1 11.3 TO: FROM: SUBJECT: Kent Studebaker, Chair Members of the Redevelopment Agency Sidaro Sin, Development Project Manager Bid Award for State Street Pedestrian Improvements DATE: April 27, 2015 ACTION Award a contract for State Street Pedestrian Improvements to Weitman Excavation, LLC in the amount of $172,970. DISCUSSION Approval of the Lake Oswego Redevelopment Agency (LORA) Board is required to award a contract of this type in order to comply with City and State Contracting and purchasing procedures. LORA is pursuing this project because the City received complaints of unsafe and non-compliant Americans with Disabilities Act (ADA) sidewalks along the west side of State Street. Sections of the sidewalk are cracked and have uneven surfaces as a result of tree root damage. The City Code requires property owners to maintain the abutting sidewalk in front of their property. Rather than continuing with the piecemeal approach to sidewalk repairs, five property owners on State Street between A and B Avenues considered this an opportunity to go beyond a routine sidewalk fix and make significant improvements to the sidewalk consistent with the rest of the downtown. They proposed partnering with the City and to share in the cost for the improvements. In December 2013, the LORA Board directed staff to develop a cost sharing agreement and work with the property owners to make these improvements. This project falls under Project G (State Street Pedestrian/Bikeway Improvements) in the East End Redevelopment Plan. When the Board first considered this project, improvements included ADA sidewalks, brick accents and decorative railings and were estimated at $125,000 with the owners contributing approximately $30,000 toward the total project cost. As the design was refined with the property owners, street lights and landscaping were added in order to be consistent with other downtown streetscapes. Doing these improvements with this project would also be more cost effective and less disruptive to businesses versus a later date. Current improvements include: 8-foot wide ADA compliant sidewalks, landscaping (including
2 Page 2 new street trees), brick accents, decorative railings, and new street lights (Attachment 1). The additional scope resulted in an increase in engineering, project administration (including construction management), and construction costs. At the November 2014 Board meeting it was reported that with the additional scope, the total project cost was estimated to be between $275,000 and $290,000. Staff has also discussed with the property owners that the final cost and their share of the project would not be known until actual contractor bids were received. The cost sharing agreement with the property owners obligates them to pay for: constructing a new sidewalk; 50% of construction related work, such as traffic control, demolition and erosion control; and a proportional share of the engineering, survey and project administration costs. In addition, two of the property owners will receive a credit totaling $5,800 for sidewalk repairs previously done in good faith based on City inspection requirements. The Board discussed this matter at its December 2013 meeting and encouraged staff to include these credits in the final project accounting. The construction bid opening for this project was conducted on April 21, LORA received bids from four contractors. Weitman Excavation, LLC, was the low bidder with a responsive and responsible bid amount of $172,970. The engineer s construction cost estimate for this project is $145,795, $27,175 under the low bidder. Factors that may have contributed to higher bids may include: the time of the year the project was advertised; availability of contractors and materials; and particular project risks and such as working on State Street with ODOT work hour restrictions and requirements. The firms submitting bids and their amounts are: Weitman Excavation, LLC $172,970 T Edge Construction, Inc. $194,936 GSE, Inc. $198,448 Brown Contracting, Inc. $209,513 Rationale for moving forward with this project includes: Property owners continued support for the project (Attachment 2); The project is identified in the East End Redevelopment Plan; Improving this section of sidewalk between Lakeview Village and the future North Anchor project on B Avenue would fill in the streetscape gap on State Street and link these two major developments; The sidewalk needs to be improved to ADA standards; and Re-bidding the project could result in even higher overall costs. Certainly, there is no guarantee that rebidding the project would result in lower bids. Construction is anticipated to begin in late May and be substantially completed by July 31, 2015.
3 Page 3 FISCAL IMPACTS The total estimated cost for the project is $293,130 with LORA responsible for $250,105 and the property owners responsible for $43,025. The construction cost is $172,970, with LORA responsible for $138,075 and the owners responsible for $34,895. This project was anticipated to be constructed in spring The current LORA budget includes $80,000 for this project. This was based on the December 2013 estimate. However, adequate funds are available in the East End Capital Projects Fund to cover the increased amount of LORA s costs for the project. RECOMMENDATION Staff recommends that the Board award the contract to Weitman Excavation, LLC, for construction of the project in the amount of $172,970. ATTACHMENTS 1. We believe this public-private partnership is a great example of getting things done to benefit not only the downtown, but the community as a whole. We request your commitment to this long-term investment in Block 49 which lies at the gateway of Lake Oswego on its northeast side, and figured prominently in the history of the town from the turn of the century. Our shared goals are to: 1. Improve the appearance of the North Entrance to Lake Oswego. 2. Complement the North Anchor Project and emphasize the 1 st Street compact retail core. 3. Establish an historic district by enhancing and upgrading the existing buildings on the State Street side of Block 49, three of which have been designated City of Lake Oswego Landmarks. 4. Distinguish Lake Oswego from other shopping centers which never had historic buildings, or did not incorporate them into development. We encourage the Board to accept the low bid and let staff move forward with this project. Per the cost sharing agreement, we are ready to meet our proportional share of the financial obligation. We are also ready to work with and will support your staff to minimize any impacts to our tenants and other downtown businesses.
