1 MINUTES OF A REGULAR MEETING OF THE CORNER BROOK CITY COUNCIL COUNCIL CHAMBERS, CITY HALL MONDAY, 7 NOVEMBER 2005, AT 7:00 P.M. PRESENT: Mayor C. Pender M. Penney, Sergeant-at-Arms CALL MEETING TO ORDER Mayor Pender called the meeting to order at 7:00 p.m APROVAL OF AGENDA On motion by Councillor J. Carey, seconded by Councillor C. Renouf, it is RESOLVED to approve the agenda as circulated with the following additions: 1. East Valley Road\West Valley Road Flood Update 2. NLFM Convention APPROVAL OF MINUTES On motion by Councillor L. Bruce, seconded by Deputy Mayor M. Murphy it is RESOLVED to approve the Minutes of the Regular Council Meeting of 2 October BUSINESS ARISING FROM MINUTES No issues were brought forward PETITIONS 1. Penney s Avenue: A petition was presented from the residents of Penney s Avenue requesting Council s consideration to have installation of curb and gutter and sidewalks on Penney s Avenue. Damien Morrisey spoke on behalf of the residents outlining some of the problems being encountered by residents resulting from inadequate infrastructure. It was agreed to bring the petition forward to the Operational Services Department for preparation of cost estimates. A report to be brought back to the next Public Council Meeting.

Riverside Drive Extension/Bear Head Road A petition was presented from residents in the Bear Head Road area requesting Council s consideration to rezone the area from environmental to residential. It was noted that the Community Services Department is reviewing this request and a report will be brought back for Council s consideration at the next Public Council Meeting. 3. Balsam Avenue On motion by Councillor J. Carey, seconded by Councillor D. Luther, it is RESOLVED to commence negotiations with A. Harvey & Company to connect the Balsam Avenue sewer to the private sewer; and, subject to a successful conclusion of these negotiations the sanitary sewer work could be carried out as part of the 2006 capital works program. It is FURTHER RESOLVED to have staff commence negotiations with A. Harvey & Co. for the City to assume the responsibility for the connector road to Maple Valley Road PROCLAMATIOINS Mayor Pender announced the following proclamations and events: - November 8 as World Planning Day in the City of Corner Brook - The week of November as Restorative Justice Week in the City of Corner Brook - November 11 as Remembrance Day. A listing of street closures for the Remembrance Day Parade was also presented LOCAL BOARD OF APPEAL It was reported that the Corner Brook Local Board of Appeal is scheduled to hear an appeal from an applicant who is appealing the refusal of a building permit to develop two lots of land on Mayfair Avenue. The deadline to submit comments on this appeal is November 18, The decisions of the Local Board of Appeal with respect to two appeals hearings were brought forward for information purposes: 1. Targett Trucking Limited Harvey Road (Council s decision upheld) 2. Nora Walsh Westmount Road (Ruled in favour of the appellant)

3 Regular Council Meeting Page 3 of TENDERS 1. Disposal of Rescue Vehicle On motion by Councillor D. Luther, seconded by Councillor J. Carey, it is RESOLVED to dispose of Rescue Unit 804 to the Cox s Cove Volunteer Fire Department for the tendered price of $3,146.46, plus HST. Vehicle to be disposed of on an as is-where is condition. No warranty, written or implied. 2. Winter Chains Contract No On motion by Councillor D. Luther, seconded by Deputy Mayor M. Murphy, it is RESOLVED to award the tender for the supply of winter chains, contract no to the Stephenville Truck Centre, at the tendered price of $15, (HST included) PERMIT REQUEST - SMALL ENGINE REPAIR SHOP BROADWAY On motion by Councillor C. Renouf, seconded by Councillor W. Downer, it is RESOLVED that under Regulation 10, Discretionary Powers of Authority, the application to operate a small engine repair shop from the single family dwelling at 139 Broadway is denied WATERSHED MANAGEMENT STRATEGY REGULATORY REVIEW The Director of Community Services presented a powerpoint presentation on Development in the Corner Brook Watershed Area (copy attached to official minutes). On motion by Councillor W. Downer, seconded by Councillor C. Renouf, it is RESOLVED to undertake a review of the Watershed Protection Regulations 1994 to ensure they do not conflict with other municipal statutes and that they adequately protect drinking water quality for the citizens of Corner Brook RESIDENTIAL LAND DEVELOPMENT STRATEGY Council affirmed their support for developing a strategy for opening up new residential land developments in the City. Mayor Pender reported in a prepared statement that staff are in the final stages of drafting new Residential Subdivision Design Standards of which they will be seeking input on from various stakeholders groups in the City. As part of the public input process, staff will be seeking suggestions for reducing the approval time for applications. He also reported that upwards to sixty residential buildings of varying sizes is estimated to be made available in the 2006 construction season.

4 Regular Council Meeting Page 4 of CANADA NEWFOUNDLAND INFRASTRUCTURE FUNDING WATER TREATMENT On motion by Councillor J. Carey, seconded by Councillor L. Bruce, it is RESOLVED to accept the $500,000 funding offered through the Canada Newfoundland Infrastructure Program on a one-third, one-third, one-third basis in order to cover additional work on the flow-monitoring program and the water treat-ability project EFFICIENCY REVIEW On motion by Councillor J. Carey, seconded by Councillor W. Downer, it is RESOLVED to have staff develop Terms of Reference and recommend a Committee structure to carry out a review of the regulatory requirements for processing applications; and to bring forward recommendation for Council s consideration at the first Public Meeting in the new year. MOTION CARRIED CANADIAN FEDERATION OF INDEPENDENT BUSINESS SURVEY Mayor Pender read a prepared statement regarding a survey conducted by the Canadian Federation of Independent Business (CFIB) with respect to small business owners rating of dealing with the City of Corner Brook. Mayor Pender commented that over the past year there has been indicators of confidence in the economy of Corner Brook, and Council will be striving to continue to carry out change to foster an improved economic situation in the City and region. He commented that the City is always open to input on our operations, however, in the case of the CFIB survey Council would have preferred to have been briefed on the survey results before they were released as they felt it did not accurately reflect the situation which currently exists in the City. It was noted that the survey was conducted during the period of January to June QUARTERLY FINANCIAL REPORT (PERIOD ENDING SEPTEMBER 30, 2005) Deputy Mayor M. Murphy presented the Quarterly Financial Report for the period ending 30 September FUNDING REQUESTS 1. VON BUILDING FUND Mayor Pender and Councillors Downer and Luther abstained from discussion and voting on this agenda item. On motion by Deputy Mayor M. Murphy, seconded by Councillor L. Bruce, it is RESOLVED to donate a further $1,000 to the Von Building Fund.

5 Regular Council Meeting Page 5 of 6 2. RED CROSS RELIEF FUND STEPHENVILLE FLOOD VICTIMS On motion by Councillor L. Bruce, seconded by Councillor C. Renouf, it is RESOLVED to contribute the sum of $1,000 to the Red Cross Relief Fund in support of flood victims in Stephenville. 3. VALUING NATURE CONFERENCE On motion by Deputy Mayor M. Murphy, seconded by Councillor L. Bruce, it is RESOLVED to approve a contribution of $5,500 to host a luncheon at the Valuing Nature Stewardship & Conservation in Canada 2006 Conference, to be held in Corner Brook in July TIRE DERIVED FUEL Mayor Pender reported that Council has met with officials from Corner Brook Pulp and Paper and the Minister of Environment to bring forward some of the concerns expressed by members of the public with respect to Corner Brook Pulp and Paper s proposal to use tire derived fuel. He stated assurances have been received from both parties that the impacts from this technology on air quality and the local environment will be negligible and will be well within accepted guideline limits. He further commented that if Corner Brook Pulp and Paper s proposal is successful the proponent will be required to expand the chemical parameters, which it currently monitors to include those that have been identified by the public. Assurance has also been given by the Minister of Environment and Conservation that if the proponent fails to meet their obligations, his Department will revoke the company s permit for tire derived fuel. The project will also be carefully monitored by the Department of Environment to ensure the safety of the public is not compromised SMALL BALANCE ADJUSTMENTS POLICY On motion by Councillor L. Bruce, seconded by Deputy Mayor M. Murphy, it is RESOLVED to approve the revised Small Balance Adjustments Policy to increase the authority of the Director of Corporate Services to $1,000 and the Coordinator of Treasury Services to $100 when making routine adjustments PAVING REPORT Councillor D. Luther presented a summary of paving projects completed as part of the 2005 Capital Works Program, as outlined in memorandum from the Engineering Technician dated 2 November 2005.

6 Regular Council Meeting Page 6 of EAST VALLEY\WEST VALLEY ROADS FLOOD UPDATE The Chief Administrative Officer reported that an information circular has been distributed to residents on East Valley Road and West Valley Road who were impacted by the flood on 11 August Staff is continuing to monitor this situation and inspections of the brook will occur on a routine basis. Residents were also requested to clean up debris on their property to prevent the debris from entering the brook. Council commended staff on the great work carried out in reinstating affected properties and their diligence in addressing the overall situation NEWOUNDLAND AND LABRADOR FEDERATION OF MUNICIPALITIES CONVENTION Mayor Pender reported on the annual NLFM convention which was held in Corner Brook from November 3-5, He commented the convention was a great success and thanked everyone who worked on the convention. Councillor Carey spoke on behalf of the Board of Directors of the NLFM and reiterated that the Board was very pleased with the overall convention ADJOURNMENT There being no further business Councillor L.
