , Please take the following requirements and Conditions pertaining to the supply of the abovementioned services. General Terms & Conditions: Conformance to the specification : Quotation to be produced as per mentioned specifications. Any mentioned brand name in quotation will assume only the original product of the specific brand. Goods will be rejected for any non-original branded product. 3

4 VAT, Tax and Transportation on price quotation : Quotation must be inclusive of VAT, AIT, Transportation (delivery up to below delivery place) and other applicable indirect taxes. Period of validity of quotation and contract : 1(one) year. There will have a contract between the parties for 1 (one) year with a probation of possible extension on mutual agreement. The deal will be bound in a legal contract to ensure both parties business rights. The contract will be using BBC Media Action s PC3 standard contract format. Purchase Order/s shall be given on as & when requirement basis base on the contract. Within the contract period any changes of the price will not be allowed and any approaches from the vendor requesting for price increase or stock unavailability will be considered as non-performance and thus the contract will be void. Goods delivery : Goods to be delivered to South Breeze Centre (4th/5th Floor), House # 5, Road # 11, Block- G, Banani, Dhaka 1213, Bangladesh within 3 (three) working days of receipt of Purchase Order. Partial / alternative Quotes : Not Permitted. Bidder has to quote for all items. No alternative offer will be acceptable. Payment Terms : Payment will be made through Account Payee Cheque within 15 (fifteen) days in favour of successful supplier after satisfactory delivery of goods, inspection (if necessary) and necessary documents. No advance payment will be entertained. 4

5 VAT and Tax Status : Deduction of Income Tax at source will be applicable as per the Bangladesh Income Tax Ordinance and VAT will be addressed as per the VAT rules. Vendor Selection : The quotation that complies with all of the specifications, requirements, time schedule and offers the lowest price, as well as other evaluation criteria indicated, shall be selected. Any offer that doesn t meet the requirement shall not be considered for Comparative Bid Analysis (CBA), thus will be rejected. Calculation error adjustment : If VAT, AIT, transportation and other indirect cost calculation is not shown or not mentioned, will be considered as all taxes inclusive prices. If the supplier does not accept the final price based on BBC Media Action s re-computation and correction of errors, its quotation will be rejected. Tender Decision : After BBC Media Action has identified the lowest price offer, BBC Media Action reserves the right to award the contract based only on the prices or overall. Contract might be done with multiple vendors. Tender Opening : There will be no public opening of proposal, the BBC Media Action is not bound to accept the lowest quotation and reserves the right to accept or reject any or all the quotations without assigning any reason whatsoever. 5

6 Annulments : BBC Media Action reserves the right to annul the solicitation process and reject all bids at any time prior to award of the contract without thereby incurring any liability to the affected bidder(s) or any obligation to provide information on the grounds for the buyer s action. The vendors waive all rights to appeal against the decision made by BBC Media Action. 6
